CIRCULAR

Regulations on the model, management, use, issuance, reissuance, replacement, revocation, and destruction of Special Protection Cards

revoke and destroy the Special Protection Certificate

Pursuant to the Law on Security Guarding dated June 20, 2017; the Law Amending and Supplementing Certain Provisions of the Law on Security Guarding dated June 28, 2024;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Commander of the Security Guarding Command;

The Minister of Public Security promulgates this Circular regulating the model, management, use, issuance, reissuance, replacement, revocation, and destruction of Special Protection Cards.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular provides detailed regulations on the model, management, use, issuance, reissuance, replacement, revocation, and destruction of Special Protection Cards for security guarding forces.

Article 2. Applicability

This Circular applies to security guarding forces under the Security Guarding Command of the Ministry of Public Security (hereinafter referred to as the Security Guarding Command), security guarding forces under the Military Security Protection Department of the Ministry of National Defense (hereinafter referred to as the Military Security Protection Department), and relevant agencies, organizations, and individuals during the implementation of security guarding work.

Chapter II

SPECIFIC PROVISIONS

Article 3. Model of Special Protection Card

1. Shape, size, material

Rectangular paper, width 53.98 mm ± 0.12 mm, length 85.6 mm ± 0.12 mm, thickness 0.76 mm ± 0.05 mm. Material: Ivory paper with a weight of 400 g/m², laminated with plastic film.2, laminate with plastic film.

2. Presentation techniques

a) Languages on the Special Protection Card are Vietnamese and English;

b) Front side

The front background color is bright red, with the National Emblem of the Socialist Republic of Vietnam printed in a diameter of 21 mm, with a golden arrow pointing from left to right;

From top to bottom: "CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM"; "SOCIALIST REPUBLIC OF VIETNAM"; "THỰC HIỆN NGAY YÊU CẦU CẢNH VỆ" and "IMMEDIATELY PERFORM PROTECTION COMMAND" within the arrow shape;

c) Back side

The back background is printed with embossed yellow patterns, below personal information is the hidden image of the Police Emblem surrounded by bronze patterns and traditional decorative motifs;

On the left from top to bottom: Police Emblem size 15.6mm x 11.6mm. A color portrait of the cardholder size 25mm x 30mm, white background, frontal view, bare head, clear face, visible both ears, not wearing glasses; wearing a white shirt with a tie, outerwear suit; security seal affixed in the lower right corner, below the personal photo. "Valid until/Date of expiry";

On the right from top to bottom: "GIẤY BẢO VỆ ĐẶC BIỆT"; "SPECIAL PROTECTION CARD"; "Number/No"; "Full name"; "Date of birth"; "Position"; "Agency"; "Date/month/year"; "MINISTER OF PUBLIC SECURITY". 3. Attached to this Circular is an Appendix detailing the model of the Special Protection Card.

Article 4. Issuance, Reissuance, Replacement of Special Protection Cards

1. Recipients of Special Protection Cards

a) The Commander and Deputy Commanders of the Security Guarding Command; the Director and Deputy Directors of the Military Security Protection Department;

b) Leaders of units under the Security Guarding Command at the department level as prescribed in Circular No. 20/2020/TT-BCA dated March 3, 2020 of the Ministry of Public Security on the functions, tasks, powers, and organizational structure of the Security Guarding Command, including: Planning and Operations Department; Protection Department for Party and State Leaders; Special Event and International Guest Protection Department; Technical Protection Department; Central Region Security Guarding Department; Southern Region Security Guarding Department;

c) Leaders of units under the Military Security Protection Department at the department level;

d) Security officers performing close protection duties;

e) Security officers performing specialized technical protection duties.

2. Circumstances for Issuance, Reissuance, Replacement of Special Protection Cards

a) Special Protection Cards are issued to the recipients specified in Clause 1 of this Article;

b) Special Protection Cards are reissued when they expire, are damaged, or there is a change in personal information of the holder;

c) Special Protection Cards are reissued if lost and approved for reissue by the Commander of the Security Guarding Command and the Director of the Military Security Protection Department according to regulations.

