Pursuant to Decree No. 02/2001/NĐ-CP dated January 9, 2001 of the Government detailing the implementation of the Labor Code and the Education Law on vocational training;
At the proposal of the General Director of the Vocational Training Administration,
DECISION:
Article 1: The Vocational Training School Charter is hereby issued together with this Decision.
Article 2: THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.
All previous regulations concerning Vocational Training Schools that conflict with this Charter are hereby abolished.
Article 3: The Heads of the Office of the Ministry, the General Director of the General Department of Vocational Training, Principals of Vocational Training Schools, and Heads of related units shall be responsible for implementing this Decision./.

VOCATIONAL TRAINING SCHOOL CHARTER

PART I
GENERAL PROVISIONS
Article 1. Scope of Application
1. This Charter stipulates the functions, tasks, powers, organizational structure, and activities of vocational training schools;
2. Vocational training schools referred to in this Charter include public vocational training schools, semi-public vocational training schools, private vocational training schools, and privately-owned vocational training schools. Semi-public, private, and privately-owned vocational training schools are collectively referred to as non-public vocational training schools;
3. This Charter does not apply to vocational training schools with foreign investment capital.
Article 2. Position of Vocational Training Schools
1. Vocational training schools are educational institutions within the national education system, established and operated in accordance with the law;
2. Vocational training schools are public service organizations with income, possessing legal personality, their own seals, and separate bank accounts.
Article 3. Conditions for Establishing Vocational Training Schools
Vocational training schools may be established when they meet the conditions specified in the Circular guiding the establishment, registration of operations, division, merger, suspension, and dissolution of vocational training institutions issued by the Ministry of Labor, Invalids and Social Affairs.
Article 4. Management of Vocational Training Schools
1. Vocational training schools are subject to unified state management over vocational training by the Ministry of Labor, Invalids and Social Affairs;
2. Vocational training schools are directly managed by the authority issuing the decision to establish them, while also being subject to territorial management by the People's Committee of the province or centrally-administered city where the school is located.
Article 5. Tasks and Powers of Vocational Training Schools
1. Based on demand and training capacity, develop annual and long-term vocational training plans for the school;
2. Implement long-term and short-term vocational training, and improve occupational skills:
a) Develop long-term and short-term vocational training programs according to the principles for developing vocational training programs issued by the Ministry of Labor, Invalids and Social Affairs; implement them upon approval or consent from the competent management authority;
b) Develop and implement programs to improve occupational skills for technical workers and staff according to occupational skill standards issued by the competent state authority;
c) Organize the compilation and review of vocational training materials and textbooks based on the assessment of the Evaluation Board established by the Principal;
3. Organize and manage the vocational training and improvement process; recognize graduation and issue vocational certificates, qualification certificates, and certificates of occupational skill improvement according to the regulations of the Ministry of Labor, Invalids and Social Affairs;
4. Conduct student recruitment, education, and management; coordinate with students' families and society in educational activities and build a healthy educational environment;
5. Research and apply scientific and technological advancements and technology in the vocational training process;
6. Manage the teaching staff, officials, and employees;
7. Manage and utilize land, equipment, other assets, and finances in accordance with the law;
8. Exploit and effectively utilize resources for vocational training; provide technical services, transfer technology, and organize production and business activities consistent with the training profession as prescribed by law;
9. Collaborate with economic, educational, and scientific organizations in vocational training and skill improvement;
10. Provide advice on vocational training and employment to students;
11. Participate in universal vocational training for workers; cooperate in technical education and career guidance for secondary school students;
12. Be granted land, lease land, exempted or reduced taxes, and credit loans for vocational training development as prescribed by law;
13. Implement regular and ad hoc reporting systems as required by higher-level management authorities;
14. Other tasks and powers as prescribed by law;
PART II
ORGANIZATION OF THE VOCATIONAL TRAINING PROCESS
Article 6. Principles and Guidelines for Vocational Training
Combining study with practice, integrating education with productive labor, linking schools with families and society; ensuring comprehensive education, focusing on practical occupational skills, emphasizing moral education, professional ethics, discipline, industrial work habits, and health.
