Issuing Regulations on Testing and Recognizing New Fertilizers

 

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Quality Goods Ordinance No. 18/1999/PL-UBTVQH10 dated December 24, 1999 of the Standing Committee of the National Assembly;

Pursuant to Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on Management of Fertilizer Production and Business;

Pursuant to the Decree No. 179/2004/NĐ-CP dated October 21, 2004 of the Government on State Management of Product and Goods Quality;

AT THE REQUEST OF THE DIRECTOR OF THE AGRICULTURE DEPARTMENT,

DECISION:

Article 1. Issuing this Decision on Regulations on Testing and Recognizing New Fertilizers.

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette. All previous regulations contrary to this Decision are hereby abolished.

Article 3. The Heads of the Ministry's Office, the Director of the Department of Agriculture, the Directors of Provincial Departments of Agriculture and Rural Development, the Heads of units, organizations, and individuals related thereto are responsible for implementing this Decision./.

REGULATIONS ON TESTING AND RECOGNIZING NEW FERTILIZERS

dated December 8, 2004)

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1. These regulations apply to the field of testing and recognizing new fertilizers.

2. Organizations and individuals, both domestic and foreign, engaged in activities related to the field of testing and recognizing new fertilizers within the territory of Vietnam must comply with these regulations.

3. Types of fertilizers that must be tested include:

a) New fertilizers produced domestically or newly imported and not yet listed in the "List of Fertilizers Permitted for Production, Trading, and Use in Vietnam" (hereinafter referred to as the Fertilizer List), including organic fertilizers, foliar fertilizers, microbial fertilizers, bio-organic fertilizers, organic-mineral fertilizers, fertilizers supplemented with growth regulators, and soil ameliorants.

b) Fertilizers listed in the Fertilizer List under the types specified in point a, Clause 3, Section I but have changed in:

Main nutrient components, or

A reduction in one of the major nutrients exceeding 5% of the original pure content per unit volume or mass compared to the recognized content.

A reduction in one of the secondary nutrients, trace elements, or organic matter exceeding 10% of the original pure content per unit volume or mass compared to the recognized content.

An increase or decrease in one of the components in foliar fertilizers exceeding 10% of the original pure content per unit volume or mass compared to the recognized content.

II. TESTING OF FERTILIZERS

1. Conditions for registering fertilizer testing

The following types of fertilizers wishing to register for testing must meet the following conditions: a) Organic fertilizers: organic matter content

22.36% (C ³ 13%) and N ³ b) Bio-organic fertilizers: organic matter content ≥ 22.36% (C ≥ 13%), moisture content ≤ 25% (for granular or powdered forms) ³  3%.

c) Microbial-organic fertilizers: organic matter content, • TCVN 6492:2011;_{Soil pH}: 5-7.

15% (C ³ 8.5%), beneficial microorganism density ³ vsv/g (vsv/ml for liquid form), moisture content ≤ 30% (for granular or powdered forms) ³ 1.10⁶ d) Microbial fertilizers: beneficial microorganism density ≥ 1.10³ 1.10⁶ vsv/g (≥ 1.10vsv/ml for liquid form) on a sterilized carrier or ≥ 1.10).

(effective) + K ³ 8.5%), beneficial microorganism density ³ f) Fertilizers supplemented with growth regulators: in addition to nutritional factors, growth regulators have a content ≤ 0.5% in a unit volume or mass₂O₅ of fertilizer.₂O ³ 8%.

2. Procedure for testing 2.1. Organizations and individuals with fertilizers for testing submit the application dossier to the Department of Agriculture, which includes: a) Application for testing registration according to

b) Documentation on the characteristics of the fertilizer being tested:

Trade name and other names (if any);Type of fertilizer (foliar or root-applied);.

Manufacturer's name or company name and country of production;

Characteristics: form (liquid, granular, powdered), color;

Composition, nutrient content (specify analytical method) as follows:

Foliar fertilizers: major, secondary, and trace elements, organic matter, carrier, and growth regulators (if any);

Bio-organic fertilizers: organic matter content, biological active substances, moisture content, pH

, other nutrients (if any);

Mineral-organic fertilizers: organic matter content, major, secondary, and trace elements, moisture content;

Microbial fertilizers: species and beneficial microorganism density, moisture content;_{Soil pH}Microbial-organic fertilizers: organic matter, species and beneficial microorganism density, moisture content;

Fertilizers supplemented with growth regulators: composition and nutrient content of the base fertilizer and permitted growth regulators;

Soil ameliorants: composition and content of each component in the product.

