Regarding the implementation of the allowance systemfor individuals

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Civil Enforcement Law dated January 14, 2004.

Considering the proposal of the Minister of Justice.

DECISION:

Article 1. The allowance system shall be applied to enforcement officers, civil enforcement officials, prosecutors, police officers, self-defense militia members, local government representatives, and social organization representatives directly participating in the compulsory enforcement of civil judgments.

The amount of allowance for those directly participating in the compulsory enforcement of civil judgments is as follows:

1. The person in charge of the compulsory enforcement: VND 50,000 per person per day of participation in enforcement;

2. Other individuals directly participating in the compulsory enforcement: VND 40,000 per person per day of participation in enforcement. Representatives of neighborhood associations, village chiefs, village elders, and village heads, when mobilized to participate in the compulsory enforcement of civil judgments as necessary, shall be entitled to allowances as stipulated in Clause 2 of this Article.

Article 2. The source of funds for implementing the allowance system for compulsory enforcement of civil judgments shall be from the enforcement costs paid by the judgment debtor according to the provisions, and in cases where the judgment debtor is exempted or granted a reduction in enforcement costs under the law, the funds shall be allocated from the state budget within the annual state budget estimates of civil enforcement agencies as provided for in the State Budget Law.

Article 3. This Decision shall take effect fifteen days after its publication in the Official Gazette and shall supersede Decision No. 242/TTg dated April 17, 1997 of the Government Chairman on the implementation of the allowance system for civil servants and employees directly participating in the compulsory enforcement of civil judgments.

Article 4. The Minister of Justice and the Minister of Finance shall be responsible for guiding the implementation of this Decision.

Article 5. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
