Pursuant to the Ordinance amending and supplementing certain articles of the Ordinance on Cadres and Civil Servants dated April 29, 2003;
Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs.
Pursuant to Decree No. 117/2003/NĐ-CP dated October 10, 2003 of the Government on recruitment, utilization, and management of cadres and civil servants in state agencies.
Considering the proposal and the unified opinion of the Supreme People's Procuracy at Circular No. 1156/VKSTC-V9 dated May 16, 2005;

Article 1. Issuing the job titles and code numbers for the ranks of Inspectors in the Prosecution Sector, including:
1. Inspector in the Prosecution Sector - Rank Code 22.218;
2. Senior Inspector in the Prosecution Sector - Rank Code 22.219;
3. Senior Inspector (High Level) in the Prosecution Sector - Rank Code 22.220.
Article 2. The qualification standards for the ranks of Inspectors in the Prosecution Sector issued along with this Decision shall serve as the basis for implementing recruitment, utilization, and management of the Inspector workforce in the Prosecution Sector.
Article 3. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.
Article 4. The Minister, heads of ministries equivalent to ministries, heads of government agencies, Chairpersons of Provincial People's Committees directly under the Central Government are responsible for enforcing this Decision.
Qualification Standards for Inspectors
(Issued together with Decision No. 73/2005/QĐ-BNV dated July 25, 2005 of the Minister of Home Affairs)
A. GENERAL QUALIFICATIONS FOR SENIOR INSPECTORS
- Loyalty to the country and the Constitution of the Socialist Republic of Vietnam, with a spirit of resolute struggle to protect socialist rule of law;
- Diligent service to the people, firm in the goal of national independence and socialism, striving to effectively implement the Party's policies and the State's laws;
- Possess good moral character, not engage in corruption, and resolutely combat corruption;
- Have a sense of organizational discipline, honesty, not opportunistic, closely connected with the people, trusted by the people;
- Understand political theory, the Party's viewpoints, and the State's policies and laws;
- Have sufficient capacity and health to work effectively, meeting the needs and assigned tasks;
- Have sufficient time to perform practical work as prescribed in this Document;
- Shall not engage in activities prohibited by law for cadres and civil servants.
B. SPECIFIC QUALIFICATIONS
I. SENIOR INSPECTOR
1. Responsibilities
Is a high-level professional civil servant, assisting the Leadership of the Supreme People's Procuracy in supervising compliance with the law in the handling of criminal, civil, family, administrative, commercial, labor cases, and other matters as prescribed by law; in temporary detention, pre-trial detention, management, and education of persons serving prison sentences; enforcement of judgments; in review of complaints and some other legal tasks assigned by the Procurator General. Assisting the Leadership of the Supreme People's Procuracy in leading and performing the task of supervising important and very complex cases involving multiple areas.
2. Knowledge
- Profound understanding of the Party's guidelines, policies, and the State's laws; the main political tasks of the sector, correctly applying these contents to assigned duties;
- Having a broad understanding of various fields of law related to the exercise of public prosecution and supervision of judicial activities;
- Profound knowledge of basic professional expertise in the field of work; broad understanding of other relevant professional expertise;
- Broad understanding of domestic and international economic and social development;
- Profound knowledge of administrative principles and procedures.
3. Qualifications regarding educational level
- Bachelor's degree in Law or higher;
- Graduated from Advanced Political Theory Studies;
- Completed training in National Public Administration Academy's Senior Specialist rank;
- Attended training courses in prosecution business according to the curriculum of the Supreme People's Procuracy or the Judicial Academy;
- Proficient in using computers;
- Knowledge of one foreign language at level C (reading, translating, speaking fluently);
- Has a scientific work or comprehensive project recognized by the Scientific Council of the sector and effectively applied;
- Capable of guiding business practices for Inspectors and Senior Inspectors;
- At least six years in the rank of Senior Inspector or Senior Specialist.
4. Qualifications regarding capability
A Senior Inspector must meet the qualifications set out in Part A of this document and be capable of performing the following tasks:
- Directly researching and conducting inspections on the procedure, process, and content of files for criminal, civil, family, administrative, commercial, labor cases, and other matters as prescribed by law within the jurisdiction of the Supreme People's Procuracy concerning preliminary investigation, appeal, cassation, and retrial procedures; participating in inspections of compliance with the law in prisons and detention centers managed by the Ministry of Public Security; inspecting compliance with the law in the execution of judgments; inspecting compliance with the law in complaint examination, ensuring that important and very complex cases have a solid basis and comply with the law; proposing solutions to the Leadership of the Supreme People's Procuracy and taking personal responsibility for their proposals.
