Regarding the establishment of the Department of War Invalids, Martyrs, and Meritorious Persons under the Ministry of Labor, Invalids, and Social Affairs

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to the Government Decree No. 96/CP dated December 4, 1993 on the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
Considering the proposal of the Minister of Labor, Invalids, and Social Affairs and the Minister, Head of the Civil Service Organization Board of the Government,

Pursuant to …;

Article 1.  The Department of War Invalids, Martyrs, and Meritorious Persons is hereby established under the Ministry of Labor, Invalids, and Social Affairs based on the former Policy Department for War Invalids and Martyrs to assist the Minister of Labor, Invalids, and Social Affairs in managing the work related to war invalids, martyrs, and meritorious persons.

The Department of War Invalids, Martyrs, and Meritorious Persons has legal personality, its own seal, operational funds provided by the State budget, and is allowed to open an account at the National Treasury, with its headquarters located in Hanoi City.

Article 2. The Department of War Invalids, Martyrs, and Meritorious Persons shall have the following tasks and powers:

1. To draft legal documents, policies, and systems concerning the work of war invalids, martyrs, and meritorious persons for the Minister of Labor, Invalids, and Social Affairs to submit to the Government for issuance or for the Ministry to issue within its authority; organize, guide, and inspect the implementation of these documents.

2. To develop long-term and annual programs and plans regarding the work of war invalids, martyrs, and meritorious persons for the Minister of Labor, Invalids, and Social Affairs to submit to the Government for approval or for the Ministry to approve within its authority.

3. To submit to the Ministry for issuance or to the Department for issuance within its authority procedures for confirmation, standards, and inspection of the implementation of policies and systems concerning the work of martyrs, war invalids, disabled veterans, and meritorious persons as prescribed by law. Organize the preservation of files, statistics on the number and changes of these subjects.

4. To guide and inspect the payment of preferential benefits to meritorious persons.

5. To organize, direct, and guide the construction and management of, and the collection of remains of martyrs, martyrs' cemeteries, monuments, and memorials for martyrs throughout the country.

6. To direct localities in the construction and management of treatment, rehabilitation, and care facilities for war invalids, disabled veterans, and meritorious persons.

Directly manage some treatment, rehabilitation, and care facilities for war invalids, disabled veterans, and meritorious persons under the responsibility of the Ministry of Labor, Invalids, and Social Affairs.

7. To coordinate with relevant departments, levels, and agencies in organizing propaganda and mobilizing the whole people to take care of war invalids, families of martyrs, and meritorious persons.

8. To manage the organization, cadres, civil servants, public officials, and material infrastructure of the Department according to the regulations of the State and the delegation of the Minister of Labor, Invalids, and Social Affairs.

Article 3. The organizational structure of the Department of War Invalids, Martyrs, and Meritorious Persons is as follows:

1. The Department has a Director and several Deputy Directors.

The Director and Deputy Directors are appointed and relieved of their positions by the Minister of Labor, Invalids, and Social Affairs.

The Director is responsible for all activities of the Department before the Minister of Labor, Invalids, and Social Affairs.

Deputy Directors assist the Director in the areas of work assigned to them.

2. The Department has an Office and several specialized and professional Departments decided by the Minister of Labor, Invalids, and Social Affairs.

3. Some treatment, rehabilitation, and care facilities for war invalids, disabled veterans, and meritorious persons.

Article 4. The Minister of Labor, Invalids, and Social Affairs, together with the Minister, Head of the Civil Service Organization Board of the Government, shall provide guidance on the organization and staffing for the work of war invalids, martyrs, and meritorious persons in local labor, invalids, and social affairs agencies.

Article 5. This Decision takes effect fifteen days from the date of issuance. The Prime Minister's Decision No. 425/TTg dated July 26, 1995 on entrusting the Vietnam Social Security with the task of paying social allowances to war invalids and meritorious persons and other previous provisions contrary to this Decision are abolished.

Article 6. The Minister of Labor, Invalids, and Social Affairs, Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision.
