DECREE

Regarding the Ho Chi Minh Prize, the State Prize and

other prizes for science and technology

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Competition and Rewards dated November 26, 2003, the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated June 14, 2005, and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated November 16, 2013;

Pursuant to the Law on Science and Technology dated June 18, 2013;

At the proposal of the Minister of Science and Technology,

The Government issues this Decree on the Ho Chi Minh Prize, the State Prize, and other prizes for science and technology.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree provides for:

1. The subjects, conditions, criteria, procedures, and formalities for awarding the Ho Chi Minh Prize and the State Prize for Science and Technology are stipulated in Article 66, Article 67, and Article 68 of the Law on Competition and Rewards dated November 26, 2003, and Clause 36 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated November 16, 2013.

2. The subjects, conditions, basis for establishing criteria, and the organization of awarding prizes by ministries, ministerial-level agencies, government agencies, central state agencies, provincial People's Committees, and municipal People's Committees under the central government for science and technology are stipulated in Clause 2 of Article 77 of the Law on Science and Technology.

3. The establishment and granting of prizes by domestic organizations and individuals, overseas Vietnamese, international organizations, foreign organizations and individuals for science and technology are stipulated in Clause 3 of Article 77 of the Law on Science and Technology.

Article 2. Applicability

Authors and co-authors who are Vietnamese or foreigners with scientific and technological works proposed for consideration for the Ho Chi Minh Prize, the State Prize, and prizes from ministries, ministerial-level agencies, government agencies, central state agencies, provincial People's Committees, and municipal People's Committees under the central government for science and technology.

Scientific and technological organizations and individuals engaged in scientific and technological activities in Vietnam may receive prizes from domestic organizations and individuals, overseas Vietnamese, international organizations, foreign organizations and individuals for science and technology.

Domestic organizations and individuals, overseas Vietnamese, foreign organizations and individuals, and international organizations that engage in activities related to establishing and granting prizes for science and technology to scientific and technological organizations and individuals engaged in scientific and technological activities in Vietnam.

State agencies and other organizations and individuals involved in awarding prizes for science and technology.

Article 3. Explanation of Terms

In this Decree, the following terms are understood as follows:

A scientific and technological work is a product of creative labor in scientific research, technological development, and the application of scientific and technological achievements, including:

a) A scientific research work is the result of activities aimed at discovering, identifying, understanding the nature and laws of natural, social, and intellectual phenomena; creating solutions for practical application;

b) A technological research and development work is a work that creates new technologies, new technical solutions, new materials, new varieties, and new products;

c) An applied technological work is a work successfully applying new technologies and new technical solutions.

A cluster of scientific and technological works includes:

a) A collection of scientific and technological works by the same author or co-authors identified as belonging to the same field of science, technology, or application area;

b) A collection of independent scientific and technological works by different authors resulting in the same outcome but using different methods, principles, and techniques.

A scientific and technological work and a cluster of scientific and technological works are collectively referred to as a work.

4. The author of a work is the person directly creating the work; if two or more persons directly create the work, they are co-authors. The author and co-author of a work are collectively referred to as the author of the work.

5. Establishing a prize for science and technology is the act of founding a prize for science and technology by an organization or individual to be awarded to scientific and technological organizations and individuals engaged in scientific and technological activities in Vietnam who meet the conditions and criteria for receiving the prize.

6. Publishing a work is the act of presenting the work before the public in the form of publication, presentation, exhibition, demonstration, and other forms.

7. Applying a work is the use of the work in practice to serve human and societal benefits.

Article 4. Scientific and technological awards

1. Ho Chi Minh Award for Science and Technology.

2. State Award for Science and Technology.

3. Scientific and technological awards of Ministries, agencies at the level of ministries, agencies under the Government, central state agencies, provincial People's Committees, municipal People's Committees directly under the Central Government (hereinafter referred to as Ministries, sectors, localities) on science and technology.

4. Scientific and technological awards established by organizations and individuals within the country, overseas Vietnamese, international organizations, foreign organizations and individuals (hereinafter referred to as organizations and individuals) to be awarded to scientific and technological organizations and individuals engaged in scientific and technological activities in Vietnam.

Article 5. Principles for naming and awarding scientific and technological awards

1. The naming of scientific and technological awards of Ministries, sectors, localities and organizations and individuals shall be carried out according to the following principles:

a) The name of a new award must not be identical or similar enough to cause confusion with the name of existing scientific and technological awards;

b) The name of an organization or individual shall not be used to name an award without their consent or that of their legitimate representative or competent authority;

c) It shall not violate the interests of the state, the rights and legitimate interests of organizations and individuals; it shall not contravene moral values and customs of the nation.

