CIRCULAR

Regulations on national technical standards for state reserves concerning weapons,
explosives, and support tools managed by the Ministry of Public Security

 

Based on the Law on Animal Husbandry 2018;

Pursuant to the National Reserve Ordinance 2004;

Pursuant to the Ordinance on Management and Use of Weapons, Explosives, and Support Tools 2011;

Pursuant to Decree No. 196/2004/NĐ-CP dated December 2, 2004 detailing the implementation of the National Reserve Ordinance;

Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 detailing and guiding the implementation of certain provisions of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 77/2009/NĐ-CP dated September 15, 2009 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

The Ministry of Public Security hereby promulgates national technical standards for state reserves concerning weapons, explosives, and support tools managed by the Ministry of Public Security as follows:

Article 1. Scope of Regulation

These Circulars stipulate national technical standards regarding technical requirements, delivery and receipt, transportation, storage, management of weapons, explosives, and support tools belonging to state reserves managed by the Ministry of Public Security, principles of application of such standards, funding guarantees, and responsibilities of related organizations and individuals.

Article 2. Applicability

This Circular applies to:

1. Units assigned the task of managing, delivering and receiving, transporting, and storing weapons, explosives, and support tools belonging to state reserves managed by the Ministry of Public Security;

2. Organizations and individuals related to the application of national technical standards for state reserves concerning weapons, explosives, and support tools managed by the Ministry of Public Security (hereinafter referred to as national technical standards for state reserves).

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Weapons include military weapons, crude weapons, and sports weapons.

2. Explosives include gunpowder and explosive accessories.

3. Support tools are types of tools specified in points a, b, c, and d Clause 9 Article 3 of the Ordinance on Management and Use of Weapons, Explosives, and Support Tools.

4. Regular storage involves regularly checking the quality of goods, maintaining appropriate temperature and humidity, cleaning warehouses daily and weekly according to a specific sequence, and preventing pests.

5. Periodic storage involves annually inspecting the operational capability of equipment, cleaning, rust prevention, and moisture protection according to standards, storing boxes of equipment, and other related tasks according to a specific sequence.

6. A sealed warehouse is a sturdy warehouse with a roof, heat-resistant ceiling, surrounding walls, and reinforced concrete floor; it can withstand environmental influences and has heat and moisture escape capabilities; it is used for storing items requiring special storage conditions.

7. A semi-sealed warehouse is a sturdy warehouse with a heat-resistant roof, reinforced concrete floor; it can withstand rain and sun; it is used for storing items without special protection requirements.

Article 4. Principles of applying technical standards for state reserves

2. Ensuring the purpose, requirements, safety, effectiveness, and contributing to national security protection and maintaining public order and social safety.

2. Ensuring the improvement of the quality and effectiveness of state reserve activities, meeting security and safety requirements.

3. Ensuring practical needs and being consistent with the state budget allocated to the Ministry of Public Security at each stage.

3. Encouraging the economical and rational use.

4. Strictly prohibiting the abuse of the application of technical standards for state reserves for personal gain or causing damage to state property.

Article 5. Technical standards for state reserves

1. Attached to this Circular are national technical standards for state reserves concerning weapons, explosives, and support tools managed by the Ministry of Public Security.

2. The technical standards prescribed in Clause 1 of this Article shall be uniformly applied throughout the People's Public Security Force. In cases where amendments or supplements to these standards are necessary, based on actual requirements and circumstances, the Logistics and Technical General Department shall take the lead in coordinating with relevant units to examine and propose to the Minister for amendment or supplementation in accordance with relevant laws.

Article 6. Funding to ensure the implementation of technical standards for state reserves

1. The funding to ensure the implementation of technical standards for state reserves shall be allocated in the annual budget estimate of the Ministry of Public Security.

2. Based on the technical standards for state reserves, the General Logistics Department - Technical Service shall coordinate with the Financial Department to develop the annual budget estimate to ensure implementation, and submit it to the competent authority for approval.

Article 7. Responsibilities of organizations and individuals in implementing technical standards for state reserves

1. Organizations and individuals providing weapons, explosives, and support equipment under the state reserves managed by the Ministry of Public Security must meet the national technical standards issued together with this Circular.

2. The General Logistics Department - Technical Service has the responsibility to direct relevant subordinate units to carry out the handover, transportation, storage, and management of weapons, explosives, and support equipment under the state reserves in accordance with the provisions of this Circular.

