Regarding the establishment of the Investment and Construction Management Board for the New Urban Area South of Ho Chi Minh City

PRIME MINISTER
Pursuant to the Law on the Organization of the Government dated September 30, 1992;
To implement the pilot model of organization and management of investment and construction in the new urban area south of Ho Chi Minh City according to the approved master plan;
Upon consideration of the proposal of the Chairman of the People's Committee of Ho Chi Minh City, the Minister of Construction, the Minister and the Head of the Organization-Cadre Department under the Government,

Article 1. Establish the Investment and Construction Management Board for the New Urban Area South of Ho Chi Minh City (hereinafter referred to as the South Management Board) to manage investment and construction in this urban area according to the approved planning, schedule, and laws.
Article 2. The South Management Board is a subordinate agency under the People's Committee of Ho Chi Minh City, having its own seal; it is allowed to open accounts at the State Treasury and banks in accordance with the provisions of the law.
Article 3. The South Management Board shall have the following tasks, powers, and responsibilities.
1. Organize the preparation of detailed planning within the scope of the new urban area to be submitted to the People's Committee of Ho Chi Minh City for approval or to be submitted by the People's Committee of Ho Chi Minh City to the competent authority for approval in accordance with the overall approved planning.
2. - Implement investment and construction management according to the planning in the new urban area based on the division of work by the People's Committee of Ho Chi Minh City; monitor, inspect, and supervise the use and operation of urban technical infrastructure projects to ensure economic and social efficiency.
Be authorized by the People's Committee of Ho Chi Minh City to manage certain aspects of investment and construction in the new urban area.
3. - Mobilize and attract domestic and foreign investment through various forms in compliance with the law;
4. - Guide, accept, organize the review, and submit to the competent state agencies for approval or issue investment permits for projects in accordance with current regulations. Monitor and inspect the implementation of investment projects after they have been approved or issued investment permits;
5. - Take the lead in coordinating with state agencies in land management, organizing land clearance, implementing compensation policies for relocation and resettlement in accordance with the law;
6. - Develop regulations and rules for managing investment and construction in the new urban area to be submitted to the People's Committee of Ho Chi Minh City for approval; disseminate, guide, and inspect the implementation of these regulations;
Article 4. The South Management Board operates in accordance with the organizational and operational charter issued by the Chairman of the People's Committee of Ho Chi Minh City, after obtaining the consensus opinion of the Minister in charge of the Organization-Cadre Department under the Government and the Minister of Construction.
The People's Committee of Ho Chi Minh City is responsible for managing all activities of the South Management Board in accordance with the established charter and coordinating the activities between the South Management Board and the People's Committees of districts and counties and departments directly under the People's Committee of Ho Chi Minh City.
Article 5. The South Management Board consists of the Director, Deputy Directors, and specialized members.
The Director, Deputy Directors, and specialized members of the South Management Board are appointed and dismissed by the Chairman of the People's Committee of Ho Chi Minh City. The support staff of the South Management Board is determined by the Chairman of the People's Committee of Ho Chi Minh City.
Article 6. The operating budget of the South Management Board is included in the state budget of the city in accordance with current regulations. The South Management Board is permitted to collect and use certain types of fees and charges on the territory in accordance with the law.
Article 7. This Decision shall take effect fifteen days from the date of signature.
Article 8. The Chairman of the People's Committee of Ho Chi Minh City, the Ministers of Construction, Planning and Investment, Finance, the Organization-Cadre Department under the Government, the Ministers, and the Heads of agencies equivalent to ministries, and the Investment and Construction Management Board for the New Urban Area South of Ho Chi Minh City are responsible for enforcing this Decision.
