CIRCULAR
Amending and supplementing certain articles of Circular No. 27/2013/TT-BGTVT
dated September 24, 2013 of the Minister of Transport stipulating
standards, tasks, and authorities for leaders and staff
of Motor Vehicle Inspection Centers

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
At the proposal of the Director of the Cadre and Civil Servant Department and the Director of the Vietnam Vehicle Inspection Agency,
The Minister of Transport issues this Circular amending and supplementing certain articles of Circular No. 27/2013/TT-BGTVT dated September 24, 2013 of the Minister of Transport stipulating standards, tasks, and authorities for leaders and staff of Motor Vehicle Inspection Centers (hereinafter referred to as Circular No. 27/2013/TT-BGTVT).
Article 1. Amending and supplementing certain articles of Circular No. 27/2013/TT-BGTVT
1. Businesses wishing to enjoy the preferential tax treatment provided by Japan under the tariff quota for natural honey imports into Japan under the Agreement between the Socialist Republic of Vietnam and Japan on Economic Partnership must submit their application at the licensing authority (Provincial People's Committee) where the exporting business is headquartered to be confirmed.
"Article 6. Standards and conditions for motor vehicle inspectors
1. Professional qualifications: graduated from a university majoring in Automotive Engineering or Mechanical Engineering, with courses including automotive theory, automobile structure, automobile structural calculation, automobile technical maintenance, internal combustion engines and automobile electricity.
2. English proficiency: at least level A or equivalent.
3. Participating in the Motor Vehicle Inspector Training Course organized by the Vietnam Vehicle Inspection Agency and obtaining a Certificate of Completion of the Motor Vehicle Inspector Training Course.
4. Work experience: at least two years working directly in the field of training as specified in Clause 1 of this Article at repair, maintenance, production, assembly facilities of automobiles (registered according to the law) or at least six months probationary period at a Motor Vehicle Inspection Center.
5. Recognized and issued a Certificate of Motor Vehicle Inspector by the Director of the Vietnam Vehicle Inspection Agency according to the model prescribed in Appendix 1 attached to this Circular."
2. Amend Article 7 as follows:
"Article 7. Standards and conditions for senior motor vehicle inspectors
1. Must be a motor vehicle inspector with at least three years of experience.
2. English proficiency: at least level B or equivalent; able to read, understand, and translate basic technical specifications of automobiles in English.
3. Participating in the Senior Motor Vehicle Inspector Training Course organized by the Vietnam Vehicle Inspection Agency and obtaining a Certificate of Completion of the Senior Motor Vehicle Inspector Training Course.
4. Recognized and issued a Certificate of Senior Motor Vehicle Inspector by the Director of the Vietnam Vehicle Inspection Agency according to the model prescribed in Appendix 1 attached to this Circular."
1. The Provincial People's Committee shall complete the confirmation of the Certificate of Tariff Quota within three (03) working days from the date of receipt of a complete set of documents.
"Article 9. Standards and conditions for leading Motor Vehicle Inspection Centers
1. Practical experience: at least three years as a motor vehicle inspector.
2. Appointed by the competent authority according to regulations."
4. Amend Article 20 as follows:
"Article 20. Recognition of motor vehicle inspectors
1. The Director of the Vietnam Vehicle Inspection Agency recognizes and issues a Certificate of Motor Vehicle Inspector according to the model prescribed in Appendix 1 attached to this Circular.
2. The Certificate of Motor Vehicle Inspector has a validity period of three years.
3. Thirty days before the Certificate of Motor Vehicle Inspector expires, the Vietnam Vehicle Inspection Agency organizes periodic evaluations to issue new Certificates of Motor Vehicle Inspectors. Evaluation results are recorded on the Inspector Evaluation Form according to the model prescribed in Appendix 2 attached to this Circular.
4. A motor vehicle inspector can have their Certificate renewed if they achieve a minimum score of 3 out of 5 in the periodic evaluation. A senior inspector can have their Certificate renewed if they achieve a score of 5 out of 5 in the periodic evaluation. If the periodic evaluation does not meet requirements, the inspector may be re-evaluated once within three months from the date of the periodic evaluation.
5. An inspector who meets the criteria for renewal and wishes to supplement additional work stages will be evaluated and issued a new Certificate after three months.
6. The procedures for recognition and issuance of Certificates of Motor Vehicle Inspectors are carried out as for the first issuance."