Article 8. Effective Date

1. This Circular takes effect from February 1, 2012.

2. Units that have applied technical standards equal to or higher than the national technical standards for state reserves before the effective date of this Circular may continue to apply them until their service life expires; in cases where they have not yet applied or have applied lower standards than those set forth in this Circular, they shall implement this Circular.

Article 9. Responsibility for implementation

1. The Director of the General Logistics Department - Technical Service is responsible for directing the Warehousing Department to organize the implementation, provide guidance, and supervise the implementation of this Circular.

2. Directors of General Departments, Heads of subordinate units under the Ministry, Provincial Police Chiefs, and Directors of Fire Prevention and Control Departments are responsible for enforcing this Circular.

During the implementation process, if any difficulties arise, local police units and departments should report to the Ministry of Public Security (through the General Logistics Department - Technical Service) for timely guidance.

1. TECHNICAL REQUIREMENTS

1. 1. Requirements for weapons, explosives, and support equipment

1. 1.1. Requirements for weapons, explosives, and support equipment entering the warehouse

- Correct in specifications, labels, and markings; 

- Quality upon entry must be new at 100%, all devices must function properly according to the signed contracts and meet the manufacturer's standards; 

- Accessories accompanying the equipment must be compatible, correct according to the signed supply contracts, and meet the manufacturer's standards.

1. 1.2. Classification of weapons, explosives, and support equipment for storage purposes

Based on the composition, specifications, quantity, storage requirements, and usage requirements, weapons, explosives, and support equipment under the state reserves managed by the Ministry of Public Security are divided into two groups as follows:

 - Group One includes types of weapons, explosives, and support equipment requiring special storage conditions: rifles with telescopic sights, binoculars, gas masks, bulletproof vests, helmets, explosive containers, and similar items must be stored at appropriate temperatures and humidity levels, protected from insect damage, and kept in enclosed warehouses.

- Group Two includes weapons, explosives, and support equipment without special storage requirements: rifles, ammunition, AK bulletproof shields, and similar items need to be stored in semi-enclosed warehouses.

1. 2. General requirements for warehouses and equipment within warehouses

1. 3.1. General requirements for warehouses

a) For warehouses storing weapons and support equipment:

- Must comply with current construction standards; - Must have a roof cover, protective walls, and be resistant to rain and sun; 

- The warehouse floor must withstand a minimum load of 5 tons/m2;

- Must meet fire prevention, firefighting, lightning protection, security, and drainage requirements; 

- Must meet lighting requirements for security, inspection, and storage operations.

b) For warehouses storing ammunition and explosives, specific standards apply.

1. 3.2. Equipment within warehouses

- For semi-enclosed warehouses: Must be equipped with various shelving units or racks, thermometers, hygrometers, dehumidifiers, brooms, cleaning cloths, dusting tools, storage, import/export, firefighting equipment, and other devices meeting the manufacturer's standards.

- Enclosed warehouses: Equipped similarly to semi-enclosed warehouses but with additional equipment such as air conditioners, storage cabinets, dehumidifiers, air dryers, and other devices meeting the manufacturer's standards.

2. HANDOVER PROCEDURES

2. 1. Transportation

- Transport vehicles for weapons, explosives, and support equipment must have sealed, clean compartments free of harmful chemicals. Weapons, explosives, and support equipment cannot be transported with other goods or flammable/explosive materials; 

- During transportation, strict adherence to safety regulations for fire and explosion prevention must be maintained; 

- When arranging weapons, explosives, and support equipment, they must be done according to each item's safety rules, avoiding impacts.

2. 2. Inspection procedures when handing over and receiving goods

2. 2.1. Inspection of documents and records

Before handing over and receiving weapons, explosives, and support equipment for storage, the following documents must be available: 

- Import plan, warehouse receipt; 

- Purchase and production contracts; - Technical documents from the manufacturer regarding structure, usage instructions, storage, and maintenance for each type of weapon, explosive, and support equipment (for imported goods, there must be one copy of these documents translated into Vietnamese) and related documents.

2. 2.2. Inspection of goods during handover and receipt

2. 2.2.1. Quantity, quality, and type inspection of goods The quantity, quality, and type of goods handed over and received must match the handover and purchase-sale documents.

2. 2.2.2. Inspection of outer packaging and packing Inspect the marking on the packaging, its suitability for the goods, and the quality condition of the packaging.

