Circular No. 71/2011/TT-BCA on Admissions to Public Security People's Police Schools

Pursuant to the Education Law on June 14, 2005; the Law Amending and Supplementing Certain Articles of the Education Law on November 25, 2009;

Pursuant to the Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

The Minister of Public Security shall stipulate the enrollment into police academies, universities, colleges, intermediate-level schools, and cultural institutions for public security personnel (hereinafter referred to collectively as police schools) as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular specifies the principles, subjects, standards, procedures, application forms, and responsibility allocation in the work of enrolling students into police schools.

2. This Circular applies to:

a) Police schools, General Corps, units under the Ministry, provincial public security services, centrally governed cities, Departments of Fire Prevention and Fighting (hereinafter referred to collectively as public security units and localities) are assigned the task of implementing the student enrollment work within the public security system; candidates who register to take the entrance examination, recruitment, and selection tests for various levels of education and training at police schools.

b) Agencies, units, and individuals outside the public security sector with quotas for taking the entrance examination, recruitment, and selection tests for training at police schools shall implement according to the provisions of this Circular.

c) Enrollments for training at police schools for foreign nationals have separate regulations.

Điều 2. Nguyên tắc tuyển sinh vào các trường Công an nhân dân

1. Enrollment into police schools must be based on requirements, operations, combat activities, and force building of the public security forces; linking cadre planning with training planning to meet the qualification standards of each position according to the cadre's current or future responsibilities after graduation; ensuring quality and quantity, implementing democracy, fairness, and transparency.

2. Enrollment into police schools shall be carried out on the basis of combining academic performance checks, health status, aptitude, political criteria, and moral character of applicants as specified separately by the Ministry of Public Security with the results of entrance examinations, recommended selections, and evaluations according to the admission regulations of the Ministry of Education and Training and the regulations of the Ministry of Public Security.

Article 3. Proportion of female student admissions

Admissions (new enrollments) of female students into police schools are determined with separate quotas accounting for 10 to 15 percent of the total training quotas of each field of study and each school; there is no limit on the proportion of preliminary female applicants and those registering for the selection process into police schools; the number of preliminary applicants is decided by the heads of public security units and localities based on their own unit’s and locality’s needs for female cadres and they are responsible for accepting them for work after graduation.

Chapter II

SPECIFIC PROVISIONS

Section 1

TUYỂN SINH ĐÀO TẠO SAU ĐẠI HỌC

Điều 4. Tuyển sinh đào tạo tiến sĩ

1. Đối tượng, điều kiện đăng ký dự tuyển

a) Subjects: teachers and educational management staff in police schools; positions such as specialists, assistants in advisory work, scientific research, and cadres planned for leadership roles from department level upwards in public security units and localities; positions requiring work experience that must have a doctoral degree as prescribed.

b) Conditions for registration for selection: in addition to the conditions for registration for selection according to the current regulations on doctoral degree training programs of the Ministry of Education and Training, applicants must hold a master's degree in the same field or a related field corresponding to the doctoral training program; have at least five years of specialized work experience, teaching, or practical work experience (excluding time spent studying and serving in the public security forces on a limited-term basis); not exceeding fifty years old.

2. Time and form of enrollment: implemented according to the current regulations on doctoral degree training programs of the Ministry of Education and Training and guidance from the Ministry of Public Security.

Article 5. Graduate School Admissions for Master's Degree Programs

1. Eligibility and Conditions for Registration to Take Examinations

a) Subjects: teachers and educational management staff in police schools; positions such as specialists, assistants in advisory work, scientific research; leaders from team level upwards in public security units and localities; positions requiring work experience that must have a master's degree as prescribed.

b) Conditions for registration for the exam: in addition to the conditions for registration for the exam according to the current regulations on master's degree training programs of the Ministry of Education and Training, additional provisions regarding diplomas and work experience and age are as follows:

- Regarding diplomas: must have a regular bachelor's degree diploma, if graduating from a part-time or combined bachelor's program, must achieve a good grade or higher in the relevant field or a closely related field corresponding to the master's training program; in cases where the bachelor's degree is in a closely related field to the master's program, supplementary knowledge must be acquired before taking the exam or having a second diploma equivalent to a regular bachelor's degree.

