This Decree amends and supplements some articles of Decree No. 120/2007/NĐ-CP on guiding the implementation of the Youth Law, providing more detailed responsibilities for ministries, ministerial-level agencies, People's Councils and People's Committees at all levels, as well as the National Committee for Youth Affairs in implementing policies and laws related to youth. This Decree takes effect from August 20, 2017.

DECREE

Amending and supplementing certain articles of Decree No. 120/2007/NĐ-CP dated July 23, 2007 of the Government guiding the implementation ofsome provisions of the Youth Law

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Youth Law dated November 29, 2005;

||| Based on the proposal of the Minister of Home Affairs;

The Government promulgates this Decree amending and supplementing certain articles of Decree No. 120/2007/NĐ-CP dated July 23, 2007 of the Government guiding the implementation of some provisions of the Youth Law.

Article 1. Amending and supplementing certain articles of Decree No. 120/2007/NĐ-CP dated July 23, 2007 of the Government guiding the implementation of some provisions of the Youth Law as follows:

1. Article 20 shall be amended and supplemented as follows:

"Article 20. Responsibilities of Ministries and Equivalent Agencies

1. Ministry of Home Affairs

a) Assist the Government in uniformly managing state administration over youth affairs;

b) Develop and issue regulations, policies, strategies, programs, and projects concerning youth, either on its own authority or by submitting them for approval to competent authorities;

c) Guide tasks related to state administration over youth for ministries, ministerial-level agencies, and provincial people's committees; organize training and capacity building for civil servants responsible for state administration over youth at central and local levels;

d) Manage international cooperation activities related to youth in accordance with the law; develop or submit international cooperation programs and projects concerning youth work to competent authorities; participate or submit for approval to competent authorities the signing, accession, and implementation of international treaties on youth work; exchange information and management experience on youth affairs;

đ) Take the lead and coordinate with the Central Committee of the Ho Chi Minh Communist Youth Union, the National Council on Youth Affairs, and other youth organizations led by the Youth Union in organizing and implementing state administration tasks over youth;

e) Coordinate with central statistical agencies in managing and utilizing statistical data on Vietnamese youth;

g) Inspect, supervise, handle complaints and denunciations, and deal with violations within its authority or recommend competent authorities to handle violations in the implementation of policies and laws concerning youth;

h) Summarize, evaluate, and report to the Government on the implementation of policies and laws concerning youth;

2. Ministry of Education and Training

a) Guide the implementation of legal provisions on universal education policies so that youth can complete universal education programs, with a focus on improving physical education and sports quality in schools; about policies on reducing tuition fees and providing scholarships to youth;

b) Guide the implementation of legal provisions on support policies for ethnic minority youth living in areas with special difficulties in economic and social conditions, youth with disabilities, youth after drug rehabilitation, and youth after reform to continue their studies, complete universal education programs, and access public services in education and training;

c) Lead and coordinate with central educational agencies to educate revolutionary ideals, political qualities, morals, lifestyles, and legal awareness, as well as social practice skills for students and university students, meeting the requirements of industrialization and modernization and building a socialist rule-of-law state;

d) Develop counseling systems for career guidance, psychological issues, and social problems, and provide healthy life skills education for youth in schools.

3. Ministry of Labor, Invalids and Social Affairs

a) Guide the implementation of legal provisions on vocational education and employment support for youth annually and during different phases;

b) Issue or submit to competent authorities for approval programs, plans, and projects on drug rehabilitation and post-rehabilitation management for youth during different phases;

c) Plan the network of vocational education institutions, labor and employment counseling services, and skill enhancement programs for youth in line with the labor market;

d) Guide the implementation of legal provisions on preferential policies and employment support for rural youth, youth who have completed military service, youth who have served in the People's Police and been discharged, voluntary youth who have completed development programs, ethnic minority youth, disabled youth, youth after drug rehabilitation, and youth after reform.

