PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government on the Program to Rapidly and Sustainably Reduce Poverty in 61 Poor Districts;
Considering the proposal of the Minister of Home Affairs,
 
DECISION:
Article 1. This Decision stipulates the policy on rotation and strengthening key cadres for communes in 61 poor districts; preferential policies to encourage young intellectuals and technical professionals to participate in working groups atcommunes (excluding towns) in 61 poor districts pursuant to Resolution No. 30a/2008/NQ-CPdated December 27, 2008 of the Government on the Program to Rapidly and Sustainably Reduce Poverty in 61 Poor Districts (hereinafter referred to as Resolution No. 30a/2008/NQ-CP).
Article 2. The policy on rotation and strengthening provincial and district cadres to assume key leadership positions in communes in 61 poor districts pursuant to Resolution No. 30a/2008/NQ-CP.
1. Objectives, sources of cadres, and duration of rotation and reinforcement
a) Implementing rotation and reinforcement with a fixed term for cadres and civil servants from provincial and district agencies to assume key leadership positions to organize and implement mechanisms and policies in communes in 61 poor districts pursuant to Resolution No. 30a/2008/NQ-CP;
b) The duration of rotation and reinforcement is from three to five years.
2. Standards for cadres and civil servants undergoing rotation and reinforcement
a) Proficient in the Party's policies and State laws on ethnic affairs and religion; understanding the local political system at commune level with its unique characteristics in ethnic minority areas;
b) Having a college degree or higher and experience in their field; preference given to cadres and civil servants who can speak and understand the language of the ethnic group and customs of the local people; capable of propaganda and mobilization; c) Possessing good moral character, a sense of responsibility, and enthusiasm for work;
d) Maximum age not exceeding forty years old; physically fit to perform assigned tasks;
đ) In the last three years before rotation and reinforcement, consistently completing assigned tasks without disciplinary action of reprimand or higher.
3. Duties of cadres and civil servants undergoing rotation and reinforcement
Cadres and civil servants undergoing rotation and reinforcement must fulfill all responsibilities and duties of their assigned positions; simultaneously, they must work with the commune party committee and administration to effectively implement the Party's policies, State laws, and resolutions of the People's Council at the same level in the following specific areas:
a) Effectively implementing administrative reform at the local level and ensuring that commune-level cadres and civil servants perform their duties professionally;
b) Organizing the development of production, leveraging the strengths of the locality, intensifying poverty reduction efforts, improving the living standards of the people, and positively transforming the socio-economic situation of the locality;
c) Effectively implementing cultural development tasks, preserving and promoting traditional cultural values of ethnic minorities, and protecting natural resources and the environment;
d) Consolidating and enhancing the quality of the political system, implementing democratic regulations at the grassroots level in accordance with the customs and culture of each ethnic region;
đ) Implementing tasks related to national defense and security, maintaining political stability, social order, and safety, ethnic policies, and religious policies;
e) Conducting propaganda and mobilization work to ensure the successful implementation of political tasks by the Party, state agencies, and mass organizations;
g) Promoting awareness among local party committees, administrations, and residents about enhancing women's empowerment and gender equality;
h) Effectively implementing family planning work, gender equality, and protection of women and prevention of domestic violence;
i) Summarizing and concluding successful mechanisms and models for wider application.
4. Benefits for cadres and civil servants undergoing rotation and reinforcement
a) Maintaining their original salary, position allowances, other benefits (if any), and staffing at the sending agency, organization, or unit. If the receiving location offers higher location allowances, regional allowances, or special allowances, they will receive the higher amount; the original agency, organization, or unit shall arrange suitable work immediately upon completion of the rotation and reinforcement period;
b) During the rotation and reinforcement period, if they complete their tasks, they will be eligible for promotion examinations, early promotion of pay grades by twelve months ahead of schedule, and priority consideration for appropriate leadership positions when needed by the agency, organization, or unit;
5. Support and allowance policies for cadres and civil servants undergoing rotation and reinforcement
In addition to the benefits stipulated in Clause 4 of this Article, cadres and civil servants undergoing rotation and reinforcement also enjoy:
a) Initial support equivalent to ten months of the national minimum wage;
b) If cadres and civil servants undergoing rotation and reinforcement move with their families, they will receive travel and baggage allowance for accompanying members and relocation allowance equivalent to twelve months of the national minimum wage for a household;
c) Additional monthly allowance equal to seventy percent of their current salary plus position allowance and seniority allowance (if applicable). This allowance is paid concurrently with monthly salary and is not included in social insurance and health insurance contributions;
d) Reimbursement for travel expenses to visit family during annual leave, public holidays, and personal leave with pay as prescribed.
6. Funding for the implementation of policies and benefits for cadres and civil servants undergoing rotation and reinforcement to communes is guaranteed by the state budget and included in the total funding for poverty reduction programs in the province and district; the managing agency or unit of cadres and civil servants prior to rotation and reinforcement shall bear the cost.
Preferential policies to encourage young intellectuals and technical professionals to participate in working groups in communes in 61 poor districts pursuant to Resolution No. 30a/2008/NQ-CP.
Article 3. Policy of preferential treatment and encouragement to attract young intellectuals and technical professionals to participate in working teams at communes belonging to the 61 poor districts according to Resolution No. 30a/2008/NQ-CP.