3. Documents for Application for Issuance, Reissuance, Replacement of Special Protection Cards include:

a) Request letter and list of cases applying for issuance, reissuance, replacement of Special Protection Cards;

b) Photographs as stipulated in Point c, Clause 2, Article 3 of this Circular;

c) In cases applying for reissuance of Special Protection Cards, the previously issued Special Protection Card must be returned.

4. Procedures for Issuance, Reissuance, Replacement of Special Protection Cards

a) The Military Security Protection Department and units under the Security Guarding Command at the department level prepare documents as stipulated in Clause 3 of this Article and submit them to the Security Guarding Command;

b) Within seven working days from the date of receipt of complete and valid documents, the Security Guarding Command will submit to the Minister of Public Security for consideration and decision on issuance, reissuance, replacement of Special Protection Cards.

Article 5. Revocation of Special Protection Certificate

1. The Special Protection Certificate shall be revoked in the following cases:

a) The subject who has been issued the Special Protection Certificate no longer falls under the circumstances stipulated in Clause 1, Article 4 of this Circular or when they retire to enjoy pension benefits;

b) The subject who has been issued the Special Protection Certificate dies, is declared missing by a court, loses civil capacity, or is restricted in civil capacity;

c) The subject who has been issued the Special Protection Certificate violates the provisions of Clause 2, Article 8 of this Circular;

d) The Special Protection Certificate is lost but found after a new Special Protection Certificate has been reissued;

đ) The subject who has been issued the Special Protection Certificate is temporarily detained, arrested for investigation, prosecution, trial purposes, or suspended from work.

2. Procedure and formalities for revoking the Special Protection Certificate

a) The Commander of the General Command of Security Guard, the Director of the Military Security Protection Department issues a decision to revoke the Special Protection Certificate;

b) When revoking the Special Protection Certificate, the unit responsible for organizing the revocation must prepare a record and hand over one copy to the person whose certificate is being revoked, and enter it into the tracking register for the revocation of Special Protection Certificates.

Article 6. Destruction of Special Protection Certificate

1. The Special Protection Certificate that has been revoked shall be destroyed, except in the case provided for in Clause 3, Article 8 of this Circular.

2. Procedure and formalities for destroying the Special Protection Certificate

a) The Military Security Protection Department collects Special Protection Certificates for destruction along with a letter of request sent to the General Command of Security Guard;

b) The General Command of Security Guard collects Special Protection Certificates for destruction from the Security Guard force, reports to the Minister of Public Security for a decision on destruction;

c) The Commander of the General Command of Security Guard establishes a Committee for Destruction chaired by one leader of the General Command of Security Guard, with members representing relevant units. The form of destruction of the Special Protection Certificate is decided by the Chairman of the Committee. The destruction must be recorded in a protocol.

Article 7. Authority to Issue, Reissue, Replace, Revoke, and Destroy the Special Protection Certificate

1. The Minister of Public Security decides on issuing, replacing, reissuing, and destroying the Special Protection Certificate.

2. The Commander of the General Command of Security Guard, the Director of the Military Security Protection Department decides on revoking the Special Protection Certificate within their jurisdiction.

Article 8. Use of the Special Protection Certificate

1. The Special Protection Certificate may only be used when performing security guard duties to require agencies, organizations, and individuals related on the territory of Vietnam to immediately implement security protection requirements in necessary cases to ensure absolute safety for the protected subject.

2. It is not allowed to misuse the Special Protection Certificate for purposes other than its intended use or abuse it to commit acts violating the law; take the Special Protection Certificate outside the territory of Vietnam; it is not allowed to forge, alter, seize, buy, sell, give, present, lease, lend, pledge, or accept pledges of the Special Protection Certificate.

3. In the case where the Special Protection Certificate is revoked according to point đ, Clause 1, Article 5 of this Circular, if the competent authority later determines that there was no violation and the person continues to perform security guard tasks, the Commander of the General Command of Security Guard, the Director of the Military Security Protection Department shall decide to return the Special Protection Certificate to that person.