2. 2.2.3. Quality inspection

- External inspection: Inspect the marking on the goods, the brightness and glossiness of the equipment, check for signs of self-aging, rusting, scratches, warping, or bending.

- Check the quantity and compatibility of the accessories accompanying the equipment.

- Test the operation of the equipment: Request the supplier to operate the equipment for testing and inspect the results obtained from the equipment (if the quantity of imported goods is large, a sampling inspection may be conducted).

2. 3. Inspection Report After reviewing the documents and inspecting the products in accordance with regulations, proceed to establish a general handover record between the parties and a detailed handover record for each batch of weapons, explosives, and support tools.

3. STORAGE

3. 1. Storage

3. 1.1. Warehouse Stacking Techniques

a) All types of weapons, explosives, and support tools must be stored on racks, platforms, stacks, or storage cabinets during warehouse storage.

- Racks should be made of steel, wood, or composite materials ensuring stability and safety during storage.

- Platforms should be made of concrete reinforced with steel, sized appropriately for the warehouse area and dimensions of the goods. The height of the racks and platforms must be at least 350mm.

- Ensure that racks, stacks, and storage cabinets are placed with a minimum distance of 600mm between batches of goods, and a minimum distance of 600mm from walls or columns of the warehouse. The width of aisles within the warehouse must be at least 1200mm to ensure transportation and stacking operations. When arranging goods in the warehouse, they must be placed at least 600mm away from the ceiling and electrical devices.

b) Requirements for Stacking Goods:

- Different types of equipment with varying shapes, categories, and qualities shall not be stacked together in the same batch.

- Weapons, explosives, and support tools shall not be stored together with chemicals or other types of goods in the same warehouse. Accessories must be placed on separate racks. Guns shall not be stored with ammunition in the same warehouse.

- When stacking goods, follow the markings on the packaging, face labels outward towards the aisle and inspection areas for easy observation, and orient boxes so that their lids point upwards. Do not stack equipment too high to avoid deformation or damage to lower equipment (the total weight of stacked equipment must not exceed the weight indicated on the packaging).

3. 1.2. Regular Maintenance

- Regularly inspect packaging and containers for signs of termite infestation, rodent damage, or tearing. If such issues are found, immediate isolation and treatment are required.

- Visually inspect the surface quality for signs of mold, condensation, or scratches on weapons, explosives, and support tools, and rust on metal components, and aging on rubber accessories. For warehouses storing optical and electronic equipment requiring special maintenance, the warehouse keeper must maintain the temperature between 20°C and 25°C, humidity between 45% and 85%, and protect against environmental factors such as light, rain, sun, wind, rodents, and insects. Immediate measures must be taken to address any safety concerns regarding the goods.

3. 1.2.1. Regular Maintenance of Weapons

- Inspect the condition of weapons stored in the warehouse. If any tilting, falling over, or minor damage to boxes, containers, racks, or cabinets is discovered, rearrange or re-stack tilted batches, repair sunken stacks, and fix minor damages to boxes, containers, racks, or cabinets.

- Clean boxes and containers from dust, moisture, and rust on the surface of weapons;

- Inspect and air dry leather and canvas parts;

- Monitor and maintain appropriate temperature and humidity levels in the warehouse;

- Ventilate the warehouse, inspect and eliminate pests, mold, and harmful insects to ensure good ventilation.

- Rotate boxes and containers containing weapons annually according to the principle of moving from top to bottom, inside out, and from center to sides. Damaged boxes and containers must be repaired or replaced.

3. 1.2.2. Storage of Bulletproof Helmets

a) A bulletproof helmet consists of two main parts: the helmet body and the visor.

- The helmet body is made of kevlar material and additives that provide bullet resistance;

- The visor is made of acrylic material resistant to scratches and polycarbonate material resistant to bullets;

- Additional accessories such as shock-absorbing pads, straps, and chin cushions are made from fabric, synthetic plastic, leather, or similar materials.

b) Bulletproof helmets are fully assembled and stored in PE bags, thus they should be kept in dry, well-ventilated places. During storage, they must be carefully packaged to prevent moisture and separated from each other. They should be stacked vertically and absolutely not stacked on top of each other or under heavy objects. The best method is to store bulletproof helmets in wooden crates, with 12 helmets per crate and kept in a cool, ventilated place.

