Specifies the duties and authorities of military agencies and units to implement Decision No. 289/QĐ-TTg dated February 26, 2010 of the Prime Minister approving the plan for implementing the Law on Militia and Self-Defense Forces.

Pursuant to the Law on Militia and Self-Defense Forces dated November 23, 2009;

Pursuant to Decision No. 289/QĐ-TTg dated February 26, 2010 of the Prime Minister approving the Plan for Implementing the Law on Militia and Self-Defense Forces;

Pursuant to Decree No. 104/2008/NĐ-CP dated September 16, 2008 of the Government on the Functions, Tasks, Authorities, and Organizational Structure of the Ministry of National Defense;

CONSIDERING the proposal of the General Staff;

CIRCULAR:

Article 1. Scope of Regulation and Applicability

This Circular specifies the duties and authorities of agencies and units within the Military, Central Military District Command, and Military District Command at the grassroots level to implement Decision No. 289/QĐ-TTg dated February 26, 2010 of the Prime Minister regarding the approval of the Plan for Implementing the Law on Militia and Self-Defense Forces.

Article 2. General Staff Department

Shall take the lead and coordinate with relevant agencies inside and outside the Military to assist the Ministry of National Defense in directing, organizing, and implementing Decision No. 289/QĐ-TTg of the Prime Minister.

1. Militia and Self-Defense Forces Department

The Militia and Self-Defense Forces Department is the permanent agency assisting the General Staff Department and the Ministry of National Defense in implementing Decision No. 289/QĐ-TTg of the Prime Minister, with the following tasks:

a) Shall take the lead and coordinate with relevant agencies inside and outside the Military to assist the General Staff Department and the Ministry of National Defense in drafting two Decrees of the Government:

- A Decree of the Government detailing and guiding the implementation of certain provisions of the Law on Militia and Self-Defense Forces;

- A Decree of the Government on coordinating activities between militia and self-defense forces and public security forces, forest rangers, and other forces in maintaining political security and social order, and protecting forests.

b) Shall take the lead and coordinate with relevant ministries and agencies to assist the General Staff Department and the Ministry of National Defense in drafting four Joint Circulars:

- A Joint Circular of the Ministry of National Defense, Ministry of Finance, Ministry of Labor, Invalids and Social Affairs, and Ministry of Home Affairs guiding the system of policies for militia and self-defense forces;

- A Joint Circular of the Ministry of National Defense and Ministry of Public Security guiding the model stamp, engraving, management, and use of stamps of local military district command and commune-level military district command;

- A Joint Circular of the Ministry of National Defense and Ministry of Public Security guiding the coordination of activities between militia and self-defense forces and public security forces in maintaining public security;

- A Joint Circular of the Ministry of National Defense and Ministry of Agriculture and Rural Development guiding militia and self-defense forces in coordinating with forest rangers in preventing and fighting forest fires.

c) Shall take the lead and coordinate with relevant military agencies to assist the General Staff Department and the Ministry of National Defense in drafting twenty-one Circulars of the Ministry of National Defense (with attached appendices).

d) Shall work together with relevant functional agencies of the General Staff Department and the Ministry of National Defense to coordinate with relevant functional agencies of the Ministry of Education and Training, Ministry of Finance, and Ministry of Natural Resources and Environment in drafting four Circulars of related ministries and agencies concerning militia and self-defense forces:

- A Circular of the Ministry of Finance guiding the preparation, execution, and settlement of budgets for militia and self-defense forces;

- A Circular of the Ministry of Natural Resources and Environment guiding localities in managing and using training grounds and exercise areas for combat readiness, training, exercises, competitions, and sports events;

- A Circular of the Ministry of Education and Training promulgating the framework curriculum for associate degree programs in basic military studies;

- A Circular of the Ministry of Education and Training promulgating the framework curriculum for bachelor's degree programs in basic military studies.

