RESOLUTION

Regarding the acceptance, classification, and handling of complaints, denunciations, and suggestions from individuals, agencies, and organizations sent to the National Assembly, its agencies, andmembers of the Standing Committee of the National Assembly

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

Pursuant to the Law on the Organization of the National Assembly, the Law on the Supervisory Activities of the National Assembly, and the Law on Complaints and Denunciations;

Pursuant to the Resolution on the establishment of the Committee for Petitions and the Resolution on the establishment of the Committee for Deputies' Affairs of the Standing Committee of the National Assembly;

RESOLUTION:

Article 1. This Resolution stipulates the procedures for accepting, classifying, and handling petitions from individuals, agencies, and organizations sent to the National Assembly, its agencies, and members of the Standing Committee of the National Assembly.

The National Ethnic Council, Committees of the National Assembly, the Committee for Petitions, and the Committee for Deputies' Affairs of the Standing Committee of the National Assembly shall be responsible for handling complaints, denunciations, and suggestions from individuals, agencies, and organizations within their respective areas of responsibility.

Article 2

1. Petitions from individuals, agencies, and organizations sent to the National Assembly, the Standing Committee of the National Assembly, the Standing Committee of the National Assembly, the Chairman of the National Assembly, Vice Chairmen of the National Assembly, Members of the Standing Committee of the National Assembly, and the Director of the Office of the National Assembly shall be received, classified, and transferred to the National Ethnic Council, Committees of the National Assembly, and the Committee for Deputies' Affairs by the Committee for Petitions according to their respective areas of responsibility.

2. Petitions from individuals, agencies, and organizations sent to the National Ethnic Council, Committees of the National Assembly shall be handled as follows:

a) The National Ethnic Council and Committees of the National Assembly shall handle petitions within their respective areas of responsibility according to their authority;

b) For petitions not within their respective areas of responsibility, they shall transfer them to the National Ethnic Council, other Committees of the National Assembly, the Committee for Deputies' Affairs, or the Committee for Petitions for handling according to their authority.

Article 3. The National Ethnic Council shall handle petitions with the following contents:

1. Suggestions and complaints regarding the implementation of economic and social development programs and projects in mountainous regions and ethnic minority areas; about the training, development, and utilization of ethnic minority cadres; and other suggestions and complaints within the area of responsibility of the National Ethnic Council;

2. Accusations against agencies, organizations, and individuals violating laws in the fields specified in Clause 1 of this Article.

Article 4. The Committee for Legal Affairs shall handle petitions with the following contents:

1. Suggestions and complaints about criminal judgments, civil judgments, family judgments, commercial judgments, labor judgments, administrative judgments; about enforcement of judgments; about searches, seizure of property, temporary detention, arrest, investigation, prosecution, trial by judicial organs; about requests for reduction of prison terms, commutation of death sentences; about being subject to judicial measures and other suggestions and complaints about judicial matters; suggestions and complaints about being subject to administrative penalties within the area of responsibility of the Committee;

2. Suggestions and complaints about property related to the implementation of socialist transformation policies; public bonds, public certificates, loans from the people during wartime; and other suggestions and complaints within the area of responsibility of the Committee;

3. Reporting crimes and providing information about criminal offenses;

4. Accusations against agencies, organizations, and individuals violating laws in the fields specified in Clauses 1, 2, and 3 of this Article, except for accusations specified in Article 11 of this Resolution.

Article 5. The Committee for Economic and Budgetary Affairs shall handle petitions with the following contents:

1. Suggestions and complaints about economic management, financial management, budgetary management, monetary policy, banking; about business activities; about housing and land; and other suggestions and complaints within the area of responsibility of the Committee.

2. Accusations against agencies, organizations, and individuals violating laws in the fields specified in Clause 1 of this Article.

Article 6. The Committee for National Defense and Security shall handle petitions with the following contents:

1. Suggestions and complaints about implementing systems and policies in the Army and Police; about housing and land managed by the Ministry of National Defense and the Ministry of Public Security; and other suggestions and complaints within the area of responsibility of the Committee;

2. Accusations against agencies, organizations, and individuals in the Army and Police violating laws, except for petitions specified in Clause 4 of Article 4 and Article 11 of this Resolution.

Article 7. The Committee for Culture, Education, Youth, Children, and Adolescents shall handle petitions with the following contents:

1. Suggestions and complaints about culture, information, education, training, sports, journalism, broadcasting, advertising, policies towards youth, children, and adolescents; and other suggestions and complaints within the area of responsibility of the Committee.

2. Accusations against agencies, organizations, and individuals violating laws in the fields specified in Clause 1 of this Article.

Article 8. The Committee for Social Issues shall handle petitions with the following contents:

1. Suggestions and complaints about labor, employment, wages; about implementing policies for those who have made contributions and preferential policies; about medical examinations, treatment, hospital fees, health insurance, population and family planning; about social insurance; about implementing social policies, religious policies; and other suggestions and complaints within the area of responsibility of the Committee.

2. Accusations against agencies, organizations, and individuals violating laws in the fields specified in Clause 1 of this Article.

Article 9. The Committee for Science, Technology, and Environment shall handle petitions with the following contents:

1. Suggestions and complaints about scientific research and technological development; about machinery, equipment, production lines; about protecting natural resources and ecological environments; about important national projects decided by the National Assembly; about intellectual property rights in the field of science and technology; and other suggestions and complaints within the area of responsibility of the Committee.

2. Accusations against agencies, organizations, and individuals violating laws in the fields specified in Clause 1 of this Article.

Article 10. The Committee for Foreign Affairs shall handle petitions with the following contents:

1. Suggestions and complaints from foreign organizations and individuals; and other suggestions and complaints within the area of responsibility of the Committee.

2. Accusations against agencies, organizations, and individuals violating laws in the fields specified in Clause 1 of this Article.

Article 11. The Committee for Deputies' Affairs assists the Standing Committee of the National Assembly in handling petitions accusing National Assembly deputies, People's Council deputies, and centrally-managed cadres.

Article 12. The Committee for Petitions assists the Standing Committee of the National Assembly:

1. In receiving, studying, and handling petitions when receiving citizens; handling petitions with contents related to multiple areas of the National Ethnic Council and Committees of the National Assembly;

2. In receiving and handling petitions not within the areas of responsibility of the National Ethnic Council and Committees of the National Assembly;

3. In receiving, classifying, updating petitions and results of handling by competent authorities to transfer to the National Ethnic Council and Committees of the National Assembly.

4. Compile and report to the Standing Committee of the National Assembly on the receipt, study, and handling of complaints, petitions, and recommendations submitted to the National Assembly, its agencies, and members of the Standing Committee of the National Assembly.

Article 13. The Standing Committee of the National Ethnic Council, the Standing Committees of the National Assembly's Committees, the Petitions Committee, and the Delegation Services Committee shall periodically report every six months or annually to the Standing Committee of the National Assembly on the receipt, study, and handling of complaints, petitions, and recommendations.

Article 14. This Resolution takes effect from July 15, 2004.

The Chairman of the National Ethnic Council, the Chairperson of the National Assembly's Committees, the Chairperson of the National Assembly's Office, the Head of the Petitions Committee, and the Head of the Delegation Services Committee of the Standing Committee of the National Assembly are responsible for implementing this Resolution./.
