- Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Finance;
- Pursuant to Decision No. 289/QĐ-TTg dated March 18, 2008 of the Prime Minister on issuing certain support policies for ethnic minority people, households under policy categories, poor households, near-poor households, and fishermen;
- Pursuant to Decision No. 965/QĐ-TTg dated July 21, 2008 of the Prime Minister regarding amendments and supplements to Decision No. 289/QĐ-TTg dated March 18, 2008 of the Prime Minister on issuing certain support policies for ethnic minority people, households under policy categories, poor households, near-poor households, and fishermen, and Decision No. 602/QĐ-TTg dated May 22, 2008 of the Prime Minister on amendments and supplements to Decision No. 201/QĐ-TTg dated February 19, 2008 on support policies for restoring rice production in the winter-spring season 2007-2008 and cattle breeding affected by severe cold in 2008, and Decision No. 289/QĐ-TTg dated March 18, 2008 on issuing certain support policies for ethnic minority people, households under policy categories, poor households, near-poor households, and fishermen (hereinafter referred to as Decision No. 965/QĐ-TTg);
At the request of the Ministry of Agriculture and Rural Development through Circulars No. 1528/BNN-KTBVNL dated June 2, 2008 and Circular No. 2059/BNN-KTBVNL dated July 17, 2008, the Ministry of Finance hereby issues guidelines for implementing Decision No. 965/QĐ-TTg dated July 21, 2008 of the Prime Minister and amending and supplementing Circular No. 35/2008/TT-BTC dated April 25, 2008 of the Ministry of Finance (hereinafter referred to as Circular No. 35/2008/TT-BTC) as follows:
Amend some phrases mentioned at Point 1d, 2d Section I of Circular No. 35/2008/TT-BTC including:
1. - Amend the phrase "registration certificate for fishing vessels" to "Fishing vessel registration certificate or confirmation of fishing vessel registration (for vessels under 20 CV)".
- Amend the phrase "inspection certificate for vessels" to "Technical safety certificate for fishing vessels or operation capability certificate for fishing vessels (for vessels 20 CV and above)".
- Amend the phrase "fishing license" to "Fishery exploitation permit".
Supplement to the second bullet point of Point 1a Section I of Circular No. 35/2008/TT-BTC as follows:
2. "Service vessels for fishery activities are vessels that collect marine products, supply materials, fuel, food, ice, transport, and process marine products for fishing vessels operating in various sea areas."
Amend Point 3 Section I of Circular No. 35/2008/TT-BTC as follows:
3. "3. Support for vessel hull insurance costs for fishing vessels and service vessels for fishery activities with engine power of 40 CV or more. Support for crew accident insurance costs for crew members working on fishing vessels and service vessels for fishery activities.
- Fishing vessels and service vessels for fishery activities must complete registration, inspection procedures, and have a fishery exploitation permit.
a) Conditions for support:
- For crew accident insurance cost support, the vessel owner purchases crew accident insurance based on the crew list, or the crew member list, or labor contracts with crew members, or according to the number of crew members specified in the fishery exploitation permit.
b) Level of support:
- The State supports 30% of the cost of purchasing vessel hull insurance for fishing vessels and service vessels for fishery activities with engine power of 40 CV or more.
- The State supports 100% of the cost of purchasing crew accident insurance for crew members working on fishing vessels and service vessels for fishery activities.
c) Time of implementation:
- Vessel owners who purchase vessel hull insurance and crew accident insurance in a given year will be supported for that year.
- The policy of supporting vessel hull insurance and crew accident insurance costs will be implemented from 2008 to 2010.
d) Supporting documents:
- For vessel hull insurance cost support: the vessel owner prepares the following documents:
+ Application for vessel hull insurance cost support with confirmation from the People's Committee of the commune regarding the residence address and whether the vessel has conducted fishing activities or provided services for fishing activities at sea (according to Model No. 02 issued together with this Circular).