- Regarding work experience and age: those with a regular bachelor's degree diploma achieving a good grade or higher in the relevant field can register for the exam two years after obtaining the diploma; others must have at least three years of practical work experience (from the date of the decision recognizing the bachelor's degree to the date of submitting the application for the exam); not exceeding forty-five years old.

2. Objectives and preferential policies, exemptions from entrance examinations: implemented according to the current regulations on master's degree training programs of the Ministry of Education and Training and guidance from the Ministry of Public Security.

3. Time and form of enrollment: implemented according to the current regulations on master's degree training programs of the Ministry of Education and Training and guidance from the Ministry of Public Security.

Section 2

ADMISSIONS FOR UNDERGRADUATE AND COLLEGE DEGREE PROGRAMS

Article 6. Regular Admissions for Undergraduate and College Degree Programs

1. Eligibility and Conditions for Registration to Take Examinations

a) Object:

- Public security officers and soldiers within the establishment who wish to improve their qualifications may be nominated by their public security units and localities to take the exam;

- Non-commissioned officers and soldiers serving on a limited-term basis in the public security forces with at least eighteen months of service (counting up to the month of the exam), willing and nominated by their public security units and localities to take the exam;

- Students with permanent residence registration in the locality where they apply for preliminary registration, being members of the Communist Party of Vietnam or Young Communist League members;

- Citizens who have completed limited-term service in the public security forces or military service in the People's Army of Vietnam may take the exam once more within twelve months from the date of discharge.

b) Subjects eligible for direct admission and preferential evaluation: high school graduates who meet the conditions for direct admission or preferential evaluation for undergraduate and college training according to the annual regulations of the Ministry of Education and Training must meet the preliminary selection requirements set by the Ministry of Public Security.

2. Conditions for registration for the exam

a) Educational Qualifications:

- The subjects specified in point a, Clause 1, Article 6 of this Circular must have graduated from general secondary education through regular education or continuing education, vocational college, or vocational training. For those who have graduated from vocational training, they must have completed junior high school, studied the required amount of knowledge, and passed the graduation exams for general secondary education subjects according to the regulations of the Ministry of Education and Training;

- During their years of general secondary education, they must achieve at least average academic performance, with three subjects in the registration group for admission to public security universities reaching at least 6.0 (six) points; specifically, students from region KV1, ethnic minority students, and public security service members serving on a fixed term basis must reach at least 5.0 (five) points;

b) Age:

- For public security officers and soldiers within the establishment, they must not exceed 30 years old (as of the year of examination);

- For students, they must not exceed 20 years old; specifically, ethnic minority students must not exceed 22 years old (as of the year of examination);

c) Moral Standards and Political Quality:

- Regarding moral standards: during their years of general secondary education, they must meet the requirements for good conduct, achieving at least satisfactory level;

- Regarding political quality: they must comply with the current regulations of the Minister of Public Security regarding the recruitment of personnel into the public security force;

For citizens currently serving on a fixed-term basis in the public security force or having completed such service in the public security force or the People's Army, they must have completed their duties annually and not violated discipline at the level of reprimand or higher;

d) Regarding health standards: candidates must not suffer from chronic or terminal illnesses; they must have balanced physical build and appearance, without deformities; for males, height must be between 1.64m and 1.80m, and weight between 48kg and 75kg; for females, height must be between 1.58m and 1.75m, and weight between 45kg and 60kg; for students from region KV1 and ethnic minority students, height and weight requirements may be reduced by 2 (two) cm and 2 (two) kg respectively; for citizens currently serving or having completed fixed-term service in the public security force, height requirements shall be implemented according to Joint Circular No. 09/2009/TTLT-BCA-BYT dated November 3, 2009, issued by the Ministry of Public Security and the Ministry of Health, guiding the health check-up for recruitment of citizens serving on a fixed-term basis in the public security force; public security units and localities that require higher height and weight criteria must report to the Minister for decision;

