Regarding the approval of the plan to adjust the restructuring and renewal of state-owned enterprises under the People's Committee of Hau Giang Province
under the People's Committee of Can Tho City
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decision No. 155/2004/QĐ-TTg dated August 24, 2004 of the Prime Minister on issuing criteria and classification lists for state-owned enterprises and independent accounting subsidiaries under state-owned corporations;
Considering the proposal of the People's Committee of Can Tho City,
DECISION:
Article 1. Approves the plan for restructuring and reforming state-owned enterprises under the People's Committee of Can Tho City in 2005 as set out in the Appendix attached hereto.
Article 2. The Chairman of the People's Committee of Can Tho City shall be responsible for:
1. Directing the restructuring and reform of state-owned enterprises under its jurisdiction in accordance with the approved content. For businesses that cannot be listed, take the initiative to restructure through one of the following forms: auction sale, dissolution, bankruptcy, and report to the Prime Minister.
2. Drafting the Plan for Restructuring the Sông Hậu and Cờ Đỏ Farms and submit it to the Ministry of Agriculture and Rural Development for review before presenting it to the Prime Minister for consideration and decision.
3. Propose to the Prime Minister the form of restructuring for the following companies: Cần Thơ Trading Company, Cần Tho Production and Construction Materials Trading Company.
4. Recommend to the Communist Party Committee of Can Tho City to list or implement other forms of restructuring for the Export Livestock Production Company and the Mekong Company because these companies do not fall within the category where the State needs to hold 100% of the charter capital.
Article 3. The Ministries of Finance, Planning and Investment, Home Affairs, Labor, Invalids and Social Affairs, Agriculture and Rural Development, and related agencies shall cooperate with the People's Committee of Can Tho City in implementing this Decision.
The Steering Committee for Enterprise Reform and Development shall be responsible for urging, guiding, and monitoring the implementation.
Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette. The Chairman of the People's Committee of Can Tho City and the heads of relevant agencies are responsible for enforcing this Decision./.
