Pursuant to Decree No. 83/NĐ-CP dated October 9, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Pursuant to Decree No. 43/2011/NĐ-CP dated June 13, 2011 of the Government on the provision of information and online public services on electronic websites or portals of state agencies;

Pursuant to Decree No. 61/2002/NĐ-CP dated June 11, 2002 of the Government on the honorarium system;

Pursuant to Circular Joint No. 19/2012/TTLT-BTC-BKHĐT-BTTTT dated February 15, 2012 of the Ministry of Finance, the Ministry of Planning and Investment, and the Ministry of Information and Communications guiding the management and utilization of funds for the application of information technology in the operations of state agencies;

Based on the proposal of the Director of the Information Center, the Head of the Editorial Board of the Government Inspectorate's Electronic Portal,

DECISION:

Article 1. This Decision hereby promulgates the Remuneration and Honorarium Payment Regulation for Regular Activities of the Government Inspectorate's Electronic Portal.

Article 2. This Decision shall take effect from the date of signing.

Article 3. The Chief of the Office, Heads of the Planning, Finance, and General Affairs Department, Directors of the Information Center, the Editorial Board of the Government Inspectorate's Electronic Portal, and heads of units under the Government Inspectorate are responsible for implementing this Decision.

 PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Regulation specifies the payment levels for authors or copyright holders when their works are published on the Government Inspectorate's Electronic Portal and for those who collect, provide news articles, and perform related editing tasks on the Government Inspectorate's Electronic Portal.

Article 2. Applicability

1. The recipients of honoraria are authors or copyright holders when their works are published on the Government Inspectorate's Electronic Portal to ensure their rights and encourage them to create more valuable works.

2. The recipients of remuneration are those who provide collected works; editorial board members who undertake editing tasks for news articles for the activities of the Government Inspectorate's Electronic Portal.

Article 3. Principles of Payment

1. Only works that have been approved and published on the Government Inspectorate's Electronic Portal will be eligible for honoraria and remuneration.

2. Honoraria and remuneration paid to authors, copyright holders, and providers of collected works are based on the type, quality, and volume of the work.

3. Authors who are reporters of the Portal, focal points of departments, bureaus, and units creating or collecting, providing works outside their assigned duties shall receive 100% of the honoraria or remuneration accordingly.

4. The level of payment for honoraria and remuneration is based on the honorarium fund of the unit decided by the Editorial Board according to the legal framework.

Article 4. Source of funding

1. The source of funds used to pay honoraria and remuneration for works from the state budget is allocated by the Government Inspectorate to the Information Center (the unit managing the Portal) according to the approved budget estimate.

2. Before July 15 each year, based on the previous year's expenditure and the projected activity plan for the following year, the Information Center prepares a detailed budget estimate for the honorarium fund for paying honoraria and remuneration for works and sends it to the Planning, Finance, and General Affairs Department for review and consolidation into the annual regular budget estimate for submission to the Government Inspectorate leadership for approval.

3. The management, use, and settlement of the honorarium fund are carried out in accordance with current laws.

hChapter II

REGULATIONS ON PAYMENT OF HONORARIA AND REMUNERATION

Article 5. Classification of Works

1. Classification according to work genres:

Works are classified into the following groups: news; translated articles; illustrative drawings and photographs; summary articles; analytical and research articles; interview articles; reader responses.

a) News: Reflecting and reporting events; analyzing reports and new legal regulations; comparing and evaluating events; using specialized language that is concise and easy to understand.

b) Forward-translated articles: Translating comprehensive summaries from one or more foreign language or ethnic minority language sources into Vietnamese, with information selection, synthesis, and content arrangement.

c) Back-translated articles: Translating comprehensive summaries from Vietnamese into another language, with information selection, synthesis, and content arrangement.

d) Illustrative drawings and photographs: High-quality photographs or drawings that clearly illustrate news articles.

đ) Summary articles: Synthesizing and summarizing information, news articles, and documents published on mass media platforms by various agencies and organizations.

e) Analytical and research articles: Articles collecting information on issues into smaller topics for research and explanation.

f) Interview articles: Topics covered in interviews address current social concerns; questions and answers are brief and clear; they reflect the consistent official stance of individuals or state agencies on the issue being interviewed.

g) Reader responses: Answering readers' questions related to legal fields or professional matters of the Inspection Department.

