the level of collection, collection regime, payment, management, and use of fees for the examination to issue certificates of biosafety for genetically modified organisms meeting the conditions for use as food and animal feed

Pursuant to the Law on Fees and Charges dated November 25, 2015;
Pursuant to Decree No. 120/2016/NĐ-CP dated August 23, 2016, promulgated by the Government detailing and guiding the implementation of certain articles of the Law on Fees and Charges;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

The Minister of Finance issues this Circular amending and supplementing certain provisions of Circular No. 225/2016/TT-BTC dated November 11, 2016, issued by the Minister of Finance on the level of collection, collection regime, payment, management, and use of fees for the examination to issue certificates of biosafety for genetically modified organisms meeting the conditions for use as food and animal feed.
Article 1. Amending and supplementing Article 2 of Circular No. 225/2016/TT-BTC dated November 11, 2016, issued by the Minister of Finance as follows:
"Article 2. Fee Payer
Organizations and individuals when requesting an examination of the dossier of genetically modified organisms meeting the conditions for use as food in accordance with Clause 1, Article 1 of Decree No. 108/2011/NĐ-CP dated November 30, 2011, promulgated by the Government amending certain articles of Decree No. 69/2010/NĐ-CP dated June 21, 2010, on biosafety for genetically modified organisms, genetic material, and products derived from genetically modified organisms; requesting an examination of the dossier of genetically modified organisms meeting the conditions for use as animal feed in accordance with Article 33 of Decree No. 69/2010/NĐ-CP shall pay the fee for the examination to issue certificates of biosafety for genetically modified organisms meeting the conditions for use as food and animal feed in accordance with this Circular."
Article 2. Amending Article 4 of Circular No. 225/2016/TT-BTC dated November 11, 2016, issued by the Minister of Finance as follows:
"Article 4. Fee Levels
The level of collection for the fee for the examination to issue certificates of biosafety for genetically modified organisms meeting the conditions for use as food and animal feed is VND 105,000,000 per examination."
Article 3. Implementation Provisions
1. This Circular takes effect from October 8, 2018.
2. During the process of implementation, if there are any difficulties, organizations and individuals are requested to promptly report them to the Ministry of Finance for study and resolution./.
