CIRCULAR
Regarding the supplementation and amendment of certain points of Circular No. 62/2001/TT-BNN dated June 5, 2001
of the Ministry of Agriculture and Rural Development guiding the export and import of goods
under the management of the specialized agricultural sector pursuant to Decision No. 46/2001/QĐ-TTg dated April 4, 2001
of the Government on the management of export and import of goods during the period 2001-2005
In order to facilitate the export and import of goods for businesses, the Ministry of Agriculture and Rural Development supplements and amends Point 1.2 and Point 1.3 of Section 1, Point 2.2 of Section 2, Point d of Section 5 (Chapter II), Point a of Section 1 and Section 4 (Chapter III) of Circular No. 62/2001/TT-BNN dated June 5, 2001 regarding guidance on the export and import of goods under the management of the specialized agricultural sector during the period 2001-2005 as follows:
I- Amend and supplement the following points:
1- Amend sub-item "b" of Point 1.2 (Section 1, Chapter II) as follows:
"b- Precious and rare wood products belonging to Group IIA as prescribed in Decree No. 18/HĐBT dated January 17, 1992 of the Council of Ministers (now the Government) are only permitted for export in the form of handicrafts and high-end furniture; when exporting, enterprises shall only need to handle procedures with the Customs office at the port of entry."
2- Point 1.3 (Section 1, Chapter II) is amended as follows:
"All products made from various types of wood (except those specified in Clause 1.1 and Clause 1.2) are permitted for export without limitation on quantity and value; when exporting, enterprises shall only need to handle procedures with the Customs office at the port of entry."
3- Amend sub-item "b" of Point 2.2 (Section 2, Chapter II)
Change F2 to F1 in the eighth line from the bottom (page 3). The full phrase will be "...are permitted to export products from generation F1 onwards,..."
4- Add Point d to Section 5 (Chapter II).
"d- Types of pesticides and raw materials for pesticides not included in the list of substances permitted for use in Vietnam, when requested for import for use in foreign investment projects in Vietnam or for other special purposes, must be approved for import by the Plant Protection Department."
5- Point a of Section 1 (Chapter III) is amended as follows:
"a- Forest Development Department (No. 2 Ngoc Ha, Ba Dinh, Hanoi; telephone (04) 8438813): Resolve difficulties arising during the implementation of Section 1 of Chapter II."
6- Section 4 (Chapter III) is supplemented as follows:
"This Circular replaces Circular No. 41/2000/TT-BNN-KH dated April 13, 2000 of the Ministry of Agriculture and Rural Development guiding the export and import of goods under the management of the specialized agricultural sector and transferring the task of issuing import permits for seedling trials, livestock breeds, plant genes, animal genes, microorganisms, and feed additives and fertilizers which have been stipulated in Circulars No. 02/NN-KNKL/TT dated March 1, 1997, and No. 09/NN-KNKL/TT dated September 17, 1996 from the Science, Technology and Product Quality Department to the Agricultural Extension Department."
II - HEffectiveness.
1- Apart from the amendments and supplements above, the remaining contents of Circular No. 62/2001/TT-BNN dated June 5, 2001 of the Ministry of Agriculture and Rural Development remain valid.
2- This Circular abolishes the following phrases:
a) "...must have permission from the local Forest Inspection Office" the second item (b) of Point 1.2, Section 1, Chapter II, line 15 (from top down); b) "and products from planted forests (except round logs and sawn timber)" (at Point 1.3, Section 1, Chapter II) line 19 (from top down) on page 2; c) F2 in the eighth line from the bottom on page 3; d) "a- Local Forest Inspection Office: cases specified in sub-item b, Clause 1.2, Section 1 of Chapter II"on page 6 of Circular No. 62/2001/TT-BNN dated June 5, 2001./.
