GUIDELINES FOR IMPLEMENTATION OF THE GOVERNMENT DECREE NO. 123/2003/NĐ-CP OF OCTOBER 22, 2003 ON STANDARDS OF MATERIALS FOR MILITARY PERSONNEL IN SERVICE

To implement Government Decree No. 123/2003/NĐ-CP dated October 22, 2003 on standards of materials for military personnel in service (hereinafter referred to as Decree No. 123/2003/NĐ-CP), the Ministry of National Defense, the Ministry of Finance, and the Ministry of Planning and Investment provide specific guidelines on the food standards for non-commissioned officers and soldiers of the infantry and the progress in implementing certain material standards as follows:

I. FOOD STANDARDS FOR NON-COMMISSIONED OFFICERS AND SOLDIERS OF THE INFANTRY

The food standards for non-commissioned officers and soldiers of the infantry specified in Clause 1, Article 3 of Decree No. 123/2003/NĐ-CP are detailed in the table below:

II. PROGRESS IN IMPLEMENTING MATERIAL STANDARDS

1. Based on the provisions of Decree No. 123/2003/NĐ-CP and the guidance provided in this Circular, the Ministry of Finance and the Ministry of Planning and Investment will develop plans to ensure the budget for the Ministry of National Defense to organize the implementation of material standards according to the following schedule:

a. In the two years 2006-2007, supplement the budget to ensure sufficient food expenses according to the prescribed standards for the relevant groups.

b. In 2006, supplement the remaining budget for the following standards: equipment for catering by 55%; combat supplies by 45%; medical supplies such as drugs, bandages, chemicals by 55%; hygiene expenses by 55%; medical uniforms by 45%; clean water supply for daily use by 50%; electricity for daily use, work, and other tasks by 50%.

Supplement 100% of the remaining budget to ensure sufficient standards for regular uniforms for officers, non-commissioned officers, and soldiers; and uniforms for special duties.

c. In 2007, continue to supplement the remaining budget to ensure sufficient standards as stipulated in Decree No. 123/2003/NĐ-CP including equipment for catering; combat supplies; medical supplies such as drugs, bandages, chemicals; hygiene expenses; medical uniforms; clean water supply for daily use and electricity for daily use, work, and other tasks.

d. From 2006 to 2010 (5 years), gradually increase the budget for medical equipment and tools; business equipment to meet the prescribed standards by 2011.

e. Construction funds for barracks (residential buildings, office buildings, public facilities, and other auxiliary works) will be allocated in the budget to be implemented from 2006 to 2016 (11 years) and may be extended for some additional years depending on the state budget's capacity to ensure funding.

2. Based on the schedule and annual budget assurance plan, the Ministry of National Defense will specify the implementation details within the military and direct units to promptly ensure the standards and regulations for the relevant groups and units. For standards and quotas defined in monetary terms, when market prices of goods fluctuate upwards, the Ministry of National Defense will study adjustments accordingly and report to the State for timely supplementary budget allocation.

III. EFFECTIVE DATE OF IMPLEMENTATION

1. This Circular takes effect 15 days after its publication in the Official Gazette. All previous regulations that conflict with this Circular are hereby abolished.

2. During the process of implementation, if there are any difficulties, units should promptly reflect them to the Ministry of National Defense for unified resolution with the Ministry of Finance and the Ministry of Planning and Investment.
