Pursuant to the Law on Publishing dated December 3, 2004 which has been amended and supplemented on some provisions on June 3, 2008;

Pursuant to Resolution No. 71/NQ-CP dated December 27, 2010 of the Government on simplifying administrative procedures within the scope of functions of the Ministry of Information and Communications;

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Article 1. Amending and supplementing certain Articles of Decree No. 111/2005/NĐ-CP dated August 26, 2005 of the Government detailing and guiding the implementation of certain provisions of the Law on Publishing which have been amended and supplemented by Decree No. 11/2009/NĐ-CP dated February 10, 2009 of the Government

"2. Other organizations are allowed to establish publishing houses, including:

Considering the proposal of the Minister of Information and Communications,

DECREE:

a) Central political-social-professional organizations directly creating and publishing works;

1. Clause 2 of Article 8 is amended and supplemented as follows:

b) Central public service units, central social-professional organizations directly creating and publishing works shall be granted a permit to establish a publishing house by the Ministry of Information and Communications after obtaining the agreement of

"3. The application dossier for a license to operate printing of publications as stipulated in Clause 2, Article 31 of the Law on Publishing shall be compiled into one set and sent through postal services, express delivery services, or delivered directly to the licensing authority as provided for in Article 15 of this Decree.

The Ministry of Information and Communications shall promulgate the model application form for a license to operate printing of publications."

3. Adding Clause 4 to Article 17 as follows:

"4. The application dossier for a license to print publications for foreign countries as stipulated in Clause 1, Article 34 of the Law on Publishing shall be compiled into one set and sent through postal services, express delivery services, or delivered directly to the licensing authority as provided for in Clause 1 of this Article."

Article 2. Amending and supplementing certain Articles of Decree No. 105/2007/NĐ-CP dated June 21, 2007 of the Government on printing activities for products that are not publications

"Article 6. Implementation methods and application dossier for a license to operate printing

1. Before participating in printing press products, counterfeit prevention stamps, printing establishments must compile one set of the application dossier for a license to operate printing and send it directly or through postal services, express delivery services to the competent state management agency as provided for in Clause 1, Article 7 of this Decree.

1. Article 6 shall be amended and supplemented as follows:

2. The application dossier for a license to operate printing includes:
a) Application form for a license (in accordance with the model issued by the Ministry of Information and Communications);
b) Curriculum vitae of the director, owner of the printing establishment;
c) Certified copy or copy attached with the original for comparison of certificates and qualifications of the director, owner of the printing establishment (if any);
d) Documents proving the existence of production premises; list of main printing equipment;
đ) Certified copy or copy attached with the original for comparison of one of the following documents: business registration certificate, enterprise registration certificate, investment certificate, decision establishing the printing establishment by the supervising authority;
e) Certified copy or copy attached with the original for comparison of the certificate of meeting security and public order conditions issued by the competent police authority."
2. Clause 1 of Article 10 is amended and supplemented as follows:

"1. Printing establishments receiving orders from abroad to print products for foreign countries, including: funeral offerings, newspapers, savings books, passports, identity cards, diplomas, certificates, counterfeit prevention stamps must submit an application dossier for a license to print for foreign countries through postal services, express delivery services, or deliver it directly to the competent state management authority as provided for in Clause 2 of this Article. The dossier shall be compiled into one set, including:

b) Two certified copies of the product sample to be printed;

c) Certified copy or copy attached with the original for comparison of the printing operation license or one of the following documents: business registration certificate, enterprise registration certificate, investment certificate, decision establishing the printing establishment by the supervising authority."
c) Certified copy or copy attached with the original for comparison of certificates and qualifications of the director, owner of the printing establishment (if any);
"3. Within five working days from the date of receipt of the complete dossier as prescribed, the Publishing Department must issue the license; if the license is not issued, a written response stating the reasons must be provided."

4. Replacing the phrase "Ministry of Culture - Information" and the phrase "Department of Culture - Information" as follows:

3. Clause 3 of Article 11 shall be amended and supplemented as follows:

a) Replacing the phrase "Ministry of Culture - Information" with the phrase "Ministry of Information and Communications" in Clause 1 of Article 7, Clause 1 of Article 9, Clause 2 of Article 10, Clause 1 of Article 11, Clause 1 of Article 14, and Clause 2 of Article 20 of Decree No. 105/2007/NĐ-CP;

b) Replacing the phrase "Department of Culture - Information" with the phrase "Department of Information and Communications" in Clause 2 of Article 5, Clause 1 of Article 7, Clause 2 and Clause 3 of Article 10, Clause 1 and Clause 2 of Article 12, and Clause 2 of Article 14 of Decree No. 105/2007/NĐ-CP.

1. This Decree takes effect from October 10, 2011.

Replace the phrase "Sở Văn hóa - Thông tin" with the phrase "Sở Thông tin và Truyền thông" in Clause 2 Article 5, Clause 1 Article 7, Clause 2 and Clause 3 Article 10, Clause 1 and Clause 2 Article 12, and Clause 2 Article 14 of Decree No. 105/2007/NĐ-CP.

Article 3. Effectiveness and Responsibility for Implementation

This Decree takes effect from October 10, 2011.

2. Ministers, heads of agencies at the ministerial level, heads of government agencies, Chairmen of provincial People's Committees, and Chairmen of municipal People's Committees directly under the Central Government are responsible for enforcing this Decree.