3. Entrance Examination: in one year, each candidate may only apply for admission to one major at one university. The organization of entrance examinations for each major at each university shall be carried out according to the annual enrollment guidelines of the Ministry of Public Security;

4. Admission Scores:

a) Implemented based on the principle of adding examination scores to preferential points for admission to universities as stipulated by the Ministry of Education and Training, ensuring the ratio of examinees for each examination group and not exceeding the quota assigned by the Ministry of Public Security. In cases where the admission plan exceeds the quota or there are unreasonable ratios of admission points among examination groups and majors, or when sending candidates for training at non-public universities (for universities with quotas), a report must be submitted to the Ministry (through the General Department of Public Security Force Construction) for decision. Admission points must not be lower than the minimum admission points for undergraduate programs as stipulated by the Ministry of Education and Training;

b) Higher education colleges will not organize entrance examinations; based on the results of university entrance examinations and candidates' preferences, colleges will propose admission plans based on the quotas assigned by the Ministry of Public Security. Admission points must not be lower than the minimum admission points for college programs as stipulated by the Ministry of Education and Training;

5. The deadline for completing grading, determining admission points, and sending examination result certificates to candidates shall be carried out according to the enrollment regulations of the Ministry of Education and Training and the annual enrollment guidelines of the Ministry of Public Security;

Article 7. Admissions for undergraduate and college education through part-time study

a) Object:

- Public security officers and soldiers within the establishment; they must have worked for at least two years up to the month of the examination (excluding study periods, fixed-term service periods in the public security force, and temporary recruitment periods); work requirements must meet the bachelor's or associate degree standards for the position;

- Those exempted from exams and given preferential admission: shall be implemented according to the current regulations on admissions for undergraduate and college education through part-time study issued by the Ministry of Education and Training and the guidance of the Ministry of Public Security.

b) Conditions for registering for admission:

- Regarding educational qualifications: they must have graduated from general secondary education through regular education or continuing education, vocational college, or vocational training. For those who have graduated from vocational training, they must have completed junior high school, studied the required amount of knowledge, and passed the graduation exams for general secondary education subjects according to the regulations of the Ministry of Education and Training;

- Regarding age: public security officers and soldiers within the establishment must not exceed 45 years old (as of the year of examination);

- Regarding organizational discipline awareness: in the two consecutive years of work immediately preceding the recruitment year, they must have completed their tasks satisfactorily, and not be under disciplinary action at the level of reprimand or higher or awaiting disciplinary action;

2. Entrance Examination: the examination groups and time of organization shall be carried out according to the current higher education and college education regulations for part-time learning issued by the Ministry of Education and Training and the regulations of the Ministry of Public Security;

3. Admission Points: the admission process shall be carried out based on the admission points, taking into account the examination scores plus preferential points for regions and categories (if applicable) to meet the established training quotas.

Article 8. Admissions for concurrent training to bachelor's and college levels

a) Eligibility: police officers and soldiers who have completed a secondary police academy diploma or a college police academy diploma and wish to train to meet job title standards requiring a college or bachelor's degree.

b) Conditions for registering for admission

- For concurrent training from secondary level to college level or from college level to bachelor's level: police officers and soldiers with good or better graduation results must have at least one year of work experience; those with average or good average graduation results must have at least two years of work experience (counting from the date of graduation) in relevant professional fields corresponding to their intended training.

- For concurrent training from secondary level to bachelor's level: police officers and soldiers with a secondary police academy diploma must have at least three years of work experience (counting from the date of graduation) in relevant professional fields corresponding to their intended training.

- For police officers and soldiers with a secondary or college diploma in a different field but within the same sector, if they wish to undergo concurrent training, they must complete additional knowledge units to meet the entry requirements of the intended concurrent training program before taking the entrance exam. The amount of additional knowledge required is determined by the Rector.

