Based on the Education Law dated June 14, 2005.

Based on Decree No. 136/2003/NĐ-CP dated November 14, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the General Director of the General Department for Building Police Forces.

DECISION:

Article 1. This Decision promulgates regulations on admission to various types of training and education programs at police academies and schools.

Article 2. This Decision shall take effect from July 1, 2006, and replace Decision No. 132/2002/QĐ-BCA(X14) dated February 26, 2002 of the Minister of Public Security on admission to various types of training and education programs at police academies and schools.

Article 3. The General Directors of the General Departments; Heads of units directly under the Minister; Directors of public security forces of provinces and centrally governed cities; Directors of academies and Principals of police schools are responsible for implementing this Decision.

REGULATIONS

On Admission to Various Types of Training and Education Programs at Police Academies and Schools

Chapter 1.

GENERAL PROVISIONS

Article 1. Admission to police academies and schools (hereinafter referred to as police schools) is one of the important tasks in personnel work, contributing to building a revolutionary, regular, competent, and increasingly modern police force; it is the responsibility of local public security units and police schools.

Article 2. Admission to police schools must truly originate from the requirements of public security work; cadre planning, training planning must be aligned with the required level according to the job position standards that cadres will hold upon graduation.

Article 3. Cadres and soldiers currently working in specialized forces with specific characteristics who need to be replaced or transferred to another profession, if meeting the criteria, may be proposed by their unit leaders for admission to training at police schools, and after graduation, they will be reassigned according to work requirements.

Article 4. Admission to police schools shall be conducted in combination with health checks, aptitude tests, political standards, and moral character assessments of applicants as prescribed by the Ministry of Public Security, along with examinations and nominations according to the Ministry of Education and Training's Admissions Regulations, aiming to select individuals with comprehensive development potential for training at police schools, ensuring quality, quantity, fairness, democracy, and transparency.

Article 5. Cadres from agencies and units outside the public security sector wishing to apply for admission to training at police schools must follow these provisions.

Article 6. Training and education programs at various levels shall be implemented in accordance with the regulations of the Ministry of Education and Training and the Ministry of Public Security.

Chapter 2.

SPECIFIC PROVISIONS

PART I. POSTGRADUATE ADMISSION

Article 7. Admission for Doctoral Training

1. Eligibility Criteria

a) Candidates for Examination

Teachers and educational managers of police schools; researchers and staff in advisory and research units at the Ministry and provincial public security departments; leaders at the department level and above who have had practical teaching, work, and combat experience for five years or more; must meet the job position standard requiring a doctoral degree; not exceeding 45 years old.

These candidates must possess a master’s degree in the relevant field or a related field suitable for doctoral study. If they have a bachelor’s degree, it must be from a full-time program with a minimum grade of good or better and in the same field as the doctoral program; they must also meet the eligibility criteria for postgraduate admissions as stipulated by the Ministry of Education and Training and the Ministry of Public Security.

b) Candidates Exempted from Examination

Outstanding graduates of master’s programs may be considered for direct admission to doctoral programs at the same institution in the year of graduation, subject to the standards and ratios set by the Ministry of Education and Training; not exceeding 40 years old.

2. Examination: This shall be carried out in accordance with the Ministry of Education and Training's Postgraduate Admissions Regulations and the Ministry of Public Security's regulations.

3. Admission Points: This shall be carried out in accordance with the Ministry of Education and Training's Postgraduate Admissions Regulations and the Ministry of Public Security's quotas. Applicants are entitled to preferential policies for eligible groups as prescribed by the state and the Ministry of Education and Training.

Article 8. Admissions for Master's Degree Training

1. Eligibility Criteria

a) Candidates for Examination

Teachers, education management officials of CAND schools; specialists, assistants, advisory officers, researchers at the Ministry and provincial-level public security agencies; leaders from team level upwards in business units; investigators at investigation agencies who have had at least three years of practical teaching, working, or combat experience must have a master’s degree according to job standards; they must not exceed 40 years old.

All such individuals must be members of the Communist Party of Vietnam, hold a regular bachelor's degree in the relevant field or a closely related field for master's training; if they graduated from a part-time or specialized bachelor's program, they must achieve at least a good grade and have the same major for master's training; those with other educational qualifications must supplement their knowledge or obtain a second degree equivalent to a regular bachelor's degree according to the Postgraduate Admission Regulations of the Ministry of Education and Training.

b) Candidates Exempted from Examination

Students graduating with excellent grades from regular undergraduate programs at CAND schools may be considered for direct admission to master's training at the same institution in the year of graduation according to standards and ratios set by the Ministry of Education and Training.

