Article 1. Issued herewith with this Decision the Regulations on the Procedures for Developing Annual Plans for Agriculture and Rural Areas of the Ministry of Agriculture and Rural Development.

Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

Article 3. Directors of Departments of Agriculture and Rural Development of provinces and centrally governed cities, Heads of competent agencies, and Heads of agencies assigned tasks shall be responsible for implementing this Decision.

REGULATIONS

PROCEDURES FOR DEVELOPING ANNUAL PLANS FOR AGRICULTURE AND RURAL AREAS
(Issued together with Decision No. 77/2001/QĐ-BNN dated July 27, 2001)

Article 1. Objectives and requirements

1- Purpose:

- To improve the quality of plans for developing agriculture and rural areas, ensuring investment in accordance with the orientation of the sector, meeting the requirements of industrialization and modernization of agriculture and rural areas;

- To enhance the responsibility of agencies and units within the Ministry of Agriculture and Rural Development in plan development;

- To strengthen coordination between units within the Ministry of Agriculture, between the Ministry of Agriculture and other Ministries and related agencies in planning for agricultural and rural development;

2- Requirements:

- To ensure that plans for developing agriculture and rural areas reflect democratic, scientific, and practical principles;

- To ensure unified state management over planning for agricultural and rural development.

Article 2. Procedures for Developing Sectoral Plans for Agriculture

1- Annually, after summarizing and evaluating the implementation of the first six months' plan, estimating the full-year plan's implementation, and determining subsequent development directions; while basing on the requirements and tasks for economic and social development set forth by the State (as reflected in the National Assembly's Resolutions and Government's Resolutions), guided by the leadership of the Ministry and the framework for developing socio-economic plans issued by the Ministry of Planning and Investment... The Department of Planning and Planning drafts the objectives, requirements, contents, and steps for developing plans for agriculture and rural areas, reports to the Ministry's leadership, and issues a Directive from the Minister regarding the development of the next year's agricultural and rural plans.

2- After receiving the Minister's Directive, the Department of Planning and Planning issues forms and guidelines for developing plans in each field to provincial Departments of Agriculture and Rural Development, affiliated enterprises, Institutes, Schools, and Bureaus; simultaneously organizing meetings to implement plan development.

3- Units base their work on the Directive and guidelines from the Ministry, their functions and responsibilities, and the fields they oversee, to determine goals, tasks, and implementation measures; at the same time, compile lists of approved investment projects to allocate investment plans. For investment projects already decided by the Ministry to prepare project proposals, they must proceed with preparation and submission to the Ministry for approval before October 15 to ensure timely allocation of investment plans. During the plan development process, units need to maintain regular communication with the Department of Planning and Planning to obtain necessary information, unify indicators and calculation methods.

3.1 Provincial Departments of Agriculture and Rural Development develop local plans for agricultural and rural development and submit them to the Ministry (Department of Planning and Planning) for consolidation across the entire sector.

3.2 The Department of Planning and Planning leads, coordinating with relevant Bureaus to organize working sessions with provincial Departments of Agriculture, affiliated companies, Institutes, and Schools to discuss and understand the situation of grassroots units.

3.3 Relevant Bureaus with specialized management functions involving multiple units and activities requiring budget allocation are responsible for developing specialized plans. Specifically:

- The Financial Accounting Bureau leads, coordinating with the Department of Planning and Planning and related units to develop plans for state budget revenue and expenditure (administrative and public service expenses).

- The Science and Technology Bureau leads, coordinating with the Department of Planning and Planning and related units to develop plans for science and technology development, plans for using public funds for science, and investment policies for construction of basic facilities for scientific units.

For basic investigation and environmental plans: The Science and Technology Bureau, along with the Department of Planning and Planning, receives basic investigation and environmental projects from units and guides their development. Special projects on water conservancy investigations require agreement from the Water Resources Management and Hydraulic Works Bureau. The Science and Technology Bureau establishes a scientific council to review projects, submitting them to the Ministry for approval. The Department of Planning and Planning allocates funds for projects according to the approved decision.