- Participating in drafting legislative projects, ordinances, regulations, procedural guidelines, circulars, directives of the Supreme People's Procuracy in the assigned area.
- Guiding, inspecting business practices, resolving case issues, and proposing corrective measures.
- Researching scientific topics assigned in criminal law, criminal procedure, civil law, civil procedure, commercial law, labor law, family law...
- Providing opinions on draft legal documents of other sectors when required.
- Summarizing, analyzing, and evaluating inspection work; proposing recommendations to improve and perfect related legal documents affecting the operations of the People's Procuracy.
- To take the lead, directly or participate in building the objectives, content, and training programs for lower-grade Inspector positions.
II. SENIOR INSPECTOR
1. Responsibilities
Is a highly specialized civil servant who assists the leadership of the People's Procuracy in checking compliance with laws in handling criminal, civil, family, administrative, commercial, and other cases as prescribed by law; in temporary detention, imprisonment management, and education of persons serving custodial sentences; in enforcing judgments; and in reviewing complaints and other legal tasks assigned by the Procurator. Assists the leadership of the Supreme People's Procuracy and provincial-level People's Procuracy in leading and performing the task of reviewing case files within their jurisdiction.
2. Knowledge
- Understands the Party's policies and State's laws; the political direction and main tasks related to the assigned professional duties.
- Master basic knowledge about prosecution and related professional fields.
- Has knowledge about general management practices and in-depth knowledge about the industry's management field.
- Proficient in national laws, deeply understands the implementation of public prosecution and supervision of judicial activities.
- Familiar with domestic and international economic and social development.
- Profound knowledge of administrative principles and procedures.
3. Qualifications regarding educational level
- Holds a Bachelor's degree in Law or higher.
- Achieved intermediate or higher theoretical political level.
- Completed training and state administration for the position of Senior Specialist at the National Academy of Public Administration.
- Attended training courses in prosecution business according to the curriculum of the Supreme People's Procuracy or the Judicial Academy;
- Knows at least one foreign language at level B (reading and translating).
- Proficient in using computers;
- Has a project recognized by the industry council and implemented for improving work procedures.
- Capable of guiding professional duties for Inspectors.
- Has served as an Inspector or Senior Specialist for at least five years.
4. Qualifications regarding capability
A Senior Inspector must meet the criteria set forth in Part A of this document and be capable of performing the following tasks:
- Directly researches and implements checks on the procedures, processes, and contents of case files for criminal, civil, family, administrative, commercial, labor, and other cases as prescribed by law at all levels of the People's Procuracy regarding preliminary, appellate, supervisory, and retrial stages; participates in checking compliance with laws at detention centers and temporary detention facilities; checks compliance with laws in enforcing judgments; checks compliance with laws in complaint review work to ensure that cases are based on evidence and comply with the law, and proposes solutions to the leadership of the People's Procuracy, taking personal responsibility for their proposals.
- Compiles, summarizes data, and archives files according to regulations.
- Summarizes, analyzes, evaluates, and draws lessons from inspection work within the assigned field; on this basis, proposes amendments to improve and perfect the case file inspection process.
- Cooperates with relevant departments and specialized units during the inspection process to ensure accuracy and compliance with the law.
- Participates in drafting laws and ordinances related to the implementation of public prosecution and supervision of judicial activities when required.
- Participates in compiling training materials for subordinates.
- Participates in scientific research projects. Has the ability to organize and direct improvements in professional management systems. Can write comprehensive reports on professional activities.
III. INSPECTOR
1. Responsibilities
Is a specialized civil servant who assists the leadership of the People's Procuracy in checking compliance with laws in handling criminal, civil, family, administrative, commercial, labor, and other cases as prescribed by law; in temporary detention, imprisonment management, and education of persons serving custodial sentences; in enforcing judgments; and in complaint review work and other legal tasks assigned by the Procurator. Assists the leadership of the People's Procuracy at all levels in directly inspecting cases as assigned by the leadership of the People's Procuracy.
2. Knowledge
- Understands the Party's policies and State's laws, and the political direction and main tasks related to the assigned professional duties.
- Master basic knowledge about laws and prosecution.
- Understands the organization and operation of the People's Procuracy system.
- Knows how to coordinate work with related units.