2. Examination: This shall be carried out in accordance with the Ministry of Education and Training's Postgraduate Admissions Regulations and the Ministry of Public Security's regulations.

3. Admission Points: Implement Clause 3, Article 7 of this Regulation.

PART II. ADMISSIONS FOR UNDERGRADUATE TRAINING

Article 9. Admissions for Regular Undergraduate Training

1. Eligibility Criteria

a) Candidates for Examination

- Officers and soldiers within the establishment of the Public Security Force who have completed high school (HS) or supplementary HS (hereinafter referred to as HS) without basic training in Public Security affairs. They must have development potential, be recommended by local Public Security units to take the exam, and must not exceed 30 years old (as of the exam date).

- Non-commissioned officers and soldiers serving on a fixed-term basis in the Public Security Force who have served at least 18 months (as of the exam date), have completed HS, have development potential, and require undergraduate training.

- High school students who have completed HS, are members of the Ho Chi Minh Communist Youth Union, must not exceed 20 years old; for ethnic minority students, the age limit is 22 years old (as of the exam date).

- The number of female high school students admitted is decided by the Director of the Provincial Public Security Force, central city Public Security Force, and heads of units with admission quotas, but it cannot exceed 5% of the total number of candidates passing the preliminary screening and must assume responsibility for post-graduation employment.

b) Direct admissions category

- High school students who have completed a regular junior college program (as stipulated by the Ministry of Education and Training) at CAND schools, recommended by the school and agreed upon by the unit and local authorities, may be directly admitted to undergraduate training in the same field.

- High school graduates who meet the criteria for direct admission to undergraduate training according to the annual regulations of the Ministry of Education and Training and pass the preliminary screening requirements set by the Ministry of Public Security.

2. Preliminary Screening Requirements

All individuals listed in Clause 1 of this Article must have good moral character, meet preliminary screening requirements, and satisfy the recruitment standards set by the Ministry for joining the Public Security Force.

a) Not suffering from chronic or terminal illnesses; not addicted to drugs; having a balanced physique; no deformities; meeting height and weight standards for males from 1.64m to 1.82m and from 48kg to 72kg; for females from 1.58m to 1.72m and from 45kg to 57kg. For students in Region 1 and ethnic minority students, the height and weight standards are reduced by 2cm and 2kg respectively. Forces requiring higher height and weight standards must report to the Ministry for approval.

b) Achieving good conduct ratings and average academic performance in high school years, with scores of at least 6 points in three subjects corresponding to the entrance examination for CAND schools. For students in Region 1, ethnic minority students, and non-commissioned officers and soldiers serving on a fixed-term basis in the Public Security Force, average grades are sufficient.

c) Individuals and their families must comply with all policies and laws of the Party and State, and local regulations; must not violate laws or be involved in social evils. Family members must meet political standards as prescribed by the Ministry of Public Security.

3. Entrance Examinations Each candidate can only apply for one major at one school. The examination groups and registration regions for each major at each school are specified in the annual admission guidelines of the Ministry of Public Security.

4. Admission Scores: The determination of admission scores is decided by the Academy Director or University President and follows the principle of adding examination scores to bonus points according to the Ministry of Education and Training regulations to meet the quota set by the Ministry of Public Security.

The deadline for grading, determining admission scores, and sending examination result certificates to candidates is carried out according to the Ministry of Education and Training's Admission Regulations.

Regular undergraduate admissions must conclude before October of the admission year.

Article 10. Recruitment for concurrent higher education programs

1. Eligibility Criteria

a) Eligible candidates: Police officers and soldiers of the Public Security Force who have worked for at least two years (excluding time spent studying, temporary service periods within the Public Security Force, and provisional recruitment periods) in their respective professional fields, and who have completed high school; they must also demonstrate potential for development and meet the vocational position standards.

b) Candidates Exempted from Examination

- Police officers who are National Armed Forces Heroes or National Labor Medallists and have completed high school.

- Police officers who have graduated from other university majors within the same group or with the same examination subject as the major they intend to apply for, according to the regulations of the Ministry of Education and Training.

All eligible candidates must require higher education at the bachelor's level in the intended major, and must not exceed 40 years old.

2. Examination: The recruitment process shall be carried out in accordance with the regulations of the Ministry of Education and Training on admissions to universities and colleges with a concurrent work-study program format. The examination subjects and registration areas for each major at each institution are specified in the annual admission guidelines issued by the Ministry of Public Security.