3. 1.2.3. Storage of Bulletproof Vests

a) Bulletproof vests are used for individual combat and consist of three main parts:

- The vest body and abrasive pieces;

- Armor plates;

- Reinforcement plates (bullet shields).

b) During storage, reinforcement plates must be carefully packaged to prevent moisture and scratches, and separated from each other; soft paper should be placed between the plates. Stack the plates vertically and do not place heavy objects on them. The best method is to store the reinforcement plates in wooden crates, with no more than 100 plates per crate and kept in a dry, ventilated place.

c) Armor plates stored in the vest body must be carefully packaged to prevent moisture; they should be stored in wooden crates, with no more than 10 vest bodies and armor plates per crate.

3. 1.2.4. Storage of Gas Masks

a) A gas mask consists of three main parts:

- The face cover;

- The filter box;

- The drinking system.

b) Materials used to produce gas masks mainly include plastic, elastic rubber, glass, compressed paper, activated carbon, aluminum alloy, synthetic fiber fabrics, and similar materials. Therefore, the most suitable conditions for storing gas masks are temperatures between 20°C and 25°C and humidity between 45% and 70%.

c) When storing in the warehouse, masks are packed in synthetic plastic bags and placed in separate cardboard boxes according to each set or can be separated into parts such as the face cover, filter box, water intake system. The best way to store gas masks is to place them in wooden crates with handles and locks. Each crate can hold from 12 to 20 sets and should be kept in a well-ventilated area.

Every day, the warehouse custodian cleans the floor of the warehouse, the surrounding areas, and regularly sweeps and dusts the outer surface of the boxes containing weapons and support tools. The warehouse custodian must frequently check and operate equipment for preserving items stored in closed warehouses to ensure temperature and humidity conditions suitable for weapons and support tools.

Weekly, the warehouse leader is responsible for inspecting the warehouse, the quantity, and quality of goods, paying special attention to factors affecting the quality of goods to promptly detect adverse developments that affect the quality of goods and take immediate corrective measures.

Monthly, the warehouse custodian checks the expiration date of goods and informs the specialized inventory management unit six months in advance to plan timely distribution.

3. 1.3. Preservation of weapons Weapons must be maintained technically according to the following regulations:

3. 1.3.1. Technical Maintenance I:

a) Maintenance cycle -

For various types of guns once a year;

For various types of equipment every six months.

b) Maintenance content: Clean, remove rust from rusty spots on the surfaces of parts and details, apply additional grease layer; soak and dry wet, moldy or moisture-absorbing positions; disassemble sights (if any) and store separately.

3. 1.3.2. Technical Maintenance II:

a) Maintenance cycle

For various types of guns and replacement parts every four years;

For optical sights, infrared sights, and various types of equipment once a year.

b) Maintenance content:

Check technical history and documentation according to the gun; clean old grease, clean and check technically; disassemble units, check and repair units; disassemble details, wash and repair details; replace units or details; reassemble units, check; complete assembly, check immersion in preservation grease; repair cases, boxes, supports, print, spray identification marks, supplement accompanying tools and spare parts, package and box; when performing maintenance, it must be carried out strictly according to the technical procedures already provided.

3. 1.3.3. Rotation of weapons, explosives, and support tools

Rotate boxes containing weapons, explosives, and support tools in the warehouse once a year;

Technically rotate from top to bottom, from inside to outside, from middle to both sides. In case of damaged boxes, they must be repaired or replaced.

3. 1.3.4. Record preservation files

After completing preservation, the warehouse custodian must record on the preservation tracking form including:

Content and quality before and after preservation;

Name and address of the preserver;

Time of preservation;

Warehouse leader, warehouse custodian, preservation staff sign.

3. 1.4. Periodic preservation of bulletproof helmets Once a year

3. 1.4.1. Inspection before preservation

Before preservation, the technical preservation officer must visually inspect all components of the helmet; pay attention to parts such as protective face shield, helmet body, and connecting parts.

3. 1.4.2. Preparation of preservation materials and equipment

Based on inspection results and preservation quotas, prepare preservation materials and equipment including: New wooden boxes treated against termites and pests, with handles and secure locks (according to specifications and styles suitable for 8 to 12 helmets per box), preservation table, hammer, pliers, nails, paraffin-coated paper, desiccant grains, white mesh fabric, industrial alcohol, cotton, brush, paintbrush, colored paint, PE plastic bags, transparent tape, brooms, soft-bristled brushes, and other preservation equipment.

