Regulations on the system, policies, and support work for organizations and individuals performing the mission of searching for and collecting the remains of烈士

Clause 1. Individuals awarded the Commendation Medal shall receive the Decision and Certificate of Recognition for the "Commendation Medal for the Development of Vietnam's Transport Industry" and be recorded in the traditional golden book of the Vietnam Transport Industry. Article 1. The Prime Minister promulgates this Decision to regulate the system, policies, and support work for organizations and individuals performing the mission of searching for and collecting the remains of烈士 within and outside the country.

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 31/2013/NĐ-CP dated April 9, 2013 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Those Who Have Contributed to the Revolution.

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 on salary systems for cadres, civil servants, public officials, and armed forces personnel;

"Based on the proposal of the Minister of National Defense;"

The Government issues this Decision to regulate certain allowances, subsidies, supplements, material standards, and logistical support for individuals engaged in the mission of searching for and collecting the remains of烈士, as well as policies for related individuals; ensuring equipment, means, materials, and financial support for the mission of searching for and collecting the remains of烈士 both domestically and abroad.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. Officers, professional military personnel, non-commissioned officers, soldiers, and defense workers under the establishment of specialized teams directly performing the mission of searching for and collecting the remains of烈士 (hereinafter referred to as search and collection teams) both domestically and abroad.

Article 2. Applicability

b) Steering Committees, Special Task Forces, and Specialized Commissions; Offices and permanent agencies at various levels for searching for and collecting the remains of烈士;

2. Organizations directly directing and implementing the search and collection of remains of revolutionary soldiers include:

a) Search and collection teams performing tasks both domestically and abroad;

3. Individuals directly mobilized by competent authorities to search for and collect the remains of烈士 (guides, protectors, participants in direct search and collection activities); individuals providing information about烈士; relatives or worshippers of烈士 seeking烈士's graves.

c) Military units tasked with collecting and completing files on revolutionary soldiers, soldier graves; welcoming relatives of revolutionary soldiers.

4. Members of Steering Committees, Special Task Forces, and Specialized Commissions at various levels for searching for and collecting the remains of烈士.

Article 3. System and policies for subjects under the establishment of search and collection teams both domestically and abroad

Chapter II

REGIME, POLICIES AND SUPPORT

Subjects specified in Clause 1, Article 2 of this Decision, during the period of directly performing the mission of searching for and collecting the remains of烈士, in addition to salary, allowances, and other benefits as prescribed, shall also enjoy the following systems and policies:

1. When performing tasks abroad

a) Allowance equal to 100% of the current rank-based salary or grade level plus leadership position allowance and seniority allowance exceeding the standard range (if applicable) for those receiving salaries or rank-based allowances for non-commissioned officers and soldiers;

b) Regional allowance: Level 1.0 compared to the basic salary;

c) Responsibility allowance: Level 0.5 compared to the basic salary;

d) Direct mission performance allowance for surveying, exhumation, and collection of烈士remains: VND 220,000 per person per actual working day. During the mission period, if receiving performance allowance, travel expenses will not be provided;

đ) Health allowance: VND 280,000 per person (not more than twice a year);

e) Additional food allowance equivalent to the basic food allowance for non-commissioned officers and soldiers of the infantry;

g) Support for learning Lao and Cambodian languages: VND 500,000 per person per year (duration not exceeding three years);

h) Provision of specialized uniforms in kind (Annex I attached);

i) If injured or ill and treated at medical facilities in the host country, hospitalization fees and transportation costs will be reimbursed.

2. When performing tasks domestically

a) Responsibility allowance: Level 0.5 compared to the basic salary;

b) Direct mission performance allowance for surveying, exhumation, and collection of烈士remains: VND 100,000 per person per actual working day. During the mission period, if receiving performance allowance, travel expenses will not be provided;

c) Health allowance: VND 280,000 per person (not more than twice a year);

d) Additional food allowance equivalent to the basic food allowance for non-commissioned officers and soldiers of the infantry;

đ) Provision of specialized uniforms in kind (Annex I attached).