2. Principles for awarding scientific and technological awards:

a) Applications for awarding scientific and technological awards shall be made voluntarily;

b) The awarding process shall be conducted objectively, transparently, fairly, and accurately;

c) Works proposed for awarding shall not infringe intellectual property rights.

3. For works proposed for the Ho Chi Minh Award, the State Award, and scientific and technological awards of Ministries, sectors, and localities, in addition to complying with the principles stipulated in Clause 2 of this Article, they must also comply with the following principles:

a) Each work can only be proposed for one award in one awarding session;

b) Each work can only be awarded one scientific and technological award.

Article 6. Authority to award scientific and technological awards

1. The Ministry of Science and Technology shall take the lead in organizing the awarding of the Ho Chi Minh Award and the State Award for Science and Technology.

2. Ministries, agencies at the level of ministries, agencies under the Government, central state agencies, provincial People's Committees, municipal People's Committees directly under the Central Government shall organize the awarding and decide to award scientific and technological awards within the scope of management of Ministries, sectors, and localities.

3. Organizations and individuals within the country, overseas Vietnamese, international organizations, foreign organizations and individuals shall organize the awarding and decide to award scientific and technological awards established by organizations and individuals.

Article 7. Funding to ensure the operation of awarding scientific and technological awards

1. Funding for awarding the Ho Chi Minh Award and the State Award for Science and Technology is regulated as follows:

a) Funding for awarding at the grassroots level shall come from the funding source of the awarding organization at the grassroots level;

In cases where the author of the work does not have a direct managing agency, funding for awarding at the grassroots level shall come from the funding source for scientific and technological affairs and shall be transferred to the Department of Science and Technology where the author submits the application for the work to be considered for the award.

b) Funding for awarding at the Ministry, sector, and locality level shall come from the funding source for scientific and technological affairs and shall be transferred to Ministries, agencies at the level of ministries, agencies under the Government, central state agencies, provincial People's Committees, municipal People's Committees directly under the Central Government;

c) Funding for awarding at the national level shall come from the funding source for scientific and technological affairs and shall be transferred to the Ministry of Science and Technology.

2. Funding for awarding scientific and technological awards of Ministries, sectors, and localities shall come from the funding source for scientific and technological affairs or the state budget already allocated to Ministries, sectors, and localities.

3. Funding for awarding scientific and technological awards of organizations and individuals shall be guaranteed by the organizations and individuals who host the awarding process.

4. Funding for awarding scientific and technological awards as stipulated in Clauses 1, 2, and 3 of Article 4 of this Decree shall be sourced from the state budget and other lawful sources funded by domestic and foreign individuals and organizations and shall be used for the following purposes:

a) Developing and implementing plans for awarding scientific and technological awards at all levels;

b) Paying remuneration to members of the awarding councils at all levels, independent experts, secretaries, and the review of applications for awarding;

c) Organizing meetings of the awarding councils at all levels;

d) Announcing lists of works proposed for awarding and results of the awarding councils at all levels through mass media;

đ) Holding press conferences to announce awarding results;

e) Organizing award ceremonies;

g) Prize money accompanying the award;

h) Other activities.

Specific expenditure levels shall be implemented in accordance with current regulations.

Chapter II

HO CHI MINH AWARD, STATE AWARD FOR

SCIENCE AND TECHNOLOGY

Section 1

Article CONDITIONS AND STANDARDS FOR CONSIDERING THE GRANTING OF THE HO CHI MINH PRIZE AND THE STATE PRIZE FOR SCIENCE AND TECHNOLOGY

Article 8. Conditions for considering the granting of the Ho Chi Minh Prize and the State Prize for Science and Technology

1. The proposed works must have valid files, be published according to regulations (except for works related to state secrets), and be applied in Vietnam.

2. The time from when the work is published or applied in practice must be at least three years, or for innovative works with significant effectiveness, it must be at least one year, calculated from the date the organizing body receives the application file for the prize.

3. At the time of awarding the prize, the author of the work must not violate the provisions of Article 8 of the Law on Science and Technology.

Article 9. Standards for considering the granting of the Ho Chi Minh Prize for Science and Technology for scientific research works

1. Exceptionally outstanding work

The research results of the work must include new inventions or be prominent and exemplary achievements leading to particularly important changes in understanding, production, national defense, security, and social life.

2. Work of very high scientific value:

a) Revealing the essence, development laws of phenomena or achieving one of the following criteria: forming new research directions; new ideas, concepts; new perceptions; new approaches; new theories; new methods; new knowledge; new scientific and technological discoveries;

b) Published and cited in reputable international or domestic scientific journals.