3. Admission Points: Admissions will be based on the total score of the entrance exam plus bonus points for region and category (if applicable), following the principle of meeting the established training quota. In addition to the regulations of the Ministry of Education and Training, the Ministry of Public Security supplements the following priority categories:

a) Priority Group 1: Police officers awarded by the Government with a Medal for Outstanding Merit in the three years prior to the examination year.

b) Priority Group 2: Police officers awarded by the Government with a Commendation for Outstanding Merit within or before two years prior to the examination year.

The bonus points for each category and the admission scores shall be determined by the Director of the Academy or the President of the Public Security University in accordance with the Ministry of Education and Training’s admission regulations and the established training quota.

Article 11. Recruitment for bachelor's degree programs for officers who have completed secondary-level public security education

1. Eligibility Criteria

a) Eligible candidates: police officers and soldiers of the Public Security Force who have completed secondary-level public security education, have worked for at least two years in their respective professional fields, and are not older than 40 years old.

b) Candidates exempted from examinations: police officers who are National Armed Forces Heroes or National Labor Medallists and have completed high school.

2. Examination: Follow Clause 3, Article 10 of this Regulation.

3. Admission Points: Follow Clause 3, Article 10 of this Regulation.

Recruitment for bachelor's degree programs for officers who have completed secondary-level public security education shall conclude before November of the recruitment year.

Article 12. Recruitment for bachelor's degree programs for police officers who have completed tertiary-level public security education

1. Eligibility Criteria

Police officers who have completed tertiary-level public security education in Law Enforcement, Criminal Investigation, Fire Prevention and Fighting, or short-term university programs; working in their respective professional fields, and requiring to upgrade their vocational qualifications to the bachelor's level; must not exceed 45 years old.

2. Examination:

a) For Law Enforcement and Criminal Investigation majors, candidates must take two subjects: Law and Basic Professional Subjects.

b) For Fire Prevention and Fighting majors, candidates must take two subjects: Basic Professional Subjects and Specialized Professional Subjects.

3. Admission Points: Follow Clause 3, Article 10 of this Regulation.

Article 13. Recruitment for second bachelor's degree programs

1. Eligibility criteria: Police officers who have graduated from non-public security university majors and are classified as Public Security Force officers with a rank equivalent to a professional officer: must not exceed 40 years old.

2. Examination: In accordance with the regulations of the Ministry of Education and Training.

3. Admission Points: Follow Clause 3, Article 10 of this Regulation.

Article 14. Recruitment for university training with preferential admission

1. Eligibility Criteria

a) Students from ethnic minority groups who have been registered as permanent residents for at least five years in special hardship areas within communes designated by the Government's regulations, have completed high school, met the preliminary health, moral character, and political criteria as stipulated in Clause 2, Article 9 of this Regulation, and are not older than twenty-five years old.

b) Students from the Boarding Schools for Ethnic Minorities under the Ministry of Public Security, who are ethnic minorities, have completed the first year of high school, and are admitted to university preferential admission based on their academic performance and conduct evaluation results, according to the quota issued by the Ministry.

2. Admission examination:

a) For the quota allocated to local public security agencies for high school students, the local public security agencies shall select candidates, submit brief lists and application files to the universities. The universities shall verify the candidates' eligibility, organize admissions, and report the results to General Department III (X14) for monitoring.

b) For students from the Boarding Schools for Ethnic Minorities under the Ministry of Public Security, the Boarding Schools for Ethnic Minorities under the Ministry of Public Security shall organize selection according to the quota set by the Ministry, submit student lists and files to academies and universities. Academies and universities shall verify the candidates' eligibility, organize admissions, and report the results to General Department III (X14) for monitoring.

Recruitment for university training with preferential admission ends before October 15th of the recruitment year.

PART III. RECRUITMENT FOR MIDDLE LEVEL TRAINING

Article 15. Recruitment for regular middle level training

1. For new recruits

a) Eligible candidates

Including those who have taken the entrance exam for regular university training at academies and universities under the Ministry of Public Security and have applied for admission to regular middle level training at police academies.

b) Direct admissions category

- High school graduates who meet the direct admission criteria set annually by the Ministry of Education and Training and the Ministry of Public Security, and satisfy the preliminary screening requirements and the standards for recruitment into the police force as prescribed by the Ministry of Public Security.

- High school graduates from the Boarding Schools for Ethnic Minorities under the Ministry of Public Security who do not meet the criteria for university preferential admission.

c) Admission score: The admission score for middle level training is determined based on the principle of taking the entrance exam scores for regular university training, adding bonus points based on region and category (if applicable), to fill the quota allocated to each region, area, and unit.

d) Bonus points: Bonus points are implemented according to the regulations of the Ministry of Education and Training. Specifically, children of public security officers are given an additional 2.0 points, including:

- Candidates whose father or mother (or both) are public security officers in the current staff (currently working or retired).

