and uniforms, insignia of railway protection forces

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Railway Law dated June 16, 2017;

At the proposal of the Minister of Transportn lThe Governor of the State Bank of Vietnam issues a Circular amending and supplementing certain legal normative documents concerning administrative procedures and formalities in the field of foreign exchange management.”

The Government issues this Decree to stipulate the organization, tasks, powers, and uniforms, insignia of railway protection forces.on organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP This Decree stipulates the organization, tasks, powers, and uniforms, insignia of railway protection forces operating on national railway networks. bThis Decree applies to railway transport enterprises operating on national railway networks and organizations and individuals related to railway protection activities.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Chapter II

Article 3. Organization of railway protection forces

Section 1

Clause 1. Railway protection forces shall be established by railway transport enterprises to perform protection duties on trains.

Clause 2. Direct protection forces on trains shall be organized into Teams and Protection Groups suitable for the scale and characteristics of production and business operations of the enterprise.

Article 4. Standards for train protection personnel

Members of Teams and Protection Groups directly performing protection duties on trains must meet the following standards:

Point 1. They must be Vietnamese citizens aged 18 or older, with a high school education or higher, and in good health to carry out train protection duties.

Point 2. They must have completed professional training for train protection and hold a certificate issued by the competent authority.

Point 3. They must have been trained in railway traffic safety procedures organized by the railway transport enterprise.

TASKS AND POWERS OF RAILWAY PROTECTION FORCES

Article 5. Tasks of railway protection forces

Section 2

Point 1. Develop plans and propose measures to ensure security and order on trains to railway transport enterprises.

Point 2. Implement professional measures to detect, prevent, and stop the following actions:

a) Threatening train safety;

b) Throwing objects from trains;

c) Damaging train equipment, causing dirtiness on trains;

d) Disrupting public order on trains;

đ) Threatening the health and lives of passengers and train personnel;

e) Stealing passengers' property, railway personnel's property, goods, and luggage transported on trains;

g) Violations of laws concerning fire prevention and explosion control on trains;

h) Other violations of the law occurring on trains.

Point 3. Coordinate with relevant agencies and forces in carrying out the following tasks:

a) In disseminating, popularizing, and educating the law to freight customers and train passengers. Guide freight customers and train passengers to participate in protecting security and order on trains;

b) In understanding the situation of security, order, and social safety on railway lines where trains operate;

c) In detecting and handling bombs, mines, biological, chemical weapons, radioactive materials, and dangerous items in luggage, goods, and mail transported on trains;

d) In controlling passenger boarding and alighting; in handling fire and explosion incidents, terrorism, smuggling, and commercial fraud on trains; in organizing medical assistance for injured persons on trains;

đ) Assist the Train Manager in exercising administrative detention powers on trains;

e) In resolving and mitigating natural disasters and railway traffic accidents;

g) In preventing and handling other violations occurring on trains.

e) In the handling and resolution of natural disaster incidents and railway traffic accidents;

g) In the prevention and handling of other violations occurring on board the train.

Article 6. Powers of Railway Security Forces on Board

1. Inspect, urge, and remind passengers and freight transporters to comply with laws and regulations concerning railway traffic safety and internal rules of the enterprise.

2. Control boarding and alighting of passengers, inspect goods and luggage transported on board. In case of discovering violations of law or internal rules, immediately report to the Train Manager for investigation and handling according to the law.

3. Arrest offenders caught in the act of committing crimes and immediately report to the Train Manager to record the violation and hand over to the police, prosecution office, or People's Committee when the train stops at the nearest station for legal processing. If there are police forces performing duties on board, hand over to the police force for handling.

4. Participate in verifying incidents occurring on board upon request of railway transportation enterprises or competent authorities.

5. Shall not abuse the name of Railway Security Forces to commit illegal acts or infringe upon the legitimate interests of organizations or individuals.

Article 7. Benefits and Policies

Railway Security Forces on Board shall enjoy the following benefits and policies:

1. Training and professional development in security work and technical skills related to their assigned tasks.

2. Being equipped with support tools as prescribed by law and various types of equipment, uniforms, badges, insignia, identification cards, and signs as stipulated in this Decree to perform assigned tasks.