Article 7. Content and Methods of Vocational Training
1. Focus on occupational skill training; ensure practicality and modernity, aligning with technology and industry;
2. Encourage students' initiative, proactivity, and creative thinking; combine professional knowledge and technical training with practical skill training to ensure graduates can perform their jobs after graduation;
3. This should be reflected in detailed programs; there must be teaching materials and textbooks for instruction and learning.
Article 8. Training Plans and Training Programs
1. Long-term and short-term training plans for each profession are approved by the direct superior management authority of the school;
2. Long-term vocational training programs and contents are issued or approved by the competent management authority according to the分级任务如下:
The short-term vocational training program and content shall be established by the school; the Rector shall promulge it for use at the school after obtaining approval from the directly superior administrative body of the school.
The program, content, and organizational form of each advanced vocational training course shall be established by the school based on technical level standards and according to agreements with learners or sending organizations; the Rector shall promulge it for use at the school.
Article 9. Study Time
1. Theoretical study time in class is calculated in periods; each period lasts 45 minutes; not exceeding six periods per day;
2. Practical study time is calculated in hours; each hour lasts 60 minutes; not exceeding eight hours per day.
Article 10. Evaluation of Learning Results and Moral Training
1. Learning results are evaluated on a scale of 0 to 10;
2. Moral training results are evaluated through classification: excellent, good, average, poor;
3. The overall classification regarding learning and moral training shall be carried out in accordance with the examination, inspection, promotion, and graduation regulations issued by the Ministry of Labor, Invalids, and Social Affairs.
CHAPTER III
TEACHERS, STAFF, AND EMPLOYEES
Article 11. School Vocational Teachers
1. They are responsible for teaching and educating students directly; they play a leading role in all teaching and educational activities;
2. They must meet the qualification standards for professional and vocational skills as stipulated in Article 11 of Decree No. 02/2001/NĐ-CP dated January 9, 2001, detailing the implementation of the Labor Code and the Education Law concerning vocational education;
3. Teachers within the establishment are recruited according to the national standards and job titles;
Contract teachers are hired by the Rector in accordance with the provisions of the law.
Article 12. Rights of School Vocational Teachers
1. To teach according to their assigned major and plan;
2. To use teaching materials, equipment, and technical facilities of the school to fulfill their teaching and educational tasks and scientific experiments;
3. To receive training and further education to improve their professional and vocational skills as prescribed by the state;
4. To participate in discussions and provide opinions on the curriculum, content, and teaching methods; on policies and plans for development, organization, and management of the school and issues related to the rights of teachers;
5. To enjoy summer vacation, semester break, Tet holiday, public holidays, weekly rest days, and other rest days as prescribed by the state and labor contracts;
6. To be contracted for guest lectures and scientific experiments at other vocational schools and educational institutions as assigned by the Rector;
7. To enjoy other rights as prescribed by the law.
Article 13. Duties of School Vocational Teachers
1. To perform teaching, educational, and scientific experimental tasks in accordance with the assigned programs and plans or contracts;
2. To set a good example in fulfilling civic duties; to comply with state laws, policies, and regulations; to follow the charter, rules, and internal regulations of the school; to participate in common activities within the school and in the local community where the school is located;
3. To continuously study and improve their professional and vocational skills; to cultivate moral character; to maintain the reputation and honor of educators; to build a united, friendly, respectful, and supportive team;
4. To respect the dignity and treat students fairly; to protect the legitimate rights and interests of students.
Article 14. Staff and Employees of School Vocational Education
Staff and employees engaged in management and service work in vocational schools have the duty to strictly fulfill their tasks and responsibilities; to contribute to the education and training of students; to be respected and to enjoy benefits as prescribed by the state or as stipulated in labor contracts.
