Regulations on duties, tasks, and working relationships of officers in the Military Command and Self-Defense Militia Unit Command

Pursuant to the Law on Legislative Acts dated June 3, 2008;

Based on the Law on Self-Defense Militia dated November 23, 2009,

Based on Decree No. 58/2010/NĐ-CP dated June 1, 2010 of the Government detailing and guiding the implementation of certain provisions of the Law on Self-Defense Militia;

Pursuant to Decree No. 104/2008/NĐ-CP dated September 16, 2008 of the Government on the Functions, Tasks, Authorities, and Organizational Structure of the Ministry of National Defense;

Article 2. This Circular applies to academies, universities, military officer schools, vocational colleges, secondary technical schools, and military schools (hereinafter referred to collectively as military schools) that organize training in accordance with the law, and related agencies, units, organizations, and individuals; it does not apply to teachers teaching at kindergartens, general education schools, national defense education centers, and security education centers.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the duties, tasks, and working relationships of officers in the Military Command of ministries, agencies at the level equivalent to ministries, government agencies, Central Party Committees, the National Assembly Office, the President's Office, the State Audit Agency, the Supreme People's Procuracy, the Supreme People's Court, central agencies of political-social organizations, economic groups, and state-owned corporations established by the Prime Minister's decision (hereinafter referred to collectively as the Military Command of ministries and central agencies); the Military Command of state agencies, political organizations, political-social organizations, public institutions, and economic organizations (hereinafter referred to collectively as the Military Command of agencies and organizations at the grassroots level); the Military Command of communes, wards, towns (hereinafter referred to collectively as the Military Command of communes); and the duties and tasks of the commanders of self-defense militia units.

Article 2. Applicability

1. Officers in the Military Command of ministries and central agencies;

2. Officers in the Military Command of agencies and organizations at the grassroots level;

3. Officers in the Military Command of communes.

4. The commander of a self-defense militia unit.

5. Agencies and units under the Ministry of National Defense, Party Committees, People's Councils at all levels, central ministries and agencies, and other relevant organizations related to the organization and operation of self-defense militias.

Chapter II

DUTIES, TASKS AND WORKING RELATIONSHIPS OF OFFICERS IN THE MILITARY COMMAND

Section 1. MILITARY COMMAND OF MINISTRIES AND CENTRAL AGENCIES

Article 3. Duties, Tasks, and Working Relationships of the Commander-in-Chief

1. Responsibilities:

The Commander-in-Chief of the Military Command of ministries and central agencies is responsible before the Party Cadre Committee, the Party Group, the Party Committee, the head of the ministry or central agency, and implements the guidance and command of the Minister and the Ministry of National Defense regarding national defense, military affairs, national defense education - security, civil defense; directly directs and organizes the implementation of these tasks.

2. Tasks:

a) Leads the study and implementation of resolutions, directives, and orders concerning national defense, military, national defense education - security, civil defense, self-defense militia, reserve mobilization tasks; advises the Party Cadre Committee, the Party Group, the Party Committee, and the head of the ministry or central agency to issue leadership and guidance documents on plans for implementing these tasks; propagates and educates cadres, civil servants, and workers about the policies of the Party and the laws of the State on national defense, military, national defense education - security, civil defense, self-defense militia, reserve mobilization;

b) Proposes to the Party Cadre Committee, the Party Group, the Party Committee, and the head of the ministry or central agency to lead and guide comprehensive national defense education for cadres, civil servants, and employees in subordinate agencies and units; assists the ministry or central agency in coordinating with the Ministry of National Defense, the Ministry of Education and Training, and other relevant agencies to organize training in national defense knowledge - security, national defense education for target groups such as cadres, civil servants, students, and trainees as prescribed by law;

c) Advises the head of the ministry or central agency to combine political tasks, economic and social development with national defense - security consolidation within planning and programs in their respective fields; coordinates with localities where their offices are located to build a whole-of-nation defense, making provinces and centrally-administered cities (hereinafter referred to collectively as provincial level) into solid defensive areas; coordinates to direct the defense area exercises of localities; directly assists the head of the ministry or central agency in building and implementing plans to ensure national defense needs in the first year of war, national defense mobilization plans, industrial mobilization plans, civil defense plans, and self-defense force construction plans;

d) Together with the Military Command, advises the head of the ministry or central agency to direct, build, and implement plans for organizing, training, and activities of self-defense forces; coordinates with the Provincial Military Command, the City Military Command (hereinafter referred to collectively as Provincial Military Command), the District Military Command, the Town Military Command, and the County Military Command (hereinafter referred to collectively as District Military Command) to consolidate and improve the Military Command of agencies and organizations at the grassroots level, self-defense units, and enhance the competence, management, and command of self-defense cadres under their jurisdiction;

đ) Directs the implementation of combat readiness systems and the management of weapons and equipment in the self-defense force's establishment; directs the self-defense force to coordinate with other forces in the area to protect production, maintain political security, social order, and safety, and implement civil defense;

e) Annually directs the preparation, execution, and settlement of the budget to ensure the implementation of national defense, military, national defense education - security, civil defense tasks, and policies for self-defense forces, reserve mobilization forces, and military rear support policies;

g) Assists the ministry or agency in managing state affairs on national defense, national defense education - security, civil defense, self-defense militia within their functional scope and tasks; implements reporting, briefing, inspection, audit, mid-term review, and final evaluation systems for these contents.