3. 1.4.3. Steps for preservation

a) Use a broom and soft-bristled brush to thoroughly clean the floor, walls, and preservation area. Use a clean cloth to wipe the outer surface of the box before opening for preservation.

b) Remove the helmet from the box and proceed with preservation:

Remove the plastic bag, place the helmet on the preservation table;

Use a clean cloth soaked in 90% alcohol to clean and wash away stains and mold;

Use fine sandpaper to remove rust stains, then use a cloth soaked in 90% alcohol to clean and sanitize;

Use a clean, dry cloth to dry and clean the helmet, then air-dry in the shade;

Wrap the helmet and visor with paraffin-coated paper;

Pack into PE plastic bags for preservation and include one bag of silica gel desiccant, expel excess air;

Seal the bag's mouth.

c) Arrange the helmets in the correct orientation in the box. Insert soft paper between two helmets and empty spaces. Pay attention to padding around the protective visor, and place one anti-moisture packet in the box. Close the box lid and arrange the boxes on the shelves as specified.

d) Inspect the helmet box; if cracks or holes appear in metal or plastic boxes, seal them with putty mixed with powder. Wooden boxes with broken or damaged slats must be repaired.

e) Protect the identification marks on the packaging and boxes; do not write additional marks on the packaging. If identification marks become blurred, they must be retouched and rewritten clearly and accurately as originally.

f) Regularly inspect and handle pest infestations of packaging.

g) At the end of the preservation day, the warehouse custodian must clean the inside and outside of the warehouse and collect preservation tools and materials to their designated places.

3. 1.4.4. Record preservation files

After completion of preservation, the warehouse custodian must record on the preservation tracking form, including:

Content and quality before and after preservation;

Name and address of the preserver; Time of preservation;

Warehouse leader, warehouse custodian, preservation staff sign.

3. 1.5. Periodic preservation of bulletproof vests Once a year

3. 1.5.1. Inspection before preservation

Before preservation, the technical preservation officer must visually inspect all components of the bulletproof vest. The vest must be intact, clean, and dry. All rough connections must be secure, and reinforced plates must not have cracks or fractures.

3. 1.5.2. Preparation of preservation materials and equipment

Based on the inspection results and preservation standards, prepare materials and equipment for preservation including: new boxes made from treated wood to prevent termites and pests. The boxes must have handles and secure locks (according to specifications suitable for 10 coats per box), preservation tables, hammers, nail pullers, nails, paraffin-coated paper, desiccants, white filter cloth, industrial alcohol, cotton, brushes, paintbrushes, colored paint, PE plastic bags, transparent tape, brooms with bristles, soft hair brushes, and other preservation equipment.

3. 1.5.3. Steps to conduct preservation

a) Use a broom and soft-bristled brush to thoroughly clean the floor, walls, and preservation area. Use a clean cloth to wipe the outer surface of the box before opening for preservation.

b) Remove armor from boxes and proceed with preservation:

- Remove protective plastic bags, transfer contaminated and moldy reinforcement plates and body armor shells to the preservation table;

- Use clean cloths and cotton soaked in 90% alcohol to clean and remove stains and mold;

- Use dry cloths to clean and dry helmets, then air-dry them in shade;

- Wrap the body armor shell, bulletproof plates, and reinforcement plates tightly with paraffin-coated paper;

Pack into PE plastic bags for preservation and include one bag of silica gel desiccant, expel excess air;

- Seal the mouth of the bag;

- Line the bottom and two sides of the box with paraffin-coated paper.

c) Arrange the body armor shells containing bulletproof plates inside the boxes properly. Insert soft paper between the gaps of reinforcement plates, empty spaces, and between reinforcement plates and the bottom and sides of the box. Place one moisture-absorbing packet in each box. Close the box lids and arrange the boxes on shelves according to regulations.

d) Inspect the boxes containing armor. If cracks or holes appear in metal or plastic boxes, seal them with putty mixed with powder. Repair wooden boxes if they show signs of broken or damaged slats.

e) Protect and maintain markings on packaging and armor boxes; do not add additional markings. If markings become faded, rewrite them clearly and accurately as originally provided.

f) Regularly inspect and handle pest infestations of packaging.

g) At the end of the preservation day, the warehouse custodian must clean the inside and outside of the warehouse and collect preservation tools and materials to their designated places.

3. 1.5.4. Record preservation files

After completion of preservation, the warehouse custodian must record on the preservation tracking form, including:

Content and quality before and after preservation;

Name and address of the preserver;

Time of preservation;

Warehouse leader, warehouse custodian, preservation staff sign.