- Candidates whose father or mother (or both) were previously public security officers, now retired due to poor health, transferred to another profession, or deceased but had continuous service in the public security sector for at least fifteen years.

The process of channeling admissions to middle level police academies is specified in the annual recruitment guidelines of the Ministry of Public Security.

Recruitment for regular middle level training ends before November of the recruitment year.

2. For current officers

a) Eligible candidates: Public Security Officers in the current staff of business units who have completed high school, wish to be trained at the middle level vocational police training, and are not older than thirty-five years old (as of August 30th of the recruitment year).

b) Admission examination: Based on the allocated quota, public security units and localities shall select candidates, submit brief officer lists to middle level schools for verification, admissions, enrollment, and report the results to General Department III (X14) for monitoring.

Article 16. Recruitment for intermediate vocational education while working      

1. Objectives: Implement as Point a, Clause 2, Article 15 of this Regulation.

2. Admission examination: Implement as Point b, Clause 2, Article 15 of this Regulation.

SECTION IV. RECRUITMENT AT VARIOUS EDUCATION LEVELS AND TRAINING

Article 17. Recruitment for cultural education for students from ethnic minorities

1. Recruitment area: Students who are members of ethnic minorities with permanent residence registration for at least five years (as of July 30 of the recruitment year) and currently residing in special difficult economic and social conditions areas classified as Zone 1 according to the Government's regulations.

2. Selection criteria: Must have three consecutive years of study leading up to the recruitment year, achieving average academic performance and good conduct when applying to attend the Ministry of Public Security's Ethnic Minority Boarding Secondary School; recruit students into grade 10 for the northern region and grades 7, 8, 9, and 10 for the southern region; must meet political and moral standards; have a balanced physique, not suffering from chronic or terminal illnesses; have normal physical and intellectual development potential. The number of young female students from ethnic minorities recruited shall be decided by the Provincial Public Security Director.

Regarding age and height, the following applies:

a) Having completed grade 6, under 14 years old, height 1.43 meters or more.

b) Having completed grade 7, under 15 years old, height 1.45 meters or more.

c) Having completed grade 8, under 16 years old, height 1.47 meters or more.

d) Having completed grade 9, under 17 years old, height 1.50 meters or more.

For female students, the height requirement is reduced by 2 centimeters. Within a three-year period, no more than two students from the same family and no more than five students from the same village will be recruited.

3. Admission process: Based on allocated quotas, local public security agencies organize selection, submit applications and lists to the school. The Ministry of Public Security's Ethnic Minority Boarding Secondary Schools review admission criteria, organize enrollment, and report results to the General Department III (X14) for monitoring implementation.

Recruitment for cultural education at the Ministry of Public Security's Ethnic Minority Boarding Secondary Schools concludes before August 20 of the recruitment year.

Article 18. Recruitment for military martial arts and special forces training

1. Eligibility criteria: Military instructors - martial arts, public security officers from units and localities, and police academies, must have graduated high school, good health, height of 1.65 meters or more, and weight of 50 kilograms or more; not exceeding 30 years old.

2. Admission examination: Candidates for recruitment must meet three-quarters of the physical fitness test requirements at a good level or higher (as stipulated in Joint Circular No. 01/1999/TTLT-BCA-UBTDTT on physical fitness standards in the police force) and other psychological and physiological standards according to the demands of military martial arts training and teaching and special forces operations.

Article 19. Recruitment for training courses

Annually, police academies offer the following training courses:

1. Training for leadership positions at the department, bureau, director-general, division, county, district, ward, post, team levels, and other positions as specified by the Ministry of Public Security.

2. Training for leadership and command positions (prior to appointment) at various levels within the police force.

3. Legal and police business training for officers who have graduated from non-police-related universities and are assigned to police positions with technical salary grades.

4. Legal and police business training for officers who have graduated from non-police-related junior colleges and are assigned to police positions.

5. Specialized business training.

Standards and target groups for these types of training will be announced in the annual recruitment guidelines.

PART V. ENROLLMENT APPLICATIONS

Article 20. Application for admission and enrollment files (for university and college levels) (for universities and junior colleges)

1. Application for admission and enrollment files shall be in accordance with the regulations of the Ministry of Education and Training and the annual guidelines of the Ministry of Public Security.

2. For police officers, the application for admission must include a health certificate and be listed on the roster submitted by the local public security unit recommending them for study.

