Regarding the issuance of the Management Regulations for Programs and Projects

implemented domestically by units under the Ministry of Agriculture and Rural Development 

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of Ministries and ministerial-level agencies;

Considering the proposals of the Heads of the Departments: Science and Technology & Agricultural Extension, Finance and Accounting, Organization and Cadres, Planning and Master Planning, Investment and Basic Construction, and the Director of the Office,

DECISION:

Article 1. Issuing along with this Decision the "Management Regulations for Programs and Projects implemented domestically by units under the Ministry of Agriculture and Rural Development".

Article 2: THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

Article 3: The Heads of Departments, Units, and other relevant units under the Ministry of Agriculture and Rural Development are responsible for implementing this Decision.

MANAGEMENT REGULATIONS FOR DOMESTIC PROGRAMS AND PROJECTS

IMPLEMENTED BY UNITS UNDER THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

(Issued together with Decision No.: 72/QD-BNN-KHCN dated July 5, 2000

PART I

GENERAL PROVISIONS

Article 1. Purpose and Requirements:

1. These regulations are issued with the purpose of:Unifying the management process of preparing and implementing domestic programs and projects in accordance with state regulations,

Encouraging agencies and organizations to participate in implementing programs and projects that align with their functions and responsibilities,

Enhancing research, technology transfer, and training capabilities in agriculture and rural development.

2. Requirement: To utilize domestic investment funds managed by the State effectively, preventing corruption and waste.

Article 2. Scope of Application:

1. These regulations apply to all research programs, target programs, basic investigation projects, model construction projects, trial production projects, testing projects, technology transfer projects, technical support projects, contracts with domestic partners funded by the state budget within the agricultural and rural development sector, and other projects implemented through self-exploitation contracts (hereinafter referred to as projects).

2. All administrative and economic service units: Research Institutes, Survey and Planning Institutes, educational institutions, Centers, Stations, Farms, Departments, Bureaus, etc. (hereinafter referred to as units) under the Ministry of Agriculture and Rural Development must comply with these regulations.

Project management units are departments of the Ministry of Agriculture and Rural Development (Departments, Bureaus, etc.) assisting the Minister in managing projects within the scope defined in Clause 2 of Article 6 of these regulations. The lead project unit is the project sponsor; if a project is solely implemented by one unit, the lead project unit is also the implementing unit; if a project involves multiple units, all participating units are considered implementing units. The project manager is the person assigned responsibility for organizing the implementation of the project by the Minister or the Head of the lead project unit according to the State's delegation.

3. IDENTIFICATION, DEVELOPMENT, REVIEW, AND APPROVAL OF PROJECTS are the agencies of the Ministry of Agriculture and Rural Development (Bureau, Department, Board) assisting the Minister in managing projects within the fields assigned as stipulated in Clause 2, Article 6 of this Regulation. The leading unit of the project is the project sponsor; if the project is implemented solely by one unit, then the leading unit of the project is also the implementing unit of the project; if the project is jointly implemented by multiple units, all participating units in the implementation of the project are the implementing units of the project. The project leader is the person entrusted with the responsibility to organize the implementation of the project by the Minister or the head of the leading project unit, according to the State's decentralization.

Chapter II

DETERMINATION, DEVELOPMENT, REVIEW AND APPROVAL OF PROJECTS

Article 3. Determination and construction of projects

1. The objectives and contents of the project must be consistent with the national strategy, plans, key programs, and priority directions of the State and the Ministry of Agriculture and Rural Development, while also being consistent with the functions, tasks, and specialized fields of the implementing unit.

2. The construction of projects must comply with current regulations and rules for each type of project, with the participation of opinions from relevant Bureaus and Departments as assigned by the Ministry of Agriculture and Rural Development as stipulated in Clause 2, Article 6 of this regulation.

3. Projects must be constructed according to a unified model of the State, ensuring the maximum use of existing related documents to avoid duplicate content.

4. Projects implemented through contracts by the unit itself must have the approval of the Ministry before they can be carried out.

Article 4. Review and approval of projects

1. All projects must be reviewed in accordance with the provisions of the State for each type of project before submitting to the competent authority for approval.

2. For projects within the approval authority of the Ministry of Agriculture and Rural Development, the leading unit of the project must submit complete project files in accordance with the regulations for each type of project to the relevant Departments and Bureaus as specified in Clause 2, Article 6 of this regulation for review and submission to the Ministry for approval.

