AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 15/2014/TT-BTNMT OF MARCH 24, 2014 ISSUED BY THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT REGULATING THE CONSTRUCTION, ISSUE OF CONFIRMATION LETTERS, AND ISSUE OF APPROVAL LETTERS FOR PROJECTS UNDER THE CLEAN DEVELOPMENT MECHANISM IN THE FRAMEWORK OF THE KYOTO PROTOCOL AS AMENDED AND COMPLEMENTED BY CIRCULARS NO. 11/2022/TT-BTNMT OF OCTOBER 20, 2022, NO. 19/2023/TT-BTNMT OF NOVEMBER 15, 2023, NO. 36/2025/TT-BNNMT OF JULY 2, 2025, AND NO. 39/2025/TT-BNNMT OF JULY 2, 2025

Pursuant to Law on Legislative Regulatory Documents No. 64/2025/QH15, amended and supplemented by Law No. 87/2025/QH15;

Pursuant to Decree No. 78/2025/NĐ-CP of April 1, 2025 issued by the Government detailing certain provisions and measures for organizing and guiding the implementation of the Law on Legislative Regulatory Documents amended and supplemented by Decree No. 187/2025/NĐ-CP of July 1, 2025;

Pursuant to Decree No. 35/2025/NĐ-CP dated February 25, 2025 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

At the proposal of the Director of the Climate Change Department;

The Minister of Agriculture and Rural Development issues this Circular amending and supplementing certain articles of Circular No. 15/2014/TT-BTNMT of March 24, 2014 issued by the Minister of Natural Resources and Environment regulating the construction, issuance of Confirmation Letters, and issuance of Approval Letters for projects under the Clean Development Mechanism within the framework of the Kyoto Protocol as amended and supplemented by Circulars No. 11/2022/TT-BTNMT of October 20, 2022, No. 19/2023/TT-BTNMT of November 15, 2023, No. 36/2025/TT-BNNMT of July 2, 2025, and No. 39/2025/TT-BNNMT of July 2, 2025 19/2023/TT-BTNMTof November 15, 2023, Circular No. 36/2025/TT-BNNMT of July 2, 2025, and Circular No. 39/2025/TT-BNNMT of July 2, 2025.

Article 1. Amend and supplement certain clauses of Article 13; add Appendix 5 before Appendix 6

1. Amend and supplement Clause 3 and Clause 4 of Article 13 as follows:

“3. The dossier for requesting amendment of the contents of the Approval Letter:

a) A request form for amending the contents of the Approval Letter according to the model attached to this Circular;

b) Amended and supplemented PDD or PoA-DD consistent with the requested amendments and related documents.

4. Procedure and formalities for amending the contents of the Approval Letter:

a) The project proponent shall submit one set of the dossier directly or send it via postal service to the Ministry of Agriculture and Rural Development or through the Ministry's Administrative Procedure Information System or the National Public Service Portal;

b) Within no more than one working day, the Climate Change Department shall check the completeness and validity of the dossier. In case the dossier is incomplete as required, the Climate Change Department shall request the project proponent to supplement the dossier;

c) Within no more than three working days from the date of receiving the dossier as prescribed, the Climate Change Department shall review the project dossier and consider the amendment of the contents of the Approval Letter;

d) Within a maximum of one working day from the date of deciding to amend the contents of the Approval Letter, the Ministry of Agriculture and Rural Development shall issue the result to the project proponent; in case of non-approval, the reasons must be clearly stated.”

2. Add Appendix No. 5 before Appendix 6 issued together with this Circular.

Article 2. Replacing certain phrases in some articles Article, Appendix

1. Replace the phrase "Ministry of Natural Resources and Environment" with the phrase "Ministry of Agriculture and Environment" in Clause 25, Article 3, Clause 1, Article 14, and Clause 3, Article 18.

2. Replace the phrase "MINISTRY OF NATURAL RESOURCES AND ENVIRONMENT OF VIET NAM" with the phrase "MINISTRY OF AGRICULTURE AND ENVIRONMENT OF VIET NAM" and replace the phrase "Ministry of Natural Resources and Environment (MONRE) of Viet Nam" with the phrase "Ministry of Agriculture and Environment (MAE) of Viet Nam" in Appendix 23 and Appendix 24.

3. Replace the phrase "Department of Natural Resources and Environment" with the phrase "Department of Agriculture and Environment" in Clause 1, Article 15, Clause 2, Article 18, and Appendix 6.

Article 3. Implementation Provisions

1. This Circular takes effect from the date of issuance.

2. For files requesting adjustments to the contents of the Approval Letter submitted to the Ministry of Agriculture and Environment before this Circular takes effect, they shall continue to be processed according to the provisions of Circular No. 15/2014/TT-BTNMT amended and supplemented by Circulars No. 11/2022/TT-BTNMT, No. 19/2023/TT-BTNMT, No. 36/2025/TT-BNNMT, and No. 39/2025/TT-BNNMT.

3. During implementation, if there are difficulties or obstacles, relevant agencies, organizations, and individuals are requested to report to the Ministry of Agriculture and Environment for timely consideration and resolution.
