Decision No. 74/2006/QD-BTC On Amending and Supplementing the State Budget Classification System

Pursuant to the State Budget Law No. 01/2002/QH 11 dated December 16, 2002;

Pursuant to the Law on Export Tax and Import Tax No. 45/2005/QH11 dated June 14, 2005;

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 26/2004/NĐ-CP dated January 15, 2004 of the Government stipulating the functions, tasks, powers, and organizational structure of the Vietnam Academy of Social Sciences;

Pursuant to Decree No. 27/2004/NĐ-CP dated January 16, 2004 of the Government stipulating the functions, tasks, powers, and organizational structure of the Vietnam Academy of Science and Technology;

Pursuant to the proposal of the Director of the State Budget Department.

DECISION:

Article 1. Amend and supplement Chapters, Sections, Sub-sections of the State Budget Classification System that have been promulgated pursuant to Decision No. 280 TC/QĐ/NSNN dated April 15, 1997 and other Decisions of the Ministry of Finance, specifically as follows:

1. Supplement and amend Chapters as follows:

1.1 Regarding the amendment of Chapter names:

- Amend the name of Chapter 045 "National Social Sciences and Humanities Center" to "Vietnam Academy of Social Sciences".

- Amend the name of Chapter 046 "National Natural Sciences and Technology Center" to "Vietnam Academy of Science and Technology".

- Amend the name of Chapter 047 "State Merit Award Institute" to "Central Merit Award Board".

- Amend the name of Chapter 119 "Vietnam National Shipbuilding Corporation" to "Vietnam National Shipbuilding Group".

- Amend the name of Chapter 121 "Vietnam Oil Corporation" to "Vietnam National Oil and Gas Group".

- Amend the name of Chapter 122 "Vietnam Coal Corporation" to "Vietnam National Coal-Mineral Industries Group".

- Amend the name of Chapter 123 "Vietnam Post and Telecommunications Corporation" to "Vietnam Post and Telecommunications Group".

- Amend the name of Chapter 124 "Vietnam Post and Telecommunications Corporation" to "Vietnam Post and Telecommunications Group".

- Amend the name of Chapter 129 "Vietnam Textile and Garment Corporation" to "Vietnam Textile and Garment Group".

- Amend the name of Chapter 173 "Vietnam Insurance Corporation" to "Bao Viet Group".

1.2 Regarding the abolition of Chapters:

- Abolish Chapter 1.065 "National Standardization, Measurement, and Quality Control Administration" and Chapter 2.065 "National Standardization, Measurement, and Quality Control Office".

- Abolish Chapter 1.070 "Vietnam Maritime Administration".

- Abolish Chapter 1.071 "Vietnam Civil Aviation Administration".

- Abolish Chapter 1.072 "National Reserve Administration".

- Abolish Chapter 1.082 "State Securities Commission".

- Abolish Chapter 1.084 "National AIDS Prevention Commission".

2. Supplement and amend Sub-sections as follows:

2.1 Regarding the amendment of Sub-section names under Section 027:

Amend the name of Sub-section 03 "Profit received by Vietnam" to "Profit distributed to the Government after tax".

2.2 Regarding the abolition of Sub-sections:

 2.2.1 Regarding Sub-sections under Section 002:

- Abolish Sub-section 03 "Tax arrears from units subject to centralized accounting".

 - Abolish Sub-section 04 "Tax arrears from units not subject to centralized accounting".

When there is a tax arrears occurrence, record under Section 002, Sub-section 99.

2.2.2 Abolish Sub-sections under Section 014:

Abolish Sub-section 04: Tax arrears from business income.

When there is a business income tax arrears occurrence, record under Section 014, Sub-section 99.

2.3 Guidance on certain contents regarding the recording of the State Budget Classification:

2.3.1 Regarding Sub-section 01 under Section 002: Record the revenue from the activities of production and business operations subject to centralized accounting of the Vietnam Electricity Corporation, Electricity Companies I, II, III, Hanoi Electricity Company, Ho Chi Minh City Electricity Company, Hai Phong Electricity Company, Dong Nai Electricity Company; Vietnam Commercial Joint Stock Bank, Vietnam Agricultural and Rural Development Bank, Vietnam Foreign Trade Joint Stock Bank, Vietnam Investment and Development Bank, Vietnam Social Policy Bank; Vietnam Southern Housing Development Bank; Vietnam National Airlines; Vietnam Post and Telecommunications Group; Bao Viet Group; Vietnam Railway Corporation;

2.3.2 Regarding the collection of overdue fees and charges:Any fees and charges included in the list issued together with Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government but not included in the list issued together with Decree No. 24/2006/NĐ-CP dated March 6, 2006 of the Government, if there is any overdue collection, record under Section 062 (other revenues), Sub-section 99 (other receipts).

Article 2. This Decision shall take effect 15 days after its publication in the Official Gazette. All provisions and guidelines concerning the State Budget Classification that conflict with this Decision shall be abolished.

Article 3. Ministries, ministerial-level agencies, government agencies, central-level mass organizations, and People's Committees of provinces and centrally-administered cities are responsible for directing, implementing, and guiding subordinate units to comply with this Decision.

Article 4. The Director of the State Budget Department, the Head of the Ministry of Finance’s General Office, and the Heads of units under the Ministry of Finance are responsible for guiding and organizing the implementation of this Decision./.
