JOINT CIRCULAR

Regulations on Incentive System for Collecting Fallen Goods and Waste Materials on Foreign Route Seagoing Vessels

In recent times, due to the lack of regulations regarding the collection and incentive system for various types of fallen goods and waste materials on seagoing vessels operating on foreign routes, many ships, after unloading their cargo, have not been permitted to bring ashore and remove from the port the agricultural products that fell during unloading and other waste materials which were dumped into the sea during cleaning operations.

To reduce losses and wastage of goods, utilize waste materials for production, increase the stock of goods for society, generate additional revenue for the State Budget, and contribute to improving the living conditions of crew members, the Ministry of Finance and the Ministry of Transport hereby stipulate the incentive system for collecting fallen goods and waste materials on seagoing vessels operating on foreign routes as follows:

1/ Objectives:

Seagoing transport vessels carrying imported and exported goods that generate activities related to the collection and consumption of fallen agricultural products such as peanuts, sesame seeds, various types of beans, coffee, pepper, rice, etc.; and waste materials such as packing materials, oil drums, etc., shall be subject to the incentive system under this Circular.

2/ Methods of Collection and Consumption of Goods and Waste Materials.

Upon arrival at a Vietnamese port, the shipowner shall be responsible for contacting business establishments to sell all collected goods and waste materials from the voyage.

- The selling price shall be calculated based on the commercial trade price minus discounts and according to the remaining quality of the collected goods and waste materials.

The shipowner must maintain records and have complete documentation to track and reflect the proceeds from the sale of collected goods and waste materials for each voyage, and base the distribution of these proceeds on the provisions set out in Point 4 of this Circular.

3/ Conditions for Award Consideration.

Ships must ensure the quality of goods and the loss rate within the specified limits during transportation as stipulated in the transportation contract between the shipowner and the foreign trade organization. Voyages that do not meet these conditions will not be eligible for the award system under this Circular.

4/ Distribution of Proceeds from Sales of Collected Goods.

- After deducting collection costs such as handling, transportation, packaging, etc., the value of the collected goods shall be distributed as follows:

+ Pay to the State Budget 20%

+ Directly reward officers and crew members who contributed to the collection of fallen goods and waste materials 50%

+ Supplement the unit's incentive fund 30%.

5/ Implementation clauses:

The system for collecting fallen goods and waste materials on seagoing vessels operating on foreign routes shall apply to central and local enterprises. During implementation, if there are any difficulties, please report them to the Ministries for study and resolution./.