Article 4. Treatment and policies for members of the Steering Committee, Special Task Force, and specialized committees at all levels

The objects specified in Clause 4, Article 2 of this Decision, during the time directly performing tasks to direct the search and collection of烈士遗骸,除工资、补贴和其他规定制度外,还享受以下待遇和政策:

1. Living expenses allowance

a) A rate of 220,000 VND/person/day when actually inspecting and directing the search and collection of烈士遗骸in foreign countries;

b) A rate of 100,000 VND/person/day when actually inspecting and directing the search and collection of烈士遗骸in domestic areas.

If the living expenses allowance is enjoyed, then the lodging subsidy stipulated for civil servants on domestic business trips shall not be enjoyed.

2. Other allowances

a) When performing tasks to direct the search and collection of烈士遗骸in foreign countries, they enjoy the work expense allowance stipulated for state cadres and civil servants on overseas business trips;

b) In cases where injuries or illnesses require treatment at medical facilities in friendly countries, hospitalization fees and transportation costs will be reimbursed.

Article 5. Treatment and policies for individuals directly mobilized to search and collect烈士遗骸;persons providing information about martyrs; support for relatives or persons worshipping martyrs to find their graves

1. Individuals directly mobilized to search and collect烈士遗骸(guides, guards; those directly participating in search and collection activities)enjoy the following treatment and policies:

a) A rate of 220,000 VND/person/day when actually mobilized to search and collect烈士遗骸in foreign countries; a rate of 100,000 VND/person/day when actually mobilized to search and collect烈士遗骸in domestic areas;

b) Guaranteed food expenses equivalent to twice the basic food allowance for infantry non-commissioned officers and soldiers;

c) Provided with funds to purchase special uniforms if they directly participate in searching and collecting烈士遗骸for more than three months;

d) Arranged with travel means or travel expenses reimbursed according to regulations for civil servants on business trips;

e) In cases where injuries or illnesses require treatment at medical facilities, hospitalization fees and transportation costs will be reimbursed.

2. Persons providing information about martyrs enjoy the following allowances:

a) A bonus of 2,000,000 VND for accurate information leading to the discovery and collection of at least one烈士遗骸;

b) Those with outstanding achievements will be commended according to regulations.

3. Relatives or persons worshipping martyrs who go to find their graves enjoy the following allowances:

a) Relatives of martyrs or persons worshipping martyrs who go to find their graves, not falling under the provisions of Clause 1, Article 64 of Decree No. 31/2013/ND-CP dated April 9, 2013 of the Government detailing and guiding the implementation of certain articles of the Ordinance on Preferential Treatment for Persons Contributing to the Revolution (hereinafter referred to as Decree No. 31/2013/ND-CP), are supported with travel expenses and food expenses when visiting units and localities (where the martyr worked or fought), with a maximum of three people per year;

b) The level of support is implemented according to the provisions of Clause 1, Article 64 of Decree No. 31/2013/ND-CP.

Article 6. Guarantee for search and collection teams operating within the country and abroad

1. Search and collection teams performing tasks within the country and abroad shall be guaranteed:

a) Special equipment, means of transportation, logistics, and living conditions (Annex II attached);

đ) Cost for repair and replacement of automobile parts at 40,000,000 VND/car/year;

e) Support cost for special task teams and provincial task forces of the host country for farewell ceremonies for remains of revolutionary soldiers at 30,000,000 VND/time, not exceeding two times/year;

d) Costs for exhuming martyrs' graves with remains at a rate of 600,000 VND per grave;

h) Cost for purchasing common medicines at 20,000,000 VND/team/year (excluding medicines supplied by the Ministry of Defense under regulations);

e) Support costs for the Special Task Force Committee and the Provincial Special Responsibility Committee when conducting farewell ceremonies for martyrs' remains at a rate of 30,000,000 VND per ceremony, not exceeding two times per year;

g) Support costs for mobilizing the people of the host country at a rate of 20,000,000 VND per team per year;

h) Costs for purchasing common medicines for prevention and treatment at a rate of 10,000,000 VND per team per year (excluding medicines provided by the Ministry of National Defense according to regulations);

i) Costs for purchasing diplomatic gifts when traveling to the host country to coordinate task implementation at a rate of 20,000,000 VND per occasion, not exceeding two times per team per year for each province of the host country;

k) Costs for hospital fees, patient transportation; purchasing water filtration equipment; passport fees, other fees; renting means of transportation, compensating damages to infrastructure, trees, crops (if any) during the performance of duties.