3. 1.6. Annual preservation of gas masks once a year

3. 1.6.1. Inspection before preservation. Before preservation, technical staff must visually inspect all parts of the gas mask.

3. 1.6.2. Preparation of preservation materials and equipment

Based on inspection results and preservation standards, prepare materials and equipment for preservation including: wood for repairing boxes, cardboard boxes, tables, hammers, nail pullers, nails, paraffin-coated paper, desiccants, white filter cloth, industrial alcohol, cotton, brushes, paintbrushes, colored paint, PE plastic bags, transparent tape, brooms with bristles, soft hair brushes, and other preservation equipment.

3. 1.6.3. Steps to conduct preservation

a) Use a broom and soft-bristled brush to thoroughly clean the floor, walls, and preservation area. Use a clean cloth to wipe the outer surface of the box before opening for preservation.

b) Remove gas masks from boxes and proceed with preservation.

- Carefully remove the tape and gently take the gas mask out of the cardboard box to avoid puncturing or scratching the PE plastic bags;

- Visually inspect the hood, filter canister, storage bags, and drinking system;

- Clean the hood, goggles, filter canister, drinking system, and storage bags using cotton soaked in alcohol and soft cloths. After preservation, all components must be clean, goggles must be bright and clear;

- Lightly tap and evenly apply talcum powder on the rubber surface of the hood, and check that the filter canister lid is securely tightened;

- Wrap the filter canister, hood, drinking system, and other systems with anti-moisture paper;

- Place the hood and filter canister into PE plastic bags, use a vacuum sealer to remove air, and seal the bag's opening.

c) Arrange preserved gas masks into cardboard boxes, reseal the box lids with tape. Line the bottom and sides of the box with preservation paper, sequentially place each gas mask set into the box. Place one moisture-absorbing packet in each box. Close the box lids and arrange the boxes on shelves according to regulations.

d) Inspect the boxes containing gas masks. If cracks or holes appear in metal or plastic boxes, seal them with putty mixed with powder. Repair wooden boxes if they show signs of broken or damaged slats.

e) Protect and maintain markings on packaging and gas mask boxes; do not add additional markings. If markings become faded, rewrite them clearly and accurately as originally provided.

f) Regularly inspect and handle pest infestations of packaging.

g) At the end of the preservation day, the warehouse custodian must clean the inside and outside of the warehouse and collect preservation tools and materials to their designated places.

3. 1.6.4. Record preservation files

After completion of preservation, the warehouse custodian must record on the preservation tracking form, including:

Content and quality before and after preservation;

Name and address of the preserver;

Time of preservation;

Warehouse leader, warehouse custodian, preservation staff sign.

3. 1.7. Annual preservation and disposal of explosive containers once a year. Explosive containers are preserved according to the manufacturer's standards.

3. 2. Fire prevention and safety

3. 2.1. Organize fire prevention and firefighting preparations, including personnel and equipment ready to extinguish fires when necessary. Especially, when using flammable chemicals such as alcohol, preservative grease, or flammable solvents, quickly use fire extinguishers or sand, large blankets to put out fires if they occur.

3. 2.2. If flammable preservative alcohol, grease, or solvents adhere to the skin, wash thoroughly with warm water and soap. Direct preservers must wear gloves and face masks (gas masks).

3. 2.3. All guidance on fire prevention, safety, and emergency response procedures must be posted in visible locations.

5. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS

4. 1. General provisions on management

4. 1.1. National reserve items assigned to the Ministry of Public Security for management shall be implemented in accordance with the Law on National Reserves No. 17/2004/PL-UBTVQH dated April 29, 2004, and Decree No. 196/2004/NĐ-CP dated December 2, 2004 detailing the implementation of the Law on National Reserves, and circulars guiding implementation by relevant ministries and agencies.

4. 1.2. National reserve items assigned to the Ministry of Public Security for unified management at the ministry’s warehouses.

4. 1.3. The Director of the Logistics and Technical Service Bureau of the Ministry of Public Security is responsible for directing the ministry’s warehouses to strictly implement the system of management for the entry, exit, preservation, and security of national reserve items within the ministry’s warehouse system.

4. 2. Provisions on receiving goods

4. 2.1. National reserve items received into warehouses according to plans approved by the leadership of the Ministry of Public Security and the Logistics and Technical Service Department.