- Age requirement: police officers and soldiers must not exceed 45 years old (as of the year of the examination).

- Discipline awareness: during the two years immediately preceding the year of application, they must have satisfactorily completed their tasks, without being under disciplinary action from a reprimand or higher, or awaiting disciplinary review.

2. Admission Examination

a) Concurrent training from college level to bachelor's level in the National Police Academy, involves examinations in two subjects: basic industry and industry knowledge.

b) Concurrent training from secondary level to bachelor's level in the National Police Academy, involves examinations in three subjects: two cultural subjects and one basic industry subject, specialized subject. The examination questions follow current regulations set by the Ministry of Education and Training.

3. Admission points: implemented according to Clause 3, Article 7 of this Circular.

Article 9. Admissions for second bachelor's degree training

1. Eligibility and age: police officers who have graduated from universities inside or outside the National Police Academy system and wish to obtain a second bachelor's degree to meet job title standards suitable for their profession and field of work, must not exceed 45 years old (as of the year of application).

2. Entrance Examination: conducted according to regulations of the Ministry of Education and Training.

3. Admission points: implemented according to Clause 3, Article 7 of this Circular.

Article 10. Admissions for commissioned university training

1. Eligibility and recruitment areas: students from the National Police Cultural Schools who have completed high school, when recruited into the National Police Cultural Schools, are ethnic minority residents with permanent residence in communes with extremely difficult socio-economic conditions as defined by current government regulations, the Ministry of Education and Training, and annual recruitment guidelines of the Ministry of Public Security.

2. Admission criteria: students who have completed high school for the first time annually at National Police Cultural Schools, where they have been rated as having good conduct and average academic performance throughout high school, with individual grades in grade 12 reaching 6.0 (six) or above. In the three years of high school at the National Police Cultural School, they must not have been disciplined with a reprimand or higher.

Section 3

ADMISSIONS FOR COLLEGE AND OTHER LEVELS OF EDUCATION

Article 11. Admissions for Regular College Programs

1. For New Applicants

a) Admission eligibility: includes individuals who have taken the regular university entrance exams at National Police Academies and registered to be admitted to regular secondary training programs at National Police Academies.

b) Direct admission and priority admission eligibility

- Direct admission:

+ High school graduates meeting direct admission criteria as stipulated annually by the Ministry of Education and Training and the Ministry of Public Security, satisfying preliminary screening requirements, and ensuring standards for recruiting personnel into the National Police Force as prescribed by the Ministry of Public Security.

+ Students from National Police Cultural Schools who have completed high school but do not meet the criteria for commissioned university training.

+ Children of deceased National Police martyrs, who have passed the National Police University entrance exam with scores equal to or above the minimum threshold set by the Ministry of Public Security and without failing any subject.

- Priority admission: children of severely disabled National Police veterans (81% or more disability); children of National Police Heroes of Armed Forces and Labor Heroes who have passed the National Police University entrance exam with scores equal to or above the minimum threshold set by the Ministry of Public Security and without failing any subject.

c) Admission points: admission points for secondary training are determined based on the principle of adding regular university entrance exam scores according to each test group plus regional and category bonus points (if applicable) to meet the quota assigned by the Ministry.

d) Bonus points: in addition to implementing regulations of the Ministry of Education and Training, the Ministry of Public Security specifies eligible recipients of bonus points, including:

- Adding 2.0 (two) points for children of police officers in the payroll (currently working or retired); children of indefinite-term contractual laborers in the National Police and retired police officers who have worked continuously in the National Police for 15 years or more.

- Adding 1.0 (one) point for children of village police chiefs currently working or retired, transferred but who have worked continuously in the village police force for 15 years or more. Heads of units and local police directors are responsible for the accuracy of these categories.