2. The standard for fuel cost guarantees stipulated in Point b and the contents of Point k Clause 1 of this Article shall be annually budgeted and settled by the Ministry of National Defense, in collaboration with the Ministry of Finance, in accordance with regulations.

Article 7. Guarantee for expenditures related to the activities of the Steering Committee, Special Task Force Committee, Special Responsibility Commission; Office, permanent bodies at various levels for searching and collecting martyrs' remains and military units assigned tasks to collect, complete烈士遗骸搜寻和收集工作的各级指导委员会、特别工作组委员会、专门委员会;办公室、常设机构以及负责收集烈士信息、完善烈士档案和烈士墓档案、迎接烈士亲属的单位的活动经费保障。

1. The Steering Committee; Special Task Force Committee, and Special Responsibility Committees at all levels shall be guaranteed:

a) Costs for serving delegations leaving and welcoming delegations arriving for negotiation and signing;

b) Support costs for the Government's Special Task Force Committee, the Special Task Force Committee of provinces in Laos, the Government's Special Responsibility Committee, the Special Responsibility Committee of military regions and provinces in Cambodia, and other foreign agencies approved by the Prime Minister to organize coordinated activities for searching and collecting martyrs' remains;

c) Costs for preliminary and final summary meetings; commendation;

d) Support costs for propaganda activities.

2. Offices, permanent bodies, and specialized agencies at all levels shall be guaranteed:

a) Equipment and means of transportation (Annex III attached);

b) Costs for organizing information collection, processing, building, and perfecting documentation and data on martyrs and their graves; decoding unit symbols and emblems; mapping search and collection operations for martyrs' remains;

c) Costs for publishing publications; maintaining public service activities related to searching and collecting martyrs' remains on the Electronic Information Portal;

d) Costs for fuel, materials, and uniforms;

đ) Costs for organizing memorial services, handover, and burial of martyrs' remains.

3. Support costs for units and localities in organizing information collection, perfecting documentation and files on martyrs and their graves; handing over grave records; supporting relatives or worshippers of martyrs in searching for martyrs' graves.

4. The standards for the costs specified in Clauses 1, 2, and 3 of this Article shall be annually budgeted by the Ministry of National Defense, in collaboration with the Ministry of Finance, in accordance with current regulations.

Chapter III

IMPLEMENTING PROVISIONS

Article 8. Principles of Application

1. The regimes prescribed in Points a, b, and c Clause 1 and Point a Clause 2 Article 3 of this Decision shall be paid together with the monthly salary and shall not be used to calculate contributions or benefits under social insurance and health insurance schemes.

2. The subjects specified in Clause 1 and 4 Article 2 of this Decision shall cease to enjoy the regimes prescribed in Articles 3 and 4 of this Decision when they are not performing the mission of searching for and collecting烈士遗骸。

Article 9. Sources of Funding for Implementation

1. The funds for implementing the regimes, policies, and support work stipulated in this Decision shall be guaranteed from the state budget in accordance with the laws on the state budget.

2. Annually, the Ministry of National Defense shall base on its tasks and prepare the budget estimate for implementation within the state budget draft to be submitted to the Ministry of Finance for consolidation and presentation to the Prime Minister for decision.

3. In addition to the allocated funds, localities and units are encouraged to allocate additional funds in accordance with the law to carry out the work of searching for and collecting烈士遗骸。

Article 10. Effective Date

1. This Decision shall take effect from February 1, 2014.

2. Abolish the regimes and policies for organizations and individuals performing the mission of searching for and collecting烈士遗骸as prescribed in previous documents from the date this Decision takes effect.

Article 11. Responsibility for Implementation

1. The Ministry of National Defense and the Ministry of Finance shall provide guidance on the implementation of this Decision.

2. Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decision./.