3. Working relationships:

a) With the Party Cadre Committee, the Party Group, the Party Committee, and the head of the ministry or central agency: Subject to the leadership of the Party Cadre Committee, the Party Group, the Party Committee; and the direct management and operation of the head of the ministry or central agency regarding national defense, military, national defense education - security, civil defense, organizational building, and activities of self-defense forces, reserve mobilization forces;

b) With the Ministry of National Defense: Subject to guidance and direction on national defense, military, national defense education - security, civil defense, self-defense work; political work, commendation and reward work for these tasks.

c) For the heads of agencies and units under the management of ministries and sectors: To take the lead, coordinate, direct and organize the implementation of national defense, military affairs, national defense education - security education, civil defense, self-defense work, and mobilization work;

d) For local Military Command Boards and self-defense units under the management of ministries and sectors: Directly or coordinate with military regions, provincial Military Command Boards, district Military Command Boards (hereinafter referred to collectively as local military authorities at all levels) to direct, manage, command, guide the implementation of national defense, military affairs, national defense education - security education, civil defense, organization building, and activities of self-defense forces;

đ) For Political Commissars: Is a relationship of coordination and cooperation in work, sharing responsibility for organizing the implementation of national defense, military affairs, national defense education - security education, civil defense, organization building, and activities of self-defense forces;

e) For Deputy Commanders and Deputy Political Commissars: Is a command relationship between superiors and subordinates;

Article 4. Responsibilities, tasks, and relationships of Deputy Commanders

1. Responsibilities:

Deputy Commanders assist and are responsible before Commanders-in-Chief and Political Commissars for the contents of work assigned; replace Commanders-in-Chief when they are absent;

2. Tasks:

a) Propose contents regarding national defense, military affairs, national defense education - security education, civil defense, self-defense work, and mobilization work to Commanders-in-Chief according to assigned tasks;

b) Implement tasks assigned by Commanders-in-Chief and Political Commissars;

c) Summarize the results of implementing assigned tasks and report to Commanders-in-Chief and Political Commissars;

3. Working relationships:

a) For Commanders-in-Chief and Political Commissars: Is a subordinate-superior relationship, subject to the command and direction of Commanders-in-Chief and Political Commissars; implement assigned tasks and report on the results of task implementation;

b) For Deputy Political Commissars: Is a relationship of coordination in work;

c) For local Military Command Boards and self-defense units under the management of ministries and sectors: Directly or coordinate with military regions, local military authorities at all levels to direct, manage, command, guide the implementation of national defense, military affairs, national defense education - security education, civil defense, organization building, and activities of self-defense forces;

Article 5. Responsibilities, tasks, and relationships of Political Commissars

1. Responsibilities:

The Political Commissar of the Military Command Board of central ministries and sectors is the Secretary or Deputy Secretary of the Party Cadre Board, Party Group, or Central Committee of the Party of central ministries and sectors, responsible for all activities of party work and political work in the implementation of national defense, military affairs, national defense education - security education, civil defense, and the construction of self-defense forces and reserve mobilization forces; operate under the direct leadership and guidance of the Party Cadre Board, Party Group, Central Committee of the Party, and the head of central ministries and sectors;

2. Tasks:

a) Together with Commanders-in-Chief, study and implement tasks, propose policies and measures to lead the implementation of various aspects of national defense, military affairs, national defense education - security education, civil defense to the Party Cadre Board, Party Group, Central Committee of the Party, and the head of central ministries and sectors, while coordinating to implement those policies and measures;

b) Take the lead in directing the implementation of political education, ideological leadership, and directly organizing political education, informing the situation, promoting the policies and laws of the Party and State on national defense and security to cadres, civil servants, workers; together with Commanders-in-Chief, coordinate with relevant agencies to implement national defense education - security education;

c) Direct the improvement of the quality of self-defense forces and reserve mobilization forces, select people for self-defense forces, ensure political reliability; cultivate sources for developing party members, regularly educate and train to enhance the role of party members and youth league members in self-defense forces and reserve mobilization forces;

d) Organize the Quyet Thang Competition Movement in self-defense forces and reserve mobilization forces; promptly identify, nurture, publicize, and expand exemplary models in the implementation of national defense, military affairs, national defense education - security education, civil defense;

đ) Together with Commanders-in-Chief, direct the Military Command Board of agencies and units under the management of ministries and sectors to maintain combat readiness systems, manage weapons and equipment within the self-defense force's establishment. Direct self-defense forces to cooperate with other forces in the locality to protect production, maintain political security, social order, and safety, and participate in civil defense work;

e) Direct the implementation of party work and political work in the construction and operation of self-defense forces and reserve mobilization forces; conscription and call-up of male citizens for military service, implementation of mobilization tasks; national defense, military affairs, national defense education - security education, civil defense tasks;

g) Direct the implementation of inspection, mid-term review, and final summary of party work and political work related to national defense, military affairs, national defense education - security education, civil defense; implement policies and benefits for self-defense forces, reserve mobilization forces, and military rear support policies;

3. Working relationships:

a) For the Party Cadre Board, Party Group, and Central Committee of the Party: Subject to leadership and direction in national defense, military affairs, national defense education - security education, civil defense, organization building, and activities of self-defense forces;

b) For Commanders-in-Chief: Is a relationship of coordination in work, sharing responsibility for organizing the implementation of national defense education - security education, civil defense, organization building, and activities of self-defense forces in the implementation of party work and political work in these tasks;

c) For Deputy Commanders and Deputy Political Commissars: Is a command relationship between superiors and subordinates, assigning Deputy Commanders and Deputy Political Commissars to implement some political work contents;

d) For local Party Committees and administrative bodies at the grassroots level where headquarters are located: Coordinate and cooperate in implementing national defense, military affairs, national defense education - security education, civil defense, and self-defense work.

Article 6. Duties, Tasks, and Relationships of the Deputy Political Commissar

1. Responsibilities:

Assist the Political Commissar in directing the implementation of national defense, military, national defense education - security education, civil defense tasks; political work for self-defense forces, reserve military personnel; replace the Political Commissar when absent.

2. Tasks:

a) Master all aspects of political work, promptly identify and report to the Political Commissar timely measures to organize the implementation of assigned tasks.

b) Assist the Political Commissar in planning political work; organizing the implementation of political work to grasp the ideological situation of self-defense forces and reserve military personnel; participate in organizing political and legal education, informing the situation, publicizing Party policies, State laws on national defense, military affairs, national defense education - security education, civil defense for self-defense forces.

3. Working relationships:

In relation to the Commandant and the Political Commissar: it is a subordinate relationship with superiors, subject to the command and leadership of the Commandant and the Political Commissar; implement assigned tasks and report on the results of task implementation; in relation to the Deputy Commandant: it is a cooperative working relationship.