3. In case of injury or death while performing duties, they may be recognized and entitled to benefits similar to those of war invalids or martyrs under the law on preferential treatment for persons who have contributed to the revolution, and other forms of commendation and reward according to the law on competition and rewards.

Section 3

TRAINING, ENHANCEMENT, AND REFRESHER COURSES FOR RAILWAY SECURITY FORCES ON BOARD

Article 8. Training Programs for Railway Security Forces on Board

1. The training program includes the following:

a) Theory: Training on necessary legal knowledge for ensuring security and order for Railway Security Forces on Board; security and order operations; propaganda and mobilization of public participation in security and order maintenance; understanding the situation of security and order in railway transportation activities; fire prevention and firefighting operations of Railway Security Forces on Board; management and use of support tools; procedures for checking personal documents, luggage, and goods when discovering law violations on board;

b) Practice: Training basic martial arts movements, techniques for movement and communication on board using signs and signals.

2. Duration of training:

a) At least six working days for theory;

b) At least four working days for practice.

3. A model Certificate of Completion of Railway Security Training Program is specified in Appendix I attached to this Decree.

4. The Ministry of Public Security shall organize the development of training programs and contents, assign agencies to conduct training, issue Certificates of Completion of the training program, and organize Railway Security Training Programs according to the contents stipulated in Clause 1 and Clause 2 of this Article.

Article 9. Professional Training on Railway Traffic Safety

1. The content of training includes:

a) Theory: Law on Railways and related guiding documents concerning railway traffic safety management; regulations on passenger, luggage, and cargo transportation on railways; regulations on handling railway traffic accidents and incidents; administrative penalties for violations in railway transport; methods and conditions for using certain equipment on trains; procedures for railway staff operations on trains; national technical standards for railway operation; emergency and first aid procedures;

b) Practice: Practical exercises on trains based on the theoretical training received.

2. Duration of training:

a) At least six working days for theory;

b) At least two working days for practical training.

3. Professional training on railway traffic safety shall be organized and implemented by railway transport enterprises.

Article 10. Supplementary Training for Security Personnel on Trains

1. Every three years, railway transport enterprises that employ security personnel on trains shall cooperate with agencies designated by the Ministry of Public Security to organize supplementary review and update of knowledge related to security duties on trains and railway traffic safety for such personnel.

2. The duration and content of supplementary training shall be jointly decided by railway transport enterprises and relevant functional agencies.

Chapter III

UNIFORMS AND BADGES OF SECURITY PERSONNEL ON TRAINS

Article 11. Uniforms of Security Personnel on Trains

1. The uniforms of security personnel on trains include male and female uniforms consistent with regulations, comprising: shirts (spring-summer, autumn-winter), trousers, peaked caps, ties (cravats), belts, and other accessories (gloves, socks, shoes, raincoats).

2. Spring-summer shirt: Short-sleeved shirt with cuffs, standing collar, two chest pockets with flaps, shoulder straps for badge attachment, gray fabric.

3. Autumn-winter shirt:

a) Black blazer with two layers, four flap pockets, V-shaped collar, cuffs, shoulder straps for badge attachment, four buttons, plastic buttons matching the color of the blazer;

b) Long-sleeved shirt with standing collar, two chest pockets with flaps, shoulder straps for badge attachment, gray fabric;

c) Black waistcoat worn under the blazer.

4. Trousers: Black fabric, straight leg, moderate width, two side pockets.

5. Peaked cap: Top and visor black, brim and strap black, yellow piping around the top and visor, two yellow piping around the connection between the brim and visor.

6. Tie (cravat): Black.

7. Belt: Black leather with shiny metal buckle.

8. Document case: Black leather (or synthetic leather, fiber) with shoulder strap.

9. Shoes: Black leather, low-cut, lace-up.

10. Socks: Black.

11. Raincoat: Specialized trench coat style.

12. The uniform model for security personnel on trains is specified in Appendix II attached to this Decree.

Article 12. Emblem and Badge of Security Personnel on Trains

1. Emblem: A circle with inner diameter equal to 2/3 of the outer diameter, red background with a golden five-pointed star, below the star is the phrase "SECURITY ON TRAINS" in gold, surrounded by a dark blue background with two golden ears of rice. Below the phrase "SECURITY ON TRAINS" is a half wheel in gold, with the letters "DSVN" (abbreviation for Vietnam Railway) in black in the center of the wheel. The outer edge of the emblem is gold.