đ) Shall take the lead and coordinate with relevant military agencies to assist the General Staff Department and the Ministry of National Defense in developing and directing military regions and localities to implement three projects:

- A project on propaganda, dissemination, and education on the Law on Militia and Self-Defense Forces;

- A project on building model organizations, training, and activities of militia and self-defense forces, and management solutions for militia and self-defense forces from 2010 to 2012;

- A pilot training program for cadres of commune-level military district command at associate and bachelor's degree levels in basic military studies (one class of 80 students for each type of training).

e) Shall take the lead and coordinate with academies and schools inside and outside the Military in compiling a system of textbooks for associate and bachelor's degree programs in basic military studies.

g) Shall take the lead and coordinate with military regions, localities, Central Military District Command, and related units to assist the Ministry of National Defense in organizing propaganda, dissemination, education, and training on laws related to militia and self-defense forces.

h) Shall coordinate with the Financial Department of the Ministry of National Defense to direct relevant agencies and units in preparing budgets and consolidating budget estimates for implementing the plan to enforce the Law on Militia and Self-Defense Forces.

i) Annually assist the General Staff Department and the Ministry of National Defense in summarizing the results of implementing Decision No. 289/QĐ-TTg and reporting to the Prime Minister.

2. Personnel Department

Shall coordinate with the Militia and Self-Defense Forces Department to assist the General Staff Department and the Ministry of National Defense in drafting a Circular of the Ministry of National Defense on equipping weapons for militia and self-defense forces and a project on training core militia and self-defense forces to complete their service obligations and become reserve soldiers of the first category.

3. Training Department

Shall coordinate with the Militia and Self-Defense Forces Department to assist the General Staff Department and the Ministry of National Defense in drafting two Circulars:

a) A Circular specifying the training program for core militia and self-defense forces;

b) A Circular specifying the list and standard of material support for training core militia and self-defense forces.

4. School Department

a) Shall coordinate with the Militia and Self-Defense Forces Department to assist the General Staff Department and the Ministry of National Defense in drafting two Circulars:

- A Circular specifying the detailed training program for associate degree programs in basic military studies;

- A Circular specifying the detailed training program for bachelor's degree programs in basic military studies.

b) Shall coordinate with the Militia and Self-Defense Forces Department and academies and schools inside and outside the Military in compiling a system of textbooks for associate and bachelor's degree programs in basic military studies.

c) Cooperate with the Militia Self-Defense Force Cadre to assist the General Staff Department, the Ministry of National Defense in piloting college and university training for basic military subjects at the Military School of Military Region 1, the Military School of Military Region 2, and the First Infantry Officer School; organize interim and final reviews, serve as pilot points, and report to the Ministry of National Defense and the Government. Take the lead in organizing college and university training for basic military subjects after serving as pilot points.

d) Direct the First Infantry Officer School, the Military School of Military Region 1, and the Military School of Military Region 2 to prepare the foundation and pilot training for associate and bachelor's degrees in basic military subjects; organize continuous training from intermediate to associate degree and from associate to bachelor's degree in basic military subjects.

Article 3. The Political General Department

1. Coordinate with the General Staff Department, functional agencies under the Central Propaganda Commission, the Ministry of Justice, the Ministry of Home Affairs, the Ministry of Information and Communications, Vietnam Television, Voice of Vietnam, news agencies, press organizations, People's Committees of provinces and centrally governed cities to organize propaganda, dissemination, training, and capacity building to enhance responsibility and unify understanding among cadres at all levels, militia self-defense forces, and the people regarding the Law on Militia Self-Defense Forces and detailed regulations implementing the Law on Militia Self-Defense Forces.

2. Direct functional agencies under its authority to coordinate with the Militia Self-Defense Force Cadre to assist the Ministry of National Defense in drafting Decrees, Circulars, and projects to implement the Law on Militia Self-Defense Forces.

3. Direct the Training and Education Cadre to coordinate with the Militia Self-Defense Force Cadre on the content of propaganda, education, and training to implement the Law on Militia Self-Defense Forces. Direct news agencies, press organizations, radio, and television of the People's Army to propagate the Law on Militia Self-Defense Forces.

4. Direct functional agencies to coordinate with relevant agencies, guide academies, and schools to train and pilot training for village-level military officers; review and approve promotions in rank for reserve officers for graduates of such training.