3. For projects using other sources of funds obtained through economic contracts by the unit itself, the review shall be conducted by the funding agency as prescribed, but the leading unit of the project must report on the content and results of the project approval to the Ministry through the relevant Departments and Bureaus as specified in Clause 2, Article 6 of this regulation.

4. Approval and signing of projects must comply with the State's regulations on approval authority.

Chapter III

Article 5. Organization of project implementation

The head of the leading unit of the project organizes the implementation of the project in accordance with the approved objectives and contents of the project and the current regulations of the State. After the project is approved, the head of the leading unit of the project forecasts personnel, coordinates with relevant Departments and Bureaus to establish the Project Management Board (or delegates the decision to the unit) and reports to the Ministry.

Article 6. Project management

1. The content of project management includes: guiding the construction of projects, reviewing and examining the content, inspecting the implementation, evaluating the results, organizing acceptance and handover, and finalizing accounts of the project.

2. Assignment of project management:

a) The Science and Technology Department assists the Minister in managing and consolidating projects funded from state science and technology funds and projects related to scientific research, technology transfer, environment, and enhancing scientific and technological capacity.

b) The Planning and Planning Department assists the Minister in managing projects funded from state economic funds and projects related to basic surveys, development investment, planning, and is responsible for consolidating all projects to report to the Ministry.

c) The Investment and Basic Construction Department assists the Minister in managing and consolidating projects funded from state investment and basic construction funds.

d) The Organization and Cadre Department assists the Minister in managing and consolidating projects funded from state training funds and projects related to human resource training, organizational structure, and administrative reform.

e) The Finance and Accounting Department assists the Minister in managing financial and accounting issues of all projects; guiding units to implement income and expenditure in accordance with the current State regulations, while proposing supplements or amendments to regulations and expenditure standards that are no longer appropriate to facilitate the implementation of projects by units.

g) The Inspectorate assists the Minister in inspection and supervision of works and projects in accordance with the State's management functions and laws on inspection and supervision.

h) Relevant Bureaus: Forestry Development, Agricultural and Forest Promotion, Resettlement and New Economic Zones, Water Resources and Irrigation Works, Flood Control and Embankment Management, Plant Protection, Animal Health, etc., manage projects within their scope as assigned by the Ministry of Agriculture and Rural Development and submit regular reports to the Planning and Planning Department for consolidation.

Article 7. Financial Management of the Project

The financial management of the project must be carried out in accordance with the current state regulations and the financial management rules of the Ministry for projects within administrative units under the Ministry of Agriculture and Rural Development.

Article 8. Management of Materials and Equipment of the Project

Materials and equipment purchased for the operation of the project belong to the State and shall be managed in accordance with current regulations. The project owner must establish records to monitor and hand over to the implementing unit after the completion of the project.

Article 9. Inspection of Project Implementation

During the implementation of the project, the Ministry of Agriculture and Rural Development will organize or coordinate with relevant ministries and sectors to conduct regular or spot inspections on the progress and use of funds for the projects.

The project owner and the head of the leading unit have the responsibility to prepare and provide all relevant information about the project when requested by the inspection team.

Article 10. Acceptance, Handover, and Reporting System

1. The project owner and the head of the leading unit are responsible for reporting to the Ministry on the progress of the project every six months at the beginning of July and January each year for units assigned in Section 2 of Article 6 of this Regulation.

2. Upon completion of the project, the project owner and the head of the leading unit must organize acceptance and handover according to the regulations applicable to each type of project and submit the Report to the Ministry through the Departments and Bureaus as stipulated in Clause 2 of Article 6 of this Regulation.

3. Relevant Departments and Bureaus of the Ministry shall cooperate in drafting unified report templates for each type of project and guiding the units to implement them.

Article 11. Management of Project Documents

Project documents are managed by the Departments and Bureaus specified in Clause 2 of Article 6 of this Regulation and related units as required by the Ministry.

Article 12. Copyrights and Registration of Copyrights

For research projects, copyright registration can only be made after the research results are evaluated and accepted by the Scientific and Technological Council and approved by the Ministry, in accordance with the regulations on the Protection of Copyrights and Industrial Property Rights.

Chapter V

IMPLEMENTATION PROVISIONS

Article 13. The Head of the Ministry's Office, Heads of Departments and Bureaus, managing and implementing agencies, and related units under the Ministry are responsible for enforcing this Regulation.

All previous provisions contrary to this Regulation are hereby abolished. Any points requiring supplementation or amendment during implementation should be promptly reported to the Ministry for consideration and resolution.
