On the basis of Decree No. 179/2004/NĐ-CP dated October 21, 2004 of the Government on state management of product and goods quality;

Article 1. Issuing the Regulation on Evaluation and Designation of Feed Testing Laboratories
Article 2. This Decision takes effect from the date of signature.
Article 3. The Heads of the Legal Inspection Department, the Feed Department, the Heads of units, organizations, and individuals related shall be responsible for implementing this Decision./.

REGULATION ON EVALUATION AND DESIGNATION OF FEED TESTING LABORATORIES
(Issued together with Decision No. 7857/QD-CN-TACN dated October 31, 2008 of the Director of the Animal Feeding Department)
1. General Provisions
Article 1. This regulation is used to evaluate and designate feed testing laboratories (TACN) capable of inspecting and testing the quality of TACN to serve quality management work in this field.
Article 2. Feed testing laboratories capable of analyzing and inspecting the quality of TACN both within and outside the agricultural sector must register to participate with the Animal Feeding Department. Only when there is a decision designating sufficient capacity will the feed testing laboratory have legal value to provide inspection data on the TACN field.
Article 3. The basis for recognizing feed testing laboratories includes:
- General requirements regarding the capability of feed testing laboratories, issued together with Decision No. 186/QD-CN-TACN dated October 31, 2008 of the Director of the Animal Feeding Department;
- Technical standards and testing methods for the indicators that the feed testing laboratories apply for participation in testing.
Article 4. The validity period of the designation decision:
The validity of the designation decision is two years from the date of signing. Two months before the expiration date, if wishing to continue operations, the feed testing laboratory or the organization to which the feed testing laboratory belongs must submit an application for re-designation.
Article 2. Application for designation of feed testing laboratories
Clause 1. The registration application for designation includes:
a) An application for designation as a feed testing laboratory for quality inspection (Annex 1).
b) A report on the operational capacity of the feed testing laboratory (Annex 2).
Clause 2. The dossier is prepared in two copies and sent to the Animal Feeding Department; within fifteen days, the Animal Feeding Department will examine the validity of the dossier.
Clause 3. If the dossier is valid, the Animal Feeding Department will be responsible for establishing an evaluation committee. In cases where the dossier is incomplete, the Animal Feeding Department will be responsible for guiding the necessary contents to be supplemented.
Article 3. Evaluation and designation of feed testing laboratories
Clause 1. Evaluation of feed testing laboratories.
a) The evaluation of feed testing laboratories is carried out through the activities of the evaluation committee. The committee consists of technical experts and specialized managers established by the Animal Feeding Department.
b) Content of evaluation, including:
- Evaluation of compliance with "General Requirements for the Capability of Feed Testing Laboratories" issued together with Decision No. 186/QD-CN-TACN dated October 31, 2008 of the Director of the Animal Feeding Department;
- Determination of testing methods and accuracy for each indicator that the feed testing laboratory applies for designation.
c) Evaluation procedure
- Review the laboratory's files, books, and documents.
- Directly evaluate the laboratory's conditions according to the content of the general requirements stipulated in Decision No. 186/QD-CN-TACN dated October 31, 2008 of the Director of the Animal Feeding Department.
- Check the accuracy of the tests and the professional skills of the laboratory staff.
- The committee reports the evaluation results to the Animal Feeding Department in writing (Annex 3) and the Committee's conclusion minutes (Annex 4).
d) Designation
- Based on the evaluation results and the committee's conclusion minutes, the Animal Feeding Department issues a Decision on the designation of feed testing laboratories for quality inspection.
- For facilities that do not meet the conditions, the Animal Feeding Department will notify the reasons for the unit to take corrective measures and necessary supplements.
Article 4. Rights and responsibilities of designated feed testing laboratories.
Clause 1. Rights:
- Request organizations and individuals sending samples of TACN to provide relevant documentation if deemed necessary.
- Conduct quality inspections of TACN according to the recognized testing indicators.
- Collect and manage inspection fees according to current regulations.
b) Responsibilities:
- Bear legal responsibility for the quality inspection results conducted by themselves.
- Concentrate all resources to perform quality inspections of TACN within the designated scope, prioritizing urgent cases requested by state management agencies.
- Store inspection records, test records, and related books according to regulations and present them when required by competent authorities.
- Report detailed changes in office location, inspection scope, equipment, personnel, etc., related to the registered inspection area to the Animal Feeding Department.
Article 5. Management of feed testing laboratory activities
Clause 1. Periodically or unexpectedly, the Animal Feeding Department is responsible for organizing inspections of the professional activities of designated feed testing laboratories.
Clause 2. Resolve complaints and disputes over the results of designated feed testing laboratories.
Clause 3. Handling violations by designated feed testing laboratories:
- Depending on the level of technical violation, the Animal Feeding Department may issue a decision to suspend partially or entirely the effectiveness of the designation decision until the feed testing laboratory corrects the errors.
- In cases where violations cause serious consequences, the Livestock Breeding Department shall establish a dossier to issue a decision revoking the effectiveness of the designation decision for the testing laboratory and implement necessary measures according to the provisions of the law.
6. Implementation organization.
- The Feed Livestock Breeding Department and the testing laboratories or organizations under which the testing laboratories are affiliated shall be responsible for implementing the provisions within their respective units' scope of responsibility as stipulated in this regulation.
- Upon issuance of the designation recognition decision for a testing laboratory, the Livestock Breeding Department shall have the responsibility to publicly announce the name, address, analytical criteria, and methods of the testing laboratory through mass media and on the Livestock Breeding Department's website.
- During the implementation of this regulation, if any difficulties arise, the testing laboratories, related organizations, and individuals are requested to promptly report them to the Livestock Breeding Department for review and adjustment as appropriate./.
