Pursuant to the Government Organization Law dated September 30, 1992;
At the proposal of the Minister, Chairman of the Vietnam Youth Union and the Minister, Head of the Organization-Cadre Department of the Government;
After exchanging opinions and reaching agreement with the First Secretary of the Central Committee of the Ho Chi Minh Communist Youth Union;
To continue to promote the glorious tradition and the vanguard role of volunteer youth in the current period,
DECISION:
FUNCTIONS AND RESPONSIBILITIES
Article 1
Volunteer youth is a form of organizing a vanguard force of young people by the Ho Chi Minh Communist Youth Union to gather young people who are willing to participate in economic and social programs and projects of the State, while performing economic and social tasks, solving employment issues, and educating, training, and vocational training for young people.
Article 2
Volunteer youth units are established to perform the following tasks: implementing State programs and projects on economic and social development in regions with many difficulties (such as mountainous areas, remote areas, border areas, islands), degraded land in plains, coastal areas along rivers and seas; carrying out certain tasks that require a vanguard force during specific periods in difficult places such as disaster recovery, health sanitation, disease treatment, teaching, disseminating science and technology, etc.; educating labor for social groups and contributing to addressing social evils (prostitution, drug abuse).
Volunteer youth units assigned to implement programs, projects, or tasks mentioned above shall be responsible for completing the assigned tasks and shall enjoy the encouraging policies stipulated in this Decision.
Along with the tasks assigned through programs, projects, and State works, each volunteer youth unit also has the responsibility to educate, train, and provide vocational training for its members, ensuring that volunteer youth members have progress in moral qualities, ethics, technical skills, and professional knowledge during their service in the volunteer youth force.
ESTABLISHMENT AND OPERATION
Article 3
The State Planning Commission, central ministries and sectors, provincial People's Committees under the central government, district People's Committees shall discuss with the Ho Chi Minh Communist Youth Union at the same level (hereinafter referred to as the Union) and create favorable conditions for the Union to establish volunteer youth units to accept and implement State programs, projects, and works of the ministry, sector, or local area.
Organizational levels of the Union may proactively build programs and projects and discuss with ministries, sectors, or provincial, municipal, district People's Committees for review and inclusion in the plans of ministries, sectors, or local areas, then the Union will establish volunteer youth organizations to implement them.
In cases of necessity, the Central Union may establish volunteer youth units to implement programs and projects directly managed by the Central Union.
Local People's Committees and relevant functional agencies at the same level shall provide legal conditions such as issuing decisions to establish, granting operating permits, deciding to dissolve units when they have completed assigned tasks, etc., for volunteer youth organizations according to current State regulations based on the proposals of the Union at the same level.
Article 4
Volunteer youth includes young people aged 18 years and older, regardless of gender, ethnicity, religion, social class, educational level, who voluntarily join (if aged 16-17, parental consent is required). Volunteer youth are issued certificates and insignias of volunteer youth by the Central Union uniformly.
From now on, volunteer youth units will only be established in units implementing programs, projects, or assigned certain tasks during specific periods, in forms such as Volunteer Youth Teams, Volunteer Youth General Teams (the upper-level organization of teams, in cases where large programs or projects involve several teams), Volunteer Youth Schools, Volunteer Youth Centers providing vocational training for social groups.
Volunteer youth units, after completing programs and projects and transferring to enterprises, shall operate according to legal documents governing various types of enterprises.
Existing volunteer youth enterprises shall continue to operate, ensuring effective business operations and exemplary compliance with laws. No new volunteer youth enterprises shall be established in towns, cities, or urban districts.
Article 5
Volunteer youth units accepting programs and projects from any source of capital (loans, public funds, investment capital, etc.) shall organize internal management structures and operate according to current regulations on managing such capital sources, and conduct accounting and bookkeeping of the unit according to guidelines provided by the Ministry of Finance.
Volunteer youth units (implementing projects) are permitted to engage in joint ventures with foreign entities under the Law on Foreign Investment to implement assigned projects.
Article 6
Volunteer youth units (General Teams, Teams, Schools, Centers, etc.) shall have separate accounts and be allowed to use their own seals according to prescribed models.

The Central Committee of the Ho Chi Minh Communist Youth Union bases its directives and guidance to all levels of the Union on State policies to propose the establishment of volunteer youth units, provide cadres, and directly guide the activities of volunteer youth units, especially regarding the implementation of education and vocational training tasks for volunteer youth members.
The Central Committee of the Ho Chi Minh Communist Youth Union shall take the lead in discussing and drafting programs and projects to build and utilize volunteer youth in conjunction with State economic and social programs and projects with the Vietnam Youth Union and related functional agencies.