4. The Ministry of Finance

Ensure funding for ministries, ministerial-level agencies, and government agencies in developing and implementing youth development policies, programs, plans, and projects according to current laws.

5. Ministry of Science and Technology

a) Guide the implementation of legal provisions on science and technology to encourage and create conditions for youth to participate in scientific research and technological application in production and daily life;

b) Guide the implementation of legal provisions to mobilize resources to support the implementation of scientific and technological tasks proposed by youth that are effective and applicable in practice.

6. Ministry of Natural Resources and Environment

a) Develop and submit to competent authorities for approval policies on preferential land use for vocational education institutions, vocational education development, housing construction for young workers in industrial zones, medical facilities, cultural, artistic, recreational, and sports activities for youth;

b) Promote awareness and form consciousness among youth regarding climate change adaptation and environmental protection through resource conservation and exemplary behavior.

7. Ministry of Planning and Investment

Cooperate with ministries and central agencies to develop planning for the development of healthcare facilities, health advisory services, cultural and artistic activity venues, recreational and entertainment facilities, physical exercise and sports facilities for young people; participate in developing mechanisms to encourage state agencies, organizations, and individuals to invest in and build healthcare facilities, health advisory services, cultural and artistic activity venues, recreational and entertainment facilities, physical exercise and sports facilities for young people.

8. The Ministry of Culture, Sports and Tourism

a) Guide the implementation of legal provisions for young people's participation in cultural and artistic creative activities; support and create conditions for young people to participate in preserving, promoting, and enjoying national cultural identity, absorbing the finest elements of human culture; build civilized lifestyles, struggle against outdated customs and unhealthy living habits;

b) Issue or submit to competent authorities for issuance programs, projects aimed at enhancing the physical strength and stature of young people;

c) Issue or submit to competent authorities for issuance policies encouraging young people to regularly train their bodies, develop physical fitness, actively participate in mass physical exercise and sports activities, domestic and international sports competitions; develop planning for the development of sports facilities for young people;

d) Guide the implementation of legal provisions on policies to create favorable conditions and support agencies, organizations, and individuals in developing advisory activities regarding love, marriage, and family happiness for young people.

9. The Ministry of Health

Issue or submit to competent authorities for issuance programs and projects for health care; provide reproductive health and sexual health services; prevent the harmful effects of tobacco; prevent the harmful effects of alcohol; prevent infectious diseases and other social diseases; implement family planning programs for young people.

10. The Ministry of National Defense

a) Develop education and training programs to enhance national defense knowledge for young people in new circumstances;

b) Guide the implementation of preferential policies and employment solutions for young people who have completed military service and voluntary participants in economic and social development in defense economic zones according to regulations.

11. The Ministry of Public Security

a) Develop education and training programs to enhance national security knowledge for young people in new circumstances;

b) Guide the implementation of legal provisions on policies to support and ensure young people's participation in preventing and combating social evils, maintaining public security and social order;

c) Guide the implementation of preferential policies and employment solutions for young people who have completed their duties in the People's Public Security Force.

12. The Ministry of Justice

a) Issue or submit to competent authorities for issuance programs, projects, and plans to promote legal awareness among young people;

b) Integrate targets to enhance legal awareness among young people into annual legal education programs and plans of the Ministry of Justice and the Central Popularization and Education of Law Council;

c) Guide the implementation of legal aid work for young people in accordance with the Legal Aid Law.

13. The Ministry of Information and Communications

a) Guide and direct news agencies to intensify propaganda on the Party's guidelines, state laws, revolutionary ideals, ethics, and lifestyle for young people;

b) Supervise and handle social networks, communication activities, online advertising, and games that have negative impacts on young people.

14. The Committee for Ethnic Minorities Affairs

Issue or submit to competent authorities for issuance programs, projects, and plans for the development of ethnic minority youth; training and development programs to cultivate outstanding ethnic minority youth leaders and managers.

