Decree No. 78/2019/ND-CP amending and supplementing certain articles of Decree No. 148/2016/ND-CP dated November 4, 2016, of the Government detailing the implementation of certain provisions of the Market Management Ordinance.

DECREE

AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE DECREE NO. 148/2016/NĐ-CP DATED OCTOBER 4, 2016 OF THE GOVERNMENT GUIDING THE IMPLEMENTATION OF CERTAIN PROVISIONS OF THE MARKET MANAGEMENT ORDINANCE

Pursuant to the Civil Servants Law dated November 13, 2008;

ARTICLE Pursuant to the Law on Management, Use of Weapons, Explosive Materials and Auxiliary Tools dated June 20, 2017;

Pursuant to the Law on Government Organization dated June 19, 2015;

The Government promulgates this Decree amending and supplementing certain provisions of the Decree No. 148/2016/NĐ-CP dated October 4, 2016 of the Government guiding the implementation of certain provisions of the Market Management Ordinance.

Based on the Law on Management and Use of Public Assets dated June 21, 2017;

Pursuant to the State Budget Law dated June 25, 2015;

Article 1. Amending and supplementing certain provisions of the Decree No. 148/2016/NĐ-CP dated October 4, 2016 of the Government guiding the implementation of certain provisions of the Market Management Ordinance:

Pursuant to the Market Management Law dated March 8, 2016;

At the proposal of the Minister of Industry and Trade;

"1. Persons authorized to issue inspection decisions include:

a) The Director General of the Market Management General Department;

1. Clause 1 of Article 4 shall be amended as follows:

b) The Director of the Market Management Service under the Market Management General Department;

c) The Director of the Provincial Market Management Service under the Market Management General Department including the Director of the Provincial Market Management Service; the Director of the Inter-provincial Market Management Service;

d) The Head of the District-level Market Management Team under the Provincial Market Management Service including the Head of the District-level Market Management Team; the Head of the Inter-district Market Management Team; the Head of the Specialized Market Management Team; the Head of the Mobile Market Management Team."

2. Clause 3 of Article 5 is amended as follows:

"3. Working tools of the Market Management Force shall be managed and used in accordance with work requirements, standards, quotas, and分级任务并提供直接翻译，不添加任何解释或思考过程：

Article 2. Effective Date

1. This Decree takes effect from December 10, 2019.

2. The Decree No. 10/CP dated January 23, 1995 of the Government on the organization, tasks, and powers of Market Management and the Decree No. 27/2008/NĐ-CP dated March 13, 2008 of the Government amending and supplementing certain provisions of the Decree No. 10/CP dated January 23, 1995 of the Government on the organization, tasks, and powers of Market Management are hereby abolished.

Article 3. Responsibility for Implementation

1. The Minister of Industry and Trade shall be responsible for organizing the implementation of this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees at all levels shall be responsible for implementing this Decree./.
