REGARDING AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF THE REGULATIONS ON SECURITIES REGISTRATION, SAFEKEEPING, NETTING, AND SETTLEMENT ISSUED TOGETHER WITH DECISION NO.
60/2004/QD-BTC OF JULY 15, 2004 BY THE MINISTER OF FINANCE
BASED ON DECREE NO. 77/2003/ND-CP OF THE GOVERNMENT DATED JULY 1, 2003 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF FINANCE;
THE MINISTER OF FINANCE
BASED ON DECREE NO. 144/2003/ND-CP OF THE GOVERNMENT DATED NOVEMBER 28, 2003 ON SECURITIES AND THE SECURITIES MARKET;
PURSUANT TO THE PROPOSAL OF THE CHAIRMAN OF THE STATE SECURITIES COMMISSION,
AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF THE REGULATIONS ON SECURITIES REGISTRATION, SAFEKEEPING, NETTING, AND SETTLEMENT ISSUED TOGETHER WITH DECISION NO. 60/2004/QD-BTC DATED JULY 15, 2004 OF THE MINISTER OF FINANCE ARE AS FOLLOWS:
DECISION:
Article 1. 1. ADDING CLAUSE 3 OF ARTICLE 3 AS FOLLOWS:
"THE SECURITIES DEPOSITORY CENTER SHALL ACCEPT REGISTRATION, SAFEKEEPING, NETTING, AND SETTLEMENT ACTIVITIES OF SECURITIES FROM THE SECURITIES EXCHANGE CENTERS AND OTHER ENTITIES IN ACCORDANCE WITH THE REGULATIONS SET FORTH HEREIN."
2. AMENDING POINT b OF CLAUSE 2 OF ARTICLE 37 AS FOLLOWS:
"b) ANNUAL CONTRIBUTION RATE IS 0.008% OF THE BROKERAGE TRANSACTION VOLUME OF DEPOSITORY MEMBERS THAT ARE SECURITIES COMPANIES OR ACCORDING TO THE VALUE OF TRANSACTIONS PROCESSED BY DEPOSITORY MEMBERS THAT ARE BANKS IN THE PREVIOUS YEAR."
THE CHAIRMAN OF THE STATE SECURITIES COMMISSION, THE SECURITIES EXCHANGE CENTERS, THE SECURITIES DEPOSITORY CENTER, DEPOSITORY MEMBERS, AND RELATED PARTIES ARE RESPONSIBLE FOR IMPLEMENTING THIS DECISION./.
Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 3. The Chairman of the State Securities Commission, the Stock Exchange Trading Centers, the Securities Depository Centers, the depositary members, and other relevant parties are responsible for implementing this Decision./.