3. Work with significant impact serving the revolutionary cause, having wide and long-lasting influence on people's lives, making a significant contribution to the development of the national economy, science, technology, or being applied in practice with one of the following effects:

a) Generating significant economic benefits or rationally changing industry structures; reducing production costs; increasing labor productivity; minimizing negative environmental impacts;

b) Making a particularly important contribution to forecasting future trends, formulating and implementing Party policies and State laws;

c) Changing societal perceptions or having a particularly important impact on social life; raising public awareness; positively altering group or class behavior in society;

d) Used to serve higher education and postgraduate training.

Article 10. Standards for considering the granting of the Ho Chi Minh Prize for Science and Technology for technological development works

1. Exceptionally outstanding work

The research results of the work must be prominent and exemplary achievements in technology, with exceptional creativity and innovation, or creating new technologies reaching advanced international or regional levels.

2. Work of very high scientific and technological value:

a) Solving key issues for technological improvement and innovation, producing new products or obtaining patents, utility models, or publishing research results in reputable international specialized journals.

b) Making a particularly important contribution to transforming production structures, creating conditions for the formation and development of new industries, enhancing product competitiveness, and economic sector capabilities.

3. Work with significant impact serving the revolutionary cause, having wide and long-lasting influence on people's lives, making a significant contribution to the development of the national economy, science, technology, or being applied in practice with one of the following effects:

a) Generating significant economic benefits or producing national products, export brands, or replacing imported goods;

b) Changing traditional labor and production methods or improving working and production conditions and environments, or contributing to improving the quality of people's lives;

c) Developing technology reaching advanced levels in the region and globally for sectors, fields, and localities.

Article 11. Criteria for awarding the Ho Chi Minh Prize for Science and Technology in applied technology projects.

1. Exceptionally outstanding work

The result of applying technology is a prominent and exemplary achievement with special creativity, contributing to industrial-scale production of goods with high economic efficiency.

2. The project has very high technological value, successfully applied and effective in national key projects, including one of the following types:

a) Creating particularly innovative technology with breakthrough characteristics;

b) Making significant technical and technological improvements that yield high effectiveness;

c) Developing an overall plan with synchronized technical solutions.

3. The project has a significant impact on serving revolutionary causes, having extensive and long-lasting influence on people's lives, making important contributions to the development of the national economy, science, technology, or practical application, including one of the following effects:

a) Generating very large socio-economic benefits, making significant contributions to socio-economic development or national defense and security, or producing products and goods with high economic efficiency, replacing imports;

b) Making important contributions to the development of science and technology in the field.

Article 12. Criteria for awarding the State Prize for Science and Technology in scientific research projects.

1. Projects with high scientific value:

a) Outstanding scientific research projects: Supplement new knowledge and ideas; make new scientific discoveries leading to new understandings and approaches in science or have a significant impact on production and life;

b) Published and cited in reputable international or domestic scientific journals.

2. Projects with significant social impact when meeting one of the following requirements:

a) Yielding economic benefits, significantly contributing to socio-economic development or rationally changing industry structures; reducing production costs; increasing labor productivity; minimizing negative environmental impacts;

b) Making important contributions to forecasting future trends, formulating and implementing Party policies and state laws;

c) Changing societal perceptions or having a significant impact on social life; raising public awareness; positively altering group and class behavior in society;

d) Used to serve higher education and postgraduate training.

Article 13. Criteria for awarding the State Prize for Science and Technology in technology development research projects.

1. Projects with high scientific and technological value:

a) Outstanding technology development research projects, solving critical issues to improve and innovate technology, creating new products;

b) Making a particularly important contribution to transforming production structures, creating conditions for the formation and development of new industries, enhancing product competitiveness, and economic sector capabilities.

2. Projects with significant social impact:

a) Yielding economic benefits, significantly contributing to socio-economic development;

b) Changing traditional labor and production methods or improving working conditions and environments, or contributing to increased labor productivity and improved quality of life for the people.

Article 14. Criteria for awarding the State Prize for Science and Technology in applied technology projects.

1. Projects with high technological value

Outstanding applied technology projects successfully implemented and effective in national key projects, including one of the following types:

a) Creating breakthrough technology;

b) Making significant technical and technological improvements yielding high effectiveness;

c) Contributing to developing an overall plan with synchronized technical solutions.

2. Projects with significant social impact:

a) Yielding economic benefits, significantly contributing to socio-economic development or national defense and security, or producing products and goods with high economic efficiency, replacing imports;

b) Making important contributions to the development of science and technology in the field.

Section 2

PROCEDURES FOR AWARDS OF THE HO CHI MINH PRIZE AND

THE STATE PRIZE FOR SCIENCE AND TECHNOLOGY

Article 15. Time and Term for Awarding the Ho Chi Minh Prize and State Prize for Science and Technology

1. The Ho Chi Minh Prize and State Prize for Science and Technology shall be awarded and announced every five years, on the occasion of National Day on September 2.

