No.: 7/TT-LB

CIRCULAR

JOINT DECREE OF THE MINISTRY OF AQUATIC RESOURCES AND THE MINISTRY OF FORESTRY NO. 7/TT-LB DATED DECEMBER 25, 1981
GUIDELINES FOR IMPLEMENTING THE DIRECTIVE NO. 291-TTg
ISSUED ON OCTOBER 24, 1980 BY THE PRIME MINISTER REGARDING
SUPPLY OF WOOD FOR THE FISHERY INDUSTRY

Directive No. 291-TTg dated October 24, 1980 of the Prime Minister (now Chairman of the Council of Ministers) on accelerating fishing, purchasing, processing, and transporting seafood to supply to cadres, workers, and employees stipulates: "To concentrate and unify management of materials and unify procurement to control sources of seafood, the aquatic resources sector is assigned the direct responsibility for managing and distributing all necessary materials for the fishery industry such as gasoline, oil, fishing nets, ropes, marine machinery, spare parts, wood for building and repairing fishing vessels, sailcloth, etc. Each year, each quarter, the Ministry of Aquatic Resources prepares plans for materials in conjunction with plans for fishing, purchasing, and transporting seafood throughout the industry. Based on the targets set by the State, relevant sectors have the responsibility to supply various types of materials required by the Ministry of Aquatic Resources according to the plan to central and local seafood enterprises to supply cooperatives, production groups, and fishermen under bilateral contracts ensuring the recovery of the corresponding amount of products in relation to the materials distributed by the State." Based on the spirit of Directive No. 291-TTg of the Prime Minister, the Joint Ministry of Forestry and Aquatic Resources guides the implementation of wood supply for the fishery industry as follows:

1. The Ministry of Aquatic Resources is directly assigned by the State to manage and distribute the target of wood used for fishery production. Each year, units subordinate to the Ministry of Aquatic Resources, provinces, cities, special zones, and military units engaged in fishing that require wood for production prepare plans submitted to the Ministry of Aquatic Resources. The Ministry of Aquatic Resources balances the demand for wood across the entire industry and prepares distribution plans for subordinate units, localities, and military units engaged in fishing. This plan is divided into six-month intervals and sent to the Ministry of Forestry at the beginning of the planning year; it includes plans for key projects, units, and regions, and delegated plans for units directly managed and distributed by the Ministry of Aquatic Resources. In cases where wood supply does not meet the annual plan, the Ministries of Aquatic Resources and Forestry will discuss to concentrate supply for key projects.

The total distribution quota of the Ministry of Aquatic Resources shall not exceed the State's quota and any adjustments or supplements made by the State.

2. Each year, the Ministries of Aquatic Resources and Forestry, and the State Planning Commission balance wood for the fishery industry and submit it for approval by the Council of Ministers, including the wood quota for the fishery industry managed and distributed by the Ministry of Aquatic Resources, which includes wood supplied to central and local units.

Based on the wood quota for the fishery industry assigned by the State to the Ministry of Aquatic Resources for management and distribution, and the distribution plan of the Ministry of Aquatic Resources, the Ministry of Forestry organizes the supply of wood to units in the forestry sector according to the Ministry of Aquatic Resources' plan, while simultaneously informing the Ministry of Aquatic Resources to monitor its implementation.

Units not included in the Ministry of Aquatic Resources' distribution plan shall not be supplied by the Ministry of Forestry.

During the planning year, if a unit does not use up the allocated wood, it must return it to the Ministry of Aquatic Resources and the Ministry of Forestry.

3. The Ministries of Aquatic Resources and Forestry are responsible for inspecting the use of wood in the fishery industry. If a unit uses wood for purposes other than intended or violates the State's regulations and policies on material supply management, the supplying agency will temporarily suspend the supply of wood and inform the unit's supervisory agency. Supply will only resume after receiving feedback from the supervisory agency.

For other necessary forest products for the fishery industry such as bamboo, rattan, reed, cane, cinnamon bark, resin, and chunks, units and localities should prepare their needs and send them to the Ministry of Aquatic Resources for consolidation and submission to the Ministry of Forestry. The Ministry of Forestry will balance this with harvesting activities and then notify the Ministry of Aquatic Resources of the capacity and quotas so that the Ministry of Aquatic Resources can distribute these products to units and localities.

If a locality or unit has the conditions to harvest these forest products directly, the Ministry of Forestry will consider each case in consultation with the People's Committee of the locality to resolve the issue.