15. General responsibilities of ministries and agencies equivalent to ministries

Based on their functions, tasks, and management authority in their respective sectors and fields, ministries and agencies equivalent to ministries shall be responsible for implementing the following tasks:

a) Issue and organize the implementation of annual and phased development programs for youth in their respective sectors and fields; organize the implementation of policies and laws concerning youth within their management functions in their respective sectors and fields;

b) Incorporate youth development policies when formulating strategic, programmatic, and planning initiatives for economic and social development in their respective sectors and fields annually and phased;

c) Annually, the Minister or Head of an agency equivalent to a ministry shall meet and dialogue with youth, seek their opinions on issues related to youth;

d) Guide specialized agencies under provincial People's Committees in implementing policies and laws concerning youth within their management authority in their respective sectors and fields;

đ) Report on the implementation of policies and laws concerning youth and the performance of state management tasks regarding youth to the Ministry of Home Affairs before December 15 each year for compilation and reporting to the Government."

2. Article 21 is amended and supplemented as follows:

"Article 21. Responsibilities of People's Councils and People's Committees at all levels

1. Provincial People's Council

a) Based on the socio-economic development conditions of the locality, issue Resolutions on youth development to concretize the Party's guidelines, State policies, and laws on youth and youth work;

b) Decide on the budget allocation for building and implementing policies, programs, projects, and plans for youth development in the locality;

c) Supervise agencies and organizations in the implementation of policies and laws concerning youth in the locality.

2. Provincial People's Committees

a) Implement policies and laws concerning youth and guiding documents issued by competent authorities regarding youth work in the locality;

b) Develop programs, plans, projects, and proposals for youth development in the locality; organize training and capacity building for cadres and civil servants responsible for state management of youth affairs in the locality;

c) Develop investment planning for developing educational, health, counseling, cultural, artistic, recreational, sports facilities suitable for young people in accordance with the socio-economic conditions of the locality, to be submitted to the Provincial People's Council for approval and implementation;

d) Build statistical data on Vietnamese youth in the locality;

e) Annually, the Chairman of the Provincial People's Committee shall regularly meet and dialogue with youth, seek their opinions on issues related to youth that need to be resolved;

f) Integrate youth development policies when drafting annual socio-economic development programs and plans for each phase;

g) Inspect, investigate, resolve complaints and denunciations, and handle violations in the implementation of policies and laws concerning youth in the locality;

h) Report on the implementation of policies and laws concerning youth and the performance of state management tasks regarding youth to the Ministry of Home Affairs before December 15th each year for consolidation and reporting to the Government.

3. People's Councils and People's Committees at district and commune levels shall implement state management over youth within their assigned duties and powers according to the delegation of authority by competent state agencies.

3. Article 22 is amended and supplemented as follows:

"Article 22. Responsibilities of the National Youth Committee of Vietnam

1. Study and propose to the Prime Minister directions and solutions to inter-sectoral issues concerning youth and youth work.

2. Take the lead and coordinate with relevant organizations and agencies to fulfill advisory functions for the Prime Minister on youth work; assist the Prime Minister in researching and directing ministries, ministerial-level agencies, government agencies, and related organizations to solve inter-sectoral issues concerning youth and youth work.

3. Coordinate with the Ministry of Home Affairs, the Central Committee of the Communist Youth Union Ho Chi Minh, ministries, ministerial-level agencies, and related organizations to inspect and urge the implementation of provisions of the Youth Law and regulations stipulated in this Decree.

Article 2. Effectiveness and responsibility for implementation

1. This Decree takes effect from August 20, 2017.

2. Abolish Article 24 of Decree No. 120/2007/NĐ-CP dated July 23, 2007 of the Government guiding the implementation of certain articles of the Youth Law.

3. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial and centrally-run city People's Committees, relevant agencies, organizations, and individuals are responsible for enforcing this Decree./.