+ Certified copies or confirmed copies by the People's Committee of the commune of the following documents: fishing vessel registration certificate; technical safety certificate for fishing vessels or operation capability certificate for fishing vessels; fishery exploitation permit (for fishing vessels).
+ Copy of the vessel hull insurance certificate still valid until the date the application for support is submitted.
- For crew accident insurance cost support: the vessel owner prepares the following documents:
+ Application for crew accident insurance cost support with confirmation from the People's Committee of the commune (according to Model No. 02 issued together with this Circular).
+ Copy of the crew accident insurance certificate still valid until the date the application for support is submitted.
- Applications for support are made annually, and the vessel owner applies for insurance cost support for a specific year and prepares the documents for that year.
Amend Point 4 Section I of Circular No. 35/2008/TT-BTC as follows:
4. "4. Support for diesel for fishermen who own fishing vessels or service vessels for fishery activities
a) Eligible recipients, conditions for support, and time of support:.
implemented according to Clause 2 Article 1 of Decision No. 965/QĐ-TTg dated July 21, 2008 of the Prime Minister. - For vessels with engine power of 90 CV or more: support of 10 million VND per fishing trip. Supported three times per year.
- The State supports 30% of the cost of purchasing vessel hull insurance for fishing vessels and service vessels for fishery activities with engine power of 40 CV or more.
- For vessels with engine power of 40 CV to less than 90 CV: support of 6.5 million VND per fishing trip. Supported four times per year.
- For vessels with engine power below 40 CV: support of 4 million VND per fishing trip. Supported five times per year.
- For fishing vessels with engine power below 40 CV: support of VND 4 million per fishing trip. Support up to five times per year.
The level of support mentioned above shall apply to all oil support instances throughout the year 2008. In cases where ship owners have already received support funds according to the level prescribed in Decision No. 289/QĐ-TTg dated March 18, 2008 of the Prime Minister, they will be provided additional support for the increased portion as stipulated in Decision No. 965/QĐ-TTg dated July 21, 2008 of the Prime Minister. In cases where ship owners have not yet received support funds, they will receive support funds according to the level prescribed in Decision No. 965/QĐ-TTg dated July 21, 2008 of the Prime Minister.
c) Regarding the support application dossier:
- Ship owners shall prepare the initial support application dossier for the year 2008 as follows:
+ An application for oil support with confirmation from the People's Committee of the commune regarding the place of residence and whether they have conducted fishing activities or provided services for such activities (in accordance with Model No. 03 attached hereto).
+ A certified copy or confirmation from the People's Committee of the commune regarding the documents prescribed in Clause 2, Article 1 of Decision No. 965/QĐ-TTg, specifically including: the fishing vessel registration certificate or a confirmation of having registered a fishing vessel (for vessels under 20 GT); the technical safety certificate of fishing vessels or the logbook of operational capability of fishing vessels (for vessels 20 GT or more); the fishing permit (for fishing vessels).
+ For vessels 90 GT or more, there must be a certified copy of the crew accident insurance certificate still valid until the date when the ship owner prepares the application dossier.
+ A confirmation from the People's Committee of the commune or border guard (border guard post or border guard station) regarding the conduct of fishing activities or provision of services for such activities.
The format of the confirmation letter from the People's Committee of the commune or border guard shall be prescribed by the People's Committee of the province or centrally governed city or delegated to relevant provincial departments by the People's Committee of the province or centrally governed city for uniform application within their respective jurisdictions.
- For subsequent support applications in 2008: Ship owners shall prepare a confirmation letter from the People's Committee of the commune or border guard (border guard post or border guard station) regarding the conduct of fishing activities or provision of services for such activities.
5. This Circular shall take effect fifteen days after its publication in the Official Gazette and shall apply to coastal provinces and centrally governed cities.
The Chairman of the People's Committee of coastal provinces and centrally governed cities shall specify and provide detailed guidance on the implementation and support for fishermen in accordance with the specific conditions of each locality.
During the implementation process, if any difficulties arise, they should be reported to the Ministry of Finance and the Ministry of Agriculture and Rural Development for consideration and resolution.