Article 4. Military Regions, Command of the Capital City of Hanoi

1. Command of Military Region 1

a) Coordinate with the Militia Self-Defense Force Cadre to direct the Military School of Military Region to prepare the foundation for training and organize pilot training for 80 individuals to reach associate degree level in basic military subjects; training period is 36 months, starting in September 2010.

b) Direct the Military Command of Lang Son Province to coordinate with the Militia Self-Defense Force Cadre to build a border militia platoon model 2010-2012 (Tân Thanh Commune Border Militia Platoon, Van Lang District, Lang Son Province).

2. Command of Military Region 2

a) Coordinate with the Militia Self-Defense Force Cadre to direct the Military School of Military Region to prepare the foundation for training and organize pilot continuous training for 80 individuals from intermediate to associate degree in basic military subjects; training period is 18 months, starting in September 2010.

b) Direct the Military Command of Ha Giang Province to coordinate with the Militia Self-Defense Force Cadre to organize pilot training for one company of militia that has completed their service obligation and meets the conditions to be converted into first-class reserve soldiers.

c) Direct the Military Command of Dien Bien Province to coordinate with the Militia Self-Defense Force Cadre to build a border militia platoon model 2010-2012 (Muong Nha Commune Border Militia Platoon, Dien Bien District, Dien Bien Province).

d) Direct the Military Command of Vinh Phuc Province to advise the Provincial People's Committee to coordinate with the Militia Self-Defense Force Cadre to build a Military Command Post of the Department of Natural Resources and Environment.

3. Command of Military Region 3

a) Direct the Military Command of Quang Ninh Province to coordinate with the Militia Self-Defense Force Cadre to build a coastal militia platoon model 2010-2012 (Xuan Lan Commune Coastal Militia Platoon, Tien Yen District, Quang Ninh Province).

b) Direct the Military Command of Quang Ninh Province to coordinate with the Militia Self-Defense Force Cadre to build a border militia platoon model 2010-2012 (Hoang Mo Commune Border Militia Platoon, Binh Lieu District, Quang Ninh Province).

c) Direct the Military Command of Quang Ninh Province to coordinate with the Militia Self-Defense Force Cadre and the Military Command Post of the Vietnam Coal-Mineral Industry Group to build a Military Command Post of the United Limited Liability Company Than Ung Bi.

d) Direct the Military Command of Quang Ninh Province to coordinate with the Militia Self-Defense Force Cadre to build a civilian enterprise guard platoon outside state-owned enterprises.

4. Command of Military Region 4

a) Direct the Military Command of Nghe An Province to coordinate with the Militia Self-Defense Force Cadre to organize pilot training for one company of militia that has completed their service obligation and meets the conditions to be converted into first-class reserve soldiers.

b) Direct the Military Command of Nghe An Province to coordinate with the Militia Self-Defense Force Cadre to build a coastal militia platoon model 2010-2012 (Dieu Ngoc Commune Coastal Militia Platoon, Dieu Chau District, Nghe An Province).

c) Direct the Military Command of Ha Tinh Province to coordinate with the Militia Self-Defense Force Cadre to build a border militia platoon model 2010-2012 (Son Kim 1 Commune Border Militia Platoon, Huong Son District, Ha Tinh Province).

5. Command of Military Region 5

a) Direct the Military Command of Quang Ngai Province to coordinate with the Militia Self-Defense Force Cadre to build a coastal militia platoon model 2010-2012 (Phu Thanh Commune Coastal Militia Platoon, Duc Pho District, Quang Ngai Province).

b) Direct the Military Command of Kon Tum Province to coordinate with the Militia Self-Defense Force Cadre to build a border militia platoon model 2010-2012 (Poy Commune Border Militia Platoon, Ngoc Hoi District, Kon Tum Province).

c) Direct the Military Command of Gia Lai Province to coordinate with the Militia Self-Defense Force Cadre to build 18 militia platoons and two companies of mobile militia from 2010-2012 (located in Dak Doa District, Gia Lai Province).