Section 2. MILITARY COMMAND OF ORGANIZATIONS AT THE LOCAL LEVEL

Article 7. Duties, Tasks, and Relationships of the Commandant

1. Responsibilities:

The Commandant of the Military Command of organizations at the local level is responsible before the Party's Central Committee and the head of the organization for national defense, military, national defense education - security education, civil defense work, self-defense force construction work, reserve mobilization force building work, conscription and call-up of male citizens for military service; subject to the guidance and command of local military authorities at various levels and the Military Command of central ministries and departments; directly direct and organize the implementation of these tasks according to the provisions of the law.

2. Tasks:

a) Together with the District Military Command, take the lead in studying and implementing resolutions, directives, orders, and tasks related to national defense, military affairs, national defense education - security education, civil defense from higher authorities; assist the Party's Central Committee and the head of the organization in issuing leadership and directive documents and plans to implement these tasks.

b) Assist the Party's Central Committee and the head of the organization in leading and directing the implementation of national defense education - security education tasks, training national defense knowledge for cadres, civil servants, employees, workers, students under their organization according to the provisions of the law.

c) Assist the head of the organization in implementing political tasks, closely combining economic and social development with strengthening national defense - security, implementing plans, master plans, and projects for economic and social development that have been approved by competent authorities to consolidate national defense and security; implementing national defense mobilization tasks within the organization according to state targets; implementing civil defense.

d) Assist the Party's Central Committee and the head of the organization in coordinating with units on the territory to educate and propagate Party policies, State laws on national defense, military affairs, national defense education - security education, civil defense, self-defense forces, national defense mobilization, conscription and call-up of male citizens for military service to cadres, workers, and employees.

e) Maintain combat readiness routines, manage weapons and equipment within the self-defense force's establishment; direct self-defense commanders to coordinate with forces on the territory to protect production, maintain political stability, public order, and social safety, and implement civil defense.

f) Together with the Political Commissar, assist the Party's Central Committee and the head of the organization in implementing plans for organizing, training, and activities of the self-defense force; improve the cadre team of the Military Command, self-defense commanders, enhance their competence, manage, and command self-defense cadres under their authority; comply with mobilization orders for reserve forces, orders to call up reserve military personnel for concentrated training, exercises, and inspections of mobilization readiness and combat readiness according to the provisions of the law; implement orders to call up male citizens for military service.

g) Propose to the Party's Central Committee and the head of the organization to direct and implement policies and benefits for the self-defense force, reserve military personnel, and military rear support policies; annually prepare budgets, execute, and settle accounts to ensure the implementation of national defense, military, national defense education - security education, civil defense tasks.

h) Implement and comply with reporting, briefing, inspection, audit, interim review, and final review systems regarding national defense, military, national defense education - security education, civil defense, self-defense forces, national defense mobilization.

3. Working relationships:

a) In relation to the Party's Central Committee and the head of the organization: Subject to direct leadership and direction from the Party's Central Committee, and direct management and operation from the head of the organization regarding national defense, military, national defense education - security education, civil defense, organizing the construction, training, and activities of the self-defense force, managing the reserve mobilization force.

b) In relation to the Military Region, local military authorities at various levels, and the Military Command of central ministries and departments: Subject to guidance, supervision, inspection, audit, and compliance with orders from the Military Region, local military authorities at various levels, and the Military Command of central ministries and departments regarding national defense, military, national defense education - security education, civil defense at the grassroots level, organizing the construction, training, and activities of the self-defense force, managing the reserve mobilization force.

c) In relation to units under the management of the organization: Take the lead in coordinating and assisting in planning and organizing the implementation of national defense, military, national defense education - security education, civil defense at the grassroots level, organizing the construction and activities of the self-defense force, the reserve mobilization force, implementing orders to call up male citizens for military service.

d) In relation to self-defense units under its management: Coordinate with local military authorities at various levels to direct, command, and guide the implementation of national defense, military, national defense education - security education, civil defense tasks, organizing the construction, training, and activities of the self-defense force.

d) For the Political Officer: It is the relationship of coordination and cooperation in work, sharing responsibility for organizing and implementing national defense and security education tasks, civil defense, organization building, training, activities of self-defense forces, reserve mobilization, recruitment and call-up of male citizens for military service.

e) For the Deputy Commander, Deputy Political Officer: It is the command relationship between superiors and subordinates, assigning tasks and guiding the implementation of tasks for the Deputy Commander and Deputy Political Officer.

Article 8. Responsibilities, Tasks, and Relationships of the Deputy Commander

1. Responsibilities:

The Deputy Commander assists and is responsible to the Commander and Political Officer for the contents of work assigned; is appointed to replace the Commander when absent.

2. Tasks:

a) To grasp the situation of national defense and military work of the agency or organization, propose to the Commander measures to organize and implement each aspect of national defense and military work assigned.

b) Directly carry out registration and management of citizens within the age range for performing militia self-defense duties, reserve mobilization force, male citizens within the age range for immediate conscription; organize the implementation of the activity plan of the self-defense force.

c) Summarize the results of national defense and military tasks according to the assigned tasks, report to the Commander and the higher-level military authority when authorized.

3. Working relationships:

With the Commander and Political Officer: It is the relationship of a subordinate with a superior, subject to the command of the Commander and Political Officer; execute the assigned tasks and report on the results of task implementation; with the Deputy Political Officer, it is the relationship of coordination in work.

Article 9. Responsibilities, Tasks, and Relationships of the Political Officer

1. Responsibilities:

The Political Officer is concurrently held by the Secretary of the Party Committee (Branch) of the agency or organization, is the person in charge of Party work and political work for the self-defense force, reserve mobilization force, and in the implementation of national defense and military tasks, national defense education, civil defense; all activities of the Political Officer are under the direct leadership of the Party Committee (Branch) of the agency or organization, guidance and direction from the Political Commissar, Political Officer of the local military authority at various levels, and the Military Command Department of central ministries and agencies regarding Party work and political work for the self-defense force, reserve mobilization force, and in the implementation of national defense and military tasks, national defense education, civil defense.

