Article 1. Position and Functions
1. The permanent office in Ho Chi Minh City is an organization under the Ministry of Home Affairs with the function of advising the Minister to monitor and compile the situation of implementing the tasks of the Ministry of Home Affairs in the southern region; and it serves as the representative office of the Ministry of Home Affairs for activities according to the program and work plan of the Ministry, the Office of the Ministry, and organizations under the Ministry.
2. The permanent office in Ho Chi Minh City has legal personality, has its own seal, and is entitled to open an account at the state treasury.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Monitor and compile the situation of implementing tasks related to the field of civil service organization work within the assigned area, including:
a) Report to the Minister regularly or urgently on developments in the region;
b) Serve as the contact point to help organizations under the Ministry gather information, suggestions, and difficulties of agencies and localities in the southern region related to the functions, tasks, and authority of the Ministry to report to the Minister for consideration and direction to resolve;
c) Participate in providing opinions with organizations under the Ministry in proposing guidelines and measures to direct the implementation of work related to the region in accordance with the actual circumstances, promptly identify new issues to report to the Minister for guidance;
d) Attend meetings convened by ministries and sectors in the South. Be responsible for grasping the situation and reporting back to the Ministry on the conclusions of the meetings when there is no representative from the Ministry's leadership or functional units of the Ministry present.
2. Assist the Office of the Ministry in performing tasks:
Organize the implementation of tasks of the Office of the Ministry in the region according to the directives of the Director of the Office of the Ministry;
b) Perform logistical support well and prepare necessary conditions to organize conferences, seminars, training sessions... of the Ministry held in the region;
c) Serve the Ministry's leadership, leadership, officials, and staff of organizations under the Ministry and guests of the Ministry according to the work program and plan approved by the Minister when working in the southern region (reception, accommodation arrangements, transportation, work facilitation...);
d) Perform other tasks as directed by the Minister and requested by the Director of the Office of the Ministry.
3. According to the directive of the Department Head of the Local Administration Department, organize and implement activities related to building local administration in southern provinces and cities as assigned by the Minister, including:
a) Guide localities in preparing files and procedures for establishing new, merging, dissolving, splitting, adjusting, upgrading administrative units below provincial level and compile the situation of territorial boundary disputes in the southern region. Conduct field surveys according to the directive of the Minister and guidance of the Department Head of the Local Administration Department to prepare reports and propose solutions;
b) Monitor the progress of implementing the election of National Assembly deputies, People's Council deputies, and the process of electing members of the People's Committee to report to the Minister and send to the Local Administration Department for comprehensive compilation;
c) Verify personnel files of candidates for People's Committee member positions as assigned by the Minister for the Local Administration Department to compile and process according to regulations;
d) Attend sessions of the People's Council, meetings of the Provincial People's Committee when assigned by the Ministry's leadership; compile and report to the Minister the contents of the sessions and meetings, and inform the Local Administration Department of relevant contents for compilation;
đ) Monitor the implementation of grassroots cadre policies and grassroots democracy regulations in the southern region, report to the Minister and inform the Local Administration Department of emerging issues for handling and resolution;
e) Coordinate with the Local Administration Department to organize training and capacity-building classes for grassroots cadres and civil servants as assigned by the Minister;
f) Cooperate with the Organization Departments of Provinces in the southern region to monitor, exchange, and grasp the operation of local administrations at all levels to provide information to the Ministry's leadership, the Local Administration Department, and related units of the Ministry;
g) Perform specific tasks as assigned by the Minister and coordinated by the Local Administration Department.
4. Assist the Civil Service and Cadre Department and other organizations under the Ministry in performing tasks:
a) Coordinate and assist the Civil Service and Cadre Department in monitoring and compiling the situation of the cadre and civil servant workforce of the Organization Departments in the region to serve the development of the civil service sector;
b) Coordinate and assist the Civil Service and Cadre Department and units under the Ministry in organizing training and capacity-building classes for civil servants in the civil service sector; training and capacity-building classes for national civil servants organized by the Ministry in the assigned region;
c) Perform specific tasks as assigned by the Minister and coordinated by the Department Head of the Civil Service and Cadre Department and heads of organizations under the Ministry;
d) Coordinate and assist the Inspector General of the Ministry of Home Affairs in conducting specialized inspections of civil service and cadre affairs and resolving complaints and grievances according to the directive of the Inspector General of the Ministry.
5. Implement statistical compilation, build information databases in the region regarding the number of administrative units; the number and quality of People's Council deputies, members of the People's Committee at various levels, grassroots cadres and civil servants, etc., to coordinate with the Local Administration Department to compile and report to the Minister periodically. Apply information technology in professional work; coordinate with the Information Technology Center to apply information technology in managing, exploiting, and using information databases to serve leadership and management of the Ministry.
6. Take the lead or participate in scientific research, and participate in professional training in fields of work assigned.
7. Perform other urgent tasks as assigned by the Minister.
Article 3. Organization and Working System
1. The permanent office in Ho Chi Minh City has a Department Head - in charge of the office, Deputy Department Heads, and other officials, civil servants, and employees...
2. The Department Head - in charge of the office is responsible to the Minister for organizing the implementation of tasks stipulated in Article 2 and has specific duties and powers as follows:
a) Organize and direct the implementation of the tasks of the Permanent Agency and be responsible to the Minister for all aspects of the work of the Permanent Agency;
b) Assign tasks, monitor, urge, and inspect the performance of tasks by Deputy Department Heads and civil servants within the Permanent Agency;
c) When authorized by the Minister, sign on behalf of the Minister to respond, provide guidance, and request information provision within the scope of authority of the Permanent Agency;
d) Coordinate with organizations within the Ministry and related agencies in resolving issues related to the functions, tasks, and powers of the Permanent Agency;
đ) Implement information work for civil servants in the Permanent Agency according to the working regulations of the Ministry;
e) Decide on the contents of reports, summaries, conclusions, and recommendations to the Minister regarding policies and solutions in the implementation of tasks of the Permanent Agency;
f) Organize the implementation of the regulations of the Ministry; manage civil servants and assets assigned according to the classification of the Ministry;
3. Implement the financial accounting management system of the state. Report and settle accounts with the Ministry's Office in accordance with the guidelines and specified timeframes.
4. Deputy Department Heads perform specialized tasks and are responsible to the Department Head for the tasks assigned.
5. Civil servants carry out specialized tasks assigned by the Department Head and are responsible to the Department Head for the execution of those tasks.
6. The Permanent Agency operates under a chief executive system combined with a specialist system; in cases where Ministry leadership directly works with Deputy Department Heads or specialists, Deputy Department Heads and specialists are responsible for implementing the opinions of Ministry leadership and promptly reporting back to the Department Head - Head of the Permanent Agency.
7. The Department Head - Head of the Permanent Agency leads and coordinates with the Department Head of the Cadre and Civil Servant Organization Department, the Director of the Ministry's Office, and the Department Head of the Local Administration Department to develop specific regulations detailing the coordination mechanism regarding operational systems, professional work direction, organization and staffing, personnel management systems, financial management, asset management, etc., of the Permanent Agency in Ho Chi Minh City, submit them to the Minister for approval, and organize their implementation.
Article 4. Effectiveness and Responsibility for Implementation
1. This Decision takes effect 15 days from the date of signature.
2. The Director of the Ministry's Office, the Department Head of the Cadre and Civil Servant Organization Department, the Department Head of the Local Administration Department, the Department Head - Head of the Permanent Agency in Ho Chi Minh City, heads of organizations and civil servants related to the Ministry are responsible for implementing this Decision./.