2. The Ministry of Science and Technology shall issue plans for awarding the Ho Chi Minh Prize and State Prize for Science and Technology and the deadlines for organizing the awarding sessions at the respective awarding councils at all levels.

Article 16. Procedures for Awarding the Ho Chi Minh Prize and State Prize for Science and Technology

The awarding of the Ho Chi Minh Prize and State Prize for Science and Technology shall be conducted at three levels as follows:

1. Basic level:

The application dossier for awarding the Ho Chi Minh Prize and State Prize for Science and Technology shall be reviewed by the basic-level awarding council established by the head of the agency or organization directly managing the author of the work.

In cases where the author of the work does not have a direct management agency or organization, the Director of the Department of Science and Technology in the place of residence of the author shall establish the basic-level awarding council.

For foreign authors with research works about Vietnam, the work must be proposed for the award by a public scientific and technological organization with a relevant field of expertise, corresponding to the field of the work, through the competent authority (if any) and the Ministry of Science and Technology. The scientific and technological organization has the responsibility to assist the author in completing the application dossier according to regulations and to establish the basic-level awarding council after receiving the consent of the competent authority and the Ministry of Science and Technology.

2. Ministry, Sector, and Local Level:

The application dossier for awarding the Ho Chi Minh Prize and State Prize for Science and Technology shall be reviewed by the ministry, sector, and local-level awarding council established by the Minister, Head of the equivalent ministry, government agency, central state agency, Chairman of the People's Committee of provinces and centrally-administered cities.

3. National Level, implemented in two steps:

a) Step 1: Review the application dossier for awarding the Ho Chi Minh Prize and State Prize for Science and Technology at the specialized national-level awarding councils established by the Minister of Science and Technology.

b) Step 2: Review the application dossier for awarding the Ho Chi Minh Prize and State Prize for Science and Technology at the national-level awarding council established by the Prime Minister based on the proposal of the Minister of Science and Technology.

The results of the awarding process shall be sent by the national-level awarding council to the Central Board for Competitiveness and Awards for consolidation of the dossier and submission to the Prime Minister for review and recommendation to the President for decision on awarding the prize.

Article 17. Composition and Principles of Operation of the Awarding Councils at All Levels

1. Composition of the Awarding Councils

a) The awarding councils at all levels consist of the Chairperson, Vice-Chairpersons, reviewing members, and other members. Members of the council represent the entities that have applied the results of the work, scientists, technologists, managers with credibility, appropriate professional qualifications, and deep understanding of the field of science and technology of the work.

The Chairperson of the awarding councils at all levels is a credible scientist with deep knowledge of the field of science and technology of the work.

The council assigns members who are experts in the field of science of the work to serve as reviewing members to write comments and evaluate the work. If necessary, the head of the awarding council may invite additional independent reviewing experts.

The author of the work or persons with rights or interests related to the work shall not be members of the awarding council for that work.

b) The basic-level awarding council shall have from seven to nine members. In special cases, the person establishing the basic-level awarding council may invite additional experts in the field of science and technology of the work to join the basic-level awarding council and bear responsibility for their decisions.

c) The ministry, sector, and local-level awarding council shall have from nine to eleven members.

d) The specialized national-level awarding council includes reputable scientists trained in the same field as the work being considered for the award and who have published works in the same field.

The number of specialized national-level awarding councils depends on the number of fields of science of the works being considered for the award.

The number of members in each specialized national-level awarding council is determined based on the number of works proposed for the award and decided by the Ministry of Science and Technology after consultation with the national-level awarding council.

The Chairperson or Vice-Chairperson (authorized in writing by the Chairperson) of the specialized national-level awarding council is a member of the national-level awarding council.

e) The national-level awarding council consists of reputable scientists in various fields of science and technology and other members, the number and composition of which are proposed by the Minister of Science and Technology.

2. Principles of Operation of the Awarding Councils at All Levels:

a) The council evaluates fairly, democratically, objectively, votes by ballot, and decides according to the prescribed ratio for each awarding level;

b) The council shall only consider files that fully meet the required documents and materials;

c) The national-level awarding council only considers works proposed by the specialized national-level awarding council; the specialized national-level awarding council only considers works proposed by the ministry, sector, and local-level awarding council; the ministry, sector, and local-level awarding council only considers works proposed by the basic-level awarding council.

d) Members of the Award Granting Council at all levels are responsible for researching, reviewing, and evaluating the award application files in writing;

đ) The meeting of the Council must have at least 3/4 of the members of the Council present, chaired by the Chairman or Vice-Chairman (authorized in writing by the Chairman) and attended by two reviewers. Members who are absent must provide their comments and evaluations in writing;

e) The contents of the meeting must be recorded in minutes, signed by the chairperson, the scientific secretary elected by the Council, and the application file for award consideration must be kept on record;

g) The process and procedures for granting awards to works related to state secrets shall be applied according to the general procedures and formalities but must comply with regulations on protecting state secrets;