2. Tasks:

a) Together with the Commander, study and implement resolutions, directives, orders of superiors, national defense and military tasks, national defense education, civil defense of their own level; propose to the Party Committee (Branch) policies and measures for leadership and content and methods for conducting Party work and political work for the self-defense force, reserve mobilization force, and the implementation of these tasks; build plans for Party work and political work and assign organizations to implement them.

b) Conduct political and ideological work for the self-defense force and reserve military personnel; directly organize political education, propaganda of the Party's guidelines, policies, and state laws on national defense and military for the self-defense force and reserve military personnel; together with the Commander and relevant officers, implement national defense education, directly train knowledge of national defense and security for cadres and party members within their authority, build a strong foundation comprehensively.

c) Carefully build the core political force, improve the overall quality of the self-defense force and reserve mobilization force, ensuring political reliability; identify and nurture candidates for party membership and youth league membership in the self-defense force and reserve mobilization force.

d) Together with the Commander, grasp the cadre strength of the self-defense force and reserve officers; organize the implementation of cadre decisions of the Party Committee (Branch), organize political training for self-defense cadres on revolutionary moral qualities and political experience; coordinate with military units to manage reserve officers.

đ) Continuously grasp the internal political situation within the self-defense force and reserve military personnel; educate officers and soldiers to enhance revolutionary vigilance, strictly adhere to internal protection systems, prevent espionage, and maintain confidentiality.

e) Organize the Quyet Thang Competition Movement linked with the competition movements of the agency or organization; promptly identify, nurture, and publicize exemplary individuals and deeds in the implementation of national defense and military tasks, national defense education, and civil defense.

g) Together with the Commander, guide and command the self-defense force to cooperate with other local forces to maintain political security, social order, and safety, civil defense; participate in building the people's national defense and mass mobilization work.

h) Guide the self-defense force and reserve mobilization force to cooperate with military units stationed in the area to conduct mass mobilization work, participate in local campaigns, contribute to building a politically stable foundation, economic and social development in the area where the agency or organization has its headquarters, and build a safe area.

i) Implement the Party's guidelines, policies, and state laws concerning the self-defense force and reserve mobilization force; motivate officials and staff of the agency or organization to implement well the military rear support policies; research and propose to superiors to ensure the policies and systems for the self-defense force and reserve mobilization force, military rear support policies, and national defense and military tasks of the agency or organization.

k) Lead the implementation of Party work and political work in the construction and operation of the self-defense force and reserve mobilization force, recruitment and call-up of male citizens for military service; implement tasks related to national defense and military work, national defense education, civil defense; implement policies and systems for the self-defense force and reserve mobilization force; military rear support policies.

l) Organize mid-term and final reviews of Party work and political work; implement reporting systems to the Party Committee (Branch) of the agency or organization and local military authorities at various levels.

3. Working relationships:

a) For the Party Committee of the agency or organization: Subject to the leadership and direction of the Party Committee on defense work, military affairs, national defense education - security, civil defense, self-defense work, reserve force construction work, recruitment and call-up of male citizens for military service;

b) For the Commander-in-Chief: Cooperate in work, jointly responsible for organizing and implementing defense, military, national defense education - security tasks, civil defense work, organizing activities related to party work, political work in carrying out these tasks;

c) For the Deputy Commander, Deputy Political Commissar: This is a command relationship between superiors and subordinates, assigning the Deputy Commander, Deputy Political Commissar to implement certain aspects of political work;

Article 10. Responsibilities, tasks, and relationships of the Deputy Political Commissar

1. Responsibilities;

The Deputy Political Commissar assists the Political Commissar in political work for the self-defense forces, reserve forces, and in performing defense, military, national defense education - security, civil defense, recruitment and call-up of male citizens for military service tasks; is accountable to the Political Commissar for assigned tasks; substitutes for the Political Commissar in his absence;

2. Tasks:

a) Grasps all aspects of political work and promptly proposes measures to the Political Commissar for organizing and implementing assigned work;

b) Assists the Political Commissar in formulating and implementing plans for political work; grasps the ideological situation of the self-defense forces and reserve personnel; organizes political and legal education, propaganda on the Party's guidelines, policies, and state laws on national defense, security, national defense education - security, civil defense for the self-defense forces and reserve personnel;

c) Summarizes the results of political work according to assigned tasks and reports to the Commander-in-Chief and Political Commissar;

3. Working relationships:

For the Political Commissar and the Commander-in-Chief, he is subject to management, direction, and command; complies with orders and accepts assignments from the Political Commissar and the Commander-in-Chief; for the Deputy Commander, it is a cooperation relationship in work;

Section 3. THE MILITARY COMMAND BOARD OF THE COMMUNE

Article 11. Responsibilities, tasks, and relationships of the Commander-in-Chief

1. Responsibilities:

The Commander-in-Chief is subject to the leadership of the Party Committee and the management of the Commune People's Committee; together with the Political Commissar of the Military Command Board of the commune, they advise the Party Committee and the Commune People's Committee on implementing defense work, civil defense, and militia self-defense work; takes the lead in coordinating with departments, agencies, and mass organizations to carry out local defense and military tasks according to directives and orders from higher military authorities, resolutions of the Party Committee, People's Council, and instructions and plans of the Chairman of the Commune People's Committee; at the same time, directly organizes, builds, trains, and operates the militia force to contribute to maintaining political security, social order, and public safety at the grassroots level and be ready to fight in any situation; registers and manages the militia force, reserve force, male citizens of conscription age, and implements annual recruitment and call-up of male citizens for military service;

