Regarding the establishment of the Management Board for Export Processing Zones and Industrial Parks of Ho Chi Minh City

Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Decree No. 322/HĐBT dated October 18, 1991 of the Council of Ministers promulgating the regulations on export processing zones, and Decree No. 192/CP dated December 28, 1994 of the Government promulgating the regulations on industrial parks;
At the proposal of the Chairman of the People's Committee of Ho Chi Minh City, the Minister in charge of the Organization-Cadre Department under the Government, and the opinions of the Ministry of Planning and Investment and the Ministry of Industry,
DECISION:
Article 1.- Establish the Management Board for Export Processing Zones and Industrial Parks of Ho Chi Minh City based on the reorganization of the Management Board for Export Processing Zones of Ho Chi Minh City to manage export processing zones and industrial parks within the city.
The Management Board for Export Processing Zones and Industrial Parks of Ho Chi Minh City shall perform tasks and powers regarding the management of export processing zones as stipulated in Article 57 of the Regulations on Export Processing Zones issued together with Decree No. 322/HĐBT dated October 18, 1991, and the management of industrial parks as stipulated in Article 20 of the Regulations on Industrial Parks issued together with Decree No. 192/CP dated December 28, 1994 of the Government.
The Management Board for Export Processing Zones and Industrial Parks of Ho Chi Minh City shall have legal personality, its own seal bearing the national emblem, and its staffing and operating budget shall be provided from the State budget.
Article 2.- The Management Board for Export Processing Zones and Industrial Parks of Ho Chi Minh City shall have one Director, several Deputy Directors, and members representing the Ministry of Finance, the Ministry of Home Affairs, the Ministry of Trade, the State Bank of Vietnam, the General Department of Customs, and the supporting staff.
The personnel of the Management Board for Export Processing Zones and Industrial Parks of Ho Chi Minh City shall be appointed by the Prime Minister at the proposal of the Chairman of the People's Committee of Ho Chi Minh City and the Minister in charge of the Organization-Cadre Department under the Government.
The supporting staff of the Management Board shall be determined by the Director of the Management Board after consultation with the Organization-Cadre Department under the Government.
Article 3.- This Decision takes effect from the date of issuance. Decree No. 62/CT dated February 26, 1992 of the Prime Minister on the personnel of the Management Board for the Tan Thuan Export Processing Zone and Document No. 433/KTĐN dated October 27, 1992 on renaming the Management Board for the Tan Thuan Export Processing Zone to the Management Board for Export Processing Zones of Ho Chi Minh City are hereby abolished.
Article 4.-The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, the Chairman of the People's Committee of Ho Chi Minh City, and the Director of the Management Board for Export Processing Zones and Industrial Parks of Ho Chi Minh City are responsible for implementing this Decision.