PART IV
STUDENTS
Article 15. Students of Vocational Schools
All Vietnamese citizens who wish to learn a trade and meet the required conditions may register to enroll in vocational training;
Learners in all training systems (long-term, short-term) in vocational schools are referred to as students;
Article 16. Rights of Students in Vocational Schools
1. To study and train according to the training objectives;
2. To be respected and treated equally; to be provided with timely and complete information about their academic and training results;
3. To use the school's technical facilities for study, training, recreation, and entertainment purposes;
4. To participate in activities of social organizations within the school;
5. To enjoy social policies and material and spiritual benefits as prescribed by the state for vocational students;
6. To be guaranteed safe working conditions and hygiene as prescribed by law;
7. To directly or through their authorized representatives propose solutions to the school to contribute to its development and protect their legitimate rights and interests;
8. To appeal to the Rector or higher authorities if their legitimate rights and interests are not resolved properly or if disciplinary measures are inappropriate;
9. To receive a vocational certificate upon graduation or a vocational certificate upon completion of the course.
Article 17. Duties of Students in Vocational Schools
1. To comply with state laws; to implement the charter, rules, and internal regulations of the school;
2. To study and train according to the school's training and education plan and program;
3. To respect teachers, staff, and employees of the school;
4. To participate in appropriate labor and social activities according to age, health, and ability;
5. To comply with safety and hygiene regulations;
6. To maintain and protect the school's property, public works within and outside the school, and the environment; to maintain public order and safety;
7. To lead a civilized and healthy lifestyle; to contribute to building, protecting, and promoting the school's traditions;
8. To pay tuition fees fully and on time as prescribed.
CHAPTER V
ORGANIZATION AND MANAGEMENT
PART 1 - ORGANIZATION AND MANAGEMENT STRUCTURE
Article 18. School organization structure
1. Principal, some Deputy Principals; Advisory Councils;
2. Functional departments, vocational departments; faculties, subject departments under direct jurisdiction;
3. Student classes;
4. Departments serving vocational training.
Article 19. Principal of a vocational school
1. The Principal is responsible for managing and directing all activities of the school;
2. The Principal of a public school is appointed or relieved of duty by the Head of the agency that decides to establish the school;
The Principal of a semi-public or private school is recognized by the Head of the agency that decides to establish the school upon proposal by the Board of Management;
The Principal of a private school is recognized by the Chairman of the People's Committee of the province or centrally governed city upon proposal by the Department of Labor, Invalids and Social Affairs.
Article 20. Qualifications of the Principal of a vocational school
1. Must be a person with good political and moral qualities; reputable in professional and vocational fields; capable of management; healthy;
2. Must have a bachelor’s degree in a relevant field suitable for the school's training mission;
3. Must be a teacher, having taught at a professional school for at least five years.
Article 21. Rights of the Principal of a vocational school
1. To decide on policies and measures to implement all tasks of the school as stipulated in Article 5 of this Regulation and other activities of the school;
2. To decide on the recruitment or signing of labor contracts with teachers, staff members according to the provisions of the law;
3. To decide on rewards and disciplinary actions against teachers, staff members, and students within the scope of authority delegated for management;
4. To decide on the establishment or dissolution of Advisory Councils;
5. To nominate Deputy Principals for decision by the competent management authority to appoint or recognize;
6. To appoint or relieve from duty heads of departments, deputy heads of departments, faculties, subject departments under direct jurisdiction, and other training service units according to the classification of the competent management authority;
7. To issue vocational certificates and certificates of vocational training to students in accordance with the regulations on issuing vocational certificates and training certificates issued by the Ministry of Labor, Invalids and Social Affairs.
Article 22. Duties of the Principal of a vocational school
1. To build the organizational structure of the school in compliance with the provisions of this charter, submit to the immediate superior management authority for approval;
2. To build and implement the charter of the school correctly after it has been approved by the immediate superior management authority;
3. To organize the development and direct the implementation of training plans, training programs, textbook compilation, teaching materials... in accordance with the regulations and guidance of the competent management authorities;
To comply with the regulations on student admission, on organizing the training process as prescribed;
4. To exploit, manage, and use resources effectively to achieve training objectives, ensuring the quality and effectiveness of training;
5. To constantly care for improving working, teaching, and learning conditions for staff, teachers, and students;
6. To comply with state regulations on property management, financial management, and economic activities (if any) within the school;
7. To organize and direct the creation of a healthy educational environment; ensure political security and social order and safety in the school and in the locality where the school is located; prevent social evils from infiltrating the school;
8. To implement democratic regulations in the school; implement policies and systems prescribed by the State for staff, teachers, and students in the school;
9. To comply with regulations on inspection and supervision by the State and by competent management authorities;
10. To fully and promptly report regularly and urgently on the situation of all aspects of the school to higher-level management agencies; to report to relevant agencies and organizations (when required) in accordance with regulations.