4. The validity period of the Special Protection Certificate is five years, starting from the date of issuance.

Article 9. Management of the Special Protection Certificate

1. The General Command of Security Guard, the Military Security Protection Department, and the department-level units directly managing security officers establish registers and assign staff to monitor the issuance, replacement, reissuance, revocation, and destruction of the Special Protection Certificate.

2. Quarterly, every six months, annually, or at any time upon request, the department-level units directly managing the subjects issued the Special Protection Certificate must inspect the management and use of the Special Protection Certificate within their unit and report the results to the General Command of Security Guard, the Military Security Protection Department.

3. Annually, the Military Security Protection Department reports on the management and use of the Special Protection Certificate within their jurisdiction, sending it to the General Command of Security Guard for consolidation. The General Command of Security Guard is responsible for reporting to the Minister of Public Security on the management and use of the Special Protection Certificate of the Security Guard force under the Ministry of Public Security and the Ministry of National Defense.

Article 10. Responsibilities of the Recipient of Special Protection Certificate

1. Properly manage and use the Special Protection Certificate in accordance with regulations.

2. In case the Special Protection Certificate is lost or damaged, it must be reported immediately in writing to the direct management unit leader for reporting to the Commander of the Security Command and the Director of the Military Security Protection Department. The Security Command and the Military Security Protection Department shall issue a notification to relevant agencies and units regarding the loss of the Special Protection Certificate.

Article 11. Handling Violations

If the recipient of the Special Protection Certificate violates the regulations on management, use, issuance, reissuance, replacement, recovery, and destruction of the Special Protection Certificate, they will be subject to disciplinary action or criminal responsibility according to the provisions of the law depending on the nature and severity of the violation.

Chapter III

IMPLEMENTING PROVISIONS

Article 12. Effective Date and Transitional Provisions

1. This Circular takes effect from January 1, 2025, and replaces Circular No. 14/2018/TT-BCA dated May 15, 2018, issued by the Minister of Public Security on the model, management, and use of the Special Protection Certificate for the Security Force, and Circular No. 89/2021/TT-BCA dated October 6, 2021, issued by the Minister of Public Security amending and supplementing some articles of Circular No. 14/2018/TT-BCA dated May 15, 2018, on the model, management, and use of the Special Protection Certificate for the Security Force.

2. Special Protection Certificates issued before this Circular takes effect remain valid until their expiration date as prescribed.

3. In cases where laws and regulations cited in this Circular are amended, supplemented, replaced, or newly issued, the referenced contents shall be implemented according to the amended, supplemented, replaced, or newly issued documents.

Article 13. Responsibility for Implementation

1. Security Command

a) Assist the Minister of Public Security in monitoring, guiding, inspecting, and urging the implementation of this Circular;

b) Coordinate with the Planning and Finance Department to prepare budgets, allocate funds, manage, use, and settle accounts for expenses related to the production of Special Protection Certificates for the Security Force in accordance with the State Budget Law and detailed regulations and guidance documents in the field of security and public order and social safety.

2. Responsibilities of the Institute of Science and Technology

a) Coordinate with the Security Command to research, design, and print Special Protection Certificates;

b) Manage technical files for the design and printing of Special Protection Certificates in accordance with regulations.

3. Heads of units under the Ministry of Public Security, Provincial Police Directors, Directors of Central City Police Departments; Directors, Principals of People's Public Security Academies and Schools, Directors of the Military Security Protection Department, and other relevant agencies, organizations, and individuals are responsible for implementing this Circular.

4. The Military Security Protection Department is responsible for coordinating with the Security Command in monitoring, guiding, inspecting, and urging the implementation of management and use of Special Protection Certificates within its jurisdiction.

During the implementation process, if there are difficulties or obstacles, local police units and organizations and individuals should report to the Ministry of Public Security (through the Security Command) for timely guidance.
