Decree No. 73/2014/ND-CP amends and supplements Article 29 of Decree No. 55/2013/ND-CP on granting permission for labor dispatch activities. This document adds the case where enterprises with national defense security tasks may carry out labor dispatch within the parent company - subsidiary company and economic group to which the enterprise belongs.

DECREE
AMENDING AND SUPPLEMENTING ARTICLE 29 OF THE DECREE NO. 55/2013/NĐ-CP OF MAY 22, 2013
of the Government stipulating DETAILING THE IMPLEMENTATION OF CLAUSE 3, ARTICLE 54 OF THE LABOR CODE ON THE ISSUE OF LICENSE FOR ACTIVITIES OF LEASING LABOR
Labour concerning the issuance of permits for labour dispatch activities, AND SECURITY DEPOSITS
AND THE LIST OF JOBS PERMITTED TO BE LEASED

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Enterprise Law dated November 29, 2005;
Based on the Labor Code dated June 18, 2012;
At the proposal of the Minister of Labor, Invalids and Social Affairs,
THE GOVERNMENT ISSUES THIS DECREE AMENDING AND SUPPLEMENTING ARTICLE 29 OF THE DECREE NO. 55/2013/NĐ-CP OF MAY 22, 2013 OF THE GOVERNMENT DETAILING THE IMPLEMENTATION OF CLAUSE 3, ARTICLE 54 OF THE LABOR CODE ON THE ISSUE OF LICENSE FOR ACTIVITIES OF LEASING LABOR, SECURITY DEPOSITS AND THE LIST OF JOBS PERMITTED TO BE LEASED.
ARTICLE 1. ADDING CLAUSE 3 TO ARTICLE 29 AS FOLLOWS:
"3. IN ADDITION TO ENGAGING IN PRODUCTION AND BUSINESS ACTIVITIES, ENTERPRISES THAT ARE ALSO RESPONSIBLE FOR CONTRIBUTING TO NATIONAL SECURITY, DEFENSE, AND THE PROTECTION OF NATIONAL SOVEREIGNTY, APPROVED BY THE PRIME MINISTER IN THE RESTRUCTURING PLAN OF THE UNIT, SHALL BE PERMITTED TO LEASE LABOR BETWEEN THE LEASING ENTERPRISE AND OTHER ENTERPRISES WITHIN THE PARENT COMPANY-SUBSIDIARY COMPANY OR ECONOMIC GROUP WHERE THE ENTERPRISE IS A MEMBER, AND FOR JOBS LISTED IN THE CATALOGUE OF HEAVY, DANGEROUS, AND HAZARDOUS WORKS, INCLUDING ESPECIALLY HEAVY, DANGEROUS, AND HAZARDOUS WORKS ISSUED BY THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS."
Article 2. Implementation clause
THIS DECREE TAKES EFFECT FROM SEPTEMBER 15, 2014.
2. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities shall be responsible for implementing this Decree.