Article 18. Procedures for awarding the Ho Chi Minh Prize and State Prize for Science and Technology at the Award Granting Council at the grassroots level

1. Application file for award consideration

The author of the work or the lawful representative of the author of the work submits one set of the application file for award consideration (paper version) and one electronic version of the application file for award consideration recorded on a CD (in PDF format, without password protection), sealed in an envelope with a tamper-evident seal, including:

a) The registration form for the application for award consideration by the author of the work or the lawful representative of the author of the work;

b) Summary report of the work;

c) Documents related to the publication and confirmation of the application of the work by the competent state agency;

d) A copy of the Certificate of Registration of the Results of Scientific and Technological Tasks for the work being considered for award that has used or received financial support from the state budget;

đ) Copies of relevant scientific and technological documents, other related materials concerning the work (if any);

For works researched about Vietnam by foreign authors where the application file uses a foreign language, it must be accompanied by a Vietnamese translation confirmed by the scientific and technological organization proposing the award consideration regarding the accuracy of the translation into Vietnamese;

2. Heads of agencies and organizations directly managing the author of the work, Directors of Provincial Departments of Science and Technology, Heads of scientific and technological organizations proposing the award consideration for works researched about Vietnam by foreign authors base on the plan for organizing the award consideration of the Ministry of Science and Technology:

a) Organize guidance and announce the deadline for receiving the application file for award consideration;

b) Receive the application file for award consideration;

c) Decide to establish the grassroots-level Award Granting Council;

d) Organize meetings of the grassroots-level Award Granting Council in accordance with regulations to review and evaluate the work;

đ) Send a request letter along with a list and the application file of works meeting the conditions and criteria for award consideration to the Head of the agency authorized to establish the Award Granting Council at the ministry, sector, or locality within five working days from the date of receipt of the results from the grassroots-level Award Granting Council;

e) Receive and handle complaints and denunciations (if any);

3. Responsibilities of the grassroots-level Award Granting Council:

a) Review and evaluate the works proposed for award consideration in accordance with regulations;

b) Request the author of the work or related organizations or individuals to submit an additional set of the application file (paper version) to be stored at the organization conducting the grassroots-level award consideration and complete the application file for award consideration according to the suggestions of the grassroots-level Award Granting Council if the work is proposed for award consideration at the next level;

c) Send the list and the application file of works meeting the conditions and criteria for award consideration and receiving at least 80% of the total votes of the Council members to the Head of the agency, organization directly managing the author of the work, Director of Provincial Department of Science and Technology, or Head of the scientific and technological organization proposing the award consideration for works researched about Vietnam by foreign authors to proceed with the subsequent procedures within five working days from the date of the award consideration results at the grassroots-level Award Granting Council.

Article 19. Procedures for awarding the Ho Chi Minh Prize and the State Prize for Science and Technology at the Award Granting Council at the Ministry, Sector, and Local Level

1. Nomination dossier for award consideration:

a) The proposal document for award consideration from the managing agency or organization directly overseeing the author of the work, the Director of the Department of Science and Technology, or the head of the scientific and technological organization proposing research works by foreign authors to Vietnam;

b) Minutes of the meeting on award consideration of the award granting council at the grassroots level;

c) The nomination dossier for award consideration as stipulated in Clause 1, Article 18 of this Decree.

2. The Minister, the head of a ministry-level agency, the head of a government agency, or other central state agencies, the Chairman of the People's Committee of provinces and centrally governed cities shall base on the plan for organizing the award consideration of the Ministry of Science and Technology:

a) Organize guidance and announce the deadline for receiving the application file for award consideration;

b) Organize the receipt and processing of nomination dossiers for award consideration;

c) Publish on the Ministry’s, sector’s, or local government’s electronic information portal the list of authors and titles of works proposed for award consideration during the award consideration period to solicit opinions;

d) Establish the award granting council at the Ministry, Sector, and Local Level;

đ) Organize meetings of the award granting council at the Ministry, Sector, and Local Level according to regulations;

e) Publish on the Ministry’s, sector’s, or local government’s electronic information portal the results of the award consideration at the award granting council at the Ministry, Sector, and Local Level before transferring the dossier to the Ministry of Science and Technology for further review at the national specialized award granting council. The information must be published online for at least seven working days;

g) Send the proposal document along with the list and dossier of works that meet the conditions and criteria for award consideration to the Ministry of Science and Technology within five working days from the date of receiving the results from the award granting council at the Ministry, Sector, and Local Level;

h) Receive and process complaints and reports (if any).

