Circular No. 78/2015/TT-BTNMT Amends and supplements certain provisions of Circulars issued by the Minister of Natural Resources and Environment related to the requirement of submitting copies of documents when performing administrative procedures.

CIRCULAR

Amending and supplementing certain Articles of Circulars issued by the Minister of Natural Resources and Environment related to the requirement of submitting copies of documents when performing administrative procedures

          Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment          Pursuant to Decree No. 23/2015/NĐ-CP dated February 16, 2015 of the Government on issuing certified copies from original registers, certifying copies from original documents, certifying signatures PROTECTION;

and certifying contracts and transactions;          At the proposal of the Director of the Legal Department;           The Minister of Natural Resources and Environment issues this Circular amending and supplementing certain Articles of Circulars issued by the Minister of Natural Resources and Environment related to the requirement of submitting copies of documents when performing administrative procedures

Article 1. Amending and supplementing Point c and Point d Clause 2 Section III of Circular No. 11/2007/TT-BTNMT dated December 25, 2007 of the Minister of Natural Resources and Environment guiding the issuance of permits for the operation of dedicated meteorological and hydrological works

"c) A certified copy from the original register or a certified copy or a copy accompanied by the original for comparison (in case individuals or organizations submit the application directly) of the professional certificates of the technical supervisor or individual;d) A certified copy from the original register or a certified copy or a copy accompanied by the original for comparison (in case individuals or organizations submit the application directly) of the land use right certificate or lease contract of the work;"Article 2. Amending and supplementing certain Articles of Circular No. 52/2013/TT-BTNMT dated December 27, 2013 of the Minister of Natural Resources and Environment stipulating the transportation of dangerous goods which are toxic substances and infectious materialsu.

1. Amending and supplementing Point c and Point d Clause 1 Article 13 as follows:

"c) A certified copy from the original register or a certified copy or a copy accompanied by the original for comparison (in case individuals or organizations submit the application directly) of the valid operating permit of the vehicle driver, the vehicle registration certificate, and the safety and environmental protection inspection certificate of the vehicle issued by the competent authority;

d) A certified copy from the original register or a certified copy or a copy accompanied by the original for comparison (in case individuals or organizations submit the application directly) of the valid certificates of the vehicle driver and escort personnel for dangerous goods according to Clause 2 Article 10 of this Circular;"

"c) A copy of the Dangerous Goods Transport Permit."

Article 3. Amending and supplementing certain Clauses of Article 9 of Circular No. 15/2014/TT-BTNMT dated March 24, 2014 of the Minister of Natural Resources and Environment stipulating the construction, issuance of confirmation letters, and approval of projects under the Clean Development Mechanism framework of the Kyoto Protocol

"3. A certified copy from the original register or a certified copy or a copy accompanied by the original for comparison (in case individuals or organizations submit the application directly) of the comments from directly affected parties due to project activities according to the model attached as Appendix 3 to this Circular."

"4. A certified copy from the original register or a certified copy or a copy accompanied by the original for comparison (in case individuals or organizations submit the application directly) of the Decision approving the Environmental Impact Assessment Report or the registration confirmation of the Environmental Protection Plan together with the Environmental Impact Assessment Report or the Environmental Protection Plan."

"6. A certified copy from the original register or a certified copy or a copy accompanied by the original for comparison (in case individuals or organizations submit the application directly) of the necessary permits and documents related to the professional activities of the project according to current regulations."

3. Amending Point c, Clause 2, Article 16 as follows:

"6. A certified copy from the original register or a certified copy or a copy accompanied by the original for comparison (in case individuals or organizations submit the application directly) of the necessary permits and documents related to the professional activities of the project according to current regulations."

1. This Circular takes effect from February 15, 2016.

1. Amending and supplementing Clause 3 as follows:

The Minister, Heads of Ministries equivalent to Ministries, Heads of agencies under the Government, Chairmen of Provincial People's Committees, Heads of units under the Ministry, Directors of Provincial Departments of Natural Resources and Environment, and relevant organizations and individuals are responsible for implementing this Circular.

2. Amending and supplementing Clause 4 as follows:

3. In the course of implementation, if there are difficulties, relevant agencies, organizations, and individuals are requested to promptly report to the Ministry of Natural Resources and Environment for consideration and resolution.

3. Amending and supplementing Clause 6 as follows:

"6. A certified copy from the original register or a notarized copy or a copy accompanied by the original for verification (in case of individuals or organizations submitting the application directly) of various permits and necessary documents related to the specialized activities of the project as prescribed by current regulations."

Article 4. Effectiveness and Responsibility for Implementation

1. This Circular takes effect from February 15, 2016.

2. The Minister, Heads of Ministries equivalent to Ministries, agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities, Heads of units under the Ministry, Directors of Provincial Departments of Natural Resources and Environment of provinces and centrally governed cities, and relevant organizations and individuals are responsible for implementing this Circular.

3. In the course of implementation, if there are any difficulties, it is requested that agencies, organizations, and individuals promptly reflect them to the Ministry of Natural Resources and Environment for consideration and resolution.