2. Tasks:

a) Conveys directives and orders from higher authorities regarding defense, civil defense, and militia self-defense work; reports and proposes initiatives to the Party Committee and the Chairman of the Commune People's Committee on policies and measures to implement these tasks;

b) Advises the Party Committee and the Commune People's Committee to issue resolutions and directives on defense, civil defense, and militia self-defense work; leads the development of plans for militia training and operations; plans for coordinating the protection of political security, social order, and public safety at the commune level; civil defense plans for the commune according to the guidance of higher-level local military authorities; leads and coordinates with departments, agencies, and mass organizations to implement related defense and military tasks at the commune level;

c) Together with the Political Commissar, proposes to the Party Committee and the Commune People's Committee to regularly consolidate and improve the cadre team of the Military Command Board and militia unit commanders, with plans to enhance their understanding and organizational, managerial, and command capabilities; consolidates and improves the organization and staffing of subordinate militia units to meet the requirements of defense, military, and security tasks at the commune level;

d) Annually, leads and coordinates with departments, agencies, and mass organizations to register citizens of conscription age for militia self-defense, reserve forces, and male citizens of conscription age for military service; strictly manages the quantity and quality of core militia, broad militia, reserve personnel, and middle-aged male citizens for military service;

đ) Organizes political education and military training for the militia force according to the training program of higher-level local military authorities and implements urgent tasks from superiors; organizes inspections, seminars, and competitions to evaluate the results of training; participates in seminars and competitions as required by local military authorities at various levels;

e) Leads and commands the militia to cooperate with the Public Security of the commune and other forces in protecting political security, social order, and public safety; be ready to fight, serve combat, mitigate disaster consequences, epidemic control, search and rescue; organizes the militia force to participate in mobilizing the masses, movements, and programs of political, economic, cultural, and social activities of the locality, contributing to building a comprehensive strong grassroots base;

g) Leads and coordinates with departments, agencies, and mass organizations to advise the Party Committee and the Commune People's Committee on organizing nationwide defense education; propagandizing and disseminating laws on national defense and security, contributing to enhancing the people's awareness and responsibility in building a nationwide defense and people's security posture, responding to complex situations that may arise;

h) Advises the Party Committee and the Commune People's Committee to build and implement plans to combine economic, cultural, and social development with the construction of a nationwide defense and people's security posture in the commune area;

i) Master the situation, together with the Political Commissar, propose to the Party Committee and the People's Committee at the commune level to lead and direct the implementation of policies and regulations for the civilian militia, reserve forces, and military rear support policies;

k) Maintain discipline and living routines, readiness for combat; register and store weapons and equipment; implement regular and ad hoc inspection and reporting systems; conduct meetings, mid-term reviews, and summaries on defense and military work according to regulations;

3. Working relationships:

a) For the Commander of the Military Command Board at the district level: Be subject to leadership and command in defense, civil defense, and civilian militia self-defense work within their authority;

b) For the Party Committee at the commune level: Be subject to leadership in defense, civil defense, and civilian militia self-defense work within their authority; when there are directives or orders from higher military authorities, the Commander shall report and discuss proposals, plans, and measures for implementation with the Secretary of the Party Committee (or Branch Committee) at the commune level;

c) For the Chairman of the People's Committee at the commune level: Be subject to direct leadership and management in defense, civil defense, and civilian militia self-defense work within their authority;

d) For the Political Commissar: Coordinate work, share responsibility for organizing and implementing defense, civil defense, and civilian militia self-defense work at the commune level according to their capacity;

đ) For the Deputy Commander and Deputy Political Commissar: Manage, command, and direct the Deputy Commander and Deputy Political Commissar to organize and implement certain aspects of defense, civil defense, and civilian militia self-defense work at the commune level according to their capacity;

e) For departments, sectors, and mass organizations at the same level: Coordinate and cooperate in organizing and implementing defense, civil defense, and civilian militia self-defense work at the commune level; for the Public Security force at the commune level, coordinate and cooperate according to their functions and tasks related to defense and security at the commune level;

g) For units stationed in the area: Coordinate and cooperate in carrying out assigned tasks related to defense, civil defense, and civilian militia self-defense work;

Article 12. Duties, tasks, and working relationships of the Deputy Commander

1. Responsibilities:

The Deputy Commander assists the Commander and replaces the Commander in his absence; be subject to the command and assignment of the Commander and Political Commissar, and be responsible to the Military Command Board at the commune level for the tasks assigned;

2. Tasks:

a) Master the situation of defense and military work at the commune level, promptly identify and propose measures to the Commander for organizing and implementing each aspect of defense and military work assigned;

b) Firmly grasp the assigned tasks, study the situation, develop plans for implementation, and report to the Commander; the Deputy Commander directly implements citizen registration and management for eligible civilian militia members, reserve forces, male citizens of conscription age, and weapons and technical equipment at the base; assist the Commander in organizing military training for core civilian militia forces; implement combat plans and security and social order protection at the commune level; directly command the commune-level mobile militia platoon or standing militia unit (if any), and perform other tasks as assigned by the Commander;

c) Summarize the situation and results of defense and military work according to the assigned tasks, report the results to the Commander, Political Commissar, and higher military authorities when authorized;

3. Working relationships:

For the Commander and Political Commissar, they are subject to management, command, and leadership; comply with orders and assignments from the Commander and Political Commissar; for the Deputy Political Commissar, it is a coordination relationship in work.

Article 13. Duties, Tasks, and Relationships of the Political Officer

1. Responsibilities:

The Political Officer of the People's Militia Command at the commune level who concurrently serves as the Secretary of the Party Committee (branch) of the commune shall be responsible for Party work and political work concerning the civilian militia, reserve forces, and in the implementation of national defense, military education, and civil defense tasks. They directly serve as the Secretary of the Military Branch Committee (where there is a military branch committee). All activities of the Political Officer are under the direct leadership of the Party Committee (Branch Committee) at the commune level, the guidance of the Military Party Committee, the Political Officer, and the direction of the Political Department of the People's Militia Command at the district level.