6. Command of Military Region 7

a) Direct the Military Command of Binh Thuan Province to coordinate with the Militia Self-Defense Force Cadre to build two coastal militia platoons model 2010-2012 (Phuoc Hoi Ward Coastal Militia Platoon, La Gi Town; Tam Thanh Commune Coastal Militia Platoon, Phu Quy Island District, Binh Thuan Province).

b) Direct the Military Command of Long An Province to coordinate with the Militia Self-Defense Force Cadre to build a border militia platoon model 2010-2012 (Hung Dinh Commune Border Militia Platoon, Tan Hung District, Long An Province).

e) Direct the Military Command of Ho Chi Minh City to coordinate with the Militia Self-Defense Force Cadre to build a civilian enterprise guard platoon outside state-owned enterprises.

7. Command of Military Region 9

a) Direct the Military Command of An Giang Province to cooperate with the Militia Self-Defense Force Department to organize pilot training for one platoon of militia that have completed their duty in the core militia self-defense force and meet the conditions to be converted into first-class reserve military personnel.

b) Direct the Military Command of Ca Mau Province to cooperate with the Militia Self-Defense Force Department to establish one marine militia squad point from 2010 to 2012 (the marine militia squad of Song Doc town, Tran Van Thoi district, Ca Mau province).

c) Direct the Military Command of An Giang Province to cooperate with the Militia Self-Defense Force Department to establish one border militia platoon point from 2010 to 2012 (the border militia platoon of Vinh Ouan commune, Chau Doc city, An Giang province).

8. The Command of Hanoi Capital

a) Organize propaganda, dissemination, training, and enhancement to improve responsibility and unify understanding among cadres at all levels, militia self-defense forces, and the people regarding the Militia Self-Defense Law.

b) Establish one commune or ward point for propaganda, dissemination, and education on the Militia Self-Defense Law.

Article 5. Officer School of the Army Region 1

1. Coordinate with the Militia Self-Defense Force Department to prepare educational foundations, teacher teams, and organize training for 80 individuals from the source to bachelor's degree level in basic military science, with a training period of 48 months, starting in September 2010.

2. Coordinate with the Militia Self-Defense Force Department to organize training for 80 individuals to upgrade from college to bachelor's degree level in basic military science; with a training period of 18 months, starting in September 2012.

Article 6. People's Military Command Construction Points

1. People's Military Command of Vietnam Post and Telecommunications Corporation

Coordinate with the Militia Self-Defense Force Department of the General Staff to establish a construction point for the People's Military Command of the Corporation.

2. People's Military Command of the Department of Natural Resources and Environment of Vinh Phuc Province

Coordinate with the Militia Self-Defense Force Department of the General Staff to establish a construction point for the People's Military Command of the Department.

3. People's Military Command of Limited Liability Company Than Ung Bi, Vietnam National Coal-Mineral Industries Group.

Coordinate with the Militia Self-Defense Force Department of the General Staff to establish a construction point for the People's Military Command of the Company.

Article 7. Agencies, Units, and People's Military Commands of Ministries and Sectors

1. Directly participate and provide advisory support to the same-level Party Committee and Administration in drafting Decrees, Resolutions of the Government and Prime Minister; Joint Circulars; Circulars of the Ministry of Defense, and implementation projects of the Militia Self-Defense Law.

2. Organize propaganda, dissemination, training, and enhancement to improve responsibility and unify understanding among cadres, employees, militia self-defense forces, and the people regarding the Militia Self-Defense Law.

3. Each province and centrally governed municipality establish one commune or ward point for propaganda, dissemination, and education on the Militia Self-Defense Law.

Article 8. Finance Department

Direct relevant agencies to guide the preparation of budgets and ensure financial resources for the implementation of Decision No. 289/QĐ-TTg of the Prime Minister.

Article 9. Effective Date

1. This Circular takes effect 45 days from the date of signature.

2. All previous regulations contrary to this Circular are abolished.

3. The Chief of General Staff, Director of the General Political Department, Heads of related agencies, units, and organizations are responsible for implementing this Circular./.