The emblem of security personnel on trains is attached to the peaked cap, and the badge is attached to the sleeve of the shirt and vest, and worn on the collar of the shirt:

a) The emblem on the peaked cap is circular, made of metal with an outer diameter of 35 mm, positioned centrally above the visor along with a white double-cypress branch measuring 54 mm high and 64 mm wide;

b) The emblem on the badge attached to the sleeve of the shirt and vest is embroidered with an outer diameter of 35 mm;

c) The emblem on the badge worn on the collar of the shirt is made of metal with an outer diameter of 18 mm.

2. Badges of security personnel on trains include badges attached to the sleeve of the shirt and vest, and worn on the collar of the shirt:

a) Badge attached to the left sleeve of the shirt and vest, 80 mm to 100 mm from the shoulder seam, shield shape, widest width 80 mm, highest height 100 mm, navy blue fabric, embroidered with the emblem of security personnel on trains, two ears of rice on either side in gold, gold border around the shield, upper part with the name of the railway transport enterprise managing the security personnel on trains in gold letters 5 mm high;

b) Badge worn on the collar of the shirt: Parallelogram with sides 55 mm x 35 mm, black background with the emblem of security personnel on trains attached.

3. Single cypress branch made of white metal worn on the collar of the vest.

4. Models of emblems, badges, and single cypress branches for security personnel on trains are specified in Appendix III attached to this Decree.

Article 13. Rank insignia for ship security forces

1. The rank insignia for ship security forces shall be provided to personnel directly engaged in ship security work and worn on both shoulders of their uniforms to distinguish the ranks of officers and staff members of the ship security forces.

The ranks of officers and staff members of ship security forces include: Security Officer, Security Team Leader, Deputy Security Team Leader, Security Team Leader.

2. The rank insignia shall be made of fabric, blackish blue in color, with dimensions of 120 mm in length, 50 mm wide at the outer edge, 40 mm wide at the inner edge, and a tip angle of 18 mm, surrounded by a yellow velvet border, with the following size and color specifications:

a) Rank insignia for the Security Team Leader: two horizontal stripes 10 mm wide made of yellow velvet, with a distance of 07 mm between the stripes, and two five-pointed gold stars in the middle, each star having a diameter of the circumscribed circle of 15 mm;

b) Rank insignia for the Deputy Security Team Leader: two horizontal stripes 10 mm wide made of yellow velvet, with a distance of 07 mm between the stripes, and one five-pointed gold star in the middle, each star having a diameter of the circumscribed circle of 15 mm;

c) Rank insignia for the Security Team Leader: one horizontal stripe 10 mm wide made of yellow velvet, and one five-pointed gold star in the middle, each star having a diameter of the circumscribed circle of 15 mm;

d) Rank insignia for the Security Officer: two V-shaped stripes 10 mm wide made of yellow velvet, with a distance of 07 mm between the stripes.

3. The model of rank insignia for ship security forces is specified in Appendix IV attached to this Decree.

Article 14. Nameplate for ship security forces

1. The nameplate for ship security forces shall be made of acrylic or hard plastic, measuring 50 mm x 84 mm, worn on the left chest of the uniform.

2. The upper part of the nameplate: dark blue background, 11 mm wide, with red letters in the middle indicating the name of the railway transport enterprise directly managing the officers and staff members of the ship security forces: height 05 mm, standing upright, complete with punctuation marks (if not long enough, abbreviations are allowed).

3. The lower part of the nameplate: white background, with a half-length photograph on the left side; on the right side, the name in deep sky blue letters, standing upright, complete with punctuation marks, height 07 mm. Below the line of the name is the position, standing upright, complete with punctuation marks, height 05 mm. Below the line of the position is the identification number and serial number of the officer or staff member.