Article 21. Enrollment files for concentrated training programs

1. For new applicants

a) A voluntary application form to join the Police Force (according to the model provided by the Ministry).

b) An autobiographical record (according to the model provided by the Ministry), confirmed by the People's Committee of the commune or ward.

c) A copy of the Birth Certificate.

d) A copy of the academic transcript and high school diploma, certified and the original must be presented upon arrival at the school for enrollment. Students enrolling in the Boarding Schools of the Ministry of Public Security must have their academic transcripts and diplomas (or graduation certificates) from previous classes and grades.

e) A background check report (according to the model provided by the Ministry).

f) A COPY of the household registration book (confirmed by the local police station where they reside) and the notification of household registration transfer.

g) A health examination report (as prescribed by the Ministry).

h) The admission approval document issued by the local public security units.

i) A copy of any priority certificates (if applicable), certified and the original must be presented upon arrival at the school for enrollment. Specifically, students entering the Cultural School must have a certificate confirming they belong to an ethnic minority group issued by the People's Committee at the district level or higher.

j) A Party and Youth League activity transfer letter (if applicable).

k) A test score report (except for the Cultural School).

l) An admission notice from the school.

2. For police officers

a) A decision to send officers for study issued by the head of the unit or the Director of the Provincial Public Security Department.

b) The original file of the officer.

c) A Party and Youth League activity certificate (if applicable).

d) A salary and uniform transfer certificate.

e) A test score report.

f) An admission notice from the school (clearly stated as for new applicants).

g) A copy of any priority certificates (if applicable), certified and the original must be presented upon arrival at the school for enrollment.

h) A copy of the academic transcript and high school diploma, certified and the original must be presented upon arrival at the school for enrollment.

Enrollment files for part-time classes and training courses have separate regulations.

Chapter 3.

ASSIGNMENT OF RESPONSIBILITIES AND IMPLEMENTATION ORGANIZATION

Article 22. The Director of the General Department of Force Building of the Public Security has the responsibility

To assist the Minister in directing and guiding the organization of the annual enrollment work according to the Regulations of the Ministry of Education and Training and this Regulation; to direct schools under the Public Security, local public security units to resolve complaints and specific issues arising during the enrollment process.

Article 23. Public Security Departments of provinces and centrally-administered cities, units assigned the task of enrollment have the responsibility:

1. To widely inform cadres, soldiers, and student youth about the policy and regulations of the Ministry regarding enrollment; to organize the acceptance of applications for admission and recruitment from candidates.

2. To conduct preliminary selection for candidates applying for admission, compile lists, complete application files, and submit them to the school and the General Department of Force Building of the Public Security as prescribed by the Ministry.

3. To deliver the admission notice, notification of successful enrollment, test score reports, and recruitment notices to each candidate.

4. To complete enrollment files and procedures for candidates admitted to Public Security schools (including those recruited by the Ministry or other units and localities).

5. To report to the leadership of the Ministry (through the General Department of Force Building of the Public Security) on the results of the enrollment process in their units and localities.

6. To bear responsibility before the Minister for actions not in compliance with regulations and negative phenomena in the assigned enrollment tasks.

Article 24. Police Academy institutions shall be responsible for

1. Receiving and examining application files; organizing entrance examinations for each level of study in accordance with the regulations of the Ministry of Education and Training and the provisions of the Ministry of Public Security.

2. Examining application files, health status, and political criteria of students registering for admission; implementing tasks and authorities regarding admissions, recruitment, and enrollment according to the division of responsibilities for managing police academy institutions as prescribed by the Ministry. For students who do not meet the prescribed standards, the principal shall be responsible for notifying them to return to their original units or the preliminary examination locations, while simultaneously reporting to the leadership of the Ministry (through the General Department of Force Building of the Public Security).

3. Being accountable to the Minister for actions that violate regulations and rules, and for negative phenomena in assigned admission tasks.

Article 25. Inspection and supervision of admission work

Annually, the General Department of Force Building of the Public Security shall take the lead in reporting to the leadership of the Ministry to establish inspection teams for admission at institutions and units, localities. Admission inspections have the authority to conduct comprehensive inspections throughout the admission process; they may suspend activities that violate the Ministry of Education and Training's admission regulations and the Ministry of Public Security's admission provisions; they may propose disciplinary measures for collective and individual violations to the leadership of the Ministry.

Article 26. Implementation

During the implementation of this Regulation, any difficulties encountered by public security units and localities, and police academy institutions shall report to the Ministry (through the General Department of Force Building of the Public Security) for research and guidance on implementation./.
