Decision No. 76/2002/QĐ-TTg On the establishment of the Working Group to implement the Convention on the Prohibition of the Development, Production, Stockpiling, and Use of Chemical Weapons and on their Destruction (Convention on the Prohibition of Chemical Weapons).

DECISION OF THE PRIME MINISTER

PRIME MINISTER

Based on the Law on Government Organization dated December 25, 2001;

BASED ON THE Ordinance on the Conclusion and Implementation of International Treaties dated August 20, 1998;

BASED ON THE Decision of the President No. 167/QĐ-CTN dated August 24, 1998 approving the Chemical Weapons Convention;

Considering the proposal of the Minister of Industry,

DECISION:

Article 1The Working Group to implement the Chemical Weapons Convention (hereinafter referred to as the Working Group) shall be established with the following composition:

1. Chairperson: One Deputy Minister of Industry.

2. Vice-Chairperson: A Department-level officer (or equivalent) from the Ministries of Foreign Affairs; National Defense; Public Security; Trade.

3. Members are specialists from the Ministries of Industry; Foreign Affairs; National Defense; Public Security; Finance; Trade; Justice; Science, Technology, and Environment; General Department of Customs, and the Government Office.

Article 2The Working Group shall have the following tasks:

1. Assist the Prime Minister in directing relevant ministries, ministerial-level agencies, government-affiliated agencies, provincial people's committees directly under the central government in implementing the Chemical Weapons Convention;

2. Develop and coordinate implementation programs and plans for the convention;

3. Monitor the implementation process; compile reports on the results of the convention's implementation, submit them to the Prime Minister for approval before officially submitting them to the Convention Organization;

4. Study and propose the drafting of legal documents to regulate or guide the implementation of the convention, submit them to the competent state agency for consideration and decision.

Article 3The Working Group shall have a permanent office located at the Ministry of Industry, which may use the seal of the Ministry of Industry. The Chairperson, Vice-Chairpersons, and members of the Working Group shall operate on a part-time basis. The Chairperson shall be responsible to the Prime Minister for all aspects of the Working Group's activities and shall decide on the Working Group's operational regulations.

The permanent office shall have some specialized staff to assist, personnel to be decided by the Minister of Industry.

Article 4The operating funds for the Working Group and the annual contribution funds to the Convention Organization shall be allocated in the annual state budget estimate of the Ministry of Industry.

Article 5This Decision shall take effect fifteen days from the date of signature.

Article 6The Minister of Industry, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial people's committees directly under the central government, the Chairperson, Vice-Chairpersons, and members of the Working Group shall be responsible for implementing this Decision./.