2. Tasks:

a) Together with the Commander, study and implement resolutions, directives, and orders from superiors regarding the defense, military, national defense education - security, and civil defense tasks of their own level; propose to the Party Committee on policies and measures for leading the civilian militia, reserve forces, and implementing these tasks; build plans for Party work and political work and assign organizations to implement them;

b) Conduct political education and ideological leadership for the civilian militia and reserve forces; directly organize political education and propaganda on the Party's guidelines, policies, and state laws on national defense and security for the civilian militia and reserve forces. Together with the Commander and relevant staff, implement nationwide national defense education, directly train knowledge on national defense - security for cadres and party members within their authority, and build strong comprehensive bases;

c) Carefully build and improve the overall quality of the civilian militia and reserve forces, ensuring political reliability; cultivate outstanding members among the civilian militia and reserve forces to develop new party members and cadres;

d) Together with the Commander, closely monitor the cadre team of the civilian militia and reserve officers at the commune level; implement decisions on cadre work by the Party Committee, organize training for civilian militia cadres on politics, revolutionary moral qualities, experience in Party work and political work, coordinate with mobilization units to manage reserve officers at the commune level;

đ) Regularly review political conditions within the civilian militia and reserve forces; strictly manage political situations within the civilian militia and reserve forces; educate officers and soldiers to enhance revolutionary vigilance, seriously comply with protection systems, prevent espionage, and maintain confidentiality;

e) Organize the Quyet Thang Competition Movement linked with local competition movements within the civilian militia and reserve forces; promptly identify, nurture, and publicize exemplary individuals and deeds in the implementation of national defense, military, national defense education - security, and civil defense tasks at the commune level;

g) Together with the Commander, guide and command the civilian militia to cooperate with the Public Security, mass organizations, and the people to maintain political security, social order and safety, prevent and mitigate the consequences of natural disasters, epidemics, search and rescue operations, and collaborate with military units stationed in the area to participate in building a nationwide defense system and mass mobilization work at the commune level;

h) Implement regulations and policies for the civilian militia and reserve forces, and military rear support policies; encourage the people to actively assist families of war invalids, martyrs, and those who have made contributions to the revolution to stabilize their lives and develop family economies;

i) Lead Party work and political work in the construction and operation of the civilian militia and reserve forces, conscription and call-up of male citizens for military service; educate and motivate deserting military personnel to return to their units; direct the establishment of combat villages and implement tasks related to national defense, military, national defense education - security, and civil defense at the commune level;

k) Organize mid-term and final reviews of Party work and political work, report systems to the Party Committee at the commune level, the Military Party Committee, and the Political Department of the People's Militia Command at the district level;

3. Working relationships:

a) For the Party Committee at the commune level: Accept leadership in Party work and political work in the implementation of national defense, military tasks; national defense education - security, civil defense, and civilian militia work;

b) For the Military Party Committee, Political Department, Political Officer, and Political Chief of the People's Militia Command at the district level: Accept guidance in Party work and political work in the implementation of national defense, military tasks; national defense education - security, civil defense, and civilian militia work;

c) For the Commander: Coordinate work, share responsibility in implementing tasks, and reach consensus on plans, measures, and organizational implementation of the Party Committee's resolutions at the commune level on national defense, military tasks; national defense education - security, civil defense, and civilian militia work;

d) For various departments, mass organizations within the commune-level political system: Coordinate and cooperate in Party work and political work in the implementation of national defense, military tasks; national defense education - security, civil defense, and civilian militia work.

Article 14. Duties, Tasks, and Relationships of the Deputy Political Instructor

1. Responsibilities:

The Deputy Political Instructor serves concurrently as the Secretary of the Commune Youth Union, responsible for political work assigned by the Political Instructor, accountable to the Political Instructor for political work with the People's Militia, Reserve Mobilization Force, and in executing national defense, military, national defense education - security education, and civil defense tasks assigned; replaces the Political Instructor when absent. He is subject to management and command by the Chief Commander in commune-level Military Command activities.

2. Tasks:

a) Master all aspects of political work, promptly identify and report to the Political Instructor measures to organize and implement assigned political work.

b) Assist the Political Instructor in planning monthly, quarterly, and annual political work; organize the implementation of political work, grasp the ideological situation of the People's Militia and Reserve Mobilization Force; organize political education, current affairs briefings, and propaganda on Party policies and State laws on national defense and security for the People's Militia and Reserve Mobilization Force.

c) Summarize the results of political work, report to the Political Instructor, the Chief Commander, and the Political Department of the County Military Command when authorized.

3. Working relationships:

In relation to the Political Instructor and the Chief Commander, he is subject to management, command, and leadership; follows orders and accepts assignments from the Political Instructor and the Chief Commander; in relation to the Deputy Chief Commander, it is a cooperative working relationship.

Article 15. Duties and Tasks of the Village Militia Leader

1. Responsibilities:

The Village Militia Leader, Hamlet Militia Leader, Village Militia Leader, Clan Militia Leader, Phum Militia Leader, Srok Militia Leader, Ward Militia Leader, Group Militia Leader (hereinafter referred to collectively as the Village Militia Leader) concurrently holds the position of group leader or squad leader, or local militia platoon leader. The Village Militia Leader is directly commanded by the Chief Commander of the Commune Military Command regarding national defense and military work in the village, hamlet, village, clan, Phum, srok, ward, or residential group (hereinafter referred to collectively as the village), under the leadership of the Village Party Committee and Village Branch, and collaborates with the village head, police officer, and people's organization to carry out national defense, military, and security tasks in the village; at the same time, he is responsible to higher authorities for the results of national defense and military work in the village.

2. Tasks:

a) Advise and propose to the Commune Military Command and directly organize and implement national defense and military work in the village.

b) Register and strictly manage core militia members, broad-based militia members, reserve mobilization force, male citizens of conscription age, and citizens of service age participating in self-defense militia in the village, motorized means, and communication equipment in the village; simultaneously organize core militia members in the village to conduct activities according to regulations.

c) Under the guidance and command of the Commune Military Command, organize annual military training for the local militia force in the village or mobilize this force to participate in military training organized by the Commune Military Command.

d) Command the local militia force to collaborate with the village police officer and other forces to maintain political stability, social order, and public safety in the village, protect the lives and property of the people, collective property, and state property in the area; participate in disaster prevention and disease control; do well in propaganda and mobilization work among the people; participate in building a comprehensive strong grassroots base according to the guidance of the Commune Military Command.

đ) Organize mid-term and final reviews of national defense and military work in the village according to the guidance of the Commune Military Command.

