MINISTRY OF FINANCE DECREE NO. 71 TC/HCSN SEPTEMBER 30, 1995

REGULATIONS ON THE INSTALLATION OF TELEPHONES AT PRIVATE RESIDENCES FOR STAFF WORKING IN STATE ORGANIZATIONS, STATE ENTERPRISES, MILITARY FORCES, AND ASSOCIATIONS

In order to implement Directive No. 368/TTg dated June 22, 1995 of the Prime Minister on thrift and the prevention of waste in state agencies, military forces, associations, and state enterprises;

After consultation and agreement with the Government Organizational Staff Department (Document No. 119 TCCB-CCVC dated July 31, 1995);

The General Post Office Administration (Document No. 1570/KTKH dated August 12, 1995), the Ministry of Finance hereby promulgates regulations on the installation of telephones at private residences for staff working in state organizations, state enterprises, military forces, and associations (hereinafter referred to as organizations and units) as follows:, I. GENERAL PRINCIPLES:

1/ All organizations and units when implementing the installation of official telephones at private residences for staff must comply strictly with the provisions of this circular.

2/ The installation of official telephones at private residences (including initial installation costs and monthly rental fees, long-distance telephone charges) shall only be implemented for individuals who genuinely need to handle work outside regular office hours and meet the criteria specified in this circular.

3/ Organizations and units funded from the State Budget that require the installation of official telephones at private residences for staff meeting the prescribed criteria must prepare their budget plans for the year, submit them to the financial authorities at all levels for review and approval, and include them in the annual budget assignment process. All expenses related to the installation of telephones at private residences for staff must be arranged within the approved annual budget plan; financial authorities at all levels will not provide additional funding beyond the approved plan.

1/ Scope and Objectives:

II. SPECIFIC PROVISIONS:

Individuals eligible for the installation of telephones at private residences to serve work outside regular office hours include:

a/ Ministers, Deputy Ministers, and equivalent positions in Ministries, agencies at the level of ministries, and government-affiliated agencies.

b/ Chairpersons, Vice-Chairpersons of associations, and Secretaries-General of mass organizations at the central level funded from the State Budget.

c/ Heads of Offices, Directors of Departments, Directors of Bureaus, and equivalent positions in Ministries, agencies at the level of ministries, government-affiliated agencies, Supreme People's Court, Supreme People's Procuracy, central-level associations...

d/ Chairpersons, Vice-Chairpersons of People's Committees, People's Councils at provincial and centrally-administered city levels.

e/ Heads of Offices of People's Committees at provincial and centrally-administered city levels.

g/ Chairpersons, Vice-Chairpersons of People's Committees, People's Councils at district, county, town, and centrally-administered city levels within provinces.

h/ Chairpersons of associations and mass organizations at provincial and centrally-administered city levels funded from the State Budget.

i/ Directors of Departments, Bureaus, and equivalent leadership positions at provincial and centrally-administered city levels.

2/ Contents of Expenditure for the Installation of Official Telephones at Private Residences Include the Following:

- Initial installation costs including design fees (if applicable), purchase of ordinary telephone sets (under VND 500,000 per set), purchase of cables, hiring labor for installation... according to contracts with postal companies.

- Monthly rental fees according to the quota set by the postal industry.

- Long-distance telephone charges incurred for official purposes of the organization or unit (if applicable) shall only apply to individuals listed under points a, b, and d above. In special cases requiring international calls, each call must be approved by the head of the organization or unit. Other individuals must cover the cost of long-distance calls themselves.

These expenditures must be reviewed by the organization or unit based on the nature of work of each individual and reflected in the contract with the postal company.

3/ Other Regulations:

- For state employees who were provided with telephones at private residences before the issuance of this circular but no longer meet the prescribed criteria, if they wish to continue using the service, they must sign a separate contract with the postal company and pay according to the contract from the date of continued use.

- For individuals who were provided with telephones at private residences but have since moved to positions not eligible for such installations or have retired, if they still wish to use the service, the equipment will not be removed, but the organization or unit must inform the postal company to transfer the equipment to personal use and directly sign a monthly rental contract with the postal company, while the individual must cover the costs according to the contract with the postal company.

- If an individual eligible for a telephone installation changes jobs but remains eligible for such installations, the previous organization or unit must inform the postal company to facilitate the signing of a new rental contract with the new organization or unit.

1/ Based on the provisions of this circular, organizations and units should review the current number of telephones to properly allocate them according to the regulations.

 III. IMPLEMENTATION PROVISIONS:

2/ Financial authorities at all levels, when allocating funds for the installation of telephones at private residences for eligible individuals, must ensure compliance with the approved annual budget plan as stipulated in this circular. Organizations and units implementing the installation of telephones at private residences for eligible individuals must ensure that the expenditure falls within the approved annual budget. Financial authorities at all levels have the right to audit expenditures related to the installation of telephones at private residences that do not comply with the provisions of this circular.

State-owned enterprises must base their application of the standards for the installation of official telephones at private residences as specified in this circular appropriately.

3/ Expenditures for the installation of official telephones at private residences for organizations and units shall be recorded under Item 74 "Official Fees" in the corresponding chapter, type, section, and category of the current State Budget Manual. State-owned enterprises may record these expenditures in production costs or circulation expenses.

Clause 3. Expenditures for official telephone equipment at private residences for agencies and units shall be recorded under item 74 "Official expenses" according to the relevant chapters, types, sub-items, and classes in the current State Budget Classification. State-owned enterprises shall record such expenditures in their cost of production or circulation expenses.

4/ The Ministry of National Defense and the Ministry of Public Security shall base on the provisions of this Circular to issue guiding documents regarding the provision of telephones for personal residences for officers meeting the standards specified in this Circular, after coordinating with the Ministry of Finance.

5/ This Circular takes effect from October 1, 1995. All previous regulations issued by ministries, sectors, agencies, and units concerning the provision of telephones for personal residences that conflict with this Circular are hereby abolished. In the process of implementing this Circular, if there are difficulties or obstacles, it is requested that all sectors, levels, agencies, and units report them to the Ministry of Finance for study and appropriate amendments.