Young intellectuals, technical professionals volunteering (not over 30 years old) participating in working groups in communes within 61 poor districts shall enjoy the following preferential policies:
1. Persons currently receiving salaries in agencies, organizations, units of the Party, State, Vietnam Fatherland Front, and other political-social organizations shall enjoy policies like provincial and district cadres transferred to communes as stipulated in Clauses 4 and 5 of Article 2 of this Decision.
2. Persons not receiving salaries in agencies, organizations, units of the Party, State, Vietnam Fatherland Front, and other political-social organizations who voluntarily participate in working groups in communes within 61 poor districts shall enjoy preferential policies including:
a) During the period of participating in working groups in communes within 61 poor districts:
- Being contracted by competent authorities with labor contracts; monthly remuneration equivalent to the salary of commune cadres and civil servants with the same level of education and years of service;
- Receiving allowances similar to those of commune cadres and civil servants in the same locality and additional attraction policies of the locality as prescribed by the People's Committee of the province;
- Participating in and enjoying social insurance and health insurance benefits according to laws on social insurance and health insurance;
- Being equipped with work tools as prescribed for cadres and civil servants;
- Receiving initial support similar to that for provincial and district cadres transferred to communes;
- Being arranged accommodation and workplace;
- Being exempted from military service during the period of participating in working groups;
- If they bravely protect national security, state property, lives, and property of citizens and get injured, they will be considered for policies like disabled veterans, if they sacrifice, they will be considered for recognition as martyrs according to laws on preferential treatment for persons meritorious to the revolution;
- Enjoying annual leave and rest regulations according to labor laws;
- Being reimbursed travel expenses for visiting family during annual leave, public holidays, and personal leave with pay according to regulations;
- Participating in local political-economic-social activities and attending political training courses when required;
b) After completing tasks in working groups in communes within 61 poor districts:
- The Central Committee of the Ho Chi Minh Communist Youth Union shall issue a Certificate "Completed Voluntary Development Tasks in Rural and Mountainous Areas" and award the "Volunteer Youth" Medal;
- Receiving a one-time allowance equal to three months' remuneration during their time in working groups in communes within 61 poor districts;
- If returning to the place of origin, they will be assisted by People's Committees at all levels to stabilize their lives;
- If they wish to stay long-term in the volunteer location, they will be prioritized for job placement, provided living conditions, production means, and living conditions;
- If they wish to bring their families to settle or build families and settle in communes within 61 poor districts, they will receive additional relocation support according to current regulations;
- Being granted bonus points when taking civil servant and public official recruitment exams according to laws;
- When recruited as civil servants or public officials, they will not have to undergo probation or trial periods and will be immediately appointed to the position recruited;
- After being appointed, their first salary increase will occur earlier than the current regulation by 12 months;
- If participating in college, university, and postgraduate entrance exams, they will be given additional points added to their exam results according to regulations of the Ministry of Education and Training.
3. The implementation costs of the working group members' benefits shall be guaranteed by the state budget and included in the total budget for poverty reduction programs in the district.
Article 4. Responsibilities of the Provincial, District, and Commune People's Committees
1. The Chairman of the People's Committee at the provincial level shall examine and decide on leadership positions in communes requiring cadre rotation and reinforcement, types of cadres, rotation and reinforcement periods ensuring compliance with the cadre criteria stipulated in Article 2 of this Decision; directing the Department of Home Affairs to develop plans for cadre rotation and reinforcement, work regulations for rotated and reinforced cadres in communes; clearly defining tasks, responsibilities, powers, relationships with grassroots organizations, annually providing specific evaluations of rotated and reinforced cadres, informing the sending agencies and units about the situation of rotated and reinforced cadres; organizing the implementation of policies to attract young intellectuals and technical professionals to participate in commune working groups.
2. The People's Committee at the district level shall implement cadre rotation and reinforcement, attracting young intellectuals and technical professionals to participate in commune working groups according to the provincial People's Committee plan; deciding the number of cadres and civil servants to be rotated and reinforced within the assigned establishment; training necessary knowledge for cadres, civil servants, young intellectuals, and technical professionals on working methods, propaganda methods, mobilizing the masses, and learning ethnic minority languages in the rotation and reinforcement locations.
3. The People's Committee at the commune level shall coordinate and create conditions for cadres and civil servants rotated and reinforced to communes to fulfill their tasks as stipulated in Clause 3 of Article 2 of this Decision; arranging accommodation and workplaces for cadres and civil servants rotated and reinforced to complete their tasks, creating conditions to assist commune working groups in fulfilling their assigned tasks.
Article 5. Responsibilities of central ministries and sectors
1. The Ministry of Home Affairs shall take the lead, coordinating with relevant ministries and agencies to monitor and summarize the implementation of this Decision in localities and report annually to the Prime Minister.
2. The Ministry of Finance shall guide the preparation of budgets, settlement, and final accounts for the implementation of the policies and benefits stipulated in this Decision and incorporate them into the total budget for poverty reduction programs in provinces and districts.
3. The Central Committee of the Ho Chi Minh Communist Youth Union shall take the lead and coordinate with relevant ministries and agencies to develop programs and plans to mobilize and encourage young people, young intellectuals, and technical professionals to voluntarily participate in working groups in the 61 poor communes to contribute to local development.
4. Other ministries and sectors shall guide and coordinate with provincial People's Committees to implement the rotation and reinforcement of cadres and civil servants to poor communes, and provide training and capacity building for rotated and reinforced cadres and civil servants to assist commune-level People's Committees in addressing related tasks and requirements.
Article 6. This Decision takes effect from June 12, 2009.
Article 7. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