Individuals specified in Point d, Clause 1, Article 11 of this Circular who have been criminally prosecuted, dismissed from service, or stripped of their National Police title are not eligible for bonus points.

e) Final admission: based on regular university entrance exam scores and candidates' registration preferences for secondary National Police training (including bonus points), admission points are reviewed from highest to lowest to meet the quota assigned by the Ministry to each secondary National Police training institution and each region.

Regular secondary training admissions end before November of the recruitment year.

2. For Officers and Soldiers in the Public Security Establishment

a) Recipients, eligibility criteria for admission: police officers and soldiers who have completed secondary education through regular education or continuing education, vocational college, or vocational training. For those who have completed vocational training, they must have graduated from junior high school, completed the required curriculum, passed the final exams in high school subjects according to the regulations of the Ministry of Education and Training; in the two consecutive years of work prior to the year of application, they must have fulfilled their duties satisfactorily, not be under disciplinary action from a warning or higher, or awaiting disciplinary review; and not exceed 35 years old (as of the year of application).

Admission process: based on allocated quotas, local police units will select candidates, submit lists of officers to attend schools for appraisal, recruitment, enrollment, and report back to the General Department of Police Force Construction for monitoring and implementation.

Article 12. Recruitment for part-time intermediate-level education

1. Recipients, eligibility criteria for admission: implemented according to point a, Clause 2, Article 11 of this Circular.

2. Admission process: implemented according to point b, Clause 2, Article 11 of this Circular.

Article 13. Recruitment for early cultural education

1. Students from ethnic minorities

a) Recipients: students from ethnic minorities with permanent residence registration for at least 05 (five) years (as of July of the year of recruitment) in communes with extremely difficult socio-economic conditions as defined by the Government.

b) Selection criteria: having completed junior high school (grade 9), with average academic performance and good conduct during junior high school; meeting political and moral standards; having a balanced physique, not suffering from chronic or terminal illnesses; having normal physical and intellectual development potential, under 17 years old, and at least 1.50 meters tall. Female students may be 02 (two) centimeters shorter.

The number of female students from ethnic minorities shall be decided by the Director of the Provincial Public Security Department but shall not exceed 15% of the annual quota allocated to local public security agencies. No more than 02 (two) students from the same family shall be recruited, and no more than 05 (five) students from the same commune within a three-year period.

c) Admission process: based on allocated quotas, local public security agencies organize selection, submit applications and lists to the schools. People's Public Security Cultural Schools check the admission criteria, organize recruitment and enrollment, and report results to the General Department of Police Force Construction for monitoring.

Other recipients: children of severely disabled People's Public Security martyrs with a disability rate of 81% or higher; children of People's Public Security martyrs; children of martyrs who died in anti-crime operations, meeting the admission criteria for People's Public Security, having completed junior high school, with good conduct during junior high school if they express a desire, shall be reviewed and recommended for direct admission to People's Public Security Cultural Schools by local public security units.

Recruitment for cultural education at People's Public Security Cultural Schools concludes before August 15 of the year of recruitment.

Section 4

APPLICATION FOR ADMISSION

Article 14. Application forms for examination registration and admission

1. Application forms for examination registration and admission for undergraduate, college, and intermediate-level regular education programs shall comply with the regulations of the Ministry of Education and Training and the annual guidelines of the Ministry of Public Security.

2. Application forms for examination registration and admission for other types of education programs shall comply with the regulations of the Ministry of Education and Training and shall be guided by People's Public Security Schools.

Article 15. Admission files for various types of concentrated training programs

1. For newly recruited trainees:

a) Voluntary application form to join the Police Force (according to the model of the Ministry of Public Security);

b) Self-declared curriculum vitae (according to the model of the Ministry of Public Security), confirmed by commune, ward, or town;

c) Background investigation report (according to the model of the Ministry of Public Security);

d) Health certificate (according to the regulations of the Ministry of Public Security);

đ) Birth certificate;

e) Permanent residence registration book;

g) School record book and high school graduation certificate or temporary high school graduation certificate for those admitted immediately upon graduation (for students entering police cultural schools, middle school graduation records and certificates are required);

h) Approval record of the Admission Council of local public security units;

i) Certificate of preferential treatment (if applicable);

k) Party activity introduction letter or Youth Union activity introduction letter;

l) Test score report (except for Police Cultural Schools);

m) Admission notice from the school.