3. Responsibilities of the award granting council at the Ministry, Sector, and Local Level:

a) Review and evaluate the works proposed for award consideration in accordance with regulations;

b) Request the author of the work or related organizations or individuals to submit an additional set of paper dossiers for retention at the award granting agency at the Ministry, Sector, and Local Level and complete the nomination dossier for award consideration according to the comments of the award granting council at the Ministry, Sector, and Local Level if the work is proposed for consideration at the next level;

c) Send the list and dossier of works that meet the conditions and criteria for award consideration and have received at least 80% approval votes from the total number of council members to the Minister, the head of a ministry-level agency, the head of a government agency, or other central state agencies, the Chairman of the People's Committee of provinces and centrally governed cities to proceed with subsequent procedures within five working days from the date of receiving the results from the award granting council at the Ministry, Sector, and Local Level.

Article 20. Procedures for awarding the Ho Chi Minh Prize and the State Prize for Science and Technology at the National Specialized Award Granting Council

1. Nomination dossier for award consideration:

a) The proposal document for award consideration from the Minister, the head of a ministry-level agency, the head of a government agency, or other central state agencies, the Chairman of the People's Committee of provinces and centrally governed cities;

b) Minutes of the meeting on award consideration of the award granting council at the Ministry, Sector, and Local Level;

c) The nomination dossier for award consideration as stipulated in Clause 1, Article 19 of this Decree.

2. The Minister of Science and Technology shall base on the plan for organizing the award consideration:

a) Organize guidance and announce the deadline for receiving the application file for award consideration;

b) Organize the receipt and processing of nomination dossiers for award consideration;

c) Publish on the Ministry of Science and Technology’s electronic information portal the list of works along with the authors and summaries of works proposed for award consideration to solicit opinions;

d) Establish the national specialized award granting councils according to regulations;

đ) Organize meetings of the national specialized award granting councils;

e) Publish on the Ministry of Science and Technology’s electronic information portal the results of the award consideration at the national specialized award granting council for at least seven working days;

g) Send the proposal document along with the list and dossier of works that meet the conditions and criteria for award consideration to the national specialized award granting council within five working days from the date of receiving the results from the national specialized award granting council;

h) Receive and process complaints and reports (if any).

3. Responsibilities of the national specialized award granting council:

a) Review and evaluate the works proposed for award consideration in accordance with regulations;

b) Request the author of the work or related organizations or individuals to submit an additional set of paper dossiers for retention at the award granting agency of the national specialized award granting council and complete the nomination dossier for award consideration according to the comments of the national specialized award granting council if the work is proposed for consideration at the next step;

c) Send the list and dossier of works that meet the conditions and criteria for award consideration and have received at least 90% approval votes from the total number of council members to the Minister of Science and Technology to proceed with subsequent procedures within five working days from the date of receiving the results from the national specialized award granting council.

Article 21. Procedures for awarding the Ho Chi Minh Prize and the State Prize for Science and Technology at the National Award Granting Council

1. Documents for nominating to grant awards at the national level:

a) A proposal for granting awards issued by the Minister of Science and Technology;

b) Minutes of the meeting to grant awards of the National Sectoral Award Granting Council;

c) The dossier for granting awards of the National Sectoral Award Granting Council as stipulated in Clause 1, Article 20 of this Decree;

2. Responsibilities of the Minister of Science and Technology:

a) Organizing the receipt and processing of nomination dossiers;

b) Organizing meetings of the National Award Granting Council in accordance with regulations;

c) Announcing the results of the award granting process of the National Award Granting Council within 15 working days on the Ministry of Science and Technology's electronic portal and publishing three consecutive issues in central newspapers;

d) Receiving and handling complaints and denunciations (if any).

3. Responsibilities of the National Award Granting Council:

a) Checking and reviewing the dossiers for granting awards of the National Sectoral Award Granting Council proposed by the Minister of Science and Technology;

b) Examining, evaluating, and voting to select works nominated for award granting in accordance with regulations;

c) Requesting authors of works or related organizations and individuals to submit supplementary one set of paper dossiers to be kept at the national-level award granting organization and completing the award granting dossiers according to the National Award Granting Council's comments;

d) Preparing the dossier for nominating to grant awards to be submitted to the Prime Minister, including: Report; list and dossiers of works meeting conditions and standards for award granting and receiving at least 90% of total members' votes; minutes of the meeting to grant awards of the National Award Granting Council.

đ) Sending the nomination dossier for award granting as stipulated in Point d of this Clause to the Central Steering Committee for Encouragement and Reward for compilation and submission to the Prime Minister within 15 working days from the date of the award granting results at the National Award Granting Council.

