THE MINISTER OF PLANNING AND INVESTMENT

Pursuant to the Enterprise Law issued on June 12, 1999.

Pursuant to the Government Decree No. 02/2000/NĐ-CP dated February 3, 2000 on business registration;

Pursuant to the Government Decree No. 75/CP dated November 1, 1995 on the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;

Considering the proposal of the Director of the General Office of the Ministry, the Head of the Cadre and Civil Servant Department, and the Head of the Department of Enterprises.

DECISION:

Article 1. The Enterprise Information Center under the Department of Enterprises of the Ministry of Planning and Investment shall be established.

Article 2. The Enterprise Information Center shall have the following tasks, powers, and responsibilities:

1. Building and managing the enterprise information system nationwide, initially focusing on building the enterprise information system in accordance with the Enterprise Law.

2. Regularly providing enterprise information to relevant agencies of the Party and State. Providing enterprise information to organizations and individuals upon request and charging fees as prescribed.

3. Collecting necessary information related to enterprise activities to provide supportive information for enterprises.

4. Guiding business registration procedures and building and managing the enterprise information system for local Departments of Planning and Investment's Business Registration Offices.

5. Advising the Ministry to issue, within its authority, specialized and procedural documents, forms, and regulations for business registration work, reporting systems, and compliance checks on reporting in business registration.

6. Announcing information on enterprise establishment, dissolution, bankruptcy, changes in business registration content, and legal information in business operations.

7. Engaging with domestic and foreign organizations, receiving assistance from sponsors to implement the construction and management of the enterprise information system.

Article 3. The Enterprise Information Center is an organization at the department level, allowed to open accounts at the Treasury and Bank according to current regulations; it may use its own seal for transactions.

- The Enterprise Information Center shall be headed by a Deputy Head of the Department of Enterprises concurrently serving as Director, assisted by a Deputy Director.

- The staffing of the Enterprise Information Center is included in the staffing of the Department of Enterprises, decided by the Minister.

- The operating funds of the Enterprise Information Center shall be provided from the state budget, revenue from service fees for information provision, and other sources.

Article 4. The Directors of the General Office of the Ministry, the Cadre and Civil Servant Department, the Department of Enterprises, the Director of the Enterprise Information Center, and related units shall implement this Decision.

This Decision replaces Decision No. 453/QĐ-BKH dated September 11, 2000 of the Minister of the Ministry of Planning and Investment regarding the establishment of the Enterprise Information Center under the Department of Enterprises and shall take effect from the date of issuance.