Article 23. Deputy Principal of a vocational school
1. The Deputy Principal assists the Principal in managing and directing certain aspects of work assigned by the Principal; is directly responsible to the Principal for those aspects of work;
2. The Deputy Principal must be a person with good political and moral qualities; have a bachelor’s degree; capable of management; healthy;
The Deputy Principal in charge of training, in addition to the above criteria, must have expertise suitable for the school's training mission; must be a teacher, having taught at a professional school for at least three years, reputable in professional and vocational fields;
3. The Deputy Principal of a public school is appointed by the Principal upon proposal by the Head of the agency that decides to establish the school;
The Deputy Principal of a semi-public or private school is recognized by the Head of the agency that decides to establish the school upon proposal by the Principal and approval by the Board of Management;
The Deputy Principal of a private school is recognized by the Chairman of the People's Committee of the province or centrally governed city upon proposal by the Principal and approval by the Director of the Department of Labor, Invalids and Social Affairs.
Article 24. Advisory Boards
1. The Training Council has the task of advising the Principal in implementing the duties and powers of the school regarding education and training; established by the Principal at the beginning of each academic year and serves as the Chair of the Council;
Members of the Training Council include: Deputy Principals, Secretary of the Party Committee (or Branch Secretary), Secretary of the Ho Chi Minh Communist Youth Union, President of the Trade Union, Heads of departments, faculties, subject departments under direct jurisdiction, some reputable teachers of the school, and representatives of enterprises;
The Head of the Training Department serves as Secretary of the Council;
The Training Council convenes at least twice a year, at the start of each semester. Additional meetings of the Council are convened by the Principal as necessary.
2. Other Advisory Councils are established by the Principal; their task is to advise the Principal on specific issues in each area of school activity;
Members, functions, duties, and operational mechanisms of each Council are defined by the Principal.
Article 25. Functional Departments, Vocational Departments
The Principal of a vocational school is assisted by functional departments and vocational departments (collectively referred to as departments). Departments have the responsibility to manage, consolidate, propose opinions, organize the implementation of decisions of the Principal according to the functions assigned.
1. All types of vocational training schools, including public, semi-public, private, and private schools, shall establish a Training Department. The Training Department shall have the following main responsibilities:
a) Assist the Principal in:
- Determining objectives, developing plans, curricula, and educational programs;
- Developing teaching schedules, organizing the compilation of curricula, materials, and textbooks;
- Organizing admissions and graduation exams;
- Directing class teacher activities, promoting excellence, rewarding achievements, and handling violations during training activities;
b) Guiding and supervising the implementation of vocational training, skill enhancement, and student education plans;
c) Organizing and managing the training and enhancement processes;
d) Establishing and implementing plans for professional skill enhancement for teachers, and activities related to teaching and learning;
đ) Summarizing, proposing procurement of equipment and facilities for training purposes;
e) Monitoring, summarizing, evaluating the quality of training activities, compiling statistics, and preparing reports on educational and training issues according to the regulations of the superior management authority and the Principal.
2. Other functional departments may be established at the request of the Principal based on the scale, workload, and specific conditions of the school in areas such as administration, management, integration, organization, political work, student education management, financial management, equipment management, basic construction...
3. The establishment of functional and specialized departments in vocational training schools:
- For public schools: proposed by the Principal, with the direct superior management authority issuing the decision to establish;
- For semi-public and private schools: decided by the Principal based on approval from the Board of Directors;
- For private schools: decided by the Principal.
Article 26. Departments and subject groups subordinate to the school
1. Departments are organized according to trades or groups of trades being trained; subject groups subordinate to the school are organized according to common subjects;
2. Departments and subject groups subordinate to the school have the following responsibilities:
a) Implementing teaching and learning plans and educational activities according to the annual training plan of the school;
b) Compiling curricula, materials, and textbooks when assigned; organizing research to innovate content and improve teaching methods to ensure and enhance training quality;
c) Organizing experimental activities and applied scientific research to incorporate technology into the training process;
d) Managing teachers, staff, and students within their units;
đ) Efficiently managing and utilizing infrastructure and equipment as prescribed by the Principal; proposing and establishing plans for supplementary and maintenance of teaching and learning equipment;
e) Reporting training and educational results regularly to the school as prescribed by the Principal.
