Considering the proposal of the Minister of Culture, Sports and Tourism,
DECISION:
Article 1. The organization of fireworks displays on Tet Festival and some national and local commemorative days shall be as follows:
1. Annual organization:
a) Tet Festival: - Fireworks of high altitude, duration of 15 minutes at five points in Hanoi Capital, four points in Ho Chi Minh City, and two points in central provinces and cities: Hai Phong, Thua Thien Hue, Da Nang, Can Tho; - Fireworks of low altitude, duration of 15 minutes at two points in other provinces; - Time of fireworks display: from 00:00 to 00:15 on the first day of Tet Festival.
b) Day of Ancestral Commemoration (the 10th day of the third lunar month): - Fireworks of low altitude, duration of 15 minutes at two points in Hung Temple and Viet Tri city, Phu Tho province; - Time of fireworks display: from 21:00 to 21:15 on the 9th day of the third lunar month.
2. Five-yearly organization once every five years and ten years:
a) National Day (September 2): - Fireworks of high altitude, duration of 15 minutes at five points in Hanoi Capital, four points in Ho Chi Minh City, and two points in central provinces and cities: Hai Phong, Thua Thien Hue, Da Nang, Can Tho; - Fireworks of low altitude, duration of 15 minutes at two points in other provinces; - Time of fireworks display: from 21:00 to 21:15 on September 2.
b) Victory Day of Dien Bien Phu (May 7): - Fireworks of low altitude, duration of 15 minutes at two points in Dien Bien Phu city, Dien Bien province; - Time of fireworks display: from 21:00 to 21:15 on May 7.
c) Reunification Day (April 30): - Fireworks of high altitude, duration of 15 minutes at five points in Hanoi Capital, four points in Ho Chi Minh City; - Time of fireworks display: from 21:00 to 21:15 on April 30.
3. Ten-yearly organization once every ten years: On the liberation day of Hanoi Capital, Hai Phong city, and central provinces and cities from Quang Tri southward. - Fireworks of high altitude, duration of 15 minutes at two points in Hanoi Capital, one point in central provinces and cities: Hai Phong, Thua Thien Hue, Da Nang, Can Tho; - Fireworks of low altitude, duration of 15 minutes at one point in other provinces from Quang Tri southward; - Time of fireworks display: from 21:00 to 21:15 on the day of liberation of each locality.
4. Form and quantity of fireworks to be displayed:
a) High-altitude fireworks: each display point uses 500 firework shells;
b) Low-altitude fireworks: each display point uses 45 firework sets.
Article 2. The organization of fireworks displays on the anniversary of the founding of provinces and centrally-administered cities (once every ten years on even-numbered years) and cultural, tourism, and sports festivals of national, regional, and international significance shall be as follows:
1. Registration procedures: Provinces and centrally-administered cities wishing to organize fireworks displays for these events must submit registration documents to the Ministry of Culture, Sports and Tourism at least 45 days in advance. The registration document must clearly state the form, quantity, number of points, time, duration, and proposed location of the fireworks display. Within seven working days from the date of receipt of the registration document, the Ministry of Culture, Sports and Tourism will study and provide clear opinions on each specific case (whether to hold fireworks or not) and report
Clause 2. Implementation principles:
a) The organization of fireworks as stipulated in this Article must be
b) The form and quantity of fireworks to be displayed for the events stipulated in Article 2 shall be implemented according to the provisions of point b, Clause 4, Article 1 of this Decision;
c) The funding for the organization of fireworks as stipulated in this Article shall be arranged by the locality itself and shall not be sourced from the State budget.
Article 3. State Management of Firework Production, Storage, Transportation, and Shooting Nationwide
1. The state shall uniformly manage the organization of fireworks production, storage, transportation, and shooting throughout the country.
2. The organization of fireworks production, storage, transportation, and shooting (both high and low altitude) must ensure safety, economy, artistic quality, and meet the public's appreciation needs.
3. Strictly prohibit the production, import, trade, storage, transportation, and use of other types of firecrackers.
Article 4. Allocation of Responsibilities for Implementation
1. Ministry of Culture and Information:
a) Take the lead and coordinate with relevant agencies to organize guidance on implementing this Decision;
b) Monitor and inspect local organizations' implementation of fireworks shooting to draw lessons, compile situations, and propose recommendations;
c) Receive registration documents for fireworks shooting and implement according to Clause 1, Article 2 of this Decision, and submit them;
2. Ministry of National Defense:
a) Is the sole entity responsible for producing fireworks shells and equipment; storing and transporting; organizing command and technical training for fireworks shooting nationwide;
b) Based on local fireworks shooting plans, proactively organize safe production of various types of fireworks, ensuring quality, quantity, and reasonable costs;
c) Organize direction and guidance for related defense units to prepare manpower, technical equipment, and equipment to cooperate with localities in properly organizing fireworks shooting as stipulated and settle accounts with each locality that organizes fireworks shooting;
d) Issue permits for transporting fireworks and shooting equipment.
3. Ministry of Finance: guide the use of local budgets and mobilization of legitimate funding sources (other than state budget) to organize fireworks shooting as stipulated in this Decision.
4. Ministry of Public Security: direct units within the sector to organize effective security and order during fireworks shooting, implement strict measures to prohibit the burning of explosive firecrackers and other types of firecrackers causing disorder, security issues, and environmental pollution.
5. Provincial People's Committees under the central government:
a) Lead and coordinate with relevant agencies to organize effective fireworks shooting, ensuring order, security, safety, and economy;
b) Ensure funding for local fireworks shooting organization in accordance with current laws;
c) Be responsible for strictly managing and complying with regulations regarding the form, quantity, number of points, time, duration, and location of fireworks shooting. Report the results of implementation to the Ministry of Culture and Information for compilation and reporting;
d) In cases where changes to the form, quantity, number of points, time, duration, and location of fireworks shooting differ from the provisions of Clauses 1, 2, and 3, Article 1 of this Decision, the Chairman of the People's Committee of provinces and centrally-administered cities must submit documents for approval;
6. Vietnam Television, Voice of Vietnam Radio: organize announcements and live broadcasts of fireworks shooting events specified in Clauses 1 and 2, Article 1 of this Decision to serve the people nationwide.
Article 5. Effective Date
This Decision takes effect 15 days after its publication in the Official Gazette. This Decision replaces Decision No. 23/2002/QĐ-TTg dated January 31, 2002, concerning the organization of fireworks shooting during Tet and some national anniversaries, and Decision No. 225/2003/QĐ-TTg dated November 5, 2003, amending and supplementing certain articles of Decision No. 23/2002/QĐ-TTg.
Article 6. Responsibility for Implementation
1. The Minister of Culture and Information shall check and resolve any difficulties arising during implementation. If there are issues exceeding authority, they must be reported.
2. Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decision./.