Chapter III

DUTIES AND TASKS OF THE COMMANDING OFFICERS OF THE SELF-DEFENSE POPULAR MILITIA UNITS

Article 16. Duties and Tasks of the Battalion Commander and Equivalent

1. Responsibilities:

The Battalion Commander is subordinate to the Commandant of the Provincial Military Command, the Naval Zone General Staff, and is under the direction and management of the head of their own agency or organization; they are responsible to superiors and the battalion command team for building, training, and activities of the self-defense force. The Battalion Commander must organize and implement tasks to build a strong battalion based on orders and directives from immediate superiors. The Battalion Commander has the authority to issue orders and directives to units under their command to carry out battalion tasks.

2. Tasks:

a) Command the battalion to implement the Party's policies, the State's laws, resolutions of the Party leadership, the management of the head of the agency or organization; directives and orders of superior commanders;

b) Be thoroughly familiar with all aspects of the battalion's situation, ensuring the battalion is ready for combat when ordered by superiors; command the battalion to complete all assigned tasks;

c) Establish and organize the implementation of plans for building, training, and activities of the battalion after approval by the competent authority;

d) Register and strictly manage the cadre and self-defense soldier personnel under their command; understand the political situation, ideological trends, level of understanding, capabilities, and operational conditions of cadres and soldiers;

đ) Be thoroughly familiar with the quantity and quality of weapons, equipment, and means managed by the battalion; maintain storage and usage regulations as prescribed by superiors;

e) Together with the Battalion Political Officer, organize political and ideological education for cadres and soldiers under their command; build unity, democracy, and effectively implement competition movements;

g) Guide, inspect, assist subordinate units in implementing tasks related to building the self-defense force; organize mid-term and final reviews, draw lessons, and report to the upper-level Military Command as stipulated.

Article 17. Duties and Tasks of the Deputy Battalion Commander and Equivalent

1. Responsibilities:

The Deputy Battalion Commander is subordinate to the Battalion Commander, assisting the Battalion Commander in military command; ready to replace the Battalion Commander in their absence; responsible to the Battalion Commander and the Battalion Political Officer for assigned tasks.

2. Tasks:

a) Be thoroughly familiar with assigned tasks, collect and study relevant situations, prepare plans for implementation and report to the Battalion Commander for approval;

b) Implement according to the approved plan;

c) Be thoroughly familiar with the battalion's situation, identify issues and promptly report to the Battalion Commander about solutions to resolve these issues;

d) Assist the Battalion Commander, guide, urge, monitor, inspect, and help subordinate units implement according to the plan. Report the situation and results to the Battalion Commander;

đ) Organize the drawing of lessons from each assigned task.

Article 18. Duties and Tasks of the Battalion Political Officer and Equivalent

1. Responsibilities:

The Battalion Political Officer is responsible before superiors for Party work and political work at the battalion level; all activities of the Battalion Political Officer are under the leadership of the Provincial Military Party Committee and the Party Committee of the agency or organization to which the battalion belongs; they are under the guidance of the Political Officer and the higher-level Political Department; together with the Battalion Commander, organize the construction of a strong unit comprehensively.

2. Tasks:

a) Together with the Battalion Commander, implement resolutions, directives, and orders from superiors, and battalion tasks; propose contents and methods to organize implementation;

b) Directly establish and implement plans for Party work and political work of the battalion during each period and task;

c) Together with the Battalion Command Team, be thoroughly familiar with the unit's situation, implement political and ideological education, current affairs propaganda, cultural and artistic activities, and the Quyet Thang Competition Movement for cadres and soldiers in the battalion;

d) Strictly manage internal political situations, educate cadres and soldiers to raise revolutionary vigilance awareness, strictly adhere to regulations on anti-sabotage and confidentiality, and build a strong unit comprehensively;

đ) Lead the implementation of Party work and political work contents in unit construction, focusing on tasks of organizing construction, training, and activities of the battalion;

e) Organize mid-term and final reviews to draw lessons from Party work and political work at the battalion level, and report the results of Party work and political work to superiors as stipulated.

Article 19. Duties and Tasks of the Deputy Political Instructor of the Battalion and Equivalent Positions

1. Responsibilities:

The Deputy Political Instructor assists the Political Instructor in political work for the self-defense force under the battalion's tasks; is responsible to the Political Instructor for assigned tasks; substitutes for the Political Instructor when absent.

2. Tasks:

a) Grasps all aspects of political work and promptly proposes measures to the Political Commissar for organizing and implementing assigned work;

b) Assists the Political Instructor in establishing and implementing plans for political work, grasping the ideological situation of the self-defense force; organizing political and legal education, propaganda on the Party's guidelines, policies, and state laws on national defense, security, national defense education, and civil defense for the self-defense force;

c) Summarizes the results of political work according to assigned tasks, reports to the Battalion Commander and Political Instructor periodically.

Article 20. Duties and Tasks of the Company Commander and Equivalent Positions

1. Responsibilities:

The Company Commander exercises management authority delegated by the Battalion Commander or higher military agency; is personally responsible to superiors and the company command team for all aspects of the company's activities. The Company Commander has the authority to issue orders to subordinate units to carry out the company's tasks.

2. Tasks:

a) Commands the company to implement the Party's guidelines and state laws; resolutions of the leadership body, directives, and orders of the head of the organization; instructions and orders of superior commanders;

b) Grasps the overall situation of the company, ensuring that the company is ready for combat upon superior orders; commands the company to complete all assigned tasks;

c) Establishes and organizes the implementation of plans for building, training, and operations of the company after approval by the competent authority;

d) Registers and strictly manages the cadre and soldier personnel under their jurisdiction; grasps the political, ideological, level of understanding, capability, and operational conditions of cadres and soldiers in the company;

đ) Grasps the quantity and quality of weapons, equipment, and means managed by the company; maintains proper storage and usage according to regulations;

e) Together with the Company Political Instructor, organizes political and ideological education for subordinate cadres and soldiers, builds unity and democracy, effectively implements competition movements;

g) Guides, inspects, and assists subordinate units in implementing tasks related to building the self-defense force; organizes mid-term and final reviews, draws lessons, and reports to the Military Command as prescribed.

