Pursuant to the Government's Decree No. 38/CP dated June 4, 1993, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Considering the proposal of the Director of the Office of the Ministry of Justice and the Director of the Department of Organization and Cadre Training, Ministry of Justice;

Article 1: This Decision promulgates the Regulation on Awarding the Medal "For the Cause of Judicial Affairs" attached hereto.

Article 2: The Directors of the Office, the Heads of the Department of Organization and Cadre Training, the Heads of units under the Ministry, the Directors of Provincial Departments of Justice, the Presidents of People's Courts at provincial level, and the Presidents of People's Courts at central city level shall be responsible for implementing this Decision.

Awarding the Medal "For the Cause of Judicial Affairs"

PART I

GENERAL PROVISIONS

Article 1: The Medal "For the Cause of Judicial Affairs" is a form of commendation of the judicial sector to recognize the contributions and achievements of individuals who have contributed to the cause of Vietnam's judicial affairs.

Article 2: The Medal "For the Cause of Judicial Affairs" has one class and is awarded only once to an individual, without posthumous awarding.

The Medal "For the Cause of Judicial Affairs" is awarded annually on the occasion of "The Traditional Day of the Judicial Sector" (August 28).

Chapter II

ELIGIBILITY AND CRITERIA FOR AWARD

Article 3: Recipients of rewards:

1. Those who have worked and are currently working in the judicial sector, including those working in units under the Ministry of Justice, local People's Courts, local judicial agencies, civil enforcement agencies, legal departments of ministries and sectors, and people's assessors.

2. Those who are currently working in Party and State agencies, social organizations, and have made significant contributions to the cause of judicial affairs.

Article 4: Criteria for awarding:

1. For those who have worked and are currently working in the judicial sector as stipulated in Clause 1 of Article 3 of this Regulation, they must meet the following conditions:

a) Having at least 20 years of service in the sector, with outstanding achievements recognized by the leadership collective;

b) For those with outstanding achievements, valuable contributions to the cause of Vietnam's judicial affairs, national labor heroes, all-national model workers, or all-sector model workers in the judicial sector, it is not necessary to meet the number of years of service specified in point a, Clause 1 of this Article.

c) Individuals who are under a warning disciplinary action can only be considered for the medal after a decision to remove the disciplinary action is made. The period under warning disciplinary action will not be counted towards the eligibility for the medal;

d) Individuals who are subject to disciplinary actions more severe than a warning or are being criminally prosecuted are not eligible for the medal.

2. For those working outside the sector (point 2 of Article 3):

- Making significant contributions in leadership and guidance that contribute to the reform and development of the judicial cause; or

- Proposing practical initiatives or scientific research projects that contribute to the development of the judicial sector.

Chapter III

IMPLEMENTATION

Article 5:

1. For those working in the judicial sector:

a) In units under the Ministry of Justice:

The head of the unit prepares the dossier and submits it to the Ministry's Competition Council for review, then forwards it to the Ministry's leadership for decision;

b) In local judicial agencies:

The provincial or central city-level Review Council prepares the dossier and submits it to the Ministry's leadership for decision;

2. For retired judicial sector cadres:

Retired judicial cadres at the provincial level are handled by the Provincial Department of Justice Director (if they were cadres of the Department of Justice or People's Court at district, urban district, town, or provincial city level) or by the President of the Provincial People's Court (if they were cadres of the provincial People's Court). They prepare the dossier and submit it to the provincial or central city-level Review Council for consideration and recommendation to the Ministry's Competition Council for review and forwarding to the Ministry's leadership for decision.

In cases where there are valid reasons and the individual cannot prepare a summary of their achievements, the organizational cadre department of the Provincial Department of Justice or the Provincial People's Court is responsible for preparing the summary on their behalf;

Article 6: For those working outside the judicial sector (point 2 of Article 3)

The Ministry's Competition Council is responsible for proposing the preparation of the dossier and submitting it to the Party Cadre and Civil Servant Committee of the Ministry and the Ministry's leadership for consideration and decision.

Article 7: The dossier for awarding the Medal "For the Cause of Judicial Affairs" includes:

1. A summary of achievements and career history of the individual, confirmed by the head of the unit managing the cadre (model number 1).

For retirees, confirmation is provided by the organizational cadre department managing the dossier at the time of retirement;

2. A list of proposed recipients of the Medal "For the Cause of Judicial Affairs", reviewed by the local Review Council (if at the local level) or by the Joint Conference: Leadership of the unit, Unit's Party Branch, and Union of the unit under the Ministry (model number 2);

3. A report or request letter (model number 3).

Article 8: The local Review Council for the Medal "For the Cause of Judicial Affairs" is established by the Provincial Department of Justice Director and consists of:

1. The Provincial Department of Justice Director - Chairperson;

2. The President of the Provincial People's Court - Vice-Chairperson;

3. The Head of the Enforcement Division - Member;

4. The Head of the Organization Division or the person in charge of organizational cadre work at the Provincial Department of Justice - Member;

5. The Chairman of the Grassroots Trade Union of the Judicial Sector (if any) or the Provincial Department of Justice Trade Union.

Article 9: Time for preparation and submission of the dossier.

a) At the end of the second quarter each year, the heads of subordinate units and the Provincial Department of Justice Directors notify the plan for receiving dossiers and the meeting schedule for review to all judicial cadres currently working or retired so that they can proceed with the preparation;

b) Dossiers must be submitted to the Ministry's Competition Council before July 20 each year to ensure timely review and announcement before August 28 - The Traditional Day of the Judicial Sector.

Chapter IV

RIGHTS OF THE RECIPIENT

MEDAL "FOR THE CAUSE OF JUDICIAL AFFAIRS"

Article 10. The recipient of the Medal "For the Cause of Judicial Affairs" receives the medal, certificate of recognition from the Minister of Justice, and is recorded in the traditional golden book of the judicial sector.

Chapter V

FINAL PROVISIONS

Article 11. During implementation, if any inappropriate points are discovered, according to the proposals of relevant individuals and organizations, the Department of Organization and Cadre Training and the Office of the Ministry shall be responsible for collecting, proposing adjustments, amendments, and supplements to improve the Regulation to ensure accurate and democratic awarding of the Medal "For the Cause of Judicial Affairs," thereby encouraging the entire sector to strive to fulfill its tasks well.