2. For police officers within the establishment:

a) Decision to send officers for study issued by the Head of the Unit or the Director of the Provincial Public Security Department;

b) Original file of the officer;

c) Party activity introduction letter or Youth Union activity introduction letter;

d) Pay transfer and uniform transfer documents;

e) Test score report form (for levels that organize entrance examinations);

f) Admission notice from the school;

g) Certificate of preferential treatment (if applicable);

h) School record book and high school graduation certificate;

The documents specified in points d, e, g, i Clause 1 and points g, h Clause 2 of Article 15 of this Circular must be submitted in certified copies (certified true copies from original documents) and the original documents must be presented when reporting to the school for admission.

Section 5

ASSIGNMENT OF RESPONSIBILITIES IN THE ADMISSION PROCESS

Article 16. Responsibilities of the General Department of Police Force Construction

1. Assist the Minister in directing and guiding the implementation of annual admissions work according to the regulations of the Ministry of Education and Training and the provisions of this Circular; direct police schools and local police units to resolve complaints and issues arising during the admissions process.

2. Conduct comprehensive inspections and checks on all stages of preliminary selection and admissions at police schools and local police units; have the authority to suspend actions violating the Ministry of Education and Training's admissions regulations and the provisions of this Circular; propose disciplinary measures for collective and individual violations to the leadership of the Ministry.

3. Annually, evaluate the organization and implementation of admissions work in the police force; propose reports to the Ministry's leadership to adjust issues outside the scope of this Circular.

Article 17. Responsibilities of local police units assigned admissions tasks

1. Establish an Admissions Council to organize and implement the unit's admissions work according to its functions.

2. Publicly announce the policy and regulations on admissions issued by the Ministry of Public Security to police officers and young students; organize the acceptance of examination and recruitment registration forms from candidates.

3. Organize preliminary selections, compile lists, complete application files to send to schools, and report the number of registrations to the General Department of Police Force Construction.

4. Transfer examination registration forms, admission results notifications, test score reports, and recruitment notices to each candidate.

5. Complete admission files and procedures for candidates admitted to police schools (including candidates recruited by other ministries or local police units).

6. Report to the Ministry's leadership (through the General Department of Police Force Construction) on the results of admissions in their units and regions.

7. Be responsible to the Minister for the recruitment tasks assigned.

Article 18. Responsibilities of Police Schools

1. Announce recruitment, organize entrance examinations, and admissions to various levels of education according to the regulations of the Ministry of Education and Training and the Ministry of Public Security.

2. Check applicants' files, health, and political standards upon admission; carry out duties and powers regarding admissions, recruitment, and enrollment according to the Minister of Public Security's regulations on the management responsibilities of police schools; return candidates who do not meet the admission standards to their original units or preliminary selection locations and report to the Ministry's leadership (through the General Department of Police Force Construction) for monitoring.

3. Be responsible to the Minister for the recruitment tasks assigned.

Chapter III

IMPLEMENTATION

Article 19. Effective Date

This Circular takes effect from the date of signature and replaces the Regulations on Admissions to Various Types of Training Programs in Police Academies and Schools issued with Decision No. 727/2006/QĐ-BCA(X14) dated June 8, 2006, of the Minister of Public Security.

Article 20. Responsibility for Implementation

1. Comrades General Directors, Heads of Units under the Ministry, Provincial Public Security Directors, Central City Public Security Directors, Fire Prevention and Control Departments Directors, Academy Directors, and Police School Principals are responsible for implementing this Circular.

During the implementation of this Circular, if any difficulties arise, local police units should reflect them to the Ministry (through the General Department of Police Force Construction) to propose supplements and amendments.

2. The General Director of the General Department of Police Force Construction is responsible for directing, guiding, and inspecting the implementation of this Circular.
