DECISION OF THE PRIME MINISTER

On the tasks, authorities, and organizational structure of the Vietnam Inspection Corporation

 

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government on the tasks, authorities, state management responsibilities, and organizational structure of the Ministry of Transport;

At the proposal of the Minister of Transport and the Minister, Head of the Civil Service Committee of the Government,

 

DECISION:

Article 1. The Vietnam Inspection Corporation is under the Ministry of Transport, assisting the Minister of Transport in performing specialized functions for technical inspection and quality certification of various types of transportation equipment and facilities, including maritime, road, railway, inland waterway, offshore drilling platforms, floating structures, floating vessels, and certain related safety devices within the transportation sector.

The Vietnam Inspection Corporation has legal personality, its own seal, bank account, and headquarters in Hanoi city.

The Vietnam Inspection Corporation's international trade name is Vietnam Register, abbreviated as VR.

Article 2. The Vietnam Inspection Corporation has the following main tasks and authorities:

1. Drafting, participating in drafting legal documents, policies, systems, procedures, regulations, economic and technical norms concerning technical inspections and quality certifications of various types of transportation equipment and facilities, including maritime, road, railway, inland waterway, offshore drilling platforms, floating structures, floating vessels, and certain related safety devices within the transportation sector, submitting them to the Minister of Transport for issuance within their authority or for submission by the Ministry of Transport to the Prime Minister for decision, and organizing and directing the implementation of these matters after they have been issued by the Ministry of Transport or competent authority.

2. Organizing the implementation of the following technical inspections:

a) Inspecting ships in Vietnam according to the contents stipulated in Decision No. 203/TTg dated December 28, 1992 of the Prime Minister on ship inspections in Vietnam.

b) Road, rail, inland waterway transportation equipment and facilities, cargo handling equipment weighing one ton or more, as prescribed by the Government and assigned by the Ministry of Transport.

c) Offshore drilling platforms and offshore drilling platform equipment.

d) Floating structures and floating vessels.

e) Boilers and pressure-bearing equipment used on transportation vehicles.

f) Types of containers used in the transportation sector.

3. Implementing certain tasks as prescribed by law and assigned by the Ministry of Transport:

a) Reviewing or participating in reviewing technical design projects for the manufacture, assembly, modification of transportation vehicles, offshore drilling platforms, and related systems and equipment.

b) Technically inspecting the manufacture, assembly, modification, repair, use, import, and export of transportation vehicles and equipment, offshore drilling platforms.

c) Issuing and revoking certificates: inspectors, product quality, technical safety, technical qualifications of transportation vehicles within the responsibility of the Corporation, and as prescribed by Vietnamese law and international treaties to which Vietnam is a party.

Inspecting and issuing certificates for technical safety management systems of enterprises with products within the scope of technical inspections conducted by the Corporation, as prescribed by Vietnamese law and relevant international regulations (ISM Code) to which Vietnam is a party.

4. Inspecting and supervising compliance with laws and policies regarding technical inspections and product quality of transportation equipment, and participating in technical appraisals of incidents and accidents caused by transportation vehicles.

5. Organizing the application of scientific and technological progress in technical inspections and international cooperation in this field.

6. Collecting inspection fees and charges as prescribed.

7. Managing the organization, staffing, and assets of the Corporation in accordance with State regulations. Organizing professional training and development for staff under the management of the Vietnam Inspection Corporation.

Article 3. The organizational structure of the Vietnam Inspection Corporation includes:

1. The Director and Deputy Directors assisting the Director. The Director is responsible to the Minister of Transport for all activities of the Corporation. Deputy Directors are responsible to the Director for the tasks assigned to them.

The Director and Deputy Directors are appointed and relieved of duty by the Minister of Transport.

2. Professional organizations assisting the Director include the Office of the Corporation and specialized departments, branches, regional inspection centers, and specialized inspection facilities established by the Minister of Transport.

Article 4. The Minister of Transport, based on the specialized management functions of the Ministry and this Decision, will specify the tasks, authorities, and organizational structure of the Vietnam Inspection Corporation.

Article 5. This Decision takes effect from the date of issuance. All previous provisions contrary to this Decision are abolished.

The Minister of Transport, Ministers, Heads of Ministries equivalent to Ministries, Heads of Government agencies, Chairmen of People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision./.