4. 2.2. Annually, within thirty days from the date the procurement plan is approved, units receiving goods or planning departments must notify the Logistics Bureau to proactively receive goods.

4. 2.3. Prior to storing goods in the warehouse, the entity receiving the goods must submit a plan for receiving goods to the General Logistics Department at least 5 to 7 days in advance so that the Director of the General Logistics Department can designate the warehouse and instruct the relevant departments and warehouses. The plan shall include the following contents: name of goods, quantity, quality, specifications, code, storage time in the warehouse, procurement, production contracts, and other requirements for preserving the goods to check the incoming goods and ensure their preservation.

4. 2.4. The standards for goods entering the warehouse shall be applied according to Section 1.1.1 of this Standard.

4. 2.5. Inspection of goods entering the warehouse shall be carried out according to Section 2.2 of this Standard.

4. 2.6. For temporarily stored goods, there must be an order from the Director of the Ministry of Public Security's Logistics and Technical Service General Department or the Director of the General Logistics Department, and inspections and detailed records of quantity, quality, and specifications of the goods must be conducted. Within 15 days from the date of temporary storage, the entity receiving the goods must issue a warehouse entry form. If the warehouse entry form is not issued beyond this period, the entity receiving the goods must pay storage fees. If no warehouse entry form is issued within one month, the goods will be returned to the entity receiving them.

4. 2.7. For used goods that have been repaired and recovered for storage, there must be an order from the Ministry leadership, the Logistics and Technical Service General Department leadership, and inspections and detailed records of quantity, quality, and condition of the goods, as well as determination of responsibility of all parties involved.

4. 3. Regulations on issuing goods

4. 3.1. Issuing state reserve goods must follow the annual plan.

4. 3.2. In cases where immediate response to combat tasks, anti-sabotage, anti-riot, disaster prevention and mitigation, fire control, and epidemic prevention with potential outbreaks is required, the Minister of Public Security decides to immediately issue state reserve goods according to Article 20 of the National Reserve Ordinance No. 17/2004/PL-UBTVQH dated April 29, 2004.

4. 3.3. When temporarily issuing state reserve goods to serve urgent tasks, there must be an order from the Ministry of Public Security leadership and strict adherence to preservation regulations.

4. 4. Transfer and handover of state reserve goods within the Ministry of Public Security's warehouse system

4. 4.1. Based on the requirements and tasks serving operations and combat in each area, ensuring convenience and suitability for storage, distribution, and preservation, the Director of the Ministry of Public Security's Logistics and Technical Service General Department reports to the Minister of Public Security to coordinate with the Ministers of Finance and Planning and Investment on plans for transferring state reserve goods within the Ministry of Public Security's warehouse system.

4. 4.2. In emergencies, the Director of the Ministry of Public Security's Logistics and Technical Service General Department reports to the Minister of Public Security to decide on the transfer of state reserve goods within the Ministry of Public Security's warehouse system, but after implementation, they must notify the Ministry of Finance and the Ministry of Planning and Investment.

4. 5. Record-keeping system for tracking goods

4. 5.1. Establishing inventory cards

Each batch of goods entering the warehouse must have an inventory card, which includes all necessary information according to Model S21-H issued along with Circular No. 213/2009/TT-BTC dated November 10, 2009, guiding accounting for state reserves.

4. 5.2. Daily logbook for preservation work

- Used to record daily or emergency situations regarding the preservation of weapons, explosives, and support tools, changes in quantity and quality. The logbook must be stamped and signed with all necessary information according to the model, with signatures and stamps from all relevant units;

- The warehouse keeper responsible for weapons, explosives, and support tools must record all changes in quality, preservation activities, and any damage and their resolution for each type during storage;

- Every three months, specialized staff must inspect and record observations and evaluations of preservation work in the preservation journal and report to leadership.

4. 5.3. Hanging tags

Each batch of goods arranged in the warehouse must have a hanging tag. Information on the tag includes the following:

- Type of goods, group of goods, item code, specifications, origin, quantity, date of entry into the warehouse;

- In cases where goods are internally transferred, the original entry date must still be recorded, along with the internal transfer date;

- Specifications and origin of goods must be accurately recorded according to the quality inspection documents.

4. 6. Storage period

- For weapons, the storage period is five years;

- For support tools, the storage period is three years (in cases where support tools have a usage period, it follows the manufacturer's usage period)./