4. The model of the nameplate for ship security forces is specified in Appendix V attached to this Decree.

Article 15. Issuance and use of equipment, uniforms, badges, rank insignia, and nameplates for ship security forces

1. The issuance of equipment, uniforms, badges, rank insignia, and nameplates for ship security forces shall be decided by the railway transport business enterprise based on specific operational conditions.

2. Personnel directly engaged in ship security work have the responsibility to:

a) Wear uniforms, badges, rank insignia, and nameplates as prescribed when performing duties;

b) Maintain and preserve all types of equipment, uniforms, badges, rank insignia, and nameplates;

c) Report immediately to the head of the enterprise if lost or damaged, and bear responsibility if consequences occur;

d) Strictly prohibit lending out and using equipment, uniforms, badges, rank insignia, and nameplates for purposes other than those intended for ship security work;

đ) Ship security forces shall be equipped with walkie-talkies, cameras, audio recorders, cameras, flashlights, and other necessary devices for ship security work.

Article 16. Funding for the activities of security forces on trains

1. The funding for the activities of security forces on trains shall be included in the business expenses of enterprises.

2. Legal sponsorship and support from organizations and individuals.

Chapter IV

RESPONSIBILITIES OF AUTHORITIES AND ORGANIZATIONS TOWARDS SECURITY FORCES ON TRAINS

Article 17. Responsibilities of the Ministry of Public Security

1. Directing competent agencies of the Ministry of Public Security to cooperate with railway transport enterprises in developing plans for organizing training and regular refresher courses for security forces on trains.

2. Taking the lead in implementing training and regular refresher courses for security forces on trains according to the plan agreed upon with railway transport enterprises.

3. Directing, inspecting, guiding the development of training programs and contents, organizing training, issuing Certificates of Completion of Security Training Courses on Trains, managing and monitoring, keeping records related to security training work on trains for assigned agencies.

4. Handling violations in accordance with the provisions of the law.

Article 18. Responsibilities of the Ministry of Transport

1. Cooperating with the Ministry of Public Security to develop security training contents on trains, in inspecting and supervising railway transport enterprises in implementing the provisions of this Decree.

2. Guiding railway transport enterprises to build and implement regular refresher courses on railway traffic safety for security forces on trains.

Article 19. Responsibilities of Railway Transport Enterprises

1. Organizing and managing security forces to ensure order and safety on trains under their management. Leading and coordinating with specialized railway inspection agencies, public security agencies, local authorities to prevent, stop, and handle according to their authority any violations of the law on trains, ensuring order, safety, protecting the lives, health, and property of passengers and freight customers.

2. Being responsible for providing uniforms, badges, insignias, emblems, and other costs for the activities of security forces on trains managed by the enterprise; stipulating the service life for uniforms, badges, emblems, insignias, and emblems of security forces on trains.

3. Based on the requirements, nature, and scale of train formations, deciding on the organizational form and deployment of security forces. Directing, building, and implementing plans and regulations for security on trains. Urging and inspecting security activities on trains.

4. Implementing guidance documents on security work on trains issued by the Ministry of Public Security.

5. Leading and coordinating with functional agencies of the Ministry of Public Security to develop plans for training and refresher courses for security forces on trains, organizing regular refresher courses on railway traffic safety for security forces on trains; coordinating with functional agencies of the Ministry of Public Security in training and regular refresher courses for security forces on trains.

6. Annually, on December 20, compiling and reporting to the Ministry of Transport and the Ministry of Public Security the following contents:

a) Total number of security personnel on trains being managed;

b) Total number of security personnel on trains trained and refresher trained in accordance with the provisions of this Decree;

c) Results of the activities of security forces on trains;

d) Difficulties and obstacles encountered during the implementation of the Decree and recommendations.

Chapter V

IMPLEMENTING PROVISIONS

Article 20. Effective Date

1. This Decree takes effect from July 1, 2018.

2. Decree No. 55/2006/NĐ-CP dated May 31, 2006 of the Government regarding the organization, tasks, powers, equipment, uniforms, insignias, and auxiliary tools of security forces on trains shall cease to be effective from the date this Decree takes effect.

Article 21. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./.
