REGULATING THE SYSTEM FOR COLLECTION, PAYMENT AND MANAGEMENT OF USE OF FEES
FOR ISSUING NATIONAL IDENTITY CARDS AND FEES FOR HOUSEHOLD REGISTRATION AND MANAGEMENT
HOUSEHOLD REGISTRATION MANAGEMENT

Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;

Pursuant to Decree No. 05/1999/NĐ-CP dated February 3, 1999 of the Government on national identity cards;

Pursuant to Decree No. 51/CP dated May 10, 1997 of the Government on household registration and management;

The Ministry of Finance hereby regulates the system for collection, payment and management of use of fees for issuing national identity cards and fees for household registration and management as follows:

I. OBJECTS OF COLLECTION AND AMOUNT OF FEES

1. Objects of collection of fees for issuing national identity cards and fees for household registration and management are as follows:

a) Vietnamese citizens when being issued new, replaced, or reissued national identity cards by public security agencies must pay the fee as prescribed in this Circular, except for the following categories who are exempted from payment:

- Father, mother, wife (or husband) of martyrs, children under 18 years old of martyrs.

- War invalids, children under 18 years old of war invalids.

- Citizens belonging to communes, towns in highland areas according to the regulations of the National Ethnic Committee.

b) Vietnamese citizens when registering and managing household registration with public security agencies must pay the fee as prescribed in this Circular, except for the following categories who are exempted from payment:

- Father, mother, wife (or husband) of martyrs, children under 18 years old of martyrs.

- War invalids, children under 18 years old of war invalids.

- Citizens completing military service or police service and returning to register their household registration.

- Citizens belonging to communes, towns in highland areas according to the regulations of the National Ethnic Committee.

2. The amount of fees for issuing national identity cards and the amount of fees for household registration and management are specified in detail in the attached appendix table of this Circular.

II. ORGANIZATION OF COLLECTION, PAYMENT AND MANAGEMENT OF USE USE

1. Public security agencies collecting fees as prescribed in this Circular must implement the following:

a) Publicly display the fee rates for issuing national identity cards and fees for household registration and management at the agency's office where the fees are collected.

b) When collecting money for fees, issue a receipt for the fee payment to the payer, which is issued by the Ministry of Finance (General Department of Taxation). The receipt for fee payment is received at the local tax authority where the public security agency is located and is managed and used in accordance with the regulations of the Ministry of Finance.

c) Implement registration, declaration, collection, payment, settlement of fee payments in accordance with Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges.

2. Public security agencies directly collecting fees for issuing national identity cards and fees for household registration and management may retain a portion of the total fee revenue collected according to the percentage ratio as follows:

a) Public security agencies in districts of centrally-administered cities, inner-city wards of provincial-level cities may retain 35% (thirty-five percent).

b) Public security agencies in mountainous, border, and island communes and towns may retain the entire amount (one hundred percent).

c) Public security agencies in other areas outside those mentioned in points a and b above may retain 70% (seventy percent). percent).

3. The retained amount according to the percentage ratio prescribed in point 2 above shall be used to cover expenses related to the collection of fees as follows: - Direct costs serving the collection of fees such as printing (buying) forms, tables, books.

- Purchase of office supplies, telephone, electricity, water, travel expenses according to current standards and norms.

- Retain a bonus and welfare fund for staff directly involved in fee collection. The average annual maximum amount for each person is not more than three months' salary if the revenue this year exceeds last year, and two months' salary if the revenue this year is lower than last year.

Provincial public security agencies can reallocate the retained fee amounts between districts and counties to ensure funding for fee collection activities and must use them for their intended purposes, with legal documentation according to the prescribed system, and settle accounts annually; if unused, they can be carried over to the next year for continued use according to the regulations.

4. The total amount of fees collected, after deducting the retained amount according to the percentage ratio prescribed in point 2 above, the remaining amount must be paid into the state budget (central budget), corresponding chapter, type, and item in the current State Budget Classification Code 046, according to the procedures and deadlines stipulated in Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges.

This Circular takes effect 15 days from the date of signature. Previous regulations on fees for issuing national identity cards and fees for household registration and management that conflict with this Circular cease to be effective. During the implementation process, if there are any difficulties, please promptly report to the Ministry of Finance for research and resolution.

III- IMPLEMENTATION

This Circular takes effect fifteen days from the date of signature. Previous regulations on fees for issuing identity cards, registration, and household management that conflict with this Circular are no longer in effect.

During implementation, if there are any difficulties, it is requested that agencies, organizations, and individuals promptly report to the Ministry of Finance for study and resolution.