5. Amend Article 21 as follows:
"Article 21. Procedures for requesting recognition and issuance of Certificates of Motor Vehicle Inspectors
1. Initial application dossier for motor vehicle inspectors includes:
a) Application form of the individual according to the model prescribed in Appendix 5 or a request for issuance of a Certificate of Motor Vehicle Inspector from an organization or entity according to the model prescribed in Appendix 6 attached to this Circular;
b) Professional resume according to the model prescribed in Appendix 4 attached to this Circular;
c) Certified copy of the bachelor's degree diploma according to Clause 1 of Article 6 of this Circular along with the transcript of grades;
d) Certified copy of the Certificate of Completion of the Motor Vehicle Inspector Training Course;
đ) Certified copy of the English proficiency certificate (still valid);
e) Color photograph (soft file, taken within six months).
2. Initial application dossier for senior motor vehicle inspectors includes:
a) Application form of the individual according to the model prescribed in Appendix 5 or a request for issuance of a Certificate of Motor Vehicle Inspector from an organization or entity according to the model prescribed in Appendix 6 attached to this Circular;
b) Professional resume according to the model prescribed in Appendix 4 attached to this Circular (if there is additional information);
c) Certified copy of the Certificate of Completion of the Senior Motor Vehicle Inspector Training Course;
d) Certified copy of the English proficiency certificate (still valid);
đ) Color photograph (soft file, taken within six months).
3. Dossier for renewal of Certificates of Motor Vehicle Inspectors includes:
a) Application form of the individual according to the model prescribed in Appendix 5 or a request for issuance of a Certificate of Motor Vehicle Inspector from an organization or entity according to the model prescribed in Appendix 6 attached to this Circular;
b) Inspector Evaluation Form;
c) Color photograph (soft file, taken within six months)."
6. Amend Article 22 as follows:
"Article 22. Procedures for recognition and issuance of Certificates of Motor Vehicle Inspectors
1. Organizations and individuals complete the dossier according to Article 21 of this Circular and submit one set of the dossier to the Vietnam Vehicle Inspection Agency.
2. The Vietnam Vehicle Inspection Agency receives and checks the dossier components: if the dossier is incomplete according to regulations, organizations and individuals are immediately guided to complete it on the same working day (for direct submission) or are guided to complete the dossier within two working days from the date of receipt (for submission through postal service or other appropriate means)."
3. In case the application dossier is complete in accordance with the regulations, the Vietnam Vehicle Inspection Agency shall conduct an evaluation of the dossier. If the dossier meets the requirements, it will decide to recognize and issue the Vehicle Inspector Certificate within ten working days from the date of receiving the dossier; if not, within two working days from the date of obtaining the dossier evaluation results, the Vietnam Vehicle Inspection Agency shall provide a written response stating the reasons.
4. The acceptance of dossiers and issuance of results shall be carried out directly or through the postal system or by other appropriate means.
7. Delete the phrase "Vehicle Inspector Card" in Article 23 of Circular No. 27/2013/TT-BGTVT.
Article 2. Effectiveness and responsibility for implementation
1. This Circular takes effect from February 15, 2015.
2. Repeal Appendix 4 of Circular No. 27/2013/TT-BGTVT; replace Appendices 3, 5, and 6 of Circular No. 27/2013/TT-BGTVT with Appendices 1, 3, and 4 respectively issued together with this Circular.
3. For vehicle inspectors who have been issued a Vehicle Inspector Certificate according to the model specified in Appendix 3 of Circular No. 27/2013/TT-BGTVT, the Vietnam Vehicle Inspection Agency shall be responsible for developing an evaluation schedule to issue a Vehicle Inspector Certificate in accordance with this Circular and complete it before December 31, 2017.
4. A Vehicle Inspector Certificate issued according to the model specified in Appendix 3 of Circular No. 27/2013/TT-BGTVT that still has validity remaining shall remain valid until the issuance of a new Vehicle Inspector Certificate in accordance with Clause 3 of this Article.
5. The Heads of the Ministry's Office, the Inspectorate, the Department Heads, the Director of the Vietnam Vehicle Inspection Agency, the Directors of the Departments of Transport of the provinces and centrally governed cities, and the Heads of agencies, organizations, and individuals related to this Circular shall be responsible for its implementation.