c) Documentation on the toxicity of the fertilizer: fertilizers produced from industrial waste, urban waste, and others containing harmful elements must analyze heavy metal content: Pb, Hg, Cd, As; pathogenic microorganism density (E. coli, Salmonella); roundworm eggs (Ascaris).

d) For imported fertilizers: manufacturer's name or company name and country of production;

within fifteen working days from the date of receipt of complete and valid application dossiers . Conducting testing within fifteen working days from the date of receipt of complete and valid application dossiers a) The entity conducting the testing

of fertilizers must meet the following conditions currently Recognized or designated by the Ministry of Agriculture and Rural Development;

Have specialized staff with university-level qualifications in fertilizer science; Facilities and equipment suitable for testing requirements.:

b) Organizations and individuals with fertilizers for testing:

Sign a contract with a testing entity

Crecognized by the Ministry of Agriculture and Rural Development or designated by the Department of Agriculture;

Foreign organizations and individuals wishing to register for fertilizer testing must have a representative office or representative in Vietnam

Enter into a contract with an inspection unit recognized by the Ministry of Agriculture and Rural Development or designated by the Department of Agriculture; Foreign organizations and individuals wishing to register for fertilizer testing must have a representative office or a representative in Vietnam.

III. REVIEW AND RECOGNITION OF NEW FERTILIZERS

1. Review of Testing

a) After completing the testing, the organization or individual with the fertilizer shall submit the application for review and recognition of new fertilizers to the General Department of Agriculture and the Science and Technology Division.

The application for review and recognition of new fertilizers includes:

Application for review and recognition of new fertilizers;

Report on testing results;

Comments from the Department of Agriculture and Rural Development regarding the testing process and the usability of the tested fertilizer at the local level.

b) Organize the review of testing results:

The Science and Technology Division shall present to the Minister of Agriculture and Rural Development to establish a specialized review board to review the testing results after receiving complete and valid files from the organization or individual with the fertilizer and comments on the testing process from the General Department of Agriculture.

2. Recognition of New Fertilizers

a) After being concluded by the specialized review board that the requirements have been met, the Science and Technology Division shall present to the Minister of Agriculture and Rural Development to issue a decision recognizing new fertilizers and include them in the Fertilizer List.

b) The decision recognizing new fertilizers shall not exceed thirty working days from the date when the review board concludes its meeting.

IV. IMPLEMENTATION

1. General Department of Agriculture

a) Draft and submit to the Ministry of Agriculture and Rural Development for issuance of procedural regulations, norms, and standards for fertilizer testing.

b) Receive and review registration applications for testing; issue test permits for new domestic fertilizers and production permits for new domestic fertilizers for testing.

c) Organize the review and submit to the Ministry Minister of Agriculture and Rural Development for recognition of testing units for fertilizers.

d) Conduct inspections, audits, and handle violations in fertilizer testing activities..

2. Science and Technology Division

a) Present to the Minister of Agriculture and Rural Development for issuance of a Decision establishing a specialized review board for recognizing new fertilizers.

b) Present to the Minister of Agriculture and Rural Development for issuance of a Decision recognizing new fertilizers.

3. Provincial Departments of Agriculture and Rural Development

a) Monitor and inspect the testing process at the local level..

b) Evaluate and assess the testing results and the usability of tested fertilizers at the local level.

4. Testing Units

a) Conduct testing in accordance with the Fertilizer Testing Regulations issued by the Ministry of Agriculture and Rural Development and bear responsibility for the testing results.

b) Report the testing results of fertilizers to the General Department of Agriculture.

5. Organizations and Individuals with Tested Fertilizers

a) Strictly comply with the provisions of this Regulation and other relevant laws.

b) Collaborate with the testing unit to report the testing results of fertilizers to the General Department of Agriculture.

c) Fees and charges for testing and recognizing new fertilizers shall be borne by the organizations or individuals with the fertilizers undergoing testing.

V. VIOLATION HANDLING

1. Organizations and individuals violating Decree 113/2003/ND-CP and this Regulation on fertilizer testing shall be criminally prosecuted depending on the nature and severity of the violation, and if damage is caused, they must compensate according to the law.

2. The Department of Agriculture and Rural Development may recommend to the Ministry of Agriculture and Rural Development to suspend or terminate testing activities for organizations and individuals who fail to meet the conditions set forth in this Regulation.

3. Any person who abuses their position or authority to obstruct legitimate activities or violate the regulations on testing and recognizing new fertilizers shall be disciplined or criminally prosecuted depending on the nature and severity of the violation, and if damage is caused, they must compensate according to the law.