2. Classification according to quality of works:

Each work belonging to different genres is classified based on quality as follows:

a) For articles (including news; reader responses; summary articles; analytical and research articles; interview articles)

- Class A article: high-quality article; easy-to-understand language, clear and concise; logical structure; highly topical; contains many useful pieces of information, provides accurate data, vivid details, convincing content, and is of interest to readers.

- Class B article: good-quality article; easy-to-understand language; topical; ensures complete and accurate information, of interest to readers, but still requires editing regarding structure and wording.

- Class C article: article with useful content, of interest to readers but not of high quality, requiring extensive editing regarding style, structure, and wording before publication; or an article with a report-like nature, listed content, published for notification purposes.

b) For drawings and photographs

- Class A drawing or photograph: works used to sharply illustrate articles, accurately reflecting event content, with high artistic value, clear lighting, composition, color, demonstrating the author's creativity.

- Class B drawing or photograph: works used to illustrate articles, reflecting event content, with artistic value, clear lighting, composition, color, demonstrating the author's creativity, requiring minimal technical editing.

- Class C drawing or photograph: works used to illustrate articles but require significant editing regarding composition, color, and lighting before use.

Article 6. Calculation of Royalties and Fees for Each Work

1. Royalty paid to the author or owner of the work:

Royalty = Royalty Coefficient Level x Value of One Unit of Royalty Coefficient

Where:

The value of one unit of royalty coefficient equals 10% of the minimum wage level.

Royalty Coefficient = Quantity of News Item Length x News Item Value Coefficient

Depending on the type and quality of the work, the Head of the Portal Editorial Board decides the level of the news item value coefficient for the work not exceeding the News Item Value Coefficient in the table below.

The royalty coefficient is determined based on the length of the news item and the news item value coefficient but does not exceed the royalty coefficient range in the table below when making payment.

The news item value coefficient applicable to each type of work is as follows:

2. Fee paid to those providing collected works and performing tasks related to the work as stipulated in this Regulation:

Fee = Royalty Coefficient Level x Value of One Unit of Royalty Coefficient

Where:

The value of one unit of royalty coefficient equals 10% of the minimum wage level.

Royalty Coefficient = Quantity of News Item Length x News Item Value Coefficient

Depending on the type of work, the Head of the Portal Editorial Board decides the level of the news item value coefficient for the work not exceeding the News Item Value Coefficient in the table below:

- For interview type: apply the above royalty framework. The ratio of royalties paid to the interviewer and the interviewee shall be agreed upon between both parties. In case the interviewee does not make a request regarding the ratio of royalties between the interviewee and the interviewer, the Head of the Editorial Board shall decide the ratio of royalties for the interviewee.

3. For works not specified in the royalty and fee framework set forth in this Article, the Head of the Portal Editorial Board shall determine the royalty coefficient for the author and owner and the corresponding fee for the collector and provider based on the nature and characteristics of the work.

Article 7. Expenses for Supporting the Editorial Board of the Portal in Collecting, Providing, and Editing News Items and Articles on the Portal

1. Staff members of the Editorial Board who are authors or owners of news items and articles published on the Portal shall enjoy royalties as prescribed in Clause 1 of Article 6.

2. Staff members of the Editorial Board who are collectors or providers of news items and articles published on the Portal shall enjoy fees as prescribed in Clause 2 of Article 6.

3. Staff members engaged in editing news items and articles shall enjoy a fee equal to 20% of the fee of the collector or provider of news items and articles (if they are concurrently serving in another position).

Chapter III

IMPLEMENTATION

Article 8. Implementation clause

1. The Director of the Department of Planning, Finance, and General Affairs is responsible for guiding budget units under the Government Inspectorate in the process of preparing budgets, managing, using, and settling accounts for state budget funds for paying royalties and fees according to this Regulation.

2. The Directors, Managers of Information Centers are responsible for guiding, inspecting, and urging the implementation of the provisions of this Regulation; ensuring the use of funds according to this Regulation is economical, effective, and in accordance with regulations.

3. During the implementation process, if there are difficulties, agencies and units are requested to promptly reflect them to the Information Center, Portal Editorial Board of the Government Inspectorate for consolidation and reporting to the Chief Inspector of the Government Inspectorate for consideration, revision, and supplementation of this Regulation appropriately./.
