CIRCULAR
Amending and supplementing Circular No. 79/2004/TT-BTC dated August 10, 2004 of the Ministry of Finance guiding the implementation of Decision No. 78/2004/QĐ-TTg dated May 7, 2004 of the Prime Minister on adjusting and supplementing certain mechanisms and policies to accelerate the progress of building clusters and residential areas and housing in provinces frequently flooded in the Mekong Delta region.
Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003 detailing and guiding the implementation of the Law on State Budget;
Pursuant to Decree No. 198/2004/NĐ-CP dated December 3, 2004 of the Government on land use fee collection;
Pursuant to Decision No. 78/2004/QĐ-TTg dated May 7, 2004 of the Prime Minister on adjusting and supplementing certain mechanisms and policies to accelerate the progress of building clusters and residential areas and housing in provinces frequently flooded in the Mekong Delta region;
The Ministry of Finance amends and supplements Circular No. 79/2004/TT-BTC dated August 10, 2004 of the Ministry of Finance guiding the implementation of Decision No. 78/2004/QĐ-TTg dated May 7, 2004 of the Prime Minister on adjusting and supplementing certain mechanisms and policies to accelerate the progress of building clusters and residential areas and housing in provinces frequently flooded in the Mekong Delta region as follows:
1. Amend and supplement Point 2 of Part I of Circular No. 79/2004/TT-BTC as follows:
"2. Management of the amount of money from selling 30% of the house base and allocation of funds to repay loans for essential infrastructure construction:
All proceeds from selling 30% of the house base at market prices in flood-prone clusters and residential areas must be invested in essential infrastructure and submitted to the state budget, recorded under the corresponding chapter, type, item, and sub-item of land use fees; when collecting house base fees from buyers, use land use fee receipts.
Provinces are responsible for allocating local budgets to repay loans from the Fund for Supporting Development of Essential Infrastructure Investment and to fund the construction of essential infrastructure for flood-prone clusters and residential areas within their jurisdiction as prescribed."
During the implementation process, if there are difficulties or obstacles, please report them to the Ministry of Finance for consideration and resolution./.
"2. MANAGEMENT OF THE AMOUNT FROM THE SALE OF 30% OF THE LAND PLOTS AND ALLOCATION OF FUNDS TO REPAY LOANS FOR URBAN INFRASTRUCTURE DEVELOPMENT:
ALL PROCEEDS FROM THE SALE OF 30% OF THE LAND PLOTS AT MARKET PRICES IN COMMUNITIES AND URBAN LINES THAT ARE FLOOD RESISTANT MUST BE SUBMITTED TO THE STATE BUDGET AND ACCOUNTED FOR UNDER THE CATEGORY "REVENUE FROM LAND USE" IN THE CORRESPONDING CHAPTER, TYPE, CLAUSE, AND SUBITEM; WHEN COLLECTING MONEY FROM THE PURCHASER, USE A RECEIPT FOR LAND USE REVENUE.
PROVINCES ARE RESPONSIBLE FOR ALLOCATING LOCAL BUDGET FUNDS TO REPAY THE LOANS FROM THE FUND FOR SUPPORTING THE DEVELOPMENT OF ESSENTIAL INFRASTRUCTURE AND TO FINANCE THE CONSTRUCTION OF ESSENTIAL INFRASTRUCTURE FOR FLOOD RESISTANT COMMUNITIES AND URBAN LINES WITHIN THEIR TERRITORIAL LIMITS AS PROVIDED BY LAW.
2. This Circular takes effect fifteen days after its publication in the Official Gazette.
IF ANY DIFFICULTIES OR OBSTACLES OCCUR DURING IMPLEMENTATION, THEY SHOULD BE REPORTED TO THE MINISTRY OF FINANCE FOR REVIEW AND RESOLUTION./."