Section 3

RIGHTS AND RESPONSIBILITIES OF AUTHORS OF WORKS AWARDED THE HO CHI MINH PRIZE AND THE STATE PRIZE FOR SCIENCE AND TECHNOLOGY

 THE STATE PRIZE FOR SCIENCE AND TECHNOLOGY

Article 22. Rights of authors of works awarded the Ho Chi Minh Prize and the State Prize for Science and Technology

1. Receiving the Certificate of the Ho Chi Minh Prize or the State Prize for Science and Technology.

2. Receiving monetary rewards from the state budget:

a) Authors of works awarded the Ho Chi Minh Prize for science and technology receive an amount equivalent to 270 times the basic salary level at the time of the decision to award the prize;

b) Authors of works awarded the State Prize for science and technology receive an amount equivalent to 170 times the basic salary level at the time of the decision to award the prize.

3. Participating in the award ceremony.

4. Enjoying other rights related to the prize.

Article 23. Responsibilities of authors of works awarded the Ho Chi Minh Prize and the State Prize for Science and Technology

Authors of works awarded the Ho Chi Minh Prize and the State Prize for Science and Technology bear legal responsibility for the authenticity of the nomination dossiers.

In case of being discovered to be dishonest during the preparation of the nomination dossier, the author of the work will have the award-granting decision revoked, the certificate and reward money reclaimed; depending on the nature and severity of the violation, they may be subject to disciplinary action, administrative penalties, or criminal prosecution; if damage is caused, compensation must be made in accordance with the law.

Chapter III

AWARDS OF MINISTRIES, SECTORS, AND LOCALITIES FOR SCIENCE AND TECHNOLOGY

Article 24. Conditions for awarding prizes

Works to be considered for prize awards must meet the following conditions:

1. Belong to the management field of the Ministry, sector, or implemented within the local scope and directly serve the development of the Ministry, sector, or economic, social, national defense, and security development of that locality.

2. Be published or applied in practice for at least one year up to the time of submitting the application for prize consideration.

3. The work proposed for prize consideration must be the result of a scientific and technological task using or receiving financial support from the state budget and must be registered and retain the results of the scientific and technological task in accordance with the provisions of the law.

4. As of the time of awarding the prize, the author of the work does not violate the provisions of Article 8 of the Law on Science and Technology.

Article 25. Basis for establishing criteria for awarding prizes

1. Regarding scientific and technological value:

a) Scientific research works must supplement new knowledge or have new scientific discoveries that impact changes in production and social life within the management scope of the Ministry, sector, or locality;

b) Research and development technology works must solve technological issues, create new technologies higher than similar technologies currently being applied in the Ministry, sector, or locality;

c) Technology application works must contribute to creating an overall plan with accompanying technical solutions or making technological improvements to successfully and creatively apply advanced technology in large projects of the Ministry, sector, or locality or have an impact on the economic-technical efficiency of such projects.

2. Regarding practical value:

a) Scientific research works must affect public awareness and social life or contribute to building mechanisms, policies, laws within the management scope of the Ministry, sector, or locality based on the science and practice of the work;

b) Research and development technology works must contribute to technological innovation or create new products with significant economic value, capable of enhancing the competitiveness of the product or industry;

c) Technology application works must bring about effectiveness in economic and social development or national defense and security or international integration; environmental protection.

3. The Minister, Head of a ministry-level agency, government agency, other central state agencies, Chairman of the People's Committee of provinces and centrally governed cities shall establish appropriate prize awarding standards based on the provisions of Clause 1 and Clause 2 of this Article, suitable to the specific conditions of their respective Ministries, sectors, or localities.

Article 26. Organization of prize awarding

1. Depending on specific conditions, Ministries, sectors, and localities may organize prize awarding for science and technology; the period for organizing prize awarding shall not be less than once every three years for prizes funded from the state budget; announce and present prizes on Vietnam Science and Technology Day on May 18 or at a time deemed appropriate by the Ministry, sector, or locality.

2. Based on the provisions of Clause 1 of this Article, the Minister, Head of a ministry-level agency, government agency, other central state agencies, Chairman of the People's Committee of provinces and centrally governed cities shall issue plans for organizing prize awarding and deadlines for completing prize awarding sessions for science and technology of their respective Ministries, sectors, or localities.

3. The Minister, Heads of ministry-level agencies, Chairmen of the People's Committees of provinces and centrally governed cities shall issue Regulations on Prize Awarding and send them to the Ministry of Science and Technology for consolidation and monitoring of implementation.

The Regulations on Prize Awarding stipulate the name, field, criteria, structure, amount of prize money, procedures, and activities of the Prize Awarding Council, and other relevant contents.

Article 27. Benefits of authors receiving awards

1. Receiving an award certificate decided by the Minister, Head of a ministry-level agency, other central state agencies, Chairperson of the People's Committee of provinces and centrally governed cities to present the award.