- The Basic Construction Investment Bureau leads, coordinating with relevant units to review investment projects and submit them to the Ministry for approval before October 15 (prior to the planning year) to provide a basis for allocating investment capital; monitoring investment execution in units.

- The Cadre and Civil Servant Organization Bureau leads, coordinating with the Department of Planning and Planning and related units to develop plans for human resource development and basic construction for postgraduate schools under the Ministry's management.

- The Agricultural Product Processing and Rural Industry Bureau leads, coordinating with relevant Bureaus to develop plans for sugarcane, fruit, salt, and agricultural machinery production.

- The Agricultural Extension and Forestry Promotion Bureau leads, coordinating with relevant Bureaus to develop plans for crop cultivation, animal husbandry, and seed implementation programs.

- The Water Resources Management and Hydraulic Works Bureau leads, coordinating with the Department of Planning and Planning and related units to develop plans for water conservancy investments.

- The Flood Control and River Dyke Management Bureau leads, coordinating with relevant Bureaus to develop plans for flood control and river dyke protection.

- The Forestry Development Bureau leads, coordinating with the Department of Planning and Planning and related units to develop plans for forestry development.

- The Forest Inspection Department, Animal Health Department, and Plant Protection Department shall take the lead in developing plans related to their respective areas of responsibility.

- Units responsible for national programs (Clean Water and Environmental Sanitation, Settled Agriculture and Rural Development, Program 661) shall take the lead in developing plans within their assigned responsibilities.

All specialized management Departments and Bureaus must complete draft plans and submit them to the Deputy Minister in charge of the sector for guidance. The Ministry will分级处理投资项目如下：

- The collective leadership of the Ministry shall approve the overall plan and projects in Groups A and B;

- The Minister and the Deputy Minister in charge of the sector shall approve specialized plans and projects in Group C.

Specialized plans, after being revised and supplemented according to the directives of the Deputy Minister in charge, shall be submitted to the Planning and Master Planning Department at the beginning of October to be included in the consolidated plan of the Sector.

4- Based on the plans of provincial departments, subordinate units, and sector-specific plans developed by functional Departments and Bureaus, the Planning and Master Planning Department shall compile a draft overall plan of the Sector and seek opinions from Departments, Bureaus, Institutes, etc., to further supplement and perfect it before submitting it to the Ministry's leadership and the Party Committee of the Ministry in November.

5- After the draft overall plan of the Sector has been revised and supplemented according to the directives of the Ministry's leadership and the Party Committee, it becomes the Ministry's plan and is submitted to relevant Ministries and sectors for their comments.

6- The Planning and Master Planning Department shall collect comments from relevant Ministries and sectors; prepare the comments for submission to the Minister for finalizing the plan according to the Minister's directives.

7- After completing the above steps, the overall plan of the Sector shall be submitted to the Ministry's leadership and the Party Committee for final approval, after which it shall be finalized as the official plan of the Sector signed by the Minister and submitted to the Government.

Article 3. The Planning and Master Planning Department is responsible for monitoring the documents submitted to the Government, working with central Ministries and sectors to protect the plan.

Upon receiving the official targets from the State, the Planning and Master Planning Department shall coordinate with functional Departments and Bureaus (as specified in Point 3.3) to unify the submission of the Ministry's decision on target allocation, notify the units, monitor implementation, and resolve difficulties to ensure that the units implement the plan effectively.

At the end of September and the beginning of October, the Planning and Master Planning Department shall coordinate with functional Departments and Bureaus to review the implementation of plans by units to develop adjustment plans, ensuring the highest efficiency in investment capital utilization.

Article 4. Heads of units are responsible for disseminating this Regulation to staff under their units, ensuring its thorough understanding and strict compliance. Annually, after each planning period, units shall convene meetings to review implementation, promote good practices, and draw lessons from non-compliance to address issues promptly.

Article 5. The Director of the Planning and Master Planning Department is responsible for guiding and supervising the implementation of the annual planning procedures by units throughout the Sector.

Article 6. This Regulation shall take effect fifteen days after the date of signature. During implementation, if there are any difficulties, they should be reported to the Planning and Master Planning Department for timely revision, supplementation, and adjustment to ensure compatibility.