Article 21. Duties and Tasks of the Deputy Company Commander and Equivalent Positions

1. Responsibilities:

The Deputy Company Commander is under the authority of the Company Commander; assists the Company Commander in military command; substitutes for the Company Commander when absent; is responsible to the Company Commander and Company Political Instructor for assigned tasks.

2. Tasks:

a) Grasps assigned tasks, collects and studies relevant situations, prepares plans for implementation, and reports to the Company Commander for approval;

b) Implements tasks according to approved plans;

c) Grasps the situation of the company, identifies issues, and promptly discusses solutions with the Company Commander;

d) Assists the Company Commander in guiding, urging, monitoring, inspecting, and helping subordinate units to implement according to plans. Grasps the situation and results, and reports to the Company Commander.

đ) Organize the drawing of lessons from each assigned task.

Article 22. Duties and Tasks of the Company Political Instructor and Equivalent Positions

1. Responsibilities:

The Company Political Instructor is responsible for and accountable to superiors for party work and political work at the company level; all activities of the Company Political Instructor are under the leadership of the same-level Party Committee, the higher-level Military Party Committee, and the guidance of the Political Instructor and the higher-level Political Department; together with the Company Commander, organize the construction of units to be comprehensively strong and complete assigned tasks.

2. Tasks:

a) Together with the Company Commander, implement resolutions, directives, orders from superiors, and the company's tasks; propose contents and measures to organize and implement them.

b) Directly build and implement plans for party work and political work of the company during each period and each task.

c) Together with the Company Command Board, grasp the situation of the unit, carry out ideological and political education, current affairs propaganda, effectively organize the Quyet Thang Competition Movement and cultural and artistic activities for officers and soldiers in the company.

d) Strictly manage internal political situations, educate officers and soldiers to raise their revolutionary vigilance awareness, strictly comply with regulations on security prevention, confidentiality, and building the unit comprehensively strong.

e) Chair the implementation of party work and political work contents in unit construction, focusing on organizational construction, training, combat operations, and public security tasks of the company.

g) Organize mid-term and final reviews to draw lessons from party work and political work in the company and report the results of party work and political work to superiors as prescribed.

Article 23. Duties and Tasks of the Deputy Company Political Instructor and Equivalent Positions

1. Responsibilities:

The Deputy Company Political Instructor assists the Company Political Instructor in political work for self-defense forces in implementing the company's tasks, is accountable to the Company Political Instructor for assigned tasks; substitutes for the Company Political Instructor when absent.

2. Tasks:

a) Grasps all aspects of political work and promptly proposes measures to the Political Commissar for organizing and implementing assigned work;

b) Assist the Company Political Instructor in establishing and implementing political work plans; grasp the ideological situation of the self-defense forces; organize political and legal education, propaganda on the Party's guidelines, policies, and state laws on national defense, security, national defense education, and civil defense for the self-defense forces.

c) Summarize the results of political work according to assigned tasks, report to the Company Commander and the Company Political Instructor periodically.

Article 24. Duties and Tasks of the Platoon Leader

1. Responsibilities:

The Platoon Leader is under the command of the Company Commander or the Chief of the Military Command Board of the commune, the Chief of the Military Command Board of the agency or organization at the grassroots level, or the Chief of the Military Command Board of the district; is accountable to superiors for all aspects of the platoon. The Platoon Leader has the authority to issue orders to Squad Leaders and soldiers under his command to perform platoon tasks.

2. Tasks:

a) Command the platoon to strictly follow the Party's guidelines, policies, state laws; orders and directives from superiors.

b) Grasp the overall situation of the platoon, maintain the platoon always ready for combat; Command the platoon to complete all assigned tasks.

c) Directly organize political education and military training for the platoon according to assigned contents; implement unit regulations, hold meetings with squads once every quarter.

d) Register and strictly manage personnel strength according to establishment, grasp the political and ideological situation, health status of officers and soldiers, their level of understanding and operational capacity within the platoon.

đ) Register and manage the quantity and quality of weapons, equipment, and other assets of the platoon; educate about the sense of responsibility in maintaining, preserving, and using the platoon's equipment.

e) Implement political work activities in the platoon, educate vigilance and confidentiality awareness; promote democracy in military work.

g) Conduct mid-term and final reviews, draw lessons from the implementation of various tasks and report results to superiors as prescribed.

Article 25. Duties and Tasks of the Squad Leader and Equivalent Positions

1. Responsibilities:

The Squad Leader is under the management of the Platoon Leader or Village Defense Team Leader or the Head of the Military Command Board at the commune level, the Head of the Military Command Board of agencies and organizations at the grassroots level; they are subject to the command of their direct superiors; they are responsible to their superiors and the squad collective for all aspects.

2. Tasks:

a) Command the squad to implement the Party's guidelines and policies, the State's laws; the regulations, orders, directives of superiors,

b) Be well-informed about all aspects of the squad, maintain the squad always ready to carry out all assigned tasks;

c) Directly command the squad in training, operations, and other tasks according to superior orders;

d) Set an example in complying with prescribed systems; ensure the squad follows living routines as stipulated;

đ) Closely manage the squad's authorized personnel strength, understand the thoughts, circumstances, capabilities, aspirations of each soldier in the squad;

e) Build unity within the squad, promote democracy, encourage competition to build a strong and comprehensive squad;

g) Timely draw lessons from the execution of squad tasks, report results to the direct superior as prescribed.

 

Chapter IV

IMPLEMENTING PROVISIONS

Article 26. Effective date

This Circular takes effect 45 days from the date of signature and replaces Decision No. 189/2006/QĐ-BQP dated January 11, 2006 by the Minister of National Defense on the duties, tasks, and working relationships of cadres in the Military Command Board of agencies and organizations, village defense cadres, and unit commanders of the Self-Defense Militia, and previous regulations inconsistent with this Circular.

Article 27. Responsibility for Implementation

The Deputy Chief of General Staff, Director of the Political General Department, Directors of the various general departments, military zone commanders, service branch commanders, Border Guard headquarters, relevant agencies and units under the Ministry of National Defense, central ministries and sectors, People's Committees at all levels, and heads of agencies and organizations are responsible for organizing and implementing this Circular./.