2. Receiving monetary awards from the state budget for authors whose works are awarded by ministries, sectors, and localities in science and technology not exceeding 100 times the base salary at the time the award decision is made.

3. Other benefits as prescribed by law.

Article 28. Responsibilities of authors receiving awards

Authors receiving awards from ministries, sectors, and localities in science and technology must bear responsibility as stipulated in Article 23 of this Decree.

Chapter IV

AWARDS BY ORGANIZATIONS AND INDIVIDUALS IN SCIENCE AND TECHNOLOGY

Article 29. Setting up and presenting awards in science and technology by organizations and individuals residing or legally operating in Vietnam

1. Domestic organizations and individuals, overseas Vietnamese, international organizations, foreign organizations and individuals residing or legally operating in Vietnam are entitled to set up and present awards in science and technology in Vietnam.

2. Domestic organizations and individuals, overseas Vietnamese, international organizations, foreign organizations and individuals residing or legally operating in Vietnam setting up and presenting awards in science and technology must register the award with the People's Committee of provinces and centrally governed cities through the Science and Technology Department where the organization's main office is located or where the individual resides before organizing the award presentation.

The registration dossier includes the application form and the Regulation on Award Presentation specifying the name of the award, principles, conditions, and criteria for awarding.

Within 15 working days from the date of receipt of the award registration dossier, the Science and Technology Department shall examine the dossier and submit it to the People's Committee of provinces and centrally governed cities for consideration and decision. Within 10 working days from the date of receipt of the award registration dossier, the People's Committee of provinces and centrally governed cities must respond in writing whether they agree to allow the organization or individual to organize the award presentation; if they disagree, they must clearly state the reasons.

Article 30. Setting up and presenting awards in science and technology by organizations and individuals not residing or operating in Vietnam

1. Overseas Vietnamese, international organizations, foreign organizations and individuals not residing or operating in Vietnam are entitled to set up and present awards in science and technology in Vietnam.

2. Organizations and individuals setting up and presenting awards in science and technology must register the award with the Ministry of Science and Technology.

The registration dossier includes the application form and the Regulation on Award Presentation specifying the name of the award, principles, conditions, and criteria for awarding. If the dossier is in a foreign language, it must be accompanied by a certified Vietnamese translation by an authorized state agency.

Within 20 working days from the date of receipt of the award registration dossier, the Ministry of Science and Technology must respond in writing whether they agree to allow the organization or individual to organize the award presentation; if they disagree, they must clearly state the reasons.

Chapter V

RESPONSIBILITIES OF STATE AGENCIES, ORGANIZATIONS, AND INDIVIDUALS FOR

ACTIVITIES RELATING TO AWARDS IN SCIENCE AND TECHNOLOGY

Article 31. Responsibilities of the Ministry of Science and Technology

1. Organize the awarding of the Ho Chi Minh Prize and the State Prize for Science and Technology in accordance with the provisions of this Decree.

2. Inspect, examine, settle complaints and denunciations related to the awarding of science and technology prizes within its management scope.

3. Coordinate with provincial People's Committees under the Central Government to manage the organization and implementation of activities related to the awarding of science and technology prizes by organizations and individuals.

Article 32. Responsibilities of Ministries, agencies at the level of ministries, government agencies, other central state agencies, and provincial People's Committees

1. Organize the awarding of prizes by ministries, sectors, and localities in the field of science and technology; consider and decide on granting permission for organizations and individuals to organize the awarding of science and technology prizes within their management scope in accordance with the provisions of this Decree.

2. Inspect, examine, settle complaints and denunciations, and handle violations related to the awarding of science and technology prizes within their management scope.

Article 33. Responsibilities of Organizations and Individuals

Organizations and individuals that set up, present, and receive awards in the field of science and technology must comply with the provisions of the Law on Competition and Rewards, the Law on Science and Technology, and the provisions of this Decree.

Chapter VI

IMPLEMENTING PROVISIONS

Article 34. Effective Date

1. This Decree takes effect from September 15, 2014.

2. Within one year from the date this Decree takes effect, ministries, sectors, and localities that have established science and technology awards shall be responsible for adjusting the regulations on awarding prizes to comply with the provisions of this Decree and submit them to the Ministry of Science and Technology for consolidation and monitoring; organizations and individuals with science and technology awards must register their awards in accordance with Articles 29 and 30 of this Decree.

Article 35. Responsibility for Implementation

1. The Minister of Science and Technology is responsible for guiding the implementation of this Decree.

2. Ministers, heads of agencies at the level of ministries, heads of government agencies, other central state agencies, Chairmen of provincial People's Committees under the Central Government, and relevant organizations and individuals are responsible for implementing this Decree./.