3. The establishment of departments and subject groups subordinate to the school is based on the trade, scale of training, number of teachers, and follows the provisions for departments under Clause 3 of Article 25 of this Charter;
4. Departments and subject groups subordinate to the school shall have a Head of Department and a Head of Subject Group, who may also have Deputy Heads of Department and Deputy Heads of Subject Group to assist them. The Head of Department and Head of Subject Group are responsible for managing and directing the activities of their departments and groups according to the tasks specified in Clause 2 of this Article and the delegation of the Principal.
Article 27. Student classes in vocational training schools
1. Student classes are organized according to the trade being trained and the course duration. Depending on the characteristics of each trade, each class shall not exceed 35 students;
2. Each student class has a class teacher. The class teacher must be a teacher experienced in organizing and managing student study and moral development activities. The class teacher is nominated by the Head of Department or Head of Subject Group and appointed by the Principal;
Specific duties of the class teacher are defined by the Principal.
3. Each student class has a class president and one to two vice-presidents. The class president and vice-presidents are nominated by the class teacher and elected by the class at the beginning of each academic year, with the Principal issuing a decision to recognize them;
Article 28. Service units for vocational training
In vocational training schools, there are service units participating in and supporting vocational training activities such as libraries, technology application and labor production centers, sports and cultural facilities, dormitories... The organization and management of these units' activities are regulated by the Principal in accordance with the law.
Article 29. Board of Directors of non-public vocational training schools
1. The Board of Directors is elected by the agencies, organizations, collectives, and individuals that jointly establish the school. The Board of Directors elects the Chairman of the Board of Directors;
2. The functions, responsibilities, and powers of the Board of Directors are stipulated in the charter of organization and operation of non-public vocational training schools.
PART 2 - POLITICAL ORGANIZATIONS, ASSOCIATIONS, AND SOCIAL ORGANIZATIONS
Article 30. Party Organization in Vocational Schools
The Communist Party of Vietnam organization in vocational schools leads the school and operates according to the Party Charter within the framework of the Constitution and laws.
Article 31. Associations and Social Organizations in Vocational Schools
Associations and social organizations in vocational schools operate according to their own charters, as prescribed by law, and have the responsibility to contribute to the implementation of educational goals as stipulated by the Education Law.
Chapter VI
PHYSICAL INFRASTRUCTURE, EQUIPMENT, AND FINANCE
Article 32. Physical Infrastructure and Equipment of Vocational Schools
1. Vocational schools must have sufficient physical infrastructure, equipment, teaching aids, and technical teaching tools to ensure that vocational training reaches the required level and skills in accordance with training objectives;
2. Standards and norms for physical infrastructure and equipment corresponding to each training profession are specified by the Ministry of Labor, Invalids, and Social Affairs.
Article 33. Financial Management
1. Publicly funded vocational schools implement financial management in accordance with current state regulations;
2. Privately funded vocational schools implement financial management in accordance with Circular Joint Circular No. 44/2000/TTLT/BTC-BGDĐT-BLDTBXH dated May 23, 2000, guiding the financial management system for non-public entities operating in the field of education and training.
Chapter VII
RELATIONSHIPS BETWEEN THE SCHOOL, PARENTS, AND SOCIETY
Article 34. School-Parent Relationships
1. The school has the responsibility to publicly announce plans, enrollment targets, standards, admission regulations for vocational training, and policies and systems for vocational students annually; actively coordinate with parents to effectively carry out educational work with students during their schooling;
2. Parents have the responsibility to create conditions for their children to study, train, and participate in school activities; closely cooperate with the school in educational activities aimed at developing the comprehensive personality of students.
Article 35. School-Society Relationships
The school has the responsibility:
1. To link with production facilities, research institutions applying science and technology, and other training institutions to facilitate opportunities for teachers and students to visit, intern, practice production, apply technology... thereby linking teaching and learning with practical production;
2. To coordinate with functional agencies of ministries, sectors, localities, and production and business establishments in determining training needs and linking training with employment.
