PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Based on the Law on Health Care for the People dated July 11, 1989;

Pursuant to Decision No. 71/2002/QĐ-TTg dated June 7, 2002, of the Government Prime Minister on the management of medicines for human treatment through non-commercial export and import, the Ministry of Health guides the management of medicines for human treatment through non-commercial export and import as follows:

Considering the proposal of the Minister of Health.

DECISION:

Article 1.

1. Medicines for humans brought into Vietnam by overseas Vietnamese residents, Vietnamese citizens working abroad under labor cooperation, expert cooperation, official duties, study, tourism; foreigners legally entering Vietnam, or sent to Vietnam from abroad or taken out of Vietnam by individuals (referred to as non-commercial imported or exported medicines) are only permitted to be imported or exported for personal and family use.

2. The Ministry of Health shall specify the quantity limits for non-commercial imported and exported medicines. Non-commercial imported or exported medicines exceeding the limits set by the Ministry of Health shall be considered illegal imports or exports of medicines.

Article 2. For narcotic drugs, psychotropic substances, or precursor chemicals used in making medicines when imported or exported non-commercially, they must comply with the regulations of the Vietnamese Ministry of Health and be subject to control by competent authorities in Vietnam.

Article 3. Strictly prohibited are the non-commercial import and export of raw materials for medicines and medicines listed in the banned import and export list.

The Ministry of Health shall specify the list of raw materials for medicines and medicines banned from non-commercial import and export.

Article 4. This Decision takes effect fifteen days after its date of issuance. The Prime Minister's Decision No. 111/TTg dated March 24, 1994 on the management of medicines for human use through non-commercial import is hereby repealed.

Article 5. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for supervising and guiding the implementation of this Decision./.
