Issuing regulations on the organization and operation of the National Defense Academy
PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Decree No. 188/CP dated December 20, 1994 on the establishment of the National Defense Academy;
At the proposal of the Minister of National Defense, the Minister of Education and Training, and the Director of the National Defense Academy./.
DECISION:
Article 1. Attached herewith is the Regulation on the organization and operation of the National Defense Academy.
Article 2. This Decision takes effect from the date of signing.
Article 3. The Director of the National Defense Academy, Ministers, Heads of Ministries equivalent to Ministries, Heads of Government agencies, Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decision.
REGULATIONS
ON THE ORGANIZATION AND OPERATIONS OF THE NATIONAL DEFENSE ACADEMY
(Issued together with Decision No. 716/TTg dated November 7, 1995)
PART I
GENERAL PROVISIONS
Article 1This Regulation stipulates the basic points regarding the organization and operations of the National Defense Academy.
Article 2.- The National Defense Academy is under the Government, serving as a center for training and enhancing senior military cadres, providing national defense knowledge to senior cadres of the Party, State, and mass organizations, and is one of the centers for military scientific research.
The Government assigns the Ministry of National Defense to directly manage it. State agencies and localities, according to their functions, have the responsibility to participate in building the Academy.
The National Defense Academy operates closely with national science centers, research institutes, academies, and universities to fulfill its tasks. The Academy has the responsibility to support other academies and universities in enhancing national defense knowledge, training military personnel, and conducting military scientific research.
Article 3The National Defense Academy is an organization with legal personality, having a seal bearing the national emblem, a separate account, and its own symbol.
The National Defense Academy is a unit prioritized by the State and the Ministry of National Defense for investment in personnel, infrastructure, equipment, aiming to innovate military education and research activities, meeting the requirements for national protection and construction.
PART II
TRAINING AND RESEARCH TASKS
Article 4The National Defense Academy implements postgraduate training and enhancement for the following subjects:
Training and enhancing high-level command and staff officers, campaign, strategic officers; local military affairs; teaching and research personnel in military sciences; postgraduate studies and doctoral programs in military sciences according to state degree regulations.
Enhancing national defense knowledge for provincial-level key cadres and equivalent cadres, leaders of central Party, State, and mass organizations.
International cooperation in training and enhancing senior military cadres.
Article 5The National Defense Academy develops training programs according to knowledge standards set by the Ministry of National Defense, the Ministry of Education and Training, and the Government's Organization and Cadre Management Board. The Academy collaborates with the Ho Chi Minh National Political Academy and the National Administration Academy in developing programs and organizing training and enhancement of national defense knowledge for senior cadres of the Party, State, and military.
All training programs aimed at obtaining degrees from the National Defense Academy must be approved by the Ministry of National Defense and registered with the Ministry of Education and Training.
Additionally, the National Defense Academy may also teach certain courses within the scope of its functional and operational tasks.
Article 6The National Defense Academy fulfills the function of conducting military and national defense research, primarily focusing on military art issues, participating in research to address national defense potential development, economic integration with national defense, national defense with security and diplomacy, contributing to incorporating advanced scientific and technological achievements into the service of national protection and construction.
CHAPTER III
ORGANIZATIONAL STRUCTURE
, Clause 1, Clause 2 Article 7a of this Regulation.The National Defense Academy is organized according to a military school system, comprising the following structure:
a. The Directorate,
b. The Training and Education Department,
c. The Political Department,
d. The Logistics and Technical Department,
e. The Military Science Research Institute,
g. The Office,
h. Departments and Teaching Divisions,
i. Student management systems.
Specific organizational structure and staffing are determined by the Ministry of National Defense.
Article 8The Military Science Council of the National Defense Academy, chaired by the Director, includes the following members:
1. Some Deputy Directors.
2. The Head of the Training and Education Department.
3. The Director of the Military Science Research Institute.
4. Some faculty members, teaching staff, and scientists both inside and outside the National Defense Academy.
Depending on work requirements, the Director of the National Defense Academy may establish specialized scientific councils and temporary advisory councils.
Article 9Based on general provisions of the Ministry of National Defense and the Ministry of Education and Training, the National Defense Academy formulates study regulations, examinations, and tests suitable to improve training quality. Students of the National Defense Academy are provided with conditions for learning and living to maximize their talents and intellects. The National Defense Academy organizes entrance exams for students according to the regulations of the Ministry of National Defense.
For students entering classes for national defense knowledge enhancement, they are convened by the Central Organization Department and the Government's Organization and Cadre Management Board.
Article 10Annual graduation ceremonies for basic training classes of the National Defense Academy are solemnly organized according to state protocol.
Outstanding graduates are rewarded and given preferential treatment according to the regulations of the Ministry of National Defense.
PART IV
FINANCE
Article 11The National Defense Academy operates an independent budget, has a separate account (including foreign currency), and complies with state budget accounting regulations.
Annually, the National Defense Academy prepares and reports on the budget revenue and expenditure project (from all sources) before the Ministry of National Defense and relevant government agencies. The Ministry of National Defense, in conjunction with relevant government agencies, approves and issues decisions assigning annual budget revenue and expenditure tasks to the National Defense Academy.
The budget of the National Defense Academy includes the following sources:
National Defense Budget allocation.
Direct state investment.
Revenue from scientific research, teaching, etc.
Other support and sponsorship.
Article 12The Director of the National Defense Academy annually assigns budget revenue and expenditure tasks to subordinate units, ensuring the Academy's operations complete its functions, tasks, and objectives as approved by the State, and must be responsible before the Ministry of National Defense and the Government for comprehensive management of the Academy's budget revenue and expenditure.
The Director of the National Defense Academy directs, guides, and supervises subordinate units in using funds according to the regulations, standards, quotas, and unit prices set by the Ministry of National Defense and the State, and at year-end, compiles and reports the final accounts of all sources of income and expenditures to the Ministry of National Defense and the Ministry of Finance.
CHAPTER V
RELATIONSHIPS AND LIMITS
Article 13The National Defense Academy directly engages with Ministries, agencies equivalent to Ministries, government agencies, People's Committees of provinces and centrally-administered cities to resolve issues related to the Academy.
The National Defense Academy is directly managed by the Ministry of National Defense and subject to State management within the scope of functions of Ministries and government agencies.
Article 14The National Defense Academy may invite professors and scientists from state agencies and the military to teach according to current regulations. The Director of the National Defense Academy has the authority to apply special allowances for teaching and outstanding research staff according to the regulations of the Government and the Ministry of National Defense.
The Director of the National Defense Academy has the authority to issue decisions recognizing positions from full-time lecturer to full-time researcher for staff within the Academy.
Article 15The National Defense Academy fulfills international cooperation tasks in training and developing high-level military personnel, researching defense areas, and inviting foreign experts to teach according to State regulations and the Ministry of National Defense's foreign affairs rules.
Article 16The Director of the National Defense Academy has the authority to issue diplomas and certificates according to current regulations.
Chapter VI
IMPLEMENTING PROVISIONS
Article 17This regulation takes effect from the date of signature.
Based on this regulation, the Director of the National Defense Academy specifies the organizational structure and activities of subordinate units.
Article 18The Minister of National Defense, the Minister of Education and Training, and the Director of the National Defense Academy are responsible for guiding the implementation of this regulation./.