Article 8
The Vietnam Youth Commission is the state management agency for Volunteer Youth with the responsibility to guide, inspect, and urge Volunteer Youth units to implement Party and State policies, particularly those specific policies for Volunteer Youth, ensuring that Volunteer Youth organizations operate in the correct direction, complete assigned tasks, and ensure that Volunteer Youth members enjoy benefits prescribed by the State; at the same time, work with relevant ministries and sectors to guide the implementation and study, improve incentive policies for Volunteer Youth.
Article 9
The State Planning Commission, central ministries and sectors, or People's Committees of provinces, cities, districts, and counties, which assign tasks to Volunteer Youth units for programs and projects, are responsible for directly approving or reporting to competent authorities for approval of related documents for each program and project (such as feasibility studies, contracts, etc.) according to current regulations applicable to each type of project; direct functional agencies to ensure the supply of material means and financial sources according to the progress of implementing programs and projects; create favorable conditions within their scope of responsibility for Volunteer Youth units to complete assigned tasks; organize acceptance and evaluation of the results of programs and projects.
INCENTIVE POLICIES
Article 10
A Volunteer Youth unit assigned to implement a program or project shall enjoy the policies prescribed for that program or project. When implementing a program or project, Volunteer Youth members enter into labor contracts with the leadership of the Volunteer Youth unit as stipulated in Chapter IV of the Labor Code. Additionally, Volunteer Youth also enjoy additional benefits prescribed in the following Articles, including policies for units and members of units.
Article 11
Volunteer Youth units receiving programs and projects in mountainous regions, remote areas, border areas, islands, in addition to enjoying the current policies of those programs and projects, may be considered for investment support for educational, vocational training, cultural, sports, and other activities aimed at encouraging young people to settle down and contribute to improving literacy in those areas.
Article 12
For cadres and members of Volunteer Youth who perform duties for one year or more in mountainous regions, remote areas, border areas, and distant islands:
a) During the working period:
In addition to being entitled to allowances, working hours, sick leave, occupational accidents, occupational diseases, and provisions for female workers under the Labor Code, they also enjoy:
Being provided with initial uniforms once to ensure that members can perform tasks specified in their labor contracts.
They are entitled to an annual leave once a year. The duration of annual leave is applied as for non-commissioned officers and soldiers serving beyond the limit set by the Law on Military Service.
b) Upon completion of their duty in Volunteer Youth units (end of the program or project):
They will be issued a certificate of completion of duty in Volunteer Youth.
If returning to their place of origin, they will be provided with travel expenses and transportation allowances from the unit to their place of origin; they will be given priority in admission and recruitment for employment placement according to regulations for demobilized military personnel.
If they voluntarily continue to work in Volunteer Youth units with demand, they will be prioritized for signing new labor contracts.
They are exempt from public service labor; for every year served in Volunteer Youth, they are exempt from one year of public service labor.
They are exempt from compulsory military service if they have served in Volunteer Youth for 24 months or more.
Article 13
State officials dispatched to work for one year or more in Volunteer Youth units in mountainous regions, remote areas, border areas, and islands shall enjoy policies and treatment like state officials working in mountainous regions according to current regulations and shall also enjoy the policies for Volunteer Youth members as stipulated in Article 13 of this Decision.
Upon completion of their duty in Volunteer Youth units (end of the program or project), they return to work at the original agency or unit, which has the responsibility to arrange work; if they wish to work at another unit, they will be arranged in accordance with their needs and capabilities and those of the unit.
Article 14
After completing their duty (end of the program or project), if Volunteer Youth members voluntarily choose to stay and establish themselves long-term in mountainous regions, remote areas, border areas, and islands, they will enjoy policies and treatment for establishing new economic zones, while continuing to enjoy policies for Volunteer Youth.
If the above Volunteer Youth units meet the conditions and voluntarily transform into production and business enterprises operating in appropriate industries and professions under the law, they will be facilitated to register and enjoy policies for establishing new economic zones, while continuing to enjoy policies for Volunteer Youth.
IMPLEMENTATION
Article 15
This Decision replaces previous Government documents on Volunteer Youth and takes effect from the date of issuance.
The Ministry of Finance, in collaboration with the Ministry of Labor, Invalids, and Social Affairs, the State Planning Commission, and the Vietnam Youth Commission, shall guide and specify the sources of funding to implement the incentive policies for Volunteer Youth prescribed in this Decision.
It is requested that the Communist Youth Union Central Committee of Ho Chi Minh closely coordinate with local authorities in implementing this Decision.
Article 16
The Minister, Head of a ministry equivalent to a ministry, head of a government-affiliated agency, Chairman of the People's Committee of provinces and centrally-administered cities, are responsible for closely coordinating with the Communist Youth Union at the same level to implement this Decision. The Minister, Director of the Government Office is responsible for assisting the Prime Minister in overseeing and urging the implementation of this Decision.
The Minister in charge of the Vietnam Youth Union shall be responsible for guiding the inspection of the implementation of this Decision and regularly reporting to the Prime Minister on any issues arising./.
